HOMES - MR. EARL WILBURN - Mr. Wilburn was recognized and
a dressed the Commission regarding special building permits
for Monarch Homes to allow them to start building the homes
with no services and not accepted by the City-until the
utilities have been accepted by the City. Mayor Meza asked
that this be taken under advisement by the Commission.

Mr. James R. Hudgens to the La Porte-Deer Park-Lomax Joint

Adjustment. Motion carried by the following vote:

ZONING BOARD TO BE APPOINTED AS A`MFMBER OF THE AIRPORT
ZONING COMMISSION TO BE CONSTITUTED BY SAID BOARD - The Attorney
stated that this item was for the Planning & Zoning Commission's
action and needed no action by the City Commission. Mr. Walter
Springall was appointed to the La Porte-Deer Park-Lomax Joint
Airport Zoning Board as a member of the Airport Zoning Commission.

11. ADMINISTRATIVE REPORTS - The City Administrator informed the
Commission of a request from the youth of the North Side
regarding the North Side Civic Center's need for the building
and grounds needed improvement and asked for consideration of
Community Development Money to be used for renovation of the
Recreation Building with a study hall and library; upgrading
of grounds, open air gym with a cover; and the feasibility of
a swimming pool, as a last request.
There was a brief discussion regarding a letter of cooperation
with the Federal Housing Authority for a federal housing program.
The proposed resolution was read determining a need for housing
assistance. This will be discussed further at the next work shop.
There was a brief discussion regarding canceling the work shop
of October 25, due to the Ducks Unlimited Banquet and changing
the frist meeting of November due to the Texas Municipal League
Convention. These items will be placed on the next regular
meeting agenda.

Coco missioner Simons that the temporary building permits for
Monarch Homes be issued. Motion carried by the following vote:

SUBJECT: LOTS 1, 2, AND 3, BLOCK 30, BEACH PARK
The above referenced property, owned by Dan Tarpey, has been
brought to our attention for zoning consideration. Although the
property is zoned R-l, it has been used commercially for a number
of years, and was thought by the owner to be zoned commercial.
The property is located at the northern tip of a half-circle
and~is situated with good access to Sylvan Beach Park and La Porte
High School. The remainder of Block 30 is a quiet neighborhood of
single family residences.
On June 26, 1978, when this property was first brought to the
• attention of the Planning & Zoning Commission, we recommended that
it be rezoned commercial, and the remainder of the block retain the
R-1 classification. However, due to the proximity of the school
and park, it is our opinion that the commercial classification should
be limited to uses which would cause no decrease in value to the
surrounding homes or be of no detrimental influence upon school
children or families using the park.
If a special use permit is issued, it is our understanding
that it would automatically terminate upon sale of the property,
thus making it impossible for the present owners to sell for
commercial use.
We feel that the present R-1 classification was an omission
at the time the zoning ordinance was adopted.
It is our recommendation that Lots 1, 2, and 3, Block 30,
Beach Park be rezoned to commercial with limited use.

as home owners without apartrient or cottunercial. Please read this
letter before tl~e Commission stating uiy objections. I would appear in
person but I do not drive at nights. (Senior citizen status)

AN ORDINANCE AMENDING ORDINANCE NO. 1000 OF THE CITY OF LA FORTE,
TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEV~IHERE; PROVID-
ING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER FOR
CONSUMPTION OFF PREMISES SIiALL NOT BE AFFECTED; DEFINING SOURCE
OF AUTHORITY; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT NO
LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN DESIGNATED;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of La Porte desires to regulate the
closing hours for the sale of beer by retailers selling beer
for consumption on premises in accord with provisions of
Article 667-10-1/2 of the Fenal Code of the State of Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF LA FORTE:
Section 1. In addition to the locations specified in
• Section 1 of Ordinance No. 1000, passed and approved by the
City Commission of the City of La Porte on August 19, 1974,
the sale of beer shall also be permitted during the hours
.set by the general laws of the State of Texas at the follow-
ing location by a retailer selling beer for consumption on
premises, to-wit:
The East Fifty Feet (E.50') of Lots Eleven
(11) through Sixteen (16), both inclusive,
Block One Hundred Seventy-nine (179), TOWN
OF LA FORTE, Harris County, Texas, located
at 204 W. Fairmont. Parkway, known as
"LAS HADAS Mexican Restaurant."
Section 2. Except and to the extent amended hereby,
Ordinance No. 1000 shall remain in full force and effect.
Section 3. This Ordinance shall take effect and be in
• force from and after its passage and approval.

SECTION 13-100' GENF~RAL RF;(~UIRL;dI~,N'I.'S AND PRUV]:SIONS
13-101 The regulations applying speci-fi.cally to use, buildings, bulk,
and premises within residential and commercial zoning districts
are set forth in this Article. Also applying to-each zoning dis-
trict are the regulations set forth in all other regulatory and
definitive articles and sections of this Ordinance.
13-102 All buildings erected hereafter, all uses of land or buildings
established or~changed hereafter, all structural alterations,
enlargements, relocations of existing buildings occurring here-
- after, shall, in addition to the other regulations of this Ordi-
nance, comply with the regulations of the zoning district in
which located, except in compliance with Subsection 6-102 of
this Ordinance.
13-103 A lot of record, which, on the effective date of this Ordinance,
has an area or width less than hereinrequired, may be used for
single-family dwelling or a permitted nonresidential use, un-
less the adjacent property is under the same ownership and could
be replatted.to make conformity possible.
SECTION 13-200 "R-1" SINGLE-FAMILY DWELLiNG'AND DUPLEX DISTRICT REGULATIONS
- ~~13-201 Use Regulations: -In "R-1" Single-Family Dwelling and Duplex
District no land shall be used and no building shall be erected
y for or converted to any use other than: --
(1) ASingle-Family Residence.
(2) Duplexes, upon petition of the property owner and after notice
and public hearing thereon as provided in Article Seventeen
hereof. (Ord. #78o-G, 8-17-70) .
(3) Churches, rectories, parish houses, and convents in conjunction
.with schools.
(}+) Public parks and public playgrounds and noncommercial athletic
fields.
(1~a) Public, private, or denominational schools having a
curriculum equivalent to a public elementary or secondary
school, by special permit.
• (5) Golf Course, but not including miniature golf course, driving
range, or any forms of commercial amusement.
(6) Community club facilities when organized for use of~a
particular residential development.
(7) Fire Stations.
(8) Accessor~* buildings, including a private garage, bona fide ~~
servants' quarters not for rent but for the use of servants
employed on the premises, when detached from tYie main building
• and located not less than seventy-five (75) feet from the
front lot line, and not less than five (5) feet from any side
property line. When the accessory building is directly attached
to the main building by a breezeway, it shall be considered an
integral part of the main building. The breezeway may be
considered a part of the accessory building. When the breezeway
' ~extends intrr the required rear yard, it, together with the main
building and all other accessory building or buildings, may
occupy not more than one-third (1/3) of the entire yard.

only and vrhich shall be removed upon completion or aban-
• donment of construction stork. Field offices for the sale
of real estate which shall be removed upon request of the
Building Inspector.

premises shall advertise the premises for a purpose for
which it is not legally zoned. One larger sign announcinv _

ment may be temporarily erected on each approved plat or
development; provided, however, that such sign shall not
exceed two hundred (200) square feet in area; provided,
however, that the location of such sign be approved by the
Buildin, Inspector; that it shall be placed so as not to
interfere with the occupancy or use of any lots in the
subdivision and that it shall be removed upon the completion
of sale of eighty-five (85) per cent of the lots or dwellings
in the subdivision.
(16) Such uses ..c may be permitted by Article Sixteen Special

trucks, or motorcycles.

and compatible with residential use in this

F~ Special Conditions.
(a) Only one employee, not of the resident family,
shall be permitted.
(b) There shall be no advertising other than one -
noni.lluminated identification sign of not
more than three (3) square feet in area,
which sign shall be attached flatwise to the
building.
(c) There shall be no other display ox• unen-
closed storage of materials or equipment
or other exterior indication of the home
occupation which detracts from the residential
character or appearance of tre building. '
(d) Such home occupation shall not generate offen-
sive noise, vibration, smoke, particulate matter,.
odorous matter, heat, or glare.
(e} !-ny home occupation involving products as menti-
oned above shall be limited to custom production,
repairing, or servicing.
13-202 Specification: In "R-1" Single-Family Dwelling and Duplex District
there shall be a.living area of not less than.one thousand fifty
(1,050) square feet; duplexes, not less than one thousand fifty
(1,050) square feet per dwelling unit.
