• • MINUTES o REGULAR MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS NOVEMBER 21, 1977 6:00 P.M. MEMBERS OF THE COMMISSION PRESENT: Mayor Pro-Tem Tom Simons; Commissioners John Tomerlin, I. J. Kibodeaux, and Virginia Cline. MEMBERS OF THE COMMISSION ABSENT: Mayor J. J. Meza. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, City Administrator; Margie Goyen, City Clerk; Knox Askins, City Attorney. • OTHER CITY OFFICIALS ABSENT: None. OTHERS PRESENT: A. J. Busch, Jr., of Busch, Hutchison & Associates. PRESIDING: Mayor Pro-Tem Tom Simons. + + + 1. CALL TO ORDER - Mayor Pro-Tem Simons called the meeting to order. + + + 2. INVOCATION - The invocation was given by Mayor Pro-Tem Simons. + + + • • • Regular Meeting 11/21/77 2 3. APPROVAL OF MINUTES - REGULAR MEETING - NOVEMBER 7, 1977 - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the minutes of a Regular Meeting held November 7, 1977. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Cline. NAYS: None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve the accounts payable as presented. A copy of the accounts payable is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Cline. NAYS: None. c: + + + 5. VISITORS WISHING TO ADDRESS THE COMMISSION - MRS. P. J. MOCK, JR., 219 Sylvan - representing Galveston Bay Conservation and Preservation Association, requesting the City Commission to send a letter asking to be a party to a hearing on December 19, on a permit application made by B. F. Goodrich for a plant in Bayport. Mrs. Mock asked that the Commission familiarize themselves with the effect the plant could have on the environment. If a letter was not sent asking to be a party to the hearing, the City would have no right to protest or voice in the hearing. If they did not wish to, the letter would not be a commitment; but an option. A copy of the letter mailed to the Texas Air Control Board is attached and made a part of these minutes. + + + • • • • Regular Meeting 11/21/77 3 6. CONSIDER AWARDING BIDS - NINE POLICE AUTOMOBILES - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to accept the recommendation of the Chief of Police and award the bid for nine police automobiles to Jay Marks Chevrolet in the amount of $47,132.52. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Cline. NAYS: None. + + + 7. CONSIDER APPROVING PAYMENT TO BUSCH, HUTCHISON & ASSOCIATES, IN THE AMOUNT OF 713.00 FOR REVISIONS TO THE ANNEXATION AND ZONING MAPS; 893.00 FOR PREPARING AIRPORT ZONING MAPS AS DIRECTED BY F.A.A. - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve payment to Busch, Hutchison & Associates in the amount of $713.00 for revisions to the Annexation and Zoning Maps; $893.00 for preparing Airport Zoning Maps as directed by the F.A.A. BELL COMPANY IN THE AMOUNT OF 68,850.00 - NEW CITY HALL BUILDING - PAY ESTIMATE NO. 1 - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve payment to P. G. Bell Company for Pay Estimate No. 1 on the New City Hall Building in the amount of $68,850.00. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Cline. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1097 - VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 823 - After the proposed ordinance .was read in full, motion by Commissioner Cline, seconded by Commissioner Kibodeaux to approve Ordinance No. 1097 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux and Cline. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY LYING WITHIN BLOCK EIGHT HUNDRED TWENTY-THREE (823) IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. + + + 10. CONSIDER_DECLARING AN EMERGENCY TO AUTHORIZE THE PURCHASE OF A MODEL 300 TYMCO STREET SWEEPER - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to declare an emergency. The City has been unable to get contractors • to fulfill contracts for street sweeping. The streets are in such a condition that debris is causing problems in our drainage and sanitary sewer. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux and Cline. NAYS: None. + + + 11. CONSIDER APPROVING PAYMENT TO B.C.M. EQUIPMENT COMPANY IN THE AMOUNT OF 21,000.00 FOR ONE MODEL 300 TYMCO TRUCK MOUNTED REGENERATIVE AIR SWEEPER COMPLETE, MOUNTED ON 1977 FORD MODEL F-350, ONE TON TRUCK - Motion by Commissioner Cline, seconded by Comm si signer Tomerlin to approve payment to B.C.M. Equipment Company in the amount of $21,000.00 for one model 300 TYMCO truck mounted regenerative air sweeper complete, mounted on 1977 Ford model F-350, one ton truck. CONSIDER APPROVING STREET LIGHTS AT THE FOLLOWING LOCATIONS: 7TH AND "D", 3RD AND "E", "B" AND 12TH STREETS - Motion by Commissioner Cline, seconded by Commissioner Kibodeaux to authorize street lights at the following locations: 7th and "D", 3rd and "E", "B" and 12th Streets. Motion carried by the following votes: AYES: Commissioners Tomerlin, Kibodeaux, Cline. NAYS: None. + + + 13. CORRESPONDENCE - A. Letter from Fairmont Park Baptist Church was read expressing appreciation to the City for assistance during their time of need. A copy of said letter is attached and made a part of these minutes. B. Letter from Turner, Collie & Braden, with progress pictures of the Grade Separation on Spencer Highway. • + + + 14. DISCUSSION OF DEPARTMENT PROJECTS - OPENING OF 12TH STREET - Commissioner Cline stated that after talking with the citizens in the area that she could recommend that 12th Street be opened only to "A" Street and not to "B", as requested by Jay Marks. + + + 15. EXECUTIVE SESSION - V.A.T.A. - ARTICLE 6252-17 - SECTION 2 - (E) AND (G) - (LITIGATION AND PERSONNEL) - Motion by Commissioner Cline, seconded by Commissioner Kibodeaux, that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline. NAYS: None. The meeting recessed at 6:34 P.M.
