• MINUTES - REGULAR MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS DECEMBER 20, 1978 7:30 P.M. MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza; Commissioners John Tomerlin, I. J. Kibodeaux, and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioner Virginia Cline. OTHER CITY OFFICIALS PRESENT: J. R. APPROVAL OF MINUTES - REGULAR MEETING AND'JOINT PUBLIC HEARING - OF DECEMBER 6, 1978 = SPECIAL MEETING - DECEMBER 13, 1978 - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the minutes of the regular meeting and the joint public hearing of December 6, 1978, and the special meeting held December 13, 1978, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 3. RATIFY AUTHORIZING: TEN STREET LIGHTS TO BE PhACED ON SOUTHERN PACIFIC GRADE"SEPARATION - Motion by Commissioner Simons, seconded by Commissioner Tomerlin to ratify authorizing ten street lights to be placed on the Southern Pacific Grade Separation. Motion carried by the following vote: • AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 4. CONSIDER P,PPROVING UTILITY EXTENSION AGREEMENT WITH ROBERT WEATHERSBY' OF' MA'RCO` EQUIPMENT RENTP,LS - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve a utility extension agreement with Robert Weathersby of Marco Equipment Rentals. A copy of the estimated costs for a six inch water line is attached and made a part of these minutes. There was a brief discussion regarding the need for a 12" line. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons that when the job was bid to bid for a six inch or a twelve inch water line. CONSIDER CALLING JOINT PUBLIC HEARING WITH PLANNING AND ZONING COMMISSION TO BE HELD ON JANUARY 7, 19 9, TO CONSIDER REZONING BLOCK 831, TOWN OF LA PORTE, FROM RESIDENTIAL - 2 TO COMMERCIAL, BEGINNING AT 7:00 P.M. - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to call a Joint Public Hearing to be held on January 17, 1979, at 7:00 P.M., to consider rezoning Block 831, Town of La Porte, from Residential-2 to Commercial. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + c: 9. CONSIDER APPROVING FINAL ACCEPTP,NCE OF UTILITIES IN CREEKMONT, SECTION I, AND THE EXTENSION OF MYRTLE"CREEK - The Administrator stated that inspections had been made of the utilities in Creekmont and that every thing was complete except for two items; he further recommended that the City accept the utilities for maintenance subject to satisfactory completion of the two remaining items, electrical service to the lift station and back fill not satisfactory in one area. Motion by Commissioner Tomerlin, seconded by Commissioner. Kibodeaux to approve the final acceptance of utilities in Creekmont Section I, and the extension of Myrtle Creek, subject to the two remaining items of electrical service to the lift station and satisfactory back fill. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 10. ADMINISTRATIVE REPORTS - A. The Administrato like to schedule a meeting for the Commission preliminary meeting with Dr. Roesler of Texas the Zoning and Subdivision Ordinances. After a meeting was scheduled for January 11, 1979, to meet with Dr. Roesler. r stated would to have a A & M to review a brief discussion, beginning at 6:00 P.M. • • • Regular Meeting 12/20/78 5 10. ADMINISTRATIVE REPORTS - (CONTINUED) B. The Administrator informed the Commission of a problem at the Southside Civic Center regarding the Heating and Air Conditioning System. Two of the three units are not working. After receiving proposals for repairs, the lowest proposal was $4,790.00 per unit. He further stated that there were no funds budgeted and recommended that the Commission declare an emergency, waive the bid procedure and authorize $9,580.00 be taken from the General Fund Contingency for repairs to two of the units at the Southside Civic Center, since activities are scheduled. DECLARE EMERGENCY - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to declare an emergency, to waive the bid procedure to have the air condition and heating units, (two) repaired, at the proposed cost of $4,790.00 per unit. The bid or proposal given to the low bidder, Bay Breeze, in the amount of $4,790.00 per unit. A total of $9,580.00; and further authorize the $9,580.00 be taken from the General Fund Contingency. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. • NAYS: None. Copies of the proposals are attached and made a part of these minutes. + + + 11. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - (E , (F), AND (G) - (LEGAL, LAND ACQUISITION AND PERSONNEL) - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. The meeting recessed at 7:56 P.M. W I T N E S S E T H (1) All references to "Utility Main(s)" hereunder shall, for the purposes of this agreement, .refer to (2) Owner is the owner of certain property in the City of La Porte, Harris County, Texas, identified as • City's utility mains do not presently extend to said property. Owr~cr has requested City to extend utility mains to Owner's said property. • i (3) City hereby agrees to construct and install an extension of its utility main(s) to said property commencing at the nearest existing utility main(s) of sufficient size and capacity. Thence along/thru City of La Porte rights-of-way and/or easements to said Owner's property: Provided, however, that should City not possess all necessary rights-of-way and/or easernents~to complete said extension(s), Owner shall be solely responsible for obtaining said additional rights-of-way and/or easements at no cost to City. (4) Owner agrees to pay all costs related to the construc- tion and .installation of said line(s) including necessary appur- tenances in conformance with City's standards and specifications for said line(s). Owner further agrees to pay all engineering fees for survey, design, contract documents, bidding, construction staking, and construction inspection. (5) Subject to the provisions of this agreement, City hereby agrees to construct and install said extension of its utility main(s) according to the plans and specifications to be prepared by City's engineer. Prior to City authorizing the City's engineer to prepare plans and specifications Owner will deposit with City in escrow a sum of money based on and equal to the City engineer's estimated project cost in conformance with Section 4, less esti- mated construction, construction staking and inspection costs. Thereafter, City will authorize the City engineer to prepare plans and specifications for said extension(s). Upon completion of plans and specifications City will place the project for bid. When bids are received they shall be tabulated by the City and a copy of said tabulation shall be provided to Owner. Thereaf ter, Owner shall deposit with City in escrow a sum equal to the amount bid by the lowest responsible chosen bidder, plus a sum equal to the estimated construction staking and inspection fees if applicable. When said deposit has been made by Owner, City shall execute a contract for said extension(s). It is agreed and understood that the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the project that result from circumstances beyond the control of City. (6)' City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage connection charge for water and/or sewer service against said property belonging to Owner. Owner shall be responsible for all other customary charges. (7) Upon execution of this agreement and compliance with terms herein, City agrees to begin the preparation of engineering plans and construction specifications for said extension(s), and to begin construction thereof as soon as the same may be let for contract as herein provided. City shall require the contractor under such contract to diligently pursue the construction of the project to completion. -~---- (8) In the event that other owners of property abutting the line(s) extended by Owner under this contract, as shown on the plat attached hereto as Exhibit A and incorporated by reference herein, shall utilize the extended line{s) constructed under this agreement, by making connection thereto under a permit from City .within a period of ten (10) years from and after the date City has accepted the construction of said facilities by the contractor, City agrees to collect from said property owners, its prevailing square footage and/or front footage connection fees from said property owners and to reimburse Owner the amount collected from such property owners, until Owner has been reimbursed a maximum ® total of the sum paid by Owner to the City under the terms of .-- this agreement, less Owner's own water and/or sewer square footage and/or front footage connection charges. •~ , ~ IN WITNESS WHI;RI;OI', the Parties to these present have executed this agreement in several counterparts, each of which shall.be deemed an original, in the year and day first mentioned above. AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK SEVEN HUNDRED EIGHTY-SEVEN (787), IN THE TOWN OF LA PORTS, HARRIS COUNTY, TEXAS. WHEREAS, the said alley in Block Seven Hundred Eighty- Seven (787) of the Town of La Porte has never been opened or used as a public thoroughfare, and .the public utilities now making use of such alley have all given their written con- sent for its closing; and WHEREAS, the City Commission of the City of La Porte has determined and does hereby find, determine and declare that the said alley is not suitable, needed, or beneficial to the public as a public alley, and should be vacated, abandoned and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTS: Section I. The alley located in Block Seven Hundred Eighty-seven (787) of the TOWN OF LA PORTS, Harris County, Texas, is hereby permanently vacated, abandoned and closed by the .City of La Porte. Section 2. These units are around (13) thirteen years old. Two of these units have been out of service for the past several weeks, both units are in bad shape.
