9. ADMINISTRATZVE`REPORTS r The City Administrator informed the
Commission that t e p ans and specifications for sanitary sewer
and water for Mc Cabe Road and Southern Pacific projects were
ready.
Dave Corbin stated that he had met with Mr. Tom Shom of the
Carlsburg Management Corporation regarding the water and sewer
project on McCabe Road and Mr. Shom was in favor of going ahead
with the project.
There was a brief discussion regarding the condition of the
lift station and the estimated cost of $85,000.00 for these
services.

10. EXTENDED SICK LEAVE ~ HERMAN CLARKE ~ Mayor Meza requested that
the City Commission consider extending sick leave to Herman Clarke.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons that the Commission extend a 30-day sick leave to Herman
Clarke; to be reconsidered at the end of each 30-day period.
Motion carried by the following vote:

11. VISITOR TO ADDRESS THE COMMISSION - Mr. Jim Hondress, representing
La Porte Soccer Teams was recognized and addressed the Commission
regarding the need for fields, preferably lighted fields, for the
Soccer Teams. There was a brief discussion regarding the new park
land the City was in the process of purchasing and the possibility
of a portion of that land being used for soccer.

ORDINANCE NO. 705-I
AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING
RULES AND REGULATIONS GOVERNING THE PLATTING OR RE-PLATTING OF
LAND IN THE SUBDIVISIONS IN THE CITY OF LA PORTE AND WITHIN THE
EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE); AND
PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE
SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION
SHALL BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00)

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Section 5.09, Park, Playground and School
Sites, of City of La Porte Ordinance No. 705, is hereby amended
by adding thereto a Paragraph 1(c), and shall hereafter read
as follows, to-wit:
"1. Parks and Playgrounds:
~, (c) Land dedicated by a subdivider to the City of
La Porte, under the terms and provisions of this
Ordinance, may, at the discretion of the City
Commission, be leased by the City of La Porte,
to a duly qualified home owner's association,
which meets the minimum standards promulgated
from time to time by the United States Department
of Housing and Urban Development, for qualifi-
cation for F.H.A. and/or V.A. loans, and which
has been incorporated as a Texas non-profit
corporation, for operation as a park area for
the recreation of residents and their guests
of the residential subdivision of which it is
a part.
The lease agreement shall be on a form approved
by the City Attorney, and specifically approved
in each instance by the City Commission, and
should provide, among other things, that the
home owner's association corporation shall be
prohibited from placing or suffering any Deed
of Trust, mortgage, or other type of lien, on
the property or upon the permanent improvements
thereon erected, and that any person, firm or
corporation making loans to the home owner's
• association for such improvements, shall look
solely to the revenues of the association for the
retirement of its debt; prescribing minimum stand-
. ards for the facilities to be erected, and the
maintenance thereof, and for the staffing of the
facilities; providing minimum ratios of off-street
parking, based upon the amount of acreage in the
park site; providing that the term of the lease
shall be f-.or a term not to exceed forty (40)
years, with a rental of Une Dollar ($1.00) per
year. to the City of La Porte, or such other con-
sideration as the City Commission of the City of
La Porte may deem proper; providing that the home
owner's association corporation shall be solely
responsible for the operation and maintenance of
• the facilities; providing that at the end or other

• termination of the lease, that title to the
improvements upon the lease property shall
revert to the City of La Porte, for public
park purposes; providing that the home owner's
association corporation shall save and hold
harmless the City of La Porte from any costs
or liabilities; and providing minimum standards
of public liability insurance to be carried by
the home owner's association corporation, with
certificates of insurance to be furnished to
the City Clerk; and such other provisions to
be contained in the lease as may be deemed
desirable by the City Commission of the City
of La Porte.
Nothing contained in the lease shall be con-
strued as a restriction upon the power of the
City Commission from time to time to promulgate,
by ordinance, reasonable rules and regulations
concerning the maintenance, operation, health,
safety and welfare of the park facility, and
the persons utilizing the same.
Nothing contained in this Ordinance shall be
• construed as binding or obligating the City
Commission of the City of La Porte to enter
into such lease agreements, but, rather, it is
the purpose of this Ordinance to set out mini-
mum standards which would be required in the
event that the City Commission, in its sole
discretion, determines to enter into such a
lease agreement.
Attached to this Ordinance as Exhibit "A",
incorporated by reference herein, and made a
part hereof, are the current minimum standards
of the United States Department of Housing and
Urban Development, for home owner's associations,
which are hereby enacted by the City Commission
of the City of La Porte as its minimum standards
for home owner's associations, in such cases as
home owner's associations are hereafter created
and operated in residential subdivisions, which
are under the jurisdiction of the City of La Porte
under its subdivision ordinance, Ordinance No. 705,
as amended."
Section 2. Penalties. Any person violating this Ordi-
• nance or any portion thereof shall upon conviction be guilty
of a misdemeanor and shall be fined not less than Ten Dollars
($10.00) nor more than Two Hundred Dollars ($200.00) and
each day that such violation continues shall constitute a
separate offense and be punishable accordingly.
Section 3. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Clerk
shall give notice of the passage of this ordinance by causing

the caption hereof to be published in the official newspaper
in the City of La Porte at least twice within ten (10) days
after the passage of this ordinance.

RE: DOW'S PROPOSED 16" HYDROCARBON PRODUCTS PIPELINE
ACROSS AND WITHIN THE CITY OF LA. PORTE,_TEXAS
Dear Mayor Meta:
Please refer to our letter of June 8, 1978 regarding our initial formal
request for the above captioned pipeline,. for your. review and approval.
The products to be transported initially through the proposed 16"
pipeline are naphtha, fuel oil and kerosene.
The proposed 16" pipeline will be constructed of O.D. x - 65, 0.354"
wall thickness, ERW carrier pipe. The pipeline will have a maximum
operating pressure of 1,440 psi, which is only 5C% of yield strength.
The DOT Spec. 195, Section 105, allows an operating pressure of 72%
of yield strength.
This pipeline shall be installed in a manner so as to tt>aintaire a
minimum depth of 48" of cover below the natural surface of the ground to
the top of the pipe. In addition, where the proposed pipeline wi7.I crass
and affect drainage ditches,. bayous and streams, eta. it will be in-
stalled to maintain a minimum depth of 60" of cover below tha bed of the
stream to the top of the pipe. At bayou crossings, the pipeline will be
coated with concrete to increase its safety.
All Federal State and local construction requirements will be satisfied
by Dow Chemical, as well as any additional good pipeline construction
practices.
Dow meets or exceeds all known safety standards in the design and
construction of its pipeline system, and this proposed pipeline will
be so designed. It is our intention to prevent ;:ipeline ruptures by
initiating a very extensive testing program before any pipeline is
put into service. After a pipeline system is placed into service,

entire life of the system. High and low pressure sensing shutdown
devices are installed at alI of our pump stations to prevent or detect
any ruptures. Block valves caill be placed at readily accessible points
to give controls throughout the system.
A summary of the tests and inspections performed before, during and
After the construction of a new pipeline system is tabulated below:
1. A chemical ladle analysis is requested from the pipe
mill of each heat of steel used in filling an order by
Dow, The analysis so determined shall conform to the
requirements specified in Par. 3.1 of the American
Petroleum Institute, Spec. 5 LX.

2. The tensile properties of the line pipe will canfarm
to the tensile requirements specified in Table 4•. 1,

3. Longitudinal, transverse and weld tensile tests (which
conform to the requirements of Paragraphs 4.6, 4.7 and 4.8
of the API Spec. 5 LX and ASTM A-370, "r:echanic.al Testing
of Steel Products, Supplement II, Steel Tubular Products")
are performed at the pipe mill on specimens front each lot
of 100 lengths of pipe.
4. Flattening tests which conform to Paz'agrapii 4.14 of the
API, Spec. 5 LX are made on the crop ends cut from each
length of pipe produced at the mill.
5. A weld ductility test is performed at the pipe mill on
specimens cut from each lot of I00 lengths, and the test
must conform to Paragraph 4.20 of the API, Spec. 5 LX.
6. The weld seam of each length of pipe is nan-destructively
inspected for cracks by the use of ultrasonic or electro-
magnetic equipment which conforms to the inspection
standards set forth in Paragraphs 7.10 - ?.13 of .the API,
Spec. 5 LX.

7. Each length of pipe will withstand, without leakage, a mill
inspection hydrostatic test to at least a pressure
of 2732 psi. and will be held for nat less than 5 seconds.

8. Prior to being coated, the pipe will undergo another
extensive non-destructive inspection by the use of
magnetic particle equipment to check for transverse and
longitudinal defects along caith an additional ultrasonic
inspection of the longitudinal seam.
9, The pipe along with any other component in the system
which is to be buried will be provided with protection.
against external corrosion. This protection encompasses
the use of an external protective coating which conforms
to the Department of Transportation Spec. Fart I95, sub-
part E, Sec. 195.238. A closely moaitoried inspection is
made by Dow inspectors of all coating application processes
and the materials used. In addition, of ter the pipe is in
place, a cathodic protection system will.be installed for
all buried facilities to mitigate corrosion deterioration
that might result in structural failure. This system will
be regularly checked to insure that the protection is ade-
quate at all times.
10. All girth welds made on the pipe in the coating m.%II or
field will be x-rayed to detect any flaws in the pipe used
in bayou crossings.
11. All construction work performed ~,r~.ll have a Dow inspector
present to insure that all regulatiu~:~.~ and good pipeli.ning
practices are enforced.
l2. The pipe will be buried, throughout this area, w%th-a m3.nimum
of four feet (4') of cover except on bayou crossings where a
minimum of five feet (5') of cover will be used. Selective
backfilling will be required. Road and Street crossings will
be cased and will be buried to have a minimum cover of three
feet (3') at the lowest point in borrow ditches.
l3. The pipe at each railroad or highway crossing will be Cased
and installed so as to adequately withstand the dynamic forces
exerted by anticipated traffic loads.

14. Upon completion, the line will. be hydrostatically tested
a.n place to 100°10 of its minimum yield strength (2876 psi. )
for 15 minutes and. then reduced L-o 9310 of yield (26!6 psi. )
for 24 hours. The limits set by Dow for this test e~cceed
the minimum requirements set by the DOT Spec. 195, Sec.
195.300.
15. Line markers that conform to DOT Spec. 155.410 4ri.11 be
located at each public road crossing, at each railroad
crossing, and in sufficient number along the rewainder of
the buried line so that its location is accurately known.
16. Inspections will be made every two weeks or less of the.
surface conditions along the pipeline right-of-way and
lands adjacent thereto.

17. Over-pressure safety shutdown devices will be installed. and
,regularly checked to determine that they are functioning
properly and are in good mechanical condition. T.n addition,
daily operating records will be maintained that indicate
the discharge pressures at each pump station, a.nd any
unusual operations of a facility. Dow will have an operator
on hand 24 hours a day to monitor all pipeline system
functions.

stewardship program, and both are organized sa as to have
the capability of immediate response on a 24-b.our basis at
all. times. The emergency response telephone number is

emergency response team is available: to respond to an emer-
gency to assist and advise if the need arises, Also, on a
free-of--cost basis, they will conduct training and informa--
tion meetings with appropriate City depar.trrents to outla.ne

Attached hereto is a list of all products that could be transported
through the proposed 16" pipeline, with characteristics of each product.
The above summary lists only the major items which have contributed to
the excellent safety record Dow has accumulated throughout aII of its
pipeline systems. As you will note, modern pipeline design and con-
struction practices conform to a very rigid and strict safety code
and standard.
Your consideration and approval of our Permit Request will be most
appreciated.

ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER
18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS;
AND APPROVING THE APPLICATION OF DOW CHEMICAL COMPANY DATED
JUNE 8, 1978, TO CONSTRUCT A SIXTEEN-INCH HYDROCARBON PRODUCTS
PIPE LINE; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte
has received an application dated June 8, 1978, from Dow
Chemical Company, requesting a permit under Section 18-A-3
of Ordinance No. 915, being Chapter 18-A of the Code of
Ordinances of the City of La Porte, to construct a sixteen-
inch hydrocarbon products pipe line crossing the City of
La Porte, all as shown on said application. The application
of Dow Chemical Company has been reviewed by the City's
Director of Public Works, whc has found that said application
meets all requirements of said Ordinance No. 915, and has
recommended its approval.
Section 2. The City Commission of the City of La Porte
hereby approves the application of Dow Chemical Company,
dated June 8, 1978, and this Ordinance shall constitute a
permit to Dow Chemical Company to lay and construct said
pipe line within the City of La Porte, all in conformance
with the requirements of said Ordinance No. 915.
Section 3. This Ordinance shall be irn full force and
effect from and after its passage and app=oval.

eight-inch ethylene pipe line crossing the City of La Porte,
and to construct a six-inch ethane pipe line crossing the
City of La Porte, all as shown on said application. The
application of Continental Oil Company has been reviewed by
the City's Director of Public Works, who has found that said
application meets all requirements of said Ordinance No. 915,
and has recommended its approval.
Section 2. The City Commission of the City of La Porte
hereby approves the application of Continental Oil Company,
dated July 20, 1978, and this'Ordinance shall constitute
a permit to Continental Oil Company to lay and construct
said pipe line within the City of La Porte, all in conform-
ance with the requirements of said Ordinance No. 915.
• Section 3. This Ordinance shall be in full force and
effect from and after its passage and approval.
