Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: A RESOLUTION SUPPORTING SENATE BILL N0. 381. + + + 9. CONSIDER RATIFICATION OF EXECUTIVE COMMITTEE REPRESENTATIVES AND ALTERNATES TO HOUSTON-GALVESTON AREA COUNCIL EXECUTIVE COMMITTEE FOR 1978 - Motion by Commissioner Tomerlin, seconded by Commissioner Cline to ratify the appointments of Mayor Benjamin Babovec and Councilman Tom Reid as representatives and Councilman Jack Nash, and Councilman Doyel Raney as alternates • of the Executive Committee to Houston-Galveston Area Council Executive Committee for 1978. CONSIDER CHANGING REGULAR MEETING DATE OF FEBRUARY 20, 1978, AT 7:00 P.M., TO FEBRUARY 22, 1978, AT 6:00 P.M., DUE TO HOLIDAY - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to change the regular meeting date of February 20, 1978 at 7:00 P.M., to February 22, 1978, at 6:00 P.M., due to the holiday. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDE TO BE RECEIVED ON FEBRUARY 22, 1978, AT 6:OO P.M. FOR ONE DUMP TRUCK CHP,SSIS AND DUMP BED - STREET DEPARTMENT '- Motion by Commissioner Cline, seconded by Commissioner Simons to authorize advertising and accepting bids to be received on February 22, 1978, at 6:00 P.M. for one dump truck chassis and dump bed for the Street Department. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 12. CONSIDER APPROVING PRELIMINARY PLAT OF GLEN MEADOWS, SECTION 2 - After a brief discussion, motion by Commissioner Simons, seconded by Commissioner Tomerlin to approve the preliminary plat of Glen Meadows, Section 2, subject to receiving a letter from the developer agreeing to the park site dedication as follows: "The park site title will pass to the City when the plat of Section 2 is filed for record. The cash contribution in lieu of required land area will be passed to the City upon final approval of Section 3 of Glen Meadows Addition. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 13. CONSIDER APPROVING PRELIMINARY PLAT OF CREEKMONT ADDITION - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the preliminary plat of Creekmont Addition. CONSIDER APPROVING PRELIMINARY PLAT OF THE WEST ONE-HALF OF OUTLOT NO. 3, NEBRASKA SYNDICATE - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Cline to table approving the preliminary plat of the West One-Half of Outlot No. 3, Nebraska Syndicate and have further discussion on the Work Shop Agend of January 25; requesting that the Planning and Zoning be present. The Subdivision Ordinance requires a minimum size of 60-foot lots. The preliminary plat shows a lot size of 50-foot. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 15. CONSIDER CALLING JOINT PUBLIC HEARING WITH PLANNING & ZONING COMMISSION TO CONSIDER REZONING 2.8818 ACRE TRACT, TIDEWOOD SUBDIVISION, 420 FEET NORTH OF MC CABE ROAD FACING HIGHWAY 146, WM. P. HARRIS SURVEY A-30, HARRIS COUNTY, TEXAS, FROM RESIDENTIAL TO "C" APARTMENT AND COMMERCIAL DISTRICT, TO BE • HELD ON FEBRUARY 22, 1978, AT 6:02 P.M. - Motion by Commissioner Kibodeaux, seconded by Commissioner Cline to call a joint public hearing with the Planning & Zoning Commission to be held on February 22, 1978, at 6:02 P.M., to consider rezoning 2.8818 acre tract, Tidewood Subdivision, 420 feet North of McCabe Road facing Highway 146, Wm. P. Harris Survey A-30, Harris County, Texas from Residential to "C" Apartment and Commercial District; and request the Planning and Zoning Commission be present at the Work Shop of January 25, 1978, to discuss their plans for the entire area down old Highway 146 in regard to zoning. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 16. CORRESPONDENCE - None. + + + r~ U • • • Regular Meeting 1/9/78 7 17. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Tomerlin requested an Executive Session. Commissioner Cline stated that the City had had little response from the article in the newspaper regarding the need for changing street names and numbers on Crescent Shores, Crescentview, and Oakhurst. It was .determined that the Ordinance should be ready for the Work Shop of January 25. Commissioner Simons informed the Administrator of telephone problems, to be further discussed after the meeting. The City Administrator requested an Executive Session. ENGINEER'S REPORT - Dave Corbin informed the Commission that the Shoreacres - Bayshore M.U.D. dispute would be coming to trial in January or February. It is not known whether or not this will solve the annexation problem of that area. It was the consensus of_ opinion that the City would like a representative to attend the hearing in Austin on January 20, 1978, at 9:00 A.M., of the Texas Department of Water Resources, • regarding priority rule changes. + + + 18. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-T7 - SECTION 2 - (E) AND (G) - (LITIGATION AND PERSONNEL) - Motion by Commissioner Kibodeaux, seconded by Commissioner Cline that the meeting recess for an Executive Session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:43 P.M. WHEREAS, the property along the waterfront is being severely damaged because of the sinking of the land; and WHEREAS, this area is suffering an unnatural phenomenon due to the sinking of the land; and WHEREAS, this phenomenon is not a direct result p~ neglect by the waterfront property owners and they should not lose their property because of the sinking land; and WHEREAS, many owners of waterfront property are denied its use because they cannot reclaim eroded or sinking land • by using bulkheads and filling behind them; and WHEREAS, the enforcement of this law amounts•to confis- cation of property without due process of law; and WHEREAS, Public Law 92-500 will result in unwarranted intrusion by the Federal Government on property owner's rights, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE .CITY OF LA PORTE, TEXAS THAT, the City supports the theory that land erosion and submerging due to subsidence was never intended to come under the laws which deal with nature's ordinary erosion and sub- merging of land; and THAT, the City of La Porte supports Senate Bill 381 which would amend Public Law 92-500 and which would return • to the owner that property which has been damaged due to subsidence and erosion and allow reclamation of same.
