HomeMy WebLinkAbout1977-06-27 Special Meeting• • MINUTES - SPECIAL MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS JUNE 27, 1977 7:00 P.M. MEMBERS OF THE COMMISSION PRESENT: J. J. Meza, Mayor; Commissioners John Tomerlin, I. J. Kibodeaux, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioner Virginia Cline. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox W. Askins, City Attorney; R. R. Hall, Assistant Chief of Police; Stanley Sherwood, Parks & Recreation Director. • OTHER CITY OFFICIALS ABSENT: H. F. Freeman, Chief of Police; Joe Sease, Fire Chief; D. R. McLaughlin, Fire Marshal. OTHERS PRESENT: Messrs. B. Harry and C. Thompson of Sonic Drive-In. PRESIDING: Mayor Meza. + + + 1. CALL TO ORDER - Mayor Meza called the meeting to order. + + + • • Special Meeting 6/27/77 2 2. PUBLIC HEARING TO CONSIDER VARIANCE TO ALLOW DRIVE-IN RESTAURANT - LOTS 21, 22, 23, 24, AND 25, BLOCK 36, TOWN OF LA PORTS - The Mayor asked the City Clerk if certified letters had been mailed to the Residential half of Block 36 and if so, how many letters were mailed: The City Clerk stated that four letters had been mailed by certified mail to the property owners on the Residential half of Block 36. There was no response by the property owners by mail, phone or person. Mayor Meza asked if there was anyone present wishing to object to the rezoning? No one spoke. Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to grant a variance to the Zoning Ordinance and allow a drive-in restaurant on Lots 21, 22, 23, and 24, also 25, Block. 36, Town of La Porte, with the following Special Conditions to the Building Permit: A. The trees at the rear of these lots shall not be removed by owners without the prior written consent of the City Commission, so that the trees can serve • as a sound and light barrier. B. Owners shall construct and maintain a solid six foot cedar fence across the rear, property line, and on the side property lines to the 25-foot front setback line. C. No alcoholic beverages shall be sold. D. No outdoor speaker or music, except the individual speakers for communication with the customers in their cars. The volume on these outdoor speakers shall be kept as low as possible, consistent with the nature of the operation. No outdoor music speakers. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + • • ~ Special Meeting 6/27/77 3 3. CONSIDER AUTHORIZING SPENDING FUNDS TO U'SE' CERTIFIED LABORATORY FOR TESTING F,ND REPORTING SANITARY SEWER SAMPLES IN LIEU OF SELF REPORTING SYSTEM - T.W.Q.B. - After a brief discussion regarding the hearing in Austin before the Texas Water Quality Board regarding the priority rating of the City, and the Texas Water Quality Board in favor of the City using a certified laboratory for testing and report sanitary sewer samples, rather than the self reporting system, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux, that this item be tabled and the Director of Finance authorized to check the possible cost for a certified laboratory to perform this service, and report back to the Commission at the work shop on June 29, 1977. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + C 4. CONSIDER REQUEST OF ALCOHOLIC ANONYMOUS FOR MEETING PLACE AT 215 S. 4TH STREET - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to allow the Alcoholic Anonymous bring the building at 215 S. 4th Street up to City Code and be allowed to use said building as a meeting place for a period of up to one year. It must meet all city code specifications and inspections by the necessary departments. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 5. ADJOURNMENT - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin that the meeting adjourn. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons.
