After tabulation by the Chief of Police and Mayor, they be authorized to proceed with the awarding of bids for air conditioning and the antenna tower at the new Police Building, to prevent delay to the construction. Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to award the bid for two automobiles to Jay Marks Chevrolet in the amount of $9,467.30, since these cars had been bid twice before. VISITORS WISHING TO ADDRESS THE COMMISSION - G. B. CARPENTER - La Porte Ambulance Service - Addressed the Commission to advise them that it had been five and one-half months without a contract and they would be closing their doors on March 15, 1978 and would have no obligation to the City after that time. + + + • Regular Meeting 3/6/78 11. CONSIDER APPROVING LEASES FOR THE CITY HALL ANNEX AND THE WELFARE OFFICE - Motion by Commissioner Cline, seconded by Commissioner Simons to approve the leases for the City Hall Annex and the Welfare Office for a six month period. CAPTION: AN ORDINANCE AMENDING CHAPTER 21, SECTIONS 25 AND 28, OF THE CODE OF ORDINANCES OF THE CITY OF LA FORTE, PROVIDING THAT ALL CHURCHES AS DEFINED IN THE ORDINANCE SHALL BE EXEMPT FROM PAYMENT OF APPLICATION FEE AND APPRAISED AMOUNT FOR VACATING, ABANDONING AND CLOSING STREETS AND ALLEYS; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • 15. DISCUSS INSURANCE - Mr. Frank Pierson was recognized and presented copies of letters from Business Men's Assurance Company, showing the experience rating for the City; renewing the Group Life and Accidental Death and Dismemberment contracts for a one year contract with no adjustment of premiums for a period of six months, October 1, 1978. Copies of said letters are attached and made a part of these minutes. • Mr. Pierson presented one plan for consideration for group dental expense benefits. Mayor Meza appointed a committee of Commissioner Tomerlin, Commissioner Cline and Chief Freeman for further study of dental expense benefits. Motion by Commissioner Simons, seconded by Commissioner Cline to accept the offer of Business Men's Assurance Company for renewing of Group Medical and Major Medical, Group Life and Accidental Death and Dismemberment for a six month contract. CONSIDER REQUEST TO VACATE, ABANDON AND CLOSE THE ALLEYS IN BLOCKS 825 AND 832, AND THE SOUTH 325 FEET OF THE ALLEY IN BLOCK 796, TOWN OF LA PORTE, HARRIS COITNTY, TEXAS - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to give tentative approval and authorize the City Clerk to send letters to utility companies for the closure of Blocks 825 and 832 and asked that permission be obtained for the closure of all of Block 796, rather than only a portion of that alley. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 19. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR MOWING PRIVATE PROPERTY TO BE RECEIVED UNTIL 5:0'0 P.M., ON APRIL 3, 1978, TO BE OPENED AND PUBLICLY READ AT 7:00 P.M. Motion by Commissioner Tomerlin, seconded by Commissioner • Kibodeaux to authorize advertising and accepting bids for Mowing Private Property to be received until 5:00 P.M. on April 3, 1978, to be opened and publicly read at 7:00 P.M. DISCUSS CONCESSION STANDS - After a brief discussion regarding the concession stands at Fairmont Park and the Swimming Pool, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to authorize the Director of Parks & Recreation to negotiate with the Baseball Association for the. operation of the concession stands and then bring back a contract for approval by the Commission. CONSIDER REQUEST OF DAVE BOOTHE TO APPROVE WATER AND SEWER EXTENSIONS FOR BLOCKS 614, 613, 338, 647, 648, AND 97, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS - After review of plans and a discussion, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to allow Dave Boothe to make water and sewer extensions in Blocks 614, 613, 338, 647, 648, and 97, at an estimated cost of $16,400.00. Mr. Boothe will accept the • responsibility to pay the City Engineer for inspections, will post the necessary bonds, following City requirements for said project. CONSIDER AWARDING BID - DUMP TRUCK CHASS'I'S AND DUMP BED - Motion by Commissioner Cline, seconded by Commissioner Simons to accept the recommendation of the Assistant Director of Public Works and award the bid for one dump truck to the low bidder, Miller Freeman Ford in the amount of $11,756.99. DISCUSSION OF DEPARTMENT PROJECTS - Commissioners Kibodeaux, and Simons requested an executive session. Commissioner Cline - asked for discussion on the need for painting and repair to the water towers. After a brief discussion, it was determined that the Engineer could get price estimates and start preparing plans and specifications for painting and repairing the elevated water towers. Community Development Fund Grant - Commissioner Cline informed the Commission t at a list of streets to be considered for the Community Development Fund Grant had been prepared and distributed for each of the Commissioners. Further stating that the list did not include all the streets that needed work, • only the ones that are in need of immediate attention. A copy of said list is attached and made a part of these minutes. + + + 26. AMBULANCE SER VICE - John Paul Zemanek was recognized and stated his concern for the possible lack of ambulance service after March 15, 1978. There was a brief discussion regarding the needed information requested by the Auditor from Mr. Carpenter on the Ambulance Service. The Commission would continue to try and resolve the situation. + + + 27. HOLDING OVER: It is agreed and understood that any holding over by the Lessee of the hereby demised premises at the expiration of this Lease shall operate and be construed as a tenancy from month to month at a rental of one and one-half times the current monthly rental, and Lessee shall be liable to Lessor for all loss or damage on account of any holding over against Lessor's will after the termi- nation of this Lease, whether such loss or damage may be contemplated at this time or not. SEVERABILITY: In the event of litigation on this instrument and should one or more clauses be found invalid all other provisions of the lease are to stand as written. TAXES: Lessor agrees to pay before they become delinquent all real property taxes and assessments lawfully levied or assessed against the demised premises or any part thereof, provided, however, Lessor may, at his sole expense dispute and contest same, and in such case, such disputed item need not be paid until finally adjudged to be valid. If after one year from the commencement date of thi~ lease, the real estate taxes on the demised premises are increased by any taxing authority at any time during the remaining portion o the primary term or any renewal or extension thereof, Lessee agrees to pay to Lessor upon demand, and as additional rental, an amount monthly equal to 1 / 12 of said increase. Lessee shall pay all taxes levied against personal property, trade fixtures and inven- tory placed by Lessee in, on or about the demised premises. BINDING UPON PARTIES: The Covenants and agreements herein contained shall inure to the benefit of and be binding upon the parties hereto, their respective heirs, legal representatives, successors and assigns. UTILITIES: Lessor agrees to provide, at his sole expense, water, sewer, electricity, and gas service connections into the demised premises; but Lessee shall pay all utility connection charges including meters, if any, and all charges incurred for any utility services used on the demised premises, and shall furnish all electric light bulbs and tubes. This Lease contains the entire agreement between the parties hereto, and no representations, warranties, express or implied, inducements, promises or agreements, oral or other between the parties not embodied herein shall be of any force or effect.
