Meza, Mayor; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, City Administrator; Margie Goyen, City Clerk; Knox Askins, City Attorney; Robert Hall, Assistant Chief of Police. • OTHER CITY OFFICIALS ABSENT: None. OTHERS PRESENT: A. J. APPROVAL OF MINUTES - REGULAR MEETING - OCTOBER 24, 1977 - Motion by Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the regular meeting of October 24, 1977, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 5. APPROVAL OF ACCOUNTS PAYABLE - After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve the accounts payable as presented. A copy is attached and made a part of these minutes. Motion carried by the following vote: • AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • • • Regular Meeting 11/7/77 3 6. VISITORS WISHING TO ADDRESS THE' COMMISSION - MRS. MAXINE SHERIDAN - was recognized and addressed the Commission regarding the need of a red light at 225 and Oak Park, or consider opening up 9th Street from Main Street to Oak Park, because of the hazards to get in and out of Oak Park Mobile Home Park. Mrs. Sheridan presented a petition and stated she would appreciate any help the Commission might be able to give. Mayor Meza accepted the petition and stated it would be given to the State Highway Department for their consideration and recommendation. + + + 7. CONSIDER AUTHORIZING MAYOR TO SIGN PLANS FOR FAIRMONT PARKWAY WIDENING - Motion by Commissioner Cline, seconded by Commissioner Simons to authorize the Mayor to sign the plans for the widening of Fairmont Parkway. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. • NAYS: None. + + + 8. RATIFY AUTHORIZING MAYOR TO SIGN RESOLUTION NO. 77-7 AUTHORIZING CITY OF LA PORTE TO ACT AS THE AGENT OF THE BAYSHORE MUNICIPAL UTILITY DISTRICT, TO OBTAIN A FEDERAL CONSTRUCTION GRANfi UNDER PUBLIC LAW 92-500 -Motion by Com- missioner Tomerlin, seconded by Commissioner Kibodeaux to ratify authorizing the Mayor to sign Resolution No. 77-7 authorizing the City of La Porte to act as the agent of the Bayshore Municipal Utility District, to obtain a federal construction grant under Public Law 92-500. CONSIDER EXEMPTING CHURCHES FROM PAYING FEES FOR STREET AND ALLEY CLOSURES - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Cline to exempt churches from paying fees for street and alley closures. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 10. DISCUSS AMBULANCE CONTRACT - Mayor Meza asked that the discussion on the ambulance contract be tabled for the executive session. + + + 11. CONSIDER CALLING A JOINT PUBLIC HEARING TO BE HELD ON DECEMBER 5, 1977, AT 7:00 P.M., TO CONSIDER REZONING THE EAST ONE-HALF • (E. 1/2) OF BLOCKS 832, AND 825, AND LOTS 17 THROUGH 29, BLOCK 796, TOWN OF LA PORTE, FROM RESIDENTIAL TO COMMERCIAL -Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to call a joint public hearing to be held on December 5, 1977, at 7:00 P.M., to consider rezoning the East one-half of_ Blocks 832, and 825, and Lots 17 through Lots 29, Block 796, town of La Porte, from Residential to Commercial. Motion carried by the following vote: AYES: Commissioners Tomerl NAYS: None. 12. DISCUSSION OF DEPARTMENT PROJECTS - CLOSING OF KATHERINE STREET - AND OPENING OF BAYSHORE - Commissioner Cline informed the Commission that she had received a reply from St. Mary's Church regarding the closing of Katherine Street and the opening of Bayshore Drive. St. Mary's Church was prepared to pay the required cost of $6,620.00 for the surfacing work and agreed to the terms. The further requested that the City proceed as soon as possible. It was the consensus of opinion that the City should proceed with the closing of Katherine Street and the opening of Bayshore Drive. Copies of the City's terms and conditions and the Church's reply are attached and made a part of these minutes. PARK SITE - "B" AND LOBIT - The City Administrator stated that the Parks and Recreation Department was making a new park on South Lobit and "B" Street; asking that the Commission consider a name for the park. Commissioner Cline proposed the name of "TOM BROWN PARK". Naming of the park will be taken under consideration. ENGINEER'S REPORT - Johnnie Busch informed the Commission that the 16th Street Sewer Line Project had not been satisfactorily • completed as of yet. + + + 14. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - (E) AND (G) - (LITIGATION AND PERSONNEL) - Motion by Commissioner Simons, seconded by Commissioner Cline that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:35 P.M. Box 211 La Porte, Texas 77571 Dear Mr. Carpenter: • On October 1, 1975, the City of La Porte entered into an agree- ment with La Porte Ambulance Service, Inc., _f or .a two-year term, for La Porte Ambulance Service, Inc. to provide ambulance ser- vice within the City of~La Porte.. This agreement was, amended by letter agreement of October 27, 1975, relating to the lease by the City `to your firm, of one CPR machine, and three hospital encoders. The City of La Porte proposes that this basic agreement, as amended, be extended"for a five-year period commencing October 1, 1977, and terminating September 30, 1982, on the same terms and conditions of the basic agreement, as amended, except as amended as follows: " (1) That the City of La Porte (hereinafter "City") agrees and promises to pay La Porte Ambulance Service, Inc. (hereinafter "Contractor") Dollars ($ ) per month for such services. (b) $65.00 base fee for transporting one person to a hospital in Houston or Galveston. (c) $5.00/15'min. charge,. if any, for waiting in excess of fifteen minutes. (d) $20.00 charge, if any, for unfounded requests for service. (e) $25.00 maximum charge for transporting one person to a doctor's office in La Porte, from location within the limits of the City of La Porte. (~) Method of dividing cost among patients if more than one is carried in the same ambulance simul- taneously to one hospital: One and one-half times the regular rate, divided by the number of patients transported; each patient to pay equal amount. MARY'S CH 816 Park Avenue La Porte, Texas 77577.-_., St. Mary's Church has requested the City of La .Porte to vacate, abandon and close that portion of Katherine Avenue lying and being situated within the property owned by St. Mary's Church. The City Commission of the City of La Porte is agreeable to closing this portion of Katherine Avenue, upon the following terms and conditions: ' (1) The City of La Porte will require St. Mary's Church to • furnish letters from each of the utilities serving La Porte, and the City of La Forte's Public Works Department, consenting to the street closing. If any of the utilities or the City Public Works Department have objections, or requires relocation of lines, this would have to be done at the sole expense of the Church. Likewise, it is possible that St. Mary's Church may have to dedicate certain substitute easements to some of the utilities. (2) The City of La Porte will require St. Mary's Church, at its expense, to deliver a right-of-way Deed to the City of La Porte, dedicating to the City of. La Porte, for public use, a street right-of-way, four hundred feet (400') in length, which would be an easterly extension of -Bayshore Drive, four hundred feet (400'), to the intersection with South Kansas Street. (3) The City of La Porte would expect St. Mary's Church to pay for all of the materials necessary to improve this 400-foot portion of Bayshore Drive with culvert, lime- stone base, and an asphalt topping, inasmuch as the portion of Katherine Avenue being closed is improved on this basis. An engineer's estimate of the cost of this material is attached to this .letter, and totals • $6,620.00. The City of La Porte will furnish all necessary labor to construct the street. ~n~~? Rev. Surveyor, has agreed to donate his engineering and survey- ing services at no cost to the City, to improve this . portion of Bayshore Drive. (5) The improvement of Bayshore Drive must be completed and opened to traffic, before the City Commission could • formally pass its ordinance, officially closing the portion of Katherine. Avenue situated within the Church's property. (6) Inasmuch as the City feels that the relative value of the portion of Katherine Avenue, which you seek to have closed, and the new portion of Bayshore Drive, which you would dedicate to the City of La Porte, are approximately the same, there would be a waiver by the City of La Porte of its usual requirement that an appraisal be made of a portion. of a street sought to be closed, and that the owner pay 75$ of the appraised value to the City. If this meets with your approval, please secure formal approval • by the Good Shepherd Council, the governing body of St. Mary's Church, and advise us of its approval.
