Meza, Mayor; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Margie Goyen, City Clerk, Knox Askins, City Attorney, Joe Sease, Fire Chief; D. R. McLaughlin, Fire Marshall. OTHER CITY OFFICIALS ABSENT: Larry L. Broussard, City Administrator; Dale Cryer, Director of Finance. OTHERS PRESENT: David Corbin, Busch, Hutchison & Associates. PRESIDING: Mayor J. J. Meza. + + + 1. CALL TO ORDER - Mayor Meza called the meeting to order. + + + 2. INVOCATION - The invocation was given by Commissioner Kibodeaux. + + + . . . e e Regular Meeting 10/24/77 2 3. APPROVAL OF MINUTES - REGULAR MEETING - OCTOBER 3, 1977. Motion by Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the Regular Meeting held October 3, 1977, as presented. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the Accounts Payable as presented. A copy of the Accounts Payable is attached and made a part of these minutes. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 5. EXPRESSION OF APPRECIATION - CARRINGTON WEEMS - Mr. Carrington Weems was recognized and addressed the Commission, expressing the appreciation of the Weems family to the City of La Porte for naming of Wharton Weems Boulevard in memory of his late father, Wharton Weems. In further appreciation, Mr. Weems gave an executed deed to the City of La Porte for the east one-half of Block 1253, Town of La Porte; in memory of his Mother, Matilde B. Weems. This gift of land to the City is to help encourage the good and orderly development of the area. The Commission expressed appreciation to the Weems family for their gift of land to the City. + + + 6. VISITORS WISHING TO ADDRESS THE COMMISSION - (A.) Mr. Ed Norton - was recognized and addressed the Commission regarding his opposition to the City's alley closing procedures, and the hazards of dumpsters. (B.) J. R. Spradling - 3302 Valley Brook - Mr. Spradling addressed the Commission regarding sewer system problems, the condition of the streets in Fairmont Park and incompetent personnel working for the City. + + + . . . e e Regular Meeting 10/24/77 3 6. VISITORS WISHING TO ADDRESS THE COMMISSION (CONTINUED) (C.) Mr. R. B. Lee - Inspections and New Home Construction - Mr. Lee read an article about post tension techniques; and expressed his concern over approval of a new home he was buying, which had a cracked slab, and the City Inspector approved. (D.) Mr. H. P. Pfeiffer - Mr. Pfeiffer addressed the Commission regarding Ordinance No. 705 and related ordinances (Subdivision Ordinance). Mr. Pfeiffer expressed his concern over unfairness to developers in the requirements of his subdivision as well as the requirement for the percentage of the park land. Mr. Pfeiffer further asked that the Commission reconsider his comments and look at these requirements more closely. + + + 7. CONSIDER AWARDING BIDS - FOUR WHEEL TRACTOR WITH FLAIL MOWER - Motion by Commissioner Cline, seconded by Commissioner Tomerlin, to accept the recommendation of the City Administrator and award the bid for a four-wheel tractor with flail mower to the low bidder, Alvin Implement and Supply, in the amount of $7,195.00. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 8. RATIFY FINAL ACCEPTANCE OF MUNICIPAL IMPROVEMENTS IN FAIRMONT PARK WEST, SECTION II - Motion by Commissioner Cline, seconded by Commissioner Simons to ratify final acceptance of Municipal Improvements in Fairmont Park West, Section II. A copy of the recommendation is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. RATIFY SIGNING OF LEASE AGREEMENT WITH HARRIS COUNTY FOR HEALTH CLINIC - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to ratify signing of lease agreement with Harris County for Health Clinic. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, None. line, and Simons. + + + 10. CONSIDER APPROVING PAYMENT TO MOTOROLA, INC., IN THE AMOUNT OF $2,160.00 FOR TEN PAGERS - FIRE DEPARTMENT - Motion by Commissioner Simons, seconded by Commissioner Cline to approve payment to Motorola, Inc., in the amount of $2,160.00 for ten pagers for the Fire Department. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 11. CONSIDER APPROVING PAYMENT TO DOUGHTIE & PORTERFIELD IN THE AMOUNT OF $23,100.27 FOR ARCHITECTURAL SERVICES - NEW CITY HALL - After a brief discussion, motion by Commissioner Cline, seconded by Commissioner Simons to approve payment to Doughtie & Porterfield in the amount of $22,396.00 and get further discussion on the remainder of the bill. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1096 - VACATING, ABANDONING AND CLOSING THE ALLEY I~BLOCK 688 - After the proposed ordinance was read in full, motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve Ordinance No. 1096 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY LYING WITHIN BLOCK SIX HUNDRED EIGHTY-EIGHT (688) IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. + + + 13. CONSIDER APPROVING PROPOSED RESOLUTION NO. 77-6 - EXEMPTING THE CITY OF LA PORTE FROM THE REQUIREMENTS OF THE VOLUNTEER FIRE FIGHTERS' RELIEF AND RETIREMENT FUND - After the proposed resolution was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Resolution No. 77-6 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 14. CONSIDER REQUEST OF ARCO PIPE LINE COMPANY TO CANCEL THEIR PIPE LINE PERMIT, ORDINANCE NO. 91S-F, DATED SEPTEMBER 15, 1975 - After the letter of request was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to cancel the pipe line permit of Arco Pipe Line Company, Ordinance No. 9l5-F, dated September 15, 1975, because the project was dead. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR CARRY- ALL FOR PARKS & RECREATION DEPARTMENT TO BE RECEIVED ON NOVEMBER 21, 1977, AT 7:00 P.M. - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to authorize advertising and accepting bids for a carry-all for the Parks & Recreation Department to be received on November 21, 1977, at 7:00 P.M. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 16. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR A BASE STATION RADIO FOR THE NEW POLICE STATION TO BE RECEIVED ON NOVEMBER 21, 1977, AT 7:00 P.M. - Motion by Commissioner Simons, seconded by Commissioner Cline to authorize advertising and accepting bids for a base station radio for the Fire Depart- ment to be located at the new Police Station, to be received on November 21, 1977, at 7:00 P.M. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 17. DISCUSS AND CONSIDER APPROVING COOPERATION AGREEMENT BETWEEN HARRIS COUNTY AND THE CITY OF LA PORTE FOR THE 1977 COMMUNITY DEVELOPMENT BLOCK GRANT - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve the Cooperation Agreement between Harris County and the City of La Porte for the 1977 Community Development Block Grant and authorize the Mayor to sign same. A copy of said agreement is attached and made a part of these minutes. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. CORRESPONDENCE - Mayor Meza read a letter from Celanese inviting the officials to attend a plant tour and lunch at the Houston Yacht Club on November 3, 1977, at 11:00 A.M., at the Clear Lake Plant. + + + 19. DISCUSSION OF DEPARTMENT PROJECTS - Mayor Meza stated that the plans for the widening of Fairmont Parkway from the Railroad to State Highway 146 were again ready for approval by the County and the City. Motion by Commissioner Simons, seconded by Commissioner Tomerlin to authorize the Mayor to sign the plans for the widening of Fairmont Parkway from the Railroad to State Highway 146. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 4 ENGINEER'S REPORT - Dave Corbin was recognized and discussed with the Commission the need for a resolution to amend our Grant for PL 92-500 to include Bayshore Municipal Utility District in our application. It was determined that The City would not bear any expense; all expenses would be borne by Bayshore Municipal Utility District. It was moved by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to authorize the City Attorney to prepare a resolution and authorize the Mayor to sign the Resolution amending the grant application for the PL 92-500. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 20. These !ailures have imposed a real and potential liability upon the ~on- -.-- ----:--- struction industry, the effect of "lhich will be felt for years to come. The actual savings through the use of the post tension tecp~ique for . the short run will be far outweighed by long term financial losses. The construction industry has a moral obligation as well as a legal obligation to construct a strong and stable foundation. If the construction industry does not fulfill these expectations, it will loose the confidence of the public. The cost of restoring this ": confidence will far outweigh any actual short term savings realized in using the post tension technique. Subdivisions. The Subdivision Ordinance requires the subdivider to perform the following: 1. Donate property for streets. ~ 2. Build concrete streets and curbing - width depending upon traffic load. 3. Sidewalks. 4. Water distribution system. ./ 5. Sewage distribution system, including manholes.~ 6. Donation of 5% of land for parks. ~ The city doesn't expend any funds, however, many cities do participate in the cost of utilities. True enough, the developers include the above items in the selling price of the land; however, I would like to point out that the city then takes ownership of the Lmprovements with the only cost to the city being the cost of an inspector and an engineer to check to be sure the work is in accordance with the ordinance. The developers-builders in non-subdivisions construct homes with the following conditions: 1. Water is available on a front foot cost. / 2. Sanitary sewage is available on a front foot cost. / 3. Driveway culverts may be purchased from suppliers, delivered to sites and city will set at no cost. The culverts may be purchased from the city; the city will furnish and/or haul and set same at no cost. Fill dirt is often placed on the culverts. Sidewalks are not required. Street lights are available at no cost to the builder or home owner. The city will clear and grade dedicated streets. The city has placed limestone on many streets where homes are being built. It seems unfair for the city to assist in non- subdivision building costs when they do not assist in subdivision costs. 2. It seems unfair for a home owner in a subdivision to pay for parks for all other citizens to use. 4. Parks and recreational land should be purchased with general funds, paid for by all citizens, for all citizens to use. t 5. Master Plan for parks should be prepared with assistance from Federal Funds. 6. Application and to cooperate with the City in the implementation of the City's Community Development Program; and WHEREAS, the Texas Legislature has enacted the "Texas Community Development Act of 1975," codified as Art. 1269.t-4 Tex.Rev.Civ.Stats., which provides, in part~ for the authorization of citie8 tv implement a community development program; and WHEREAS, the Texas Legislature has further enacted "The Interlocal Cooperation Act," codified as Art. 4413 (32c) Tex.Rev.Civ.Stats., which provides, in part, that the County may contract with the City to perform governmental functions and services for the City; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the County and the City, in consideration of the mutual covenants and agreements herein contained, do mutually agree as follows: e e I. The lawsuit also seeks civil damages' of $1,000 tor each alleged violation since February 1975.
