participation for 18-inch sanitary sewer line for Fairmont
Park. Motion carried by the following vote:

10. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1093, AMENDING
1976 EDITION OF THE STANDARD BUILDING CODE, AS AMENDED,
FIRE DETECTION SYSTEMS - Motion by Commissioner Simons,
seconded by Commissioner Tomerlin to approve Ordinance
No. 1093 as read. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING THE 1976 EDITION OF THE STANDARD
BUILDING CODE, AS AMENDED, AND ALSO KNOWN AS THE BUILDING CODE OF
THE CITY OF LA PORTE, BY AMENDING SECTION 1127, FIRE DETECTION
SYSTEMS, TO REQUIRE THAT EVERY NEWLY CONSTRUCTED DWELLING OR UNIT
WITHIN AN APARTMENT HOUSE, CONDOMINIUM, TOWNHOUSE, AND EVERY GUEST
ROOM IN A MOTEL OR HOTEL, AND EVERY BASEMENT OR CELLAR WITHIN SUCH
DWELLINGS, HAVE A U.L. APPROVED SMOKE DETECTOR PERMANENTLY INSTALLED;
REQUIRING EVERY EXISTING DWELLING UNIT WITHIN AN APARTMENT HOUSE,
CONDOMINIUM, TOWNHOUSE, AND EVERY GUEST ROOM IN A MOTEL OR HOTEL,
AND EVERY BASEMENT OR CELLAR WITHIN SUCH DWELLINGS TO MEET THE
REQUIREMENTS OF SECTION 1127 WITHIN THE REQUIRED TIME PERIOD SET
OUT IN SECTION TWO OF THIS ORDINANCE; REQUIRING EVERY EXISTING

11. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1094, AMENDING CODE
OF ORDINANCES - ARSON REWARD - After a brief discussion regarding
the proposed ordinance and increasing the amount of the reward,
motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux
that this item be tabled for discussion at the regular Work Shop
on September 28, 1977. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

13. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Cline stated
that she had met with the Port of Houston Authority and the
• City of Morgan's Point regarding street lights for Crestlane.
The Port Authority will have two requests forth coming regarding
changing the name of Crestlane and closing certain streets.

14. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 -
(E) AND (G) - (LITIGATION AND PERSONNEL) - Both the City
Administrator and City. Attorney requested executive sessions.
Motion by Commissioner Simons, seconded by Commissioner Kibodeaux
that the meeting recess for an executive session. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
The meeting recessed at 7:40 P.M.
The meeting reconvened at 9:32 P.M.

15. ENTEX AGREEMENT - Motion by Commissioner Simons, seconded by
Commissioner Tomerlin to authorize the Mayor to sign a letter
of agreement with Entex. A copy of said letter is attached
and made a part of these minutes. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAY5: None.

16. ADJOURNMENT - Motion by Commissioner Simons, seconded by
Commissioner Kibodeaux that the meeting adjourn. Motion

NOTICE TO BIDDERS
BID EXTENSION
Sealed bids addressed to the Mayor and City Commission of the
City of La Porte, Harris County, Texas, and marked "FOUR WHEEL
TRACTOR WITH MOWER" will be received at the La Porte City Hall,
124 South Second Street, until 7:00 P.M., October 3, 1977, at
which time they will be publicly opened and read aloud. Bids.
received after closing time will be returned unopened.
The City Commission of the City of La Porte has extended the bid
date to the above mentioned date instead of September 19, 1977,
due to a cancellation of the September 19, 1977, meeting.

I.
EMERGENCY PNBULANCE SERV] CE RE~UI]~EMEIvTS
Contractor covenants and agrees to furnish an~bu]_ance service
in compliance with the following rec,uire:r,ents:
(a) Contractor si~a]l hive and maintain ambulances and
crews available twenty-four ]~,~urs daily for erner-
yency dispatch.

or points within the City of La Porte to be
selected by Contractor, subject to written
approval of the Chief of Poli c.e. Tt i s the inten-

reasonable period from the time of dispatch, and
it is within the contemplation of the parties

(c) The City of La Porte will furnish telephone con-
nections between the Police Station and the
office of Contractor at City expense.
(d) It is the intention of the parties hereto that
the Contr.-ctor is authorized to furnish e;:,erycncy
ambulance and invalid coach service onto. Con-
tractor shall only provide hearse service for the
transportation to any mor~oue, mortuary or funeral
home of the•L-ody of any person officially declared
dead, when authori zed by p,: oix~r authority .

(c) All such ambu7a;;ces must be di.sti_nct_ly marked,
• showing the name of the Contractor providing
service.
(d) All -such ambulances must be licensed as emergency
vehicles in compliance with Article 4590-b of the
Revised Civil Statutes of tl,e State of Texas, and
amendments thereto, and in compliance with the
Rules and P.c:gulations of the State Board of Health.
Each such ambulance shall be manned by wo persons;
attendant and driver. The driver shall have a
_ valid chauffeur's license issued by the Department
. of Public Safety of the State of Texas, and an
Emergency Care Attendant (Class. B) certificate
issued L-y the State Board of Health in compliance
with Section 3, Article 4590-b, Revised Civil
Statutes of Texas. The attc~,d.-7nt shall be a state
registered Ernergc-icy Medical Technician (Class A) .
(e) Each ambulance shall be equipped with a siren and
red light in good working condition.
(f) 1. Each ambulance shall be equipped with a two-way
radio which transmits and receives on frequencies
designated for use by the City of La Porte.
• 2. Radios will be operated on City of La Porte
local government frequency _- 154.055_megacycles.
~ 3. The radios will be purchased by the Contractor
and will be leased to.the City of La Porte for a
period to coincide with the contract for emergency
service.
4. Radios must he maintained to meet current F.C.C.
specifications. The maintenance costs will be borne by
the Contractor.
• ~ 5_ Radios must have an annual frequence check by
the City Radio Technician - during the month of
• February.

(g) An oxygen tank ~~;,d mask in ~,~orking condition shall

pounds per square inch absolute (psia).
(h) The Chief of Police of the Ci.t:y of La Porte shall
dc:termi_ne the standards for ~:mbulance equipment.
In determining tt,e adequacy of c-quipment, the Chief
of Police shall take into consideration the current
list of minimal equipment for ambulances adopted
by the American College of Surgeons or its duly :-
authorized Committee on Trauma. ..
(i) Each ambulance shall provide for the usual trans-~
port of one patient lying down- and shall also be '
equipped with an additional cot, which may be a
folding type, for transportation of a second patient,
when needed. Each cot or bed furnished shall be
provided with a suitable locking mechanism which
will prevent i.t from rolling free ~,~hile the ambu-
lance is in motion.

INSPECTION AND APPkOVAl, OF AN~ULANCES
AND ACCESSORY EQUIPI~iL~ 1JT BY CITY
All .ambulances and accessory equipment shall be subject to
inspection by the Chief of Police of the City of La Porte, or his
duly appointed representative, •and if at any time same are not in
compliance with the provisions hereof or if any ambulance is in
need of mechanical repairs in order to insure its satisfactory
condition, then the Chief of Felice shall inform Contractor of
such defects and such an~}~ulance shall r,ot be used until "all defects
are remedied to the satisfaction of the Chief of Police.
IV.
DE'T'ERMINING SELECTION OF HOSPITAL
It is expressly understood that the patients being picked up

shall have the right to designate any hospital to which they wish
to be transported. In the event the patient is incapacitated,
the highest ranking police officer on the Scene shall designate
a hospital and, in the event there is no officer on the scene,
the ambulance driver shall do so.

six months thereafter, Contractor shall file with the City Clerk
during the month immediately following each such period a composite,
cumulative report on the emerycncy ambulance service, both within
City and within the boundaries of the La Porte Independent School
District, showing, to-wit:.
(a) Nwnber of calls made;
(b) Number of calls for service which have been paid for
and amount received by .Contractor for such service;
(c) Number of calls not paid for and amount of such
unpaid charges; and
(d)
Proof of response, from tirne.of call to arrival at
scene.

VIII.-
COMPLIA)4CE T-aITH LAW AIvD OkDIT7ANCES
Contractor agrees to operate the ambulances in accordance with
the requirements of the State and Federal law, and applicable ordi-
nances of the City of La Porte.

LIAB7LI`1'Y INSU1271NCE
During tl~e term of this contract and any extensions thereof,
Contractor shall purchase and keep i.n full force and effect, public
' liability insurance on each of its ambulance units, and professional
liability insurance (malpractice insurance) on each of its employees
administering patient care, with minimum limits of Fifty Thousand .

Hundred Thousand
Dollars ($50,OOD.00) for property damage; One
Dollars ($100,000.00) for each person; and Three Hundred Thousand
Dollars ($300,000.00) for each accident. In addition, Contractor
shall keep and maintain taorkmen's Compensation insurance on its
employees. Contractor shall file certificates of insurance cover-
age with the City Clerk during the term of this contract and any
. extensions thereof.

XI.
INDEMNIFICATION AND ASSUI~IPT]:ON OF LIABILITY
Contractor covenants and agrees to indemnify, and does hereby
indemnify, hold harmless and defend, the City of La Porte, its
'agents, servants or employes, prom and against any and all claims
for damages or injuries to hursons or property of ~~,hatsoever kind
• or character, whet}~er real or asserted, arising out of or incident
to the operation of its emergency ambulance service and all other
of its operations arising under or otherwise incident__to the pro-
visions of this contract; and Contractor hereby assumes all.lia-
bility and responsi}~ility for injuries, claims or suits for damages
Lo persons or property, of cahatever kind or character, whether
real or asserted, occurring during the term of this agreement,
arising out of or by reason of the oi~erati.on of its emergency
ambu-lance service and all other of his operations arising under
or otherwise incident to~tl~e provisions of this contract.
XII.
REVOCATION OF CONTRACT
• The City Commission reserves .the right to cancel this con-
tract in the event the services perfoi:med by Contractor hereunder
are unsatisfactory in the judgment of t}~e City Commission. This
contract shall be subject to a semi-annual review by the City
Commission which may, where it deems it necessary, recorrUnend
modifications_ Modifications or cancellation s}~all not be
ordered by the City Commission without an opportunity for hearing

XIII.
' SERVICE OU'1'SIDE Cl'i'Y
Centractor shall have the right and privilege to furnish
~~r:bul~i-~ce service within the houT~d~~rics of_ the La Porte Independent
School District, provided that the b~_sic level and quality of ser-
vice to City, as provided f:or herein, is not diminished. Con-
t?~actor sha7.1 charge usual and customary fcc-_s for such service.
Contractor may negotiate contracts for such service with other
entities within such boundaries, and shall be entitled to retain
_ reve:~ues received under such contracts; provided, however, such
revenues shall be re1~orted i.o City wider Paragraph VI hereof.
xlv.

This contract shall l;ecome effective on October 1, 1975, and
shall be in force and effect for a period of two (2) years, ter-
minating on September 30, 1977, unless othol~aise cancelled as
provided in Paragraph XII. Contractor reserves option to renew
this contract for an additional period of five (5) years. It is
entered into subject to the Charter and Ordinances of the City
of La Porte and applicable State and Federal laws.

Ladies and Gentlemen:
September 9, 1977
Entex, Inc. (Entex) filed its Statement of .Intent to
Change Rates with the City of La Porte (City) on March 30,
1977. Subsequently, you entered on a hearing at which
evidence was presented by Entex in support of the proposed
change; you approved a Bond permitting Entex to collect
its proposed rates, subject to refund, pending a final
determination of the rate case; and finally, you denied
Entex any increase in rates. Entex filed its Petition for
Review of the City's action with the Railroad Commission of
Texas (Commission) on September 7, 1977.
Entex and the City were unable to reach agreement with
respect to the proper level of rates because, inter alia, of
certain provisions of a Proposal for Decision published in
Entex's Beaumont rate case, docketed as GUD N0. 710 at the
Commission. Both the City and Entex recognize that, whatever
the outcome of the Beaumont case at the Commission, the case
may be appealed to the courts, and that the final determina-
tion, at the Commission or in the courts, of the Beaumont
case may have some effect on the disposition of certain
issues in the Entex - La Porte rate case. Accordingly, in
consideration of the mutual benefits accruing to Entex and
to the City and subject to the terms and conditions hereof,
it is agreed as follows:
(lj Entex and the City agree to continue attempts to
settle their dispute and, in the event a settlement
has not been reached prior to a final determination
in the Beaumont case, to reopen negotiations no
later than ten (10) days after such final decision;

(2) Entex and the City agree to file a joint motion
with the Commission requesting that the case not
be set for hearing, except (i) on the motion of
either party to the proceeding pending before the
Commission, or (ii) where no settlement agreement
has been reached within sixty (60) days after the
final determination in Entex's Beaumont case;
(3) The Bond under which Entex is currently collecting
its proposed rates, is hereby modified so that,
from the date this agreement is signed by the
City, the rates so collected shall be in accordance
with the rate schedules currently in effect in
the Cities of Lomax, Morgan's Point, and Shoreacres;
except as expressly modified hereby, said Bond
shall remain in full force and effect on the
terms and conditions therein stated;
(4) Entex agrees that during the period of this
agreement it will not file an increase in rates
• greater than the increase filed for in the Cities
of Lomax, Morgan's Point, and Shoreacres; provided,
however, that the City will allow any such increase
permitted to become effective in said cities to
become effective in La Porte under a Bond containing
terms identical to those set forth in this agreement;
(5) Entex and the City agree that it shall be appropriate
upon a final determination of the Entex - La Porte
rate case, to set rates for each annual period
subject to the appeal on the actual data for that
period; further, it shall be appropriate for both
parties to present evidence for the future period
after said final determination based on any test
period the respective parties deem appropriate;
(6) Entex and the City agree that none of the rate
case expenses incurred prior to the date the City
executes this letter shall be recovered by way of
a surcharge to the rates finally established
either by agreement or by the Commission or the
courts; however, it shall be proper to include
said rate case expenses as expense items in any
rate case;
