1. CALL TO ORDER - Mayor Meza called the meeting to order.

2. RATIFY LETTER TO SHOREACRES - Motion by Commissioner
Tomerlin, seconded by Commissioner Simons to ratify sending
a letter to Shoreacres regarding proposed annexation. A
copy of the letter is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

Commissioner Tomerlin that the meeting adjourn. Motion carried

We understand that the City Council of the City of Shoreacres will
_ consider releasing Shoreacres' extraterritorial jurisdiction over
Bayshore Municipal Utility District, so that the District can be
annexed by the City of La Porte, at your meeting of September l~,
1977.
We further understand that there might be an interest on the part
of the City of Shoreacres, in consolidating the City of Shoreacres
• with the City of La Porte. Our City Attorney has advised us that
this would be possible, once the City of La Porte and the City of
Shoreacres become "adjoining and contiguous to each other, which
would be the case following the annexation of B.M.U.D. by the City
of La Porte.
We are advised that the consolidation would then be accomplished
under Article 1188, Revised Civil Statutes. These provisions of
State Law provide for an election to be held first in the City of
Shoreacres and, if this election is in favor of consolidation with
La Porte, then an election would be held in the City of La Porte.
Upon favorable passage in the City of La Porte, the former City
of Shoreacres would be merged into and become a part of the City
o f ~ho-r eac~r--es . ,~ ~,~,,~ ,
This matter has been discussed by the .City Commission of the City of
La Porte, which has authorized me to advise the City of Shoreacres
that, should the citizens of the City of Shoreacres vote favorably
for consolidation, in an election to be held after La Forte's annexa-
tion of B.M.U.D. establishes a common boundary between, the two cities,
then the La Porte City Commission would view with favor, and would
actively support a favorable vote in La Porte on the consolidation
question.

Art. 1192.Registration ~ ~ •
If a majority of the qualified voters at said election in each of
said cities shall vote in favor of. consolidation, the lriayor or -chief
executive officer. exercising like or similar powers of each ~of said
cities as soon as practicable after the returns of said election have been
made, shall certify to the Secretary of State an authenticated copy
under the seal of the said cities showing the approval of t11e.. qualified
voters of the consolidation of the two cities. ~ The Secretary of State
shall there><]pon file and record the same in a separate book to be ,kept
in his office for such purpose. The returns of such election shall be
recorded at length in the record books of the respective cities, and the
..consolidation of such cities shall be held thereupon to be consummated.

After .the consummation of such consolidation, all record books,
public property,' money on hand, credits, accounts and all other assets
of the smaller of the annexed cities shall be turned over to the officers
of the larger city, who shall be retained in office as the officials of the
consolidated city during the remainder of their respective terms, and
by such consolidation the offices existing in the smaller municipality
shall be abolished and declared vacant, and the persons holding such
offices shall not be entitled after the consummation- of such consolida-
tion, to further remuneration or compensation. All outstanding lia-
bilities of the two cities so consolidated shall be assumed by the con-
solidated city... Whenever at the time of any such consolidation the
respective cities shall have on hand any bond funds voted for public
improvements not already appropriated or contracted for, such money
shall. be kept in a separate fund and devoted to public improvements
in the territory for which such bonds were voted, and shall not be
diverted to any other purpose. Id. .
