APPROVAL OF MINUTES - REGULAR MEETING - DECEMBER 5, 1977 - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the minutes of the regular meeting of December 5, 1977, as presented. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline and Simons. NAYS: None. + + + 4. EVELYN KENNEDY - was recognized and expressed her appreciation to the Commission for renaming the Civic Center the "Evelyn Kennedy Civic Center" and for the relationship between the City and the Neighborhood Centers Association. + + + 6. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE RECEIVED ON JANUARY 23, 1978, FOR TWO 1978 COMPACT AUTOMOBILES - AT 7:00 P.M. FOR PARKS & RECREATION AND INSPECTION DEPARTMENT - Motion by CV!Lullissioner Simons, seconded by Commissioner Kibodeaux to authorize advertising and accepting bids to be received on January 23, 1978, at 7: 00 P. M. , for two 1978 compact automobiles for the Parks & Recreation and Inspection Department. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. CONSIDER CALLING SPECIAL WORK SHOP ON JANUARY 16, 1978, AT 7:00 P.M., WITH CHARTER REVISION COMMTTTEETOREVIEW PROPOSED, AMENDMENTS TO HOME RULE CHARTER - M:otion by CV!Luuissioner Simons, seconded by Commissioner Cline to call a Special Work Shop on January 16, 1978, at 7:00 P.M., with Charter Revision Committee to review the proposed amendments to Horne Rule Charter. CAPTION: AN ORDINANCE REGULATING GAME ROOMS, PROVIDING LICENSING PROCEDURES AND FEES, REGISTERING OF SKILL OR PLEASURE ORIENTED COIN-OPERATED MACHINES AND PAYMENT OF OCCUPATIONAL TAX THEREON, REGULATING HOURS OF OPERATION, PRO- VIDING STANDARDS FOR OPERATION, PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. + + + 12. BETWEEN THE CITY AND COMMUNITY DEVELOPMENT - After a brief discussion, motion by Commissioner Cline, seconded by Commissioner Simons that appointing a representative be postponed for additional study and Community Development Agency be called and informed that the City has not made an appointment, but will continue to make a diligent search for a member. CONSIDER CALLING JOINT PUBLIC HEARING TO BE HELD ON JANUARY 23, 1978, AT 7:02 P.M., TO ALLOW A DUPLEX TO BE BUILT ON LOTS 19 THRU 24, BLOCK 12, BAY FRONT ADDITION - Motion by Commissioner Cline, seconded by Commissioner Kibodeaux to call a joint public hearing to be held on January 23, 1978, at 7:02 P.M., to allow a duplex to be built on Lots 19 thru 24, Block 12, Bay Front Addition. DISCUSS WORKMEN'S COMPENSATION INSURANCE - Motion by Com- missioner Kibodeaux, seconded by Commissloner Simons to authorize the City Administrator to apply to Texas Municipal League for Workmen's Compensation Insurance for the City beginning January 1, 1978. A Christmas Card addressed to the Commission from Mr. Jim Wyatt of Houston Lighting & Power Company. B. A letter from Neighborhood Centers expressing appreciation for the donation of $3,000.00 for the program in La Porte. A copy of said letter is attached and made a part of these minutes. C. A letter from Jack Campbell, Mayor of the City of Seabrook, requesting consideration of a resolution supporting Senate Bill 381. A copy of said letter is attached. D. A letter from Community Development Agency with completed copy of the FY-78 Cooperation Agreement with Harris County. Both are attached and made a part of these minutes. + + + 20. DISCUSSION OF DEPARTMENT PROJECTS - A. Mayor Meza informed the Commission that the City had appeared before the Subsidence . District and had proposed to increase the water withdrawal for 1978 to 600,000,000 gallons, which would be an increase of 100,000,000 gallons. It will be from three to five years before surface water will be available. Reports to the Harris- Galveston Coastal Subsidence District are attached and made a part of these minutes. B. Commissioner Simons requested an executive session. C. ENGINEER's REPORT - Dave Corbin gave a status report of La Porte's PL 92-500 Construction Grant; and that there would be a public hearing in Austin in January to consider proposed rule changes to the Municipal Facilities Construction Grant Priority Rating Process. The City Commission of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 5th day of December, 1977, at 7:00 P.M., a joint public hearing was held before the Planning and Zoning Commission and the City Commission, of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re-classi- fication of the zoning classification of the hereinafter described parcel of land. Box 1115 LaPorte, Texas 77571 Dear Mayor Meza: This Agency's Planning Department has set up a citizen participation mechanism in order to comply with the intent of the Housing and Community Development Act of 1974. This letter is to request that a citizen from your low in- come area, i.e., from the target area for Community Development pro- jects, be appointed to act as liaison between Community Development e and your City Council. The citizen will be responsible for calling citizen meetings in the target areas for input into the upcoming application. This person will meet at least twice a year with Com- munity Development staff. In addition this Task Force member will be asked to meet with other Task Force participants in a meeting once a month. It is necessary that we know the Task Force appointee's name as soon as possible. Our Planning Department has scheduled a meeting of the Citizen Participation Task Force for December 20, 1977 at 7:30 p.m. at the Community Development Agency's office, 4625 North Freeway, Suite 330. Department of Housing and Urban Development for the fourth year funding for the Community Development Block Grant Program, said application being hereinafter sometimes referred to as the "Grant Applicationi" and WHEREAS, the County is willing to include the City's population in the Grant Application and to cooperate with the City in the implementation of the City's Community Development Program; and WHEREAS, the Texas Legislature has enacted the "Texas Community. . Development Act of 1975," codified as Art. 1269l-4 Tex.Rev.Civ.Stats., which - provides, in part. for the authorization of cities; tv impl€:ment a community development program; and WHEREAS, the Texas Legislature has further enacted "The Interlocal Cooperation Act," codified as Art. 4413 (32c) Tex.Rev.Civ.Stats., which provides, - e in part, that the County may contract with the City to perform governmental , functions and services for the City; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the County and the City, in consideration of the mutual covenants and agreements herein contained, do mutually agree as follows: I. . The County and the City agree to cooperate in undertaking, or assisting in undertaking, essential community development and housing assistance activities, specifically urban renewal and publicly assisted housing. Department of, Housing and Urban Development and that no determination has been made at the time of execution of this agreement as to where and for what purposes the fourth year funding, if any, for the Community Development Block Grant Program will be sought or expended. In this regard it is agreed that the County shall not be obligated to seek funds for I expenditure in the City or for assistance to residents of the City in the Grant Application. If such funds for expenditure in the City or for assistance to its . residents are awarded as a result of the Grant Application, the County may, in its - sole descretion, override such distribution of the award and spend such funds elsewhere, and/or for other purposes when necessary or desireable in order to achieve compliance with Title I of the Housing and Community Development Act of 1974, as amended, and all-appropriate implementing regulations applicable thereto. - e The City has received no assurance, written or oral, from the County to the t contrary, and is aware that the execution of this contract does not constitute any guarantee on the part of the County that funds received pursuant to the Grant Application, if any, will be expended for projects within the City limits of the City or for assistance to the residents of the City. v. .
