Meza; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: None OTHER CITY OFFICIALS PRESENT: Margie Goyen, City Clerk; Knox Askins, City Attorney; Gail Hamilton, Associate; H. F. CALL TO ORDER - Mayor Meza called the meeting to order. 2. INVOCATION - The invocation was given by Mayor Meza. • Regular Meeting 4/17/78 2 3. ACCEPT BIDS - ONE 1978 PICK-UP TRUCK - SANITATION DEPARTMENT - The following bids were opened and read aloud: BIDDER AMOUNT JOE CAMP FORD P. 0. Box 1118 La Porte, Texas 77571 $ 4,198.74 Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to accept the bids for tabulation and recommendation. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 4. APPROVAL OF MINUTES - REGULAR MEETING - APRIL 3, 1978 - SPECIAL MEETING - APRIL 10, 1978 — Motion by Commissioner Tomerlin, seconded by Commissioner Cline to approve the minutes of the Regular Meeting of April 3, 1978, and the Special Meeting of April 10, 1978, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 5. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the Accounts Payable as presented. A copy of the Accounts Payable is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. • NAYS: None. 0 . • Regular Meeting 4/17/78 3 6. VISITORS WISHING TO ADDRESS THE COMMISSION - MR. JIMMY RAY SPRADLTNG, 3302 VALLEY BROOK - was recognized and addressed the Commission regarding the need for sidewalks and street lights in different areas of Fairmont Park; building lines and the need for reinforcement in drive ways. A brief discussion was held on these items. 7. CONSIDER AWARDING BIDS - MOWING PRIVATE PROPERTY - The Inspector read a recommendation, stating he had not been able to reach the low bidder for an equipment list, and recommended the next two lowest bidders. The low bidder, Mr. W. L. Brown was present, and did not feel that it would be difficult to reach him; further stating he felt that he had sufficient and proper equipment for the mowing. Action was tabled, to be brought back before the Commission, • later in the meeting, to give the Inspector the opportunity to talk with Mr. Brown about his equipment. After the other agenda items had been acted upon, the Inspector was recognized, suggesting that his first recom- mendation be withdrawn and recommended awarding the bid for "Mowing Private Property" to the low bidder, Mr. W. L. Brown, in the amount of $3.80 per lot. Motion by Commissioner Simons, seconded by Commissioner Cline, to award the bid for Mowing Private Property to the low bidder, Mr. W. L. CONSIDER APPROVING PAYMENT TO LEONARD, KOEHN, ROSE, WEBB & HURT, IN THE AMOUNT OF $450.00 FOR LEGAL AND PROFESSIONAL SERVICES - ENTEX Motion by Commissioner Cline, seconded by Commissioner Simons to approve payment to Leonard, Koehn, Rose, Webb & Hurt in the amount of $450.00 for legal and professional services, Entex Case. A copy of the invoice is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 9. CONSIDER AUTHORIZING BUSCH, HUTCHISON & ASSOCIATES TO PREPARE PLANS AND SPECIFICATIONS FOR EXTENSION OF 16TH STREET WATER AND SEWER LINES - This extension will be for Southern Pacific and Custom Blasting Services. At a meeting between the City, Southern Pacific, and Custom Blasting, held April 7, 1978, it was agreed that each Southern Pacific and Custom Blasting Services • would put approximately $5,000.00 up for engineering fee for Busch, Hutchison and Associates, to prepare plans, specifications, and bid documents for the project. At this time no approval has been received from the two firms. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to table this item until the regular Work Shop to be held April 26, 1978. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 10. CONSIDER APPROVING PAYMENT TO LA PORTE INDEPENDENT SCHOOL DISTRICT IN THE AMOUNT OF $846.80 FOR JOINT ELECTION EXPENSE - There was a brief discussion regarding the election expense and the City only bearing one-half of the common expense. Charges for election clerks and one machine for College Park were included. Motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve payment to La Porte Independent School District in the corrected amount of $776.80. Copies of invoices are attached and made a part of these minutes. Motion • carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: Commissioner Cline, opposed to paying for one clerk working only a portion of the day and making the same as those working the full day of the Election. • Regular Meeting 4/17/78 5 11. CONSIDER APPROVING PAYMENT TO MOTOROLA, INC., FOR BASE STATION RADIO FOR THE FIRE DEPARTMENT, AT THE NEW POLICE BUILDING, IN THE AMOUNT OF $5,523.00 Motion by Commissioner Simons, seconded by Commissioner Tomerlin to approve payment to Motorola, Inc., for a base station radio for the Fire Department, to be located at the new Police Building, in the amount of $5,523.00. Copies of the invoices are attached. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 12. CONSIDER ACCEPTANCE BY THE CITY FOR REPAIR OF THE 16TH STREET SANITARY SEWER LINE - A letter from the Engineer recommending acceptance by the City was read. A copy of the recommendation is attached and made a part of these minutes. After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Cline to table action on acceptance until the • City was notified that the County would accept the road repairs for the County to continue to maintain 16th Street. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. 13. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1117 VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 825, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS - It was determined that all the necessary requirements had been met. After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Ordinance No. 1117 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1118 - VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 832 - TOWN OF LA PORTE, HARRIS COUNTY, TEXAS - After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Ordinance No. 1118 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK EIGHT HUNDRED THIRTY-TWO (832), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. (FRED WESTERGREN) 15. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1119 - VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 796 - TOWN OF LA PORTE, HARRIS COUNTY, TEXAS - After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Ordinance No. 1119 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK SEVEN HUNDRED NINETY-SIX (796), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. 16. CORRESPONDENCE - Mayor Meza informed the Commission of a request from the City of Deer Park regarding a proposed drainage ditch to provide adequate .flow capacity to convey the 100-year flood flow; the outfall of the proposed channel would be Big Island Slough. The Mayor then read a letter from Busch, Hutchison & stating that a great deal of study would be necessary the extent of the improvements needed now, as well as that would be required with the additional load from if allowed. CORRESPONDENCE - (CONTINUED) It was the consensus of opinion that alternate methods for draining the northeast area of Deer Park be explored. Harris County Mayors and Councilmens Meeting to be held April 20, 1978, at 6:30 P.M., at the Doctors Club, Houston. 17. DISCUSSION OF DEPARTMENT PROJECTS - Mayor Meza stated that he had asked Commissioner Cline and Mr. Nutting to attend a hearing before the Houston Galveston Area Council on the Federal Water Pollution Control/Waste Treatment Management Plan. Commissioner Cline stated that the hearing was to consider the creation of a Water Quality Council. Those present were speaking for or against the Council. It was the consensus of the Engineer that the creation of the Water Quality Council would be just another agency to slow things down. • Mr. Nutting stated that he had called Houston Galveston Area Council and that a compromise had been met. There may be a Council eventually, but not at this time; approximately two years before the changes would be made. It was the consensus that it was most important that the City have a representative at all hearings. Commissioner Simons expressed appreciation to Commissioner Cline and Mr. Nutting for attending the hearing on behalf of the City. ENGINEER'S REPORT - Mr. Busch informed the Commission that the Regional E. P. A. Director had reviewed the Facilities Plan for the City of La Porte. His evaluation was that it will not require an impact statement at this time. is • • • Regular Meeting 4/17/78 0 18. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - E) AND (G) (LITIGATION AND PERSONNEL) - Motion by Commissioner Tomerlin, seconded by Commissioner Cline that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 8:03 P.M. The meeting reconvened at 8:47 P.M. 19. DISCUSSION REGARDING SPENWICK MUNICIPAL UTILITY DISTRICT - Mayor Meza called the meeting to order to hear discussion from Dave Corbin on Spenwick M.U.D., Deeter Ufer, Bayshore Engineers and Mr. Cecil Knight representing Spenwick M.U.D. Spenwick M.U.D. has completed Step 2 on grant application. As soon as La Porte approves plan, Step 3 can be implemented. Small project moves faster; will be pumping sewer into Fairmont Park before new plant is any where near ready. Spenwich M.U.D. needs City of La Porte approval before Water Rights Commission will approve selling of bonds. Flow of sewer from Spenwick M.U.D. (260 water taps), houses in 1972 plus 5% growth - 91,000 gallons per day. Planned development in Fairmont Park plus Spenwick M.U.D. would over- load Fairmont Plant 580,000 gallons per day in Fairmont Park now. The Commission agreed to proceed with supporting Spenwick M.U.D. grant application. Spenwick M.U.D. needs letter from La Porte stating they have reviewed and approved the wastewater treatment plant plans. Contract between La Porte and Spenwick needs to be submitted for approval also. Charge one and one-half times sewer rate charged in La Porte ($9.15 per month resident in Spenwick). At present time Spenwick cannot build water system and have meters at each service. Nine months after construction - September of 1979, on stream. • Regular Meeting 4/17/78 • E 20. SPECIAL WORK SHOP - APRIL 22, 1978, AT 9:O0 A.M. - Mayor Meza called a special work shop for Saturday, April 22, 1978, at 9:00 A.M. to discuss the budget. 21. ADJOURNMENT - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons that the meeting adjourn. S.P. proposed to Custom Blasting that the two firms equally share the overage, being the difference between the final cost of the project, and the water and sewer connection fees pay- able by the two companies, and, that upon refund over the 10-year period allowed by the agreement, that the first monies go to CBS, and when it has been fully reimbursed, then future* monies go to S.P: Mr. Busch indicated that upon -authorization, he could finish the plans and specs in about -four weeks, and that the contractor should be allowed no=more-than 60-days-to complete the job, after contract letting. I have asked Mrs.`Goyen to place the matter --- on the agenda for the regular meeting of April 17, by which time we should have approvals from the two firms, to go ahead with the engineering work. Meza PROPOSED DRAINAGE DITCH IN NORTHEAST DEER PARK The referenced ditch was discussed in a Master Drainage Plan For The City Of Deer Park as prepared by Espey, Huston & Assoc Cates, Inc. for Bayshore Engineers, Inc. The proposed di~tch, referred to as Proposed Channel No. B 106-07-00 in the Drainage Plan, was to be concrete -lined to provide adequate flow capacity to convey the 100-year flood flow. The report also noted that new bridges would be needed where the proposed channel crossed Underwood Road and where the existing HCFCD No, B 106-05-00 crosses "L" Street. The • outfall of the proposed channel is to be Bi'g Island Slough. The Master Drainage Plan mentioned above did not discuss the effect the proposed drainage channel would have on the upstream and downstream portions of Big Island Slough. Big Island Slough, as tt exists today, drains a large area including the Fairmont Park Subdivision of ha Porte. During heavy rain- fall periods, ft is evident that Big Island Slough- is to desperate need of cleaning and enlargement. A great deal of study would be necessary to determine the extent of the improvements needed now as well as those that would be required with the additional load of the proposed channel from Deer Park.
