3. APPROVAL OF MINUTES - REGULAR MEETING - DECEMBER 5, 1977 -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to approve the minutes of the regular meeting of
December 5, 1977, as presented. Motion carried by the
following vote:
AYES: Commissioners Kibodeaux, Cline and Simons.
NAYS: None.

4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline,
seconded by Commissioner Simons to approve the Accounts
Payable as presented. A copy is attached and made a part
of these minutes. Motion carried by the following vote:

5. VISITORS WISHING TO ADDRESS THE COMMISSION - MRS. EVELYN KENNEDY -
was recognized and expressed her appreciation to the Commission
for renaming the Civic Center the "Evelyn Kennedy Civic Center"
and for the relationship between the City and the Neighborhood
Centers Association.

6. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON JANUARY 23, 1978, FOR TWO 1978 COMPACT AUTOMOBILES -
AT 7:00 P.M. FOR PARKS & RECREATION AND INSPECTION DEPARTMENT -
Motion by CV!Lullissioner Simons, seconded by Commissioner
Kibodeaux to authorize advertising and accepting bids to be
received on January 23, 1978, at 7: 00 P. M. , for two 1978
compact automobiles for the Parks & Recreation and Inspection
Department. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

7. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1098 - VACATING,
ABANDONING AND CLOSING THE ALLEY IN BLOCK 1108 - After the
proposed ordinance was read in full, motion by' Commissioner
Cline, seconded by Commissioner Simons to approve Ordinance
No. 1098 as read. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE
ALLEY LYING WITHIN BLOCK ELEVEN HUNDRED EIGHT (1108) IN THE
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS.

8. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1099 - CHANGING
THE NAME OF A PORTION OF SPENCER HIGHWAY TO WEST MAIN -
After the proposed ordinance was read in full, motion by
Commissioner Kibodeaux, seconded by Commissioner Simons to
. approve Ordinance No. 1099 as read. Motion carried by the
following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.

CAPTION: AN ORDINANCE CHANGING THE NAME OF SPENCER HIGHWAY,
A PUBLIC STREET IN THE CITY OF LA PORTE, TO WEST MAIN STREET;
AND PROVIDING AN EFFECTIVE DATE HEREOF.

9. CONSIDER APPROVING PAY ESTIMATE NO. 2 - P. G. BELL COMPANY -
IN THE AMOUNT OF $86,963.40 - NEW CITY HALL - Motion by
Commissioner Cline, seconded by Commissioner Simons to approve
Pay Estimate No. 2 to P. G. Bell Company in the amount of
$86,963.40 for the New City Hall. A copy of the pay estimate
is attached and made a part of these minutes. Motion carried
by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.

10. CONSIDER CALLING SPECIAL WORK SHOP ON JANUARY 16, 1978, AT
7:00 P.M., WITH CHARTER REVISION COMMTTTEETOREVIEW PROPOSED,
AMENDMENTS TO HOME RULE CHARTER - M:otion by CV!Luuissioner
Simons, seconded by Commissioner Cline to call a Special
Work Shop on January 16, 1978, at 7:00 P.M., with Charter
Revision Committee to review the proposed amendments to
Horne Rule Charter. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

II. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1100 - GAME ROOM
ORDINANCE - After the proposed ordinance was read in full,
motion by Commissioner Simons, seconded by Commissioner
Cline to approve Ordinance No. 1100 as read. Motion carried
by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
. NAYS: None.
CAPTION: AN ORDINANCE REGULATING GAME ROOMS, PROVIDING
LICENSING PROCEDURES AND FEES, REGISTERING OF SKILL OR
PLEASURE ORIENTED COIN-OPERATED MACHINES AND PAYMENT OF
OCCUPATIONAL TAX THEREON, REGULATING HOURS OF OPERATION, PRO-
VIDING STANDARDS FOR OPERATION, PROVIDING THAT ANY PERSON
VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY
OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY
SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING
FOR SEVERABILITY AND AN EFFECTIVE DATE.

12. CONSIDER REQUEST OF A. J. WHIPPLE REGARDING ENCROACHNENT ,
ON UTILITY EASEMENT - After a letter was read regarding
the improvements at 10250 Creekview, motion by Commissioner
Simons, seconded by Commissioner Kibodeaux that this item
be tabled for additional information and study. Motion carried
by the following vote:

13. CONSIDER APPROVING PROPOSED ORDINANCE NO. 780-LL - REZONING
THE EAST ONE-HALF (E.l/2) OF BLOCKS 832 AND 825, LOTS 17
THRU 29, BLOCK 796, TOWN OF LA PORTE FROM RESIDENTIAL T~
"c" APARTMENT AND COMMERCIAL - After the proposed
ordinance was read in full, motion by Commissioner Simons,
seconded by Commissioner Kibodeaux to approve Ordinance
No. 780-LL as read. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780, THE
CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFI-
CATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;
AND PROVIDING AN EFFECTIVE DATE HEREOF.

14. CONSIDER APPOINTING REPRESENTATIVE TO ACT AS LIAISON
. BETWEEN THE CITY AND COMMUNITY DEVELOPMENT - After a brief
discussion, motion by Commissioner Cline, seconded by
Commissioner Simons that appointing a representative be
postponed for additional study and Community Development
Agency be called and informed that the City has not made an
appointment, but will continue to make a diligent search for
a member. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

15. CONSIDER CALLING JOINT PUBLIC HEARING TO BE HELD ON JANUARY 23,
1978, AT 7:02 P.M., TO ALLOW A DUPLEX TO BE BUILT ON LOTS 19
THRU 24, BLOCK 12, BAY FRONT ADDITION - Motion by Commissioner
Cline, seconded by Commissioner Kibodeaux to call a joint public
hearing to be held on January 23, 1978, at 7:02 P.M., to allow
a duplex to be built on Lots 19 thru 24, Block 12, Bay Front
Addition. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

16. DISCUSS WORKMEN'S COMPENSATION INSURANCE - Motion by Com-
missioner Kibodeaux, seconded by Commissloner Simons to
authorize the City Administrator to apply to Texas Municipal
League for Workmen's Compensation Insurance for the City
beginning January 1, 1978. Motion carried by the following
vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

17. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1101 - RENAMING
SOUTHS IDE CIVIC CENTER THE "EVELYN KENNEDY CIVIC CENTER" -
After the proposed ordinance was read in full, motion by
Commissioner Simons, seconded by Commissioner Kibodeaux to
approve Ordinance No. 1101 as read. Motion carried by the
following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.

18. RATIFY AUTHORIZING 57 STREETLIGHTS - GLEN MEADOWS - SECTTON I -
Motion by Commissioner Cline, seconded by Commissioner Simons
to ratify authorizing 57 street lights for Glen Meadows,
Section I Subdivision. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.

19. CORRESPONDENCE - A. A Christmas Card addressed to the Commission
from Mr. Jim Wyatt of Houston Lighting & Power Company.
B. A letter from Neighborhood Centers expressing appreciation
for the donation of $3,000.00 for the program in La Porte.
A copy of said letter is attached and made a part of these
minutes.
C. A letter from Jack Campbell, Mayor of the City of Seabrook,
requesting consideration of a resolution supporting Senate Bill
381. A copy of said letter is attached.
D. A letter from Community Development Agency with completed
copy of the FY-78 Cooperation Agreement with Harris County.
Both are attached and made a part of these minutes.

20. DISCUSSION OF DEPARTMENT PROJECTS - A. Mayor Meza informed
the Commission that the City had appeared before the Subsidence
. District and had proposed to increase the water withdrawal
for 1978 to 600,000,000 gallons, which would be an increase
of 100,000,000 gallons. It will be from three to five years
before surface water will be available. Reports to the Harris-
Galveston Coastal Subsidence District are attached and made a
part of these minutes.
B. Commissioner Simons requested an executive session.
C. ENGINEER's REPORT - Dave Corbin gave a status report of
La Porte's PL 92-500 Construction Grant; and that there would
be a public hearing in Austin in January to consider proposed
rule changes to the Municipal Facilities Construction Grant
Priority Rating Process. A copy of the report is attached and
made a part of these minutes.

executive session. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.
The meeting recessed at 8:02 P.M.
The meeting reconvened at 9:29 P.M.

e AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY
LYING WITHIN BLOCK ELEVEN HUNDRED EIGHT (1108) IN THE
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Eleven Hundred Eight
(1108) has never been opened or used as a public thorough-
fare, and the public utilities now making use of such alley
have all given their written consent for its closing; and
WHEREAS, the City Commission of the City of La Porte
has determined and does hereby find, determine and declare
that the said alley is not suitable, needed, or beneficial
to the public as a public alley, and should be vacated,
abandoned and permanently closed:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
e CITY OF LA PORTE THAT:
Section 1. The alley located in Block Eleven Hundred
Eight (1108) of the TOWN OF LA PORTE, Harris County, Texas,
is hereby permanently vacatedf abandoned and closed by the
City of La Porte.
Section 2. This Ordinance shall take effect and be in
force from and after its passage and approval.

Gentlemen:
As you have requested, I have appraised a strip of land 16' X 400'
in Block No. 1108, being the alley between 1st Street and 2nd
Street, from West J ( W. Fairmont Pkwy.) to West K Street, in the
City of LaPorte, Harris County, Texas, and shown on the attached
plat.
The purpose of this appraisal was to estimate the Fair Market
Value of said property.
In my opinion the highest and best use of Subject Property is
commerical.
It is my opinion thst the property appraised has a Fair Market
e Value as of December 13, 1977 of
Fee Value: 6,400 s/f @ $0.75 s/f = $4,800.00
Easement Value: 75% of Fee Value = $3,600.00

AN ORDINANCE CHANGING THE NAME OF SPENCER HIGHWAY, A PUBLIC
STREET IN THE CITY OF LA PORTE, TO WEST MAIN STREET; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The name of that portion of Spencer Highway,
from the Southern Pacific Railroad tracks to Underwood Road,
is hereby changed to West Main Street, and said portion of
said public street shall be known as West Main Street from and
after the effective date of this ordinance.
Section 2. This Ordinance shall be effective from and
after its passage and approval.

e AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte
hereby finds, determines and declares that heretofore, to-wit:
on the 5th day of December, 1977, at 7:00 P.M., a joint public
hearing was held before the Planning and Zoning Commission and
the City Commission, of the City of La Porte, Texas, pursuant to
due notice, to consider the question of the possible re-classi-
fication of the zoning classification of the hereinafter described
parcel of land. There is attached to this Ordinance as "Exhibit
.
e A," and incorporated by reference herein and made a part hereof
for all purposes, a copy of "Notice of Public Hearing" which
the City Commission of the City of La Porte hereby finds was
properly mailed to the owners of all properties located within
two hundred feet (200') of the properties under consideration.
Section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.

Section 3. Subsequent to such public hearing, the City
of La Porte Planning and Zoning Commission met in special
session on December 5, 1977, to consider the changes in
classification which were the subject of such joint public
e hearing. The City Commission of the City of La Porte is in
receipt of the written recommendations of the City of La Porte
Planning and Zoning Commission, by letters dated December 5,
1977, the original of which letter is attached hereto as
"Exhibit C," incorporated by reference herein, and made a

part hereof for all purposes.
Section 4. The City Commission of the City of La Porte
hereby accepts the recommendation of the City of La Porte

Planning and Zoning Commission, and the zoning classification
of the hereinafter described parcel of land, situated within
the corporate limits of the City of La Porte, is hereby
changed in accordance therewith, and the zoning classification
of said parcel of land shall hereafter be "District C--
Apartment and Commercial District." The description of said
parcel of land re-zoned is as follows, to-wit:
The East one-half (E.l/2) of Blocks Eight
Hundred Thirty-two (832), Eight Hundred
Twenty-five (825), and Lots Seventeen (17)
through Twenty-nine (29), Block Seven Hundred
Ninety-six (796), TOWN OF LA PORTE, Harris

Dear Mayor Meza:
This Agency's Planning Department has set up a citizen
participation mechanism in order to comply with the intent of the
Housing and Community Development Act of 1974.
This letter is to request that a citizen from your low in-
come area, i.e., from the target area for Community Development pro-
jects, be appointed to act as liaison between Community Development
e and your City Council. The citizen will be responsible for calling
citizen meetings in the target areas for input into the upcoming
application. This person will meet at least twice a year with Com-
munity Development staff. In addition this Task Force member will
be asked to meet with other Task Force participants in a meeting
once a month.
It is necessary that we know the Task Force appointee's
name as soon as possible. Our Planning Department has scheduled
a meeting of the Citizen Participation Task Force for December 20,
1977 at 7:30 p.m. at the Community Development Agency's office,
4625 North Freeway, Suite 330. At this meeting we will be discussing
possible projects for the FY78 Application and it is important that
your representative bring a list of needs for each of the target
areas in your City to present at this meeting.
Please advise us of the appointee's name, address and tele-
phone number. I twill be necessary for our Planning Department to
contact the appointee immediately.

Section 1. The La Porte Souths ide Civic Center is hereby
re-named the "Evelyn Kennedy Civic Center," in honor of Mrs.
Evelyn Kennedy upon her retirement, and in recognition of
her many years of faithful service to the City of La Porte
and to the La Porte-Bayshore Neighborhood Centers Association.
Section 2. This Ordinance shall be effective immediately

. WHEREAS, the property along the waterfront is being severely damaged because
of the sinking of the land; and
WHEREAS, this area i's suffering an unnatural phenomenon due'to the sinking

of the land; and
WHEREAS, this phenomenon is not a direct result of neglect by the waterfront
property owners and they should not' lose their property because of
the sinking land; and
WHEREAS, many owners of waterfront property are denied its use because they
cannot reclaim eroded or sinking land by using bulkheads and filling
behind them; and
WHEREAS, the enforcement of, this law amounts to confiscation of property
without due process of law; and
e WHEREAS, Pub I ic Law 92-500 will result in unwarranted intrusion by the
Federal Government on property owner's rights,
NqW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEABROOK,
TEXAS:
lHA T , the City supports the theory that land erosion and submerging due
to subsidence was never intended to come under the laws which deal
with nature's ordinary erosion and submerging of land; and
THAT, the City of Seabrook supports Senate Bi I I 381 which would amend
Public Law 92-500 and which would return to the owner that property
which has been damaged due to subsidence and erosion and al low
reclamation of same.

THIS AGREEMENT, made and entered into by and between Harris County, a
body corp-orate and politic under the laws of the State of Texas, hereinafter

referred to as the "County~" and The City of La Portp.
, a municipal corporation under the laws of the State of
Texas, her'einafter referred to as the "City,"
WIT N E SSE T H:
WHEREAS, the City has elected to have its population included as a portion
of the population of the County in the County's "urban county" application to the U.
,
e\ S. Department of Housing and Urban Development for the fourth year funding for
the Community Development Block Grant Program, said application being
hereinafter sometimes referred to as the "Grant Applicationi" and
WHEREAS, the County is willing to include the City's population in the Grant
Application and to cooperate with the City in the implementation of the City's
Community Development Program; and
WHEREAS, the Texas Legislature has enacted the "Texas Community.
. Development Act of 1975," codified as Art. 1269l-4 Tex.Rev.Civ.Stats., which

provides, in part. for the authorization of cities; tv impl€:ment a community
development program; and
WHEREAS, the Texas Legislature has further enacted "The Interlocal
Cooperation Act," codified as Art. 4413 (32c) Tex.Rev.Civ.Stats., which provides, -
e in part, that the County may contract with the City to perform governmental
,
functions and services for the City;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the
County and the City, in consideration of the mutual covenants and agreements
herein contained, do mutually agree as follows:

The City agrees to allow the County to include the City's population with that
of the County in the Grant Application, and the County agrees to include the same
e in the Grant Application.

The City agrees to allow the U. S. Department of Housing and Urban
Development to use the City's population and other necessary demographic
characteristics in the determination of whether the. County will qualify as an
"urban county" as defined in the Housing and Community Development Act of 1974,
as amendcr~, and the rules and regulations promulgated pursuant thereto.
III.
The County and the City agree to cooperate in undertaking, or assisting in
undertaking, essential community development and housing assistance activities,
specifically urban renewal and publicly assisted housing.
IV.
The City acknowledges that it is aware that the Grant Application has not yet
e\. been completed or ,submitted to the U. S. Department of, Housing and Urban
Development and that no determination has been made at the time of execution of
this agreement as to where and for what purposes the fourth year funding, if any,
for the Community Development Block Grant Program will be sought or expended.
In this regard it is agreed that the County shall not be obligated to seek funds for

expenditure in the City or for assistance to residents of the City in the Grant
Application. If such funds for expenditure in the City or for assistance to its
. residents are awarded as a result of the Grant Application, the County may, in its

sole descretion, override such distribution of the award and spend such funds
elsewhere, and/or for other purposes when necessary or desireable in order to
achieve compliance with Title I of the Housing and Community Development Act of
1974, as amended, and all-appropriate implementing regulations applicable thereto. -
e The City has received no assurance, written or oral, from the County to the
t
contrary, and is aware that the execution of this contract does not constitute any
guarantee on the part of the County that funds received pursuant to the Grant
Application, if any, will be expended for projects within the City limits of the City
or for assistance to the residents of the City.

This agreement shall remain in full force and effect for the entire fourth year
funding period covered by the Grant Application (July 1, 1978 through June 30,

regulations applicable to the Grant Application do not permit the County to allow
the City to withdraw from this agreement or otherwise prior terminate the term of
this agreement at any time after December 1, 1977.
VI.
In performance of this agreement, the City and the County shall observe and
comply with all applicable Federal, State, County and City statutes, ordinances,
I. rules and regulations.
VII.
Should the U. S. Department of Housing and Urban Development reject or
refuse to accept this agreement for any reason, the County may terminate this
agreement by giving written notice of the same to City.

This agreement shall be of no force and effect unless and until it is executed
by both parties hereto and certified by counsel for both parties hereto on the forms
set forth below.
IN TESTIMONY WHEREOF, this instrument has been executed in triplicate'
counterparts, each to have the force and effect of an original as follows:
