CANVASS RESULTS OF REGULAR ELECTION - APRIL 1, 1978 - ORDINANCE NO. 1113 - The results of the regular election of April 1, 1978, were canvassed. Commissioner Cline questioned no result sheet showing machine numbers from the Baker Voting Precinct. The City Attorney suggested that the City Clerk contact the School, the following morning, to see if perhaps the sheet might have been placed in the School packets rather than the City. After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Ordinance No. 1113 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE DECLARING THE RESULTS OF THE REGULAR ELECTION HELD IN THE CITY OF ELECTION OF A MAYOR; A CITY CITY COMMISSIONER, POSITION LA PORTE ON APRIL 1, 1978, FOR THE COMMISSIONER, POSITION 2, AND A 4. 5. CONSIDER CALLING SPECIAL MEETING OF APRIL 10, 1978, AT 7:00 P.M. TO ADMINISTER OATH OF OFFICE TO NEW CITY OFFICIALS - Motion by Commissioner Cline, seconded by Commissioner Kibodeaux to call a Special Commission Meeting to be held on April 10, 1978, at 7:00 P.M., to administer oath of office to the newly elected City Officials. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 6. APPROVAL OF MINUTES - REGULAR MEETING - MARCH 20, 1978 - Motion by Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the Regular Meeting of March 20, 1978, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • Regular Meeting 4/3/78 4 7. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the accounts payable as presented. A copy is attached and made a part of these minutes. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1114 - VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 686, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner isCline to approve Ordinance No. 1114 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK SIX HUNDRED EIGHTY-SIX (686), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. (DECKER MC KIM - $2,158.92) 10. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1115 - CREATING A JOINT AIRPORT ZONING BOARD - After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1115 as read. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1115 (CONTINUED) CAPTION: AN ORDINANCE CREATING A JOINT AIRPORT ZONING BOARD TO BE KNOWN AS THE LA PORTE-DEER PARK-LOMAX JOINT AIRPORT ZONING BOARD AND INVESTING SUCH JOINT BOARD WITH THE POWERS SUCH BOARDS ARE AUTHORIZED TO EXERCISE UNDER THE PROVISIONS OF CHAPTER 391 OF THE ACTS OF 1947 (ARTICLE 46e-1, ET SEQ, REVISED CIVIL STATUTES OF TEXAS); AND PROVIDING AN EFFECTIVE DATE HEREOF. 5 11. CONSIDER APPROVING PAYMENT TO JAY MARKS CHEVROLET IN THE AMOUNT OF $22,494.32 FOR FOUR 1978 CHEVROLETS FOR THE POLICE DEPARTMENT - Motion by Commissioner Simons, seconded by Commissioner Cline to approve payment to Jay Marks Chevrolet in the amount of $22,494.32 for four 1978 Chevrolets for the Police Department. CONSIDER APPROVING PAYMENT TO JAY MARKS CHEVROLET IN THE AMOUNT OF $9.639.30 FOR TWO 1978 CHEVROLETS FOR INSPECTION AND PARKS & RECREATION DEPARTMENTS - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve payment to Jay Marks Chevrolet in the amount of $9,639.30 for two 1978 Chevrolets for the Inspection and Parks & Recreation Departments. CONSIDER APPROVING PAYMENT TO BUSCH-HUTCHISON & ASSOCIATES, IN THE AMOUNT OF $105.74 FOR REPRODUCTION OF ZONING MAP AND PRINTS - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve payment to Busch, Hutchison & Associates in the amount of $105.74 for reproduction of the Zoning Map and prints. A copy of the invoice is attached. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 14. CONSIDER APPROVING PAYMENT TO HUGH L. LANDRUM IN THE AMOUNT OF 9,500.00 FOR FIRST OF FOUR EQUAL PAYMENTS FOR 1978 ADVALOREM TAX WORK - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve payment to Hugh L. Landrum in the amount of $9,500.00 for first of four equal payments for 1978 advalbrem tax work. A copy of the invoice is attached and made a part of these minutes. CONSIDER APPROVING PAYMENT TO SOLAR HEATING & AIR CONDITIONING IN THE AMOUNT OF $3,975.00 FOR ROUGH -IN AIR CONDITIONING AT NEW POLICE BUILDING - Motion by Commissioner Simons, seconded by Commissioner Cline to approve payment to Solar Heating & Air Conditioning in the amount of $3,975.00 for rough -in of air conditioning at New Police Building. A copy of the invoice is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. CONSIDER APPROVING PAYMENT TO EDDIE GRAY FOR JOINT PARTICIPATION ON 18-INCH SANITARY SEWER LINE - FAIRMONT PARK WEST - After a brief discussion regarding this project and the fact that no bids or contract information had been presented to the Commission, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to table this item for further study and discussion. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 17. CONSIDER APPROPRIATION OF FUNDS IN THE AMOUNT OF $5,000.00 FOR CHARTER REVISION COMMITTEE - Motion by Commissioner Simons, seconded by Commissioner Cline to appropriate funds in the amount of $5,000.00 for the Charter Revision Committee; said funds to be taken from Engineering and Legal fees. Motion carried by the following vote: isAYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 18. CONSIDER APPROVING SPECIFICATIONS AND AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR CLEANING AND PAINTING ELEVATED WATER STORAGE TANKS TO BE RECEIVED UNTIL 7:00 P.M., ON MAY 1, 1978 - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve the specifications and authorize advertising and accepting bids for cleaning and painting elevated water tanks to be received until 7:00 P.M., on May 1, 1978. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • Regular Meeting 4/3/78 19. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR 1,000 FEET 1-1/2 INCH FIRE HOSE AND 1,500 FEET 2-1/2 INCH FIRE HOSE FOR THE FIRE DEPARTMENT TO BE RECEIVED ON MAY 1, 1978, AT 7:01 P.M. - Motion by Commissioner Simons, seconded by Commissioner Cline to authorize advertising and accepting bids to be received until 7:01 P.M., on May 1, 1978 for 1,000 feet of 1-1/2 inch Fire Hose and 1,500 feet of 2-1/2 inch Fire Hose for the Fire Department. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 20. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR ONE 1978 FOUR-WHEEL DRIVE PICK-UP TRUCK FOR THE FIRE DEPARTMENT TO BE RECEIVED ON MAY 1, 1978, AT 7:02 P.M. - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to authorize advertising and accepting bids for one 1978 four- wheel drive pick-up truck for the Fire Department to be received on May 1, 1978, at 7:02 P.M. Funds to come from vehicle replacement. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 21. CONSIDER AUTHORIZING EXPENDITURE OF $178.73 FOR JOINT PARTICI- PATION FOR SOUTHWESTERN BELL RATE CASE THROUGH TEXAS MUNICIPAL LEAGUE - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to authorize the expenditure of $178.73 for joint participation for Southwestern Bell Rate Case through Texas Municipal League. CONSIDER CALLING JOINT PUBLIC HEARING WITH PLANNING AND ZONING 0 COMMISSION TO CONSIDER REZONING 4.110 ACRES IN LOT 10, BLOCK 2, OF W. J. PAYNE SUBDIVISION OF THE W. M. JONES LEAGUE, ABSTRACT 482 FROM RESIDENTIAL TO COMMERCIAL FOR NURSERY USE ONLY - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to accept the recommendation from the Planning & Zoning Commission and call a joint public hearing to consider rezoning 4.110 acres in Lot 10, Block 2, of W. J. Payne Subdivision of the W. M. Jones League, Abstract 482 from Residential to Commercial for Nursery Use Only. A copy of the recommendation is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 23. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1116 - APPOINTING A BOARD OF EQUALIZATION - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner • Cline to approve Ordinance No. 1116 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE APPOINTING A BOARD OF EQUALIZATION COMPOSED OF THREE MEMBERS; SETTING THE DATE OF ITS FIRST MEETING; AND PRESCRIBING ITS POWERS AND DUTIES; AND DECLARING AN EFFECTIVE DATE. 24. CONSIDER AWARDING BIDS - TWO MOWERS FOR PARKS & RECREATION DEPARTMENT - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to accept the recommendation of the Parks & Recreation Director and award the bid for two mowers to Trevathan Tractor City in the amount of $6,500.00. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 0 • Regular Meeting 4/3/78 25. CORRESPONDENCE - Mayor Meza read a letter from the Texas Department of Community Affairs, regarding federal funds for assistance to local governments in strengthening their personnel systems and functions. A copy of said letter is attached and made a part of these minutes. 26. DISCUSSION OF DEPARTMENT PROJECTS - Mayor Meza stated that he would like an executive session with the Fire Prevention Department. Commissioner Cline introduced the new Public Works Director, Mr. Gerard Nutting. 10 Commissioner Simons informed the Commission that an outstanding citizens award, the Thomas Jefferson Award, had been awarded to Mrs. Eugenia Riley. The Parks & Recreation Director requested an executive session. • The Attorney requested an executive session. 27. MRS. EUGENIA RILEY was recognized and asked the status of the Charter Revision, further stating that she would like to be informed of their meetings. A meeting was scheduled for April 11, 1978, at 7:00 P.M. 28. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - (E) AND (G) - (LITIGATION AND PERSONNEL) - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • The meeting recessed at 7:59 P.M. TML, in a memorandum dated March 16, subsequently invited all affected cities to con- vene in Austin on March 23 to discuss what role the cities should play in the SWB proceeding. - Representatives from approximately 50 of the affected cities met yesterday and appointed a steering committee to coordinate a consolidated effort on behalf of cities served by SWB. Alvin Imp. bid a Kubota 6000 tractor which has been discontinued. b. Trevathan bid the Kubota 6100 which is the replacement for the 6000. c. The 6100 is a.3 cylinder diesel engine with 14 H.P. • d. The 6000 is a 2 cylinder diesel engine with 12.5 H.P. e. The 6100 has large tires which gives it a higher ground clearance than the 6000. f. Because of the large engine and added options., I believe that it would be to the Cities advantage to pay the $195.00 dollars difference and award the bid to Trevathan Tractor City.
