J. Meza, Mayor; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; H. F. Freeman, Chief of Police; Joe Sease, Fire Chief; Stanley Sherwood, Parks & Recreation Director. • OTHER CITY OFFICIALS ABSENT: D. R. McLaughlin, Fire Marshal. OTHERS PRESENT: A. J. Busch, Jr., of Busch, Hutchison & Associates, Consulting Engineers. PRESIDING: Mayor Meza. + + + 1. CALL TO ORDER - Mayor Meza called the meeting to order. + + + 2. INVOCATION - The invocation was given by Commissioner Tomerlin. + + + • • • Regular Meeting 7/18/77 3. APPROVAL OF MINUTES - REGULAR MEETING - JULY 5, 1977 - Motion by Commissioner Kibodeaux, seconded by Commissioner Cline to approve the minutes of the regular meeting of July 5, 1977. Motion carried by the following vote: 2 AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve the accounts payable as presented. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • + + + 5. VISITORS WISHING TO ADDRESS THE COMMISSION - MS. JEANIE BUNCH - Vice Chairman of La Porte Girl Scouts, was recognized and addressed the Commission regarding pornographic magazines being displayed in the candy isle in the Sylvan Beach Grocery Store. Ms. Bunch asked that the Commission have some kind of ordinance or resolution prohibiting pornography. Ms. Bunch was informed that the City Attorney was in the process of preparing an ordinance for consideration at this time. The Commission expressed appreciation to Ms. Bunch for her interest. + + + • • • • Regular Meeting 7/18/77 3 6. CONSIDER APPROVING PROPOSED ORDINANCE NO. 780-KK - A SPECIAL USE PERMIT - COASTAL TANK LINING - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 780-KK as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 7. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1083 - AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND SEWAGE DISPOSAL," OF THE CODE OF ORDINANCES - After the proposed ordinance was • read in full, motion by Commissioner Kibodeaux, seconded by Commissioner Cline to approve Ordinance No. 1083 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND SEWAGE DISPOSAL," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 8. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1084 - AMENDING CHAPTER 12, ARTICLE III, "GARBAGE AND TRASH", OF THE CODE OF ORDINANCES - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to charge $3.00 per unit per month. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1084 - AMENDING CHAPTER 12, ARTICLE III, "GARBAGE AND TRASH", OF THE CODE OF ORDINANCES (CONTINUED) After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve Ordinance No. 1084 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE AMENDING CHAPTER 12, ARTICLE III, "GARBAGE AND TRASH," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 4 9. CONSIDER AWARDING BID - TWO PATROL UNITS - POLICE DEPARTMENT - Upon the recommendation of Chief Freeman, motion by Commissioner • Cline, seconded by Commissioner Simons to reject the bids and rebid at a later date for two patrol units, because the bidders could not meet specifications. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 10. CONSIDER AUTHORIZING EIGHT STREET LIGHTS FOR CRESCENT VIEW ADDITION: 2-SOUTH "Y", 2-B~y, l-REYNOLDS, 1-CRESCENT, AND 2-OAKHURST - Motion by Commissioner Cline, seconded by Commissioner Simons to authorize eight street lights for Crescent View Addition: 2-South "Y", 2-Bay, 1-Reynolds, 1-Crescent, and 2-Oakhurst. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • • Regular Meeting 7/18/77 5 11. CONSIDER APPROVING PAYMENT TO B~SCa, HUTCHI8ON & ASSOCIATES SANITARY SEWERS, WATER LINES P,ND APPURTENANCES IN BLOCKS 45 AND 72 - FIELD SURVEYING - IN THE AMOUNT OF 448.50; RESIDENT REPRESENTATIVE - IN THE AMOUNT OF 868.00; CHEMLIME SANITARY SEWER - 1.6TH STREET - RESIDENT REPRESENTATIVE - IN THE AMOUNT OF $448.00 - After a brief discussion, motion by Commissioner Simons, seconded by Commissioner Cline to approve payment to Busch, Hutchison & Associates for Sanitary Sewers, Water Lines and Appurtenances in Blocks 45 and 72, Field Surveying in the amount of $448.50; Resident Representative - in the amount of $868.00; Chemlime Sanitary Sewer - 16th Street - Resident Representative in the amount of $448.00, and the City in turn bill Chemlime for the Resident Representative in the amount of $448.00. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • 12. DISCUSS UPDATING ZONING MAP AND CITY LIMIT MAP - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to update the Zoning Map and the City Limit Map and continue to do so on a quarterly basis. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 13. CORRESPONDENCE - A. Letter from the Secretary of State, Mark White, requesting a donation of private funds in the amount of $100.00 for providing the U.S.S. Texas, with the ship's silver. A copy is attached. B. Letter from Jon Lindsay, County Judge, requesting ideas of county needs to help in determining what capitol improvements should be included in the next bond election. C. Letter from Turner Collie & Braden, enclosing photographs showing construction progress on the Southern Pacific Grade • Separation. D. Meeting Notice of Houston-Galveston Area Council on July 21st, 1977, at 2:00 P.M. • Regular Meeting 7/18/77 6 14. DISCUSSION OF DEPARTMENT PROJECTS - COMMISSIONER CLINE asked if the City had been invited to attend the Meeting in Austin which was to be held on August 1, 1977, regarding the bridge to go over the ship channel? After a brief discussion it was the consensus of opinion that as many of the officials as could would go to the meeting in Austin. AIR PORT ZONING BOARD - There was a brief discussion regarding the Air Port Zoning Board, required for the completion of the grant, between La Porte and Lomax. It was the consensus of opinion that the Commission should meet and be on the agenda for the next Lomax Council Meeting. + + + 15. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - (E) AND (G) - (LITIGATION AND PERSONNEL)- Motion by Commissioner Cline, seconded by Commissioner Tomerlin that the meeting recess for an executive session. Motion carried by the following vote: • AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:42 for an executive session.
