LA PORTE CITY COMMISSION, LA PORTE, TEXAS
AND
THE PLANNING AND ZONING COMMISSION
DECEMBER 6, 1978
7:00 P.M.

Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and
Tom C. Simons.

• 1. CALL TO ORDER - Mayor Meza called the joint public hearing to
order.

2. CONSIDER A VARIANCE REQUEST FOR LOTS 14, 15, AND 16, BLOCK 155,
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, TO ALLOW A DUPLEX TO
BE BUILT, AND IF SO, GRANT A VARIANCE REGARDING THE REQUIRED
1050 SQUARE FEET IN THE SECOND LIVING UNIT - Pat Muston,
chairman of t e Planning and Zoning Commission was recognized
and stated they had received a request to allow a duplex to
be built on Lots 14, 15, and 16, Block 155, and if the Commission
allowed this, then asked to give a variance to the 1050 square
feet in the second unit; also, asked for clarification of the
term "duplex". Mrs. Muston further stated that the Planning and
Zoning Commission members were in favor of granting the request.
A copy of the recommendation is attached and made a part of these
minutes.
Ms. Rachel Hampton presented a sketch and set of plans for the
proposed duplex.
Mayor Meza asked if there was anyone present wishing to speak
in opposition to the rezoning request?
The following citizens spoke in opposition to the request:
• Steve Remick - 808 S. 2nd - was recognized and spoke in opposition
to t e request.
Dennis Dunham - 816 S. 1st - stated he was opposed to any high
density unit and stated he opposed the request.
Charles Sanders - 805 S. 2nd - stated he was opposed to any
change in zoning; if it was allowed, then what would happen
to the next three vacant lots?
Douglas Newton - 811 S. 2nd - opposed to the request.
Leroy Cope-land- - 810 S. 2nd - opposed.
A. L. McFayle - 902 S. 2nd - opposed.
Wm. Carpenter - 814 S. 2nd - opposed.
Ms. Rachel Hampton spoke for the request. She stated that
the estimated cost of the unit would be $57,000. She planned
to live in one unit and rent to an elderly friend. She further
stated that she was a school teacher in La Porte and planned
to remain here until retirement.
After a brief discussion, motion by Commissioner Cline, seconded
by Commissioner Tomerlin that the public hearing be recessed for
the Planning and Zoning Commission to leave the chambers and bring
back their recommendation.

2. CONSIDER A VARIANCE REQUEST FOR LOTS 14, 1S, 16, BLOCK 155 (CONTINUED)
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
The public hearing recessed at 7:25 P.M.
The public hearing reconvened at 7:35 P.M.
The Planning and Zoning Commission Chairman, Pat Muston was
recognized and stated that the Planning and Zoning Commission
recommended that the request for rezoning Lots 14, 15, and 16,
Block 155, Town of La Porte, not be granted.
Motion by Commissioner Cline, seconded by Commissioner Simons
that the request for.. Lots 14, 15, and 16, Block 155, Town of
La Porte, be denied. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
• NAYS: None.

S~JBJECT: Joint Public Hearing regarding Lots 14, 15, 16,
Block 155, Town of La Porte
Rachel Hampton has requested a variance for the property
referenced above. It is presently zoned R-1 and abutts com-
mercial property at the rear of the lots.
Ms. Hampton proposes to build a large two-story home with
a second living unit to serve as rental property. The struc-
ture has the appearance of a single-family residence rather
than a duplex.
The Planning & Zoning Commission requests a joint public
hearing with the City Commission to hear property owners'
opinions on the requested variance and to clarify the meaning
of the term "duplex." If this structure is determined to be
a duplex, Ms. Hampton will also request a variance regarding
the required 1050 square feet in the second living unit.
