LA PORTE CITY COMMISSION, LA PORTE, TEXAS
OCTOBER 24, 1977

3. APPROVAL OF MINUTES - REGULAR MEETING - OCTOBER 3, 1977.
Motion by Commissioner Cline, seconded by Commissioner Simons
to approve the minutes of the Regular Meeting held October 3,
1977, as presented. Motion carried by the following vote:

4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Tomerlin,
seconded by Commissioner Kibodeaux to approve the Accounts
Payable as presented. A copy of the Accounts Payable is attached
and made a part of these minutes. Motion carried by the following
vote:

5. EXPRESSION OF APPRECIATION - CARRINGTON WEEMS - Mr. Carrington
Weems was recognized and addressed the Commission, expressing
the appreciation of the Weems family to the City of La Porte
for naming of Wharton Weems Boulevard in memory of his late
father, Wharton Weems. In further appreciation, Mr. Weems
gave an executed deed to the City of La Porte for the east
one-half of Block 1253, Town of La Porte; in memory of his
Mother, Matilde B. Weems. This gift of land to the City is
to help encourage the good and orderly development of the area.
The Commission expressed appreciation to the Weems family for
their gift of land to the City.

6.
VISITORS WISHING TO ADDRESS THE COMMISSION - (A.) Mr. Ed Norton -
was recognized and addressed the Commission regarding his opposition
to the City's alley closing procedures, and the hazards of dumpsters.
(B.) J. R. Spradling - 3302 Valley Brook - Mr. Spradling addressed
the Commission regarding sewer system problems, the condition of
the streets in Fairmont Park and incompetent personnel working
for the City.

6. VISITORS WISHING TO ADDRESS THE COMMISSION (CONTINUED)
(C.) Mr. R. B. Lee - Inspections and New Home Construction -
Mr. Lee read an article about post tension techniques; and
expressed his concern over approval of a new home he was buying,
which had a cracked slab, and the City Inspector approved.
(D.) Mr. H. P. Pfeiffer - Mr. Pfeiffer addressed the Commission
regarding Ordinance No. 705 and related ordinances (Subdivision
Ordinance). Mr. Pfeiffer expressed his concern over unfairness
to developers in the requirements of his subdivision as well as
the requirement for the percentage of the park land. Mr. Pfeiffer
further asked that the Commission reconsider his comments and look
at these requirements more closely.

7. CONSIDER AWARDING BIDS - FOUR WHEEL TRACTOR WITH FLAIL MOWER -
Motion by Commissioner Cline, seconded by Commissioner Tomerlin,
to accept the recommendation of the City Administrator and award
the bid for a four-wheel tractor with flail mower to the low bidder,
Alvin Implement and Supply, in the amount of $7,195.00. Motion
carried by the following vote:

Commissioners Tomerlin, Kibodeaux, Cline, and Simons.

8. RATIFY FINAL ACCEPTANCE OF MUNICIPAL IMPROVEMENTS IN FAIRMONT
PARK WEST, SECTION II - Motion by Commissioner Cline, seconded
by Commissioner Simons to ratify final acceptance of Municipal
Improvements in Fairmont Park West, Section II. A copy of the
recommendation is attached and made a part of these minutes.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.

9. RATIFY SIGNING OF LEASE AGREEMENT WITH HARRIS COUNTY FOR
HEALTH CLINIC - Motion by Commissioner Tomerlin, seconded
by Commissioner Kibodeaux to ratify signing of lease agreement
with Harris County for Health Clinic. Motion carried by the
following vote:

10. CONSIDER APPROVING PAYMENT TO MOTOROLA, INC., IN THE AMOUNT OF
$2,160.00 FOR TEN PAGERS - FIRE DEPARTMENT - Motion by
Commissioner Simons, seconded by Commissioner Cline to approve
payment to Motorola, Inc., in the amount of $2,160.00 for ten
pagers for the Fire Department. Motion carried by the following
vote:

11. CONSIDER APPROVING PAYMENT TO DOUGHTIE & PORTERFIELD IN THE
AMOUNT OF $23,100.27 FOR ARCHITECTURAL SERVICES - NEW CITY HALL -
After a brief discussion, motion by Commissioner Cline, seconded
by Commissioner Simons to approve payment to Doughtie & Porterfield
in the amount of $22,396.00 and get further discussion on the
remainder of the bill. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.

12. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1096 - VACATING,
ABANDONING AND CLOSING THE ALLEY I~BLOCK 688 - After the
proposed ordinance was read in full, motion by Commissioner
Kibodeaux, seconded by Commissioner Tomerlin to approve
Ordinance No. 1096 as read. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE
ALLEY LYING WITHIN BLOCK SIX HUNDRED EIGHTY-EIGHT (688) IN THE
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS.

13. CONSIDER APPROVING PROPOSED RESOLUTION NO. 77-6 - EXEMPTING
THE CITY OF LA PORTE FROM THE REQUIREMENTS OF THE VOLUNTEER
FIRE FIGHTERS' RELIEF AND RETIREMENT FUND - After the
proposed resolution was read in full, motion by Commissioner
Simons, seconded by Commissioner Kibodeaux to approve
Resolution No. 77-6 as read. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

14. CONSIDER REQUEST OF ARCO PIPE LINE COMPANY TO CANCEL THEIR
PIPE LINE PERMIT, ORDINANCE NO. 91S-F, DATED SEPTEMBER 15,
1975 - After the letter of request was read in full, motion
by Commissioner Simons, seconded by Commissioner Kibodeaux
to cancel the pipe line permit of Arco Pipe Line Company,
Ordinance No. 9l5-F, dated September 15, 1975, because the
project was dead. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.

15. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR CARRY-
ALL FOR PARKS & RECREATION DEPARTMENT TO BE RECEIVED ON
NOVEMBER 21, 1977, AT 7:00 P.M. - Motion by Commissioner
Tomerlin, seconded by Commissioner Kibodeaux to authorize
advertising and accepting bids for a carry-all for the
Parks & Recreation Department to be received on November 21,
1977, at 7:00 P.M. Motion carried by the following vote:

16. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR A
BASE STATION RADIO FOR THE NEW POLICE STATION TO BE RECEIVED
ON NOVEMBER 21, 1977, AT 7:00 P.M. - Motion by Commissioner
Simons, seconded by Commissioner Cline to authorize advertising
and accepting bids for a base station radio for the Fire Depart-
ment to be located at the new Police Station, to be received on
November 21, 1977, at 7:00 P.M. Motion carried by the following
vote:

17. DISCUSS AND CONSIDER APPROVING COOPERATION AGREEMENT BETWEEN
HARRIS COUNTY AND THE CITY OF LA PORTE FOR THE 1977 COMMUNITY
DEVELOPMENT BLOCK GRANT - Motion by Commissioner Kibodeaux,
seconded by Commissioner Tomerlin to approve the Cooperation
Agreement between Harris County and the City of La Porte for
the 1977 Community Development Block Grant and authorize the
Mayor to sign same. A copy of said agreement is attached and
made a part of these minutes. Motion carried by the following
vote:

18. CORRESPONDENCE - Mayor Meza read a letter from Celanese
inviting the officials to attend a plant tour and lunch
at the Houston Yacht Club on November 3, 1977, at 11:00 A.M.,
at the Clear Lake Plant.

19. DISCUSSION OF DEPARTMENT PROJECTS - Mayor Meza stated that
the plans for the widening of Fairmont Parkway from the
Railroad to State Highway 146 were again ready for approval
by the County and the City. Motion by Commissioner Simons,
seconded by Commissioner Tomerlin to authorize the Mayor
to sign the plans for the widening of Fairmont Parkway from
the Railroad to State Highway 146. Motion carried by the
following vote:

ENGINEER'S REPORT - Dave Corbin was recognized and discussed
with the Commission the need for a resolution to amend our
Grant for PL 92-500 to include Bayshore Municipal Utility
District in our application. It was determined that The City
would not bear any expense; all expenses would be borne by
Bayshore Municipal Utility District. It was moved by
Commissioner Kibodeaux, seconded by Commissioner Tomerlin
to authorize the City Attorney to prepare a resolution and
authorize the Mayor to sign the Resolution amending the
grant application for the PL 92-500. Motion carried by
the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

Houston area. This technique is }~o~m as post tension. This tech-
nique offers certain advantages to the conventional slab reinforce-
nlent which may be more apparent than real. The. post tension tech-
nique of reinforce~ent in slab foundations appears to offer certain
advantages in cutting cost and cutting time. z..':any construction
firms have been lured into using this technique for these reasons.
There has bec12- enough experience ~ to ~ that ~e.re have been
!T1any failures in structures built using post tension J,;;?,E reinforcement.
These !ailures have imposed a real and potential liability upon the ~on-
-.-- ----:---
struction industry, the effect of "lhich will be felt for years to come.
The actual savings through the use of the post tension tecp~ique for
.
the short run will be far outweighed by long term financial losses.
The construction industry has a moral obligation as well as a legal
obligation to construct a strong and stable foundation. If the
construction industry does not fulfill these expectations, it will
loose the confidence of the public. The cost of restoring this
":
confidence will far outweigh any actual short term savings realized
in using the post tension technique. Of course, the construction
industry has only to look at the governmental regulations ilnposed
on other industries to realize that if the construction industry

does not fulfill its moral and legal obligations, it will be invit~
.ing governmental control to a far gr~ater degree than that which

REQUEST RECONSIDERATION OF ORDINANCE NO.. 705
AND RELATED ORDINANCES
I.
Subdivisions.
The Subdivision Ordinance requires the subdivider
to perform the following:
1. Donate property for streets. ~
2. Build concrete streets and curbing - width
depending upon traffic load.
3. Sidewalks.
4. Water distribution system. ./
5. Sewage distribution system, including manholes.~
6. Storm water drainage system. v-/
7. Five (5) years advance for street lights. L-.
8. Street signs.
9. Donation of 5% of land for parks. ~
The city doesn't expend any funds, however, many
cities do participate in the cost of utilities.
True enough, the developers include the above items
in the selling price of the land; however, I would like
to point out that the city then takes ownership of the
Lmprovements with the only cost to the city being the
cost of an inspector and an engineer to check to be sure
the work is in accordance with the ordinance. Taxes are
levied and collected on the imp~~y~nt.

The developers-builders in non-subdivisions construct
homes with the following conditions:
1. Water is available on a front foot cost. /
2. Sanitary sewage is available on a front foot cost. /
3. Driveway culverts may be purchased from suppliers,
delivered to sites and city will set at no cost.
The culverts may be purchased from the city; the
city will furnish and/or haul and set same at no
cost. Fill dirt is often placed on the culverts.
Sidewalks are not required.
Street lights are available at no cost to the
builder or home owner.
The city will clear and grade dedicated streets.
The city has placed limestone on many streets
where homes are being built.
The city has routinely blacktopped many streets
after homes have been built.

III. Conclusion.
1. It seems unfair for the city to assist in non-
subdivision building costs when they do not
assist in subdivision costs.
2. The city has an option to purchase some 27
acres of park land and if purchased, would be
paid for with general funds.
3. It seems unfair for a home owner in a subdivision
to pay for parks for all other citizens to use.
4. Parks and recreational land should be purchased
with general funds, paid for by all citizens,
for all citizens to use.
t 5. Master Plan for parks should be prepared with
assistance from Federal Funds.
6. The subdivider is placed at a disadvantage with
other developments in the area.

Lessor will pay, before they become delinquent, all the taxes and
assessments whatever which may be payable for, on, or in respect of the leased
premises, or any part thereof during said term.

Lessor agrees that all fixtures and all personal property created

by the Lessee at the termination of this lease, or any extension thereof,

XI.
In the event Lessee shall hold over and remain in possession of '
the leased premises herein leased after the expiration of this agreement
without a written renewal thereof, such . holding over shall not be deemed to

per day which may be terminated at any time by either the Lessor or Lessee.

Notwithstanding anything hereto to the contrary or that may be con-
strued to the contrary, it is understooo am agreed that if Lessor refuses or
fails to perform anyone or more of its undertakings and obligations which
are to be performed during the term of this lease, then and in that event
Lessee shall have the right to terminate this lease upon ten (10) days' written
notice given to Lessor by registered or certified United States Mail, postage
prepaid, return receipt requested, addressed to N-77, Ltd., P. O. Pox 1277,
laPorte, Texas 77571; am such right shall be considered exercised and completed
upon Lessee's defX)sit of the notice in the United States Mail as aforesaid.
It is further understood that Lessee's exercise of any of the rights or options
under this paragraph shall not prejudice Lessee's right to recover damages
which Lessee has sustained as a result of Lessor's refusal or failure to

perform, and that tit rights and options under thi4llaragraph are cumulative
. with, and not in lieu of, other remedies provided oy law.
XIV.
It is agreed between the parties hereto that the Lessee shall have
the option to re-lease the premises for a term of twelve (12) months from

AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY
LYING WITHIN BLOCK SIX HUNDRED EIGHTY-EIGHT (688) IN THE
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Six Hundred Eighty-
eight (688) has never been opened or used as a public

thoroughfare, and the public utilities now making use of
such alley have all given their written consent for its
closing; and
WHEREAS, the City Commission of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO!1MISSION OF THE
CITY OF LA PORTE THAT:

Section 1. The alley located in Block Six Hundred
Eighty-eight (688) of the TOWN OF LA PORTE, Harris County,
Texas, is hereby permanently vacated, abandoned and closed by

Section 2. This Ordinance shall take effect and be in

AN ORDINANCE GRANTING A PERMIT UNDER SECTION l8-A-3 OF
ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER
l8-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS;
AND APPROVING THE APPLICATION OF ARCO PIPE LINE COMPANY ON
BEHALF OF ATLANTIC RICHFIELD COMPANY DATED AUGUST 27, 1975,
TO CONSTRUCT A 24-INCH PIPE LINE FOR THE TRANSPORTATION OF
CRUDE OIL; AND PROVIDING AN EFFECTIVE DATE HEREOF.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte
has received an application dated August 27, 1975, from ARCO
PIPE LINE COMPANY, on behalf of Atlantic Richfield Company,
requesting a permit under Section l8-A-3 of Ordinance No. 915,
being Chapter l8-A of the Code of Ordinances of the City of
La Porte, to construct a 24-inch pipe line for the transportation
of crude oil, crossing the City of La Porte, all as shown on
said application. The application of ARCO PIPE LINE COMPANY
has been reviewed by the City's Director of ' Public Works,' who
has found that said application meets all requirements of said
Ordinance No. 915, and has recommended its approval.
Section 2. The City Commission of the City of La Porte
hereby approves the application of ARCO PIPE LINE COMPANY,
dated August 27, 1975, and'this Ordinance shall constitute
a permit to ARCO PIPE LINE COMPANY to lay and construct said
pipe line within the City of La Porte, all in conformance
with the requirements of said Ordinance No. 915.
Section 3. This Ordinance shall be in full force and
effect from and after its passage and approval.

limits of La Porte, Texas. To date said pipe line has
not been laid and due to our inability to procure
necessary permits our Bayport Project has been abandoned.

Thus we, on behalf of Atlantic Richfield Company,
respectfully request the cancellation of said
Ordinance effective September 14, 1977. Your
notification of concurrence to our request will be
greatly appreciated.

Enelosed please find three (3) copies of the Cooperative
Agreement and Attorney's Certificates. It is necessary that
you execute this agreement by November 15, 1977 in order to
meet H.U.D. 's 1978 deadline for inclusion in the 1978 applica-
tion.
Please return the three (3) signed copies to this agency.
We will return one (1) certified copy to you upon completion of
the transaction. Along with the Cooperative Agreement, it will
be necessary to have three (3) signed certifificates from the City's
Attorney stating that the t€r~s and provisions of the agreement
are fully authorized under state arid local laws and that the Agree-
ment is fully executed by the City in accordance with all applicable
requirements of state and local laws and two (2) certified copies
of the City's Ordinance or resolution authorizing the execution of
the Cooperative Agreement.
After the Cooperative Agreements are signed, this agency
would like to meet with you in determining target areas and as-
certaining project eligibility and priorities for the FY 78 Block
Grant Applicatioll. In selecting the projects, please observe the
li.U.D. statuatory requirements that such project primarily serve
low and moderate income residents and the elimination of slums and
blight. Mr. Tom Van Dyke will be our staff person who will contact

THIS AGREEMENT, made and entered into by and between Harris County, a
body corp~rate and politic under the laws of the State of Texas, hereinafter
referred to as the "County," and The City of La Porte
, a municipal corporation under the laws of the State of
Texas, hereinafter referred to as the "City,"
WIT N E SSE T H:
WHEREAS, the City has elected to have its population included as a portion
of the population of the County in the County's "urban county" application to the U.
t S. Department of Housing and Urban Development for the fourth year funding for

the Community Development Block Grant Program, said application being
hereinafter sometimes referred to as the "Grant Application;" and
WHEREAS, the County is willing to include the City's population in the Grant
.
Application and to cooperate with the City in the implementation of the City's
Community Development Program; and
WHEREAS, the Texas Legislature has enacted the "Texas Community
Development Act of 1975," codified as Art. 1269.t-4 Tex.Rev.Civ.Stats., which
provides, in part~ for the authorization of citie8 tv implement a community
development program; and
WHEREAS, the Texas Legislature has further enacted "The Interlocal
Cooperation Act," codified as Art. 4413 (32c) Tex.Rev.Civ.Stats., which provides,
in part, that the County may contract with the City to perform governmental
functions and services for the City;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the
County and the City, in consideration of the mutual covenants and agreements
herein contained, do mutually agree as follows:

The City agrees to allow the County to include the City's population with that
of the County in the Grant Application, and the County agrees to include the same
in the Grant Application.

The City agrees to allow the U. S. Department of Housing and Urban
Development to use the City's population and other necessary demographic,
charac~eristics in the determination of whether the, County will qualify as an
"urban:county" as defined in the Housing and Community Development Act of 1974.

In this ,regard it is agreed' that the County shall not b'e obligated -to seek funds for
expenditure in the City or for assistance to residents of the City in the Grant
Application. If such flJ,nds for expenditure in the City or' for assistance to its
residents are awarded as a result of the Grant Application, the County may. in its
sole descretion, override' such distribution of the award and spend such' funds'
elsewhere, and/or for other purposes when necessary or desireable in order to
acl1ieve compliance with Title I of the Housing and Community Development Act of
1974, as amended, and all-appropriate implementing regulations applicable thereto.
The Ci~y has received no assurance. written or oral, from the County to the
contrary, and is aware that the execution of this contract does not constitute any
guarantee on the part of the County that funds received pursuant to the Grant
Application, if any, will be expended for projects within the City limits of the City
or for assistance to the residents of the City.
V.
This agreement shall remain in full force and effect for the entire fourth year

funding period covered by the Grant Application (July 1. 1978 through June 30,
1979). :The City acknowledges that it has been advised and is aware that federal

regulations applicable to the Grant Application do not permit the County to allow
the City to withdraw from this agreement or otherwise prior terminate the term of
this agreement at any time after December It 1977.
VI.
In performance of this agreement, the City and the County shall observe and

comply with all applicable Federal, Statet County and City statutes, ordinances,
rules and regulations.
VII.
Should the U. S. Department of Housing and Urban Development reject or
refuse to accept this agreement for any reason, the County may terminate this
agreement by giving written notice of the same to City.
VIII.
This agreement shall be of no force and effect unless and until it is executed
by both parties hereto and certified by counsel for both parties hereto on the forms
set forth below.
IN TESTIMONY WHEREOFt this instrument has been executed in triplicate
counterparts, each to have the force and effect of an original as follows:
(a) It has been executed on behalf of the County on the
day of

have been good and rewarding years for us and we would

to the area in 1967.

We are planning a brief program including a plant tour
and luncheon for officers of the area Chambers of Commerce
and other local officials on November 3, 1977. We would
like very much for you to attend.
The program will begin at 11:00 a.m. in the main office
building. After presenting a brief overview of our
operations, we will tour the plant by bus and then have
lunch at the Houston Yacht Club at about 12:15 p.m. The
program should be completed by 1:30 p.m.

The State ot Texas asked a state court
Monday for an injunction against the
City of Shore Acres and the Bayshore
Municipal Utility District tor alleged:
violation of water pollution laws.
The lawsuit also seeks civil damages'
of $1,000 tor each alleged violation since
February 1975. It alh~ged that waste from'
the Shoreacres sewage treatment plant'
flows into Taylor Bayou and from there'
to the San Jacinto-Brazos Coastal Basin'
in violation at state permits.
Mayor Rowe H. Holmes of Shore Acres'
said, "This suit comes as a complete sur.:
prise." He said he could not comment'
until he had more information on the

AGENT OF THE BAYSHORE MUNICIPAL UTILITY DISTRICT, TO OBTAIN
A FEDERAL CONSTRUCTION GRANT UNDER PUBLIC LAW 92~500.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Attached to this Resolution as Exhibit "A",
incorporated by reference herein and made a part hereof for
all purposes, is a certified copy of a Resolution of the Board
of Supervisors of the Bayshore Municipal Utility District,
passed and approved September 7, 1977.
Section 2. The City Commission of the City of La Porte
hereby agrees to act as the agent of the Bayshore Municipal
Utility District, to apply for and obtain a Federal Construc-

SUFFICIENT FUNDS TO RBIMBURSE THE CITY OF LA PORTE FOR COSTS
EXPENDED BY THE CITY FOR THIS PURPOSE.
WHEllliAS, Bayshore Municipal Utility District must improve
its sewage collection and make long range arrangements for
the treatment of sewage; and
HHEREAS, the City of La Porte has made an application for
a Federal Construction Grant under EPA Public La,,; Number 92-
500 for the City of La Porte and is willing to amend its appli-
cation to include Bayshore Municipal Utility District in this
project, the successful complebion of a joint facility being
conditioned upon the occurrence of certain contingencies which
will be described hereinafter; and
WHEREAS, it will be necessary for Bayshore Municipal Utility
District to reimburse the City of La Porte for any costs expended
by said City as a result of this amended application; and
vJIIEREAS, each such application must be processed in three
steps, the first step of which is a study and preparation of
preliminary plans and an analysis of the existing facility,
the initial phase of which is an infiltration inflow analysis
of the existing sewage collection system, followed by a sanitary
sewer evaluation survey if the original analysis justifies
such a survey and thirdly the preparation of a facility plan
describing how to solve the problem and what to build, thereby
ending step li the second step of which is the preparation
of the plans and specifications and the third step of which
is the construction phase; and
vmEREAS, the magnitude of the La Porte project causes it

to have a much higher priority for funding than an independent
application processed by Bayshore Municipal utility Distri~t
would have; and
HHEREAS, a joint application and joint effort would benefit
the region and avoid duplication.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS
OF 'l'HE BAYSHORE MUNICIPAL uTILrry DIS'l'RICT THAT:
Said Board of Supervisors hereby designates the City of
La Porte, Texas as its agent to apply for and obtain a Federal
C0""''''~:''uction Grant under EPA La\17 Number 92-500 as a part of
. ,;1': as an amendment to the pending application for such a grant
by the City of La Porte, and authorizes the City of La Porte
to proceed with said application through step one as described
hereinabove wherein an infiltration inflmv analysis and a

Extra Territorial Jurisdiction Claim of the City of Shoreacres
to the territory comprised by the Bayshore Municipal utility
District is released for purposes of annexation by Bayshore
Municipal utility District by the City of La Porte.
Further, this agreement and .the agency relationship may
be cancelled by the Bayshore Municipal Utility District upon
days written notice to the City Secretary of the City
of La Porte after which time Bayshore Municipal Utility District
shall have no further obligation to proceed as contemplated,
save and except the obligation to reimburse ,the City of La
Porte for any monies actually expended on behalf of Bayshore
