MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: None. 'OTHER CITY OFFICIALS PRESENT: J. R. Hudgens, City Administrator; • Margie Goyen, City Clerk; H. F. Freeman, Chief of Police; Gerard Nutting, Director of Public Works; Stan Sherwood, Parks & Recreation Director; and Paul Hickenbottom, Fire Inspector; Knox Askins, Attorney. OTHER CITY OFFICIALS ABSENT: Joe Sease, Fire Chief; D. R. McLaughlin, Fire Marshal. PLANNING & ZONING COMMISSION MEMBERS: Pat Muston, Chairman; Walter Springall, Mose Davis, Lindsay Pfeiffer, and Dallie Wright. OTHERS PRESENT: Decker McKim of Decker McKim Realty, Jimmy R. Spradling, Mr. and Mrs. J. Tarpey and other citizens interested in the proposed rezoning. PRESIDING: Mayor J. J. Meza. + + + • C • Joint Public Hearing 10/04/78 2 1. CALL TO ORDER - Mayor Meza called the public hearing to order. + + + 2. CONSIDER REZO ING BLOCK 30, BEACH PARK,-HARRIS COUNTY, fiEXAS, FROM RESTDEN''I'IAL TO "C" APARTMENT AND COMMERCIAL - The public hearing was opened and Pat Muston, c airman of the Planning & Zoning Commission read a recommendation that only Lots 1, 2, and 3, Block 30, Beach Park, be rezoned to commercial classifi- cation with limited use. A copy of the recommendation is attached and made a part of these minutes.. Mayor Meza asked if there was anyone else desiring to speak for the rezoning? There was no one. Mayor Meza asked if there was anyone desiring to speak against the rezoning? A letter was read from Mr. Sam K. McLelland opposing the rezoning. A copy of the letter is attached and made a part of these minutes. • Commissioner Cline asked if Mr. McLelland owned property within Block 30? The City Clerk affirmed. Commissioner Tomerlin asked what the Planning & Zoning Commission intended in regard to the recommendation for limited use? The intent was to prohibit the sale of beer and alcohol. It was determined that the Ordinance limited the locations for the sale of on premise consumption. Each individual location would have to have prior approval of the City Commission. There was a brief discussion regarding permitted uses for the property and whether it should be rezoned or remain residential. Motion by Commissioner Cline, seconded by Commissioner Simons that the meeting recess for one hour to allow the Planning and Zoning Commission to make a recommendation. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CONSIDER REZONING BLOCK 30, BEACH PARK (CONTINUED) Planning & Zoning Chairman, Pat Murton, addressed the Commission regarding item 37 and 38 of the commercial classification. The Planning & Zoning Commission would object to the liquor, beer and wine retail sales, lounges, taverns and private clubs and asked that these uses be restricted; and recommended that only Lots 1, 2, and 3, of Beach .Park be rezoned to "C" Apartment and Commercial. Commissioner Simons moved to rezone the entire block of Block 30, Beach Park. Motion died for lack of a second, Commissioner Cline moved to rezone Lots 1, 2, and 3, Block 30, Beach Park. Motion died for lack of a second. It was moved by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to deny the request for rezoning. AYES: Commissioners Tomerlin and Kibodeaux. NAYS: Commissioners Cline, Simons, and Mayor Meza, voting to break the tie. • Mr. J. Tarpey was recognized and addressed the Commission stating that the property had been purchased as commercial, it had always been used as commercial property and did not see how the Commission could deny the request. Commissioner Cline stated that she felt that the property was commercial property and that the City had been at fault in overlooking this property and not showing this property as commercial property on the Zoning Map. Motion by Commissioner Cline, seconded by Commissioner Tomerlin that Lots 1, 2, and 3, Block 30, Beach Park, be rezoned to "C" Apartment and Commercial. Motion carried by the following vote: AYES: Commissioners Tomerlin, Cline, and Simons. NAYS: Commissioner Kibodeaux. + + + 3.
