JANUARY 17, 1979 - Motion by Commissioner Cline, seconded by
Commissioner Simons to approve the minutes of the regular
meeting of January 10, 1979, the Joint Public Hearing of
January 17, 1979, and the special meeting of January 17,
1979, as presented. Motion carried by the following vote:

4. CONSIDER ACCEPTING ZINGERY MAP COMPANY PROPOSAL - After
a brief discussion, motion by Commissioner Tomerlin, seconded
by Commissioner Cline to accept the recommendation of the
City Administrator and accept the proposal of Zingery Map Company
to develop a map system for the City, at a cost of $2.50 per
parcel. A copy of the recommendation and proposal is attached
and made a part of these minutes. Motion carried by the following

read in full, motion by Commissioner Cline, seconded by Commissioner
Tomerlin to approve Ordinance No. 664-H. Motion carried by the
following vote:

award the bid for one side loader garbage truck to Ebeling
Manufacturing Company (EMKO) of Plainview, Texas, in the amount
of $39,200.00. A copy of the recommendation is attached and
made a part of these minutes. Motion carried by the following

to authorize the execution of a contract with Texas A & M
University for revisions to Zoning and Subdivision Ordinances in

14. ADMINISTRAfiIVE REPORTS - The Administrator informed the
Commission of a memo from the Director of Parks & Recreation
regarding the availability of a 1965 GMC 45-passenger bus
through Texas Surplus Properties, at a cost of $575.00.
Because of the growth of senior citizens and the success of
the Nutrition Center, there was a need for additional transportation.
There was a general discussion regarding the costs involved in
painting, tires, interior repair and the fact that the bus was not
air conditioned. It was determined that the Shop Superintendent,
Mr. Bob Kendle would go and inspect the bus and make a recommenda-
tion before the purchase could be made. If the City was not
going to purchase the bus, there were other entities interested
that were on the waiting list.
The Administrator requested an executive session for a
contractural matter.

SUBJECT: Map System
In this fiscal year's budget we set aside $27,000.00 in
the Tax Division to have a map system developed.
I have received two proposals (attached) for the delivery
of this service. They are:
Zingery Map Company, Inc. $2.50 per parcel
International Aerial Mapping Company $37,975.00
In reviewing the proposals it is my recommendation that we
contract with Zingery Map Company, Inc., for this service. The
Zingery proposal will provide us wi h much more information and
is approximately 50~ less expensiv an the International pro-
posal.

Dear Mr. Hudgins:
The following is an outline of the mapping system Zingery Map Company
• proposes to construct for the City of La Porte. The proposal is preliminary
and adustments can be made to suit the City or the Mapper.

. Zingery Map Company will deliver to the City of La Porte a complete
mapping system to be used and owned by the City of La Porte. The system
will consist of the following maps.
1. A 1" = 1000' double line mylar street map of the entire city showing
existing streets, subdivisions, schools and city boundries and utility
districts.
2. A set of maps of the city 1" = 100' on mylar. These maps will show
lots and blocks dimension, block number, street rights-of-way, easements
etc.
3. Record Research
The mapper will obtain and use the following materials in addition
to other material or documents as required in the maintenance and
updating of the ownership maps:
a. All recorded vesting instruments that sell, transfer or convey
ownership of real property or ownerships including wills and trusts
during the period of the contract.
b. All newly recorded subdivisions or r.esubdivisions of existing
subdivisions and all local surveys.
c. All right-of-way plans for new roads, railroads, and changes of
existing right-of-ways for all Federal, State, County, and City streets.
Final ownership maps must show the travel portions of all U.S.,
State, County, and Punicipal highways, roads, streets along with
• the dimensions of such right-of-ways.
d. All new right-of-ways for transmission lines (gas or electric).
4. Minimum Map Inclusions
As a minimum, the final ownership maps will depict only the major
detail from the planimetric manuscript with at least the following
detail shown:
a. Each established parcel and its boundries
b. Abstracts and Surveys
c. U.S., State, County, Municipal, etc., Highways, Roads, Streets
and Name or Number. This includes determination of and the
showing of Rights-of-ways.
d. Political boundries and subdivisions
e. County boundries
f. Municipal boundries
g. Government Lot Numbers
h. Subdivision names, block and lot numbers or other designation.
i. Canals, rivers, creeks, etc.
j. Railroad Right-of-way
k. Major utility lines as shown on planimetric manuscripts
1. Churches, schools, cemeteries, airports, government lands, etc.
are to be identified on the ownership map by name.

In accordance with our previous discussions we are pleased
to submit the following proposal for providing planimetric maps at a
scale of 1 "=100' .
We propose to initiate this project by completing aerial photo-
graphic coverage at a scale of 1"=500' to cover the planimetric mapping
area. This aerial photography will be accomplished with a 6" focal
length Wild RC8 precision mapping camera with 60% forward overlap
along flight lines and 33°/o sidelap between adjacent strips,
Necessary horizontal control will be established within the
designated mapping area to provide basic requirements for aerotri-
angulation to meet National Map Accuracy Standards, Traverse work
for establishing the required horizontal control will be completed with
one second optical reading theodolites and Hewlett-Packard distance
measuring equipment. All traverse lines will be initiated at established
monumented stations within the area and will be closed to similar stations
or completed as loops to provide for final adjustment of the completed
data.
Aerotriangulation will be accomplished on our Galileo Santoni
Stereocartograph utilizing glass diapositives PUGGED on our Wild
Transfer Device to provide a minimum of six horizontal and vertical
control points per photographic- model. Instrument measurements
resulting from these aerotriangulation operations will subsequently
be adjusted by a strip and block method to provide a least squares
adjustment of all PUGGED points to the established field control.
These adjustments will be accomplished by our standard aerotri-
angulation programs on an IBM 1620 Computer.

Following the completion of the control adjustments planimetric
map compilation will be implemented at a scale of 1"=100' on Wild B85
and Kelsh plotters. All detail visible in the photo image and compatible
with final map scale will be compiled. The resulting compilation manu-
scripts will be thoroughly checked for completeness and quality prior to
the implementation of final sheet preparation.
Sheet finalization will be accomplished by negative engraving
techniques wherein all planimetric detail will be engraved with symbols
and lineweights compatible with final scale. A master mask containing
appropriate marginal data, to include a bar scale, date of photography,
grid note and title block will be prepared and composited with the com-
pleted scribecoat, for each sheet, on matte surface film. These com-
posite film positives will be finalized with mechanical lettering devices
to provide appropriate names data for streets, drainage features and
other appropriate detail.
Final sheet size will be 24" x 36" in overall size with a 20" x 30"
. (2000' x 3000') neat image area. All map sheets will be assigned an appro-
priate identification number utilizing an atlas numbering system to provide
for future expansion of the initial mapping area and an Index to Sheets will
be prepared on 24" x 36" material and furnished for reference and relative
location of the individual final sheets. Matching sheet numbers will be
drafted on appropriate sides of the topographic sheets for use reference.
Approximately 98 planimetric sheets will be required to cover the estimated
8900 acres comprising the mapping area. A sheet layout of the mapping
area will be submitted for approval prior to implementing the project.
All work in this project will be accomplished in accordance with
the highest professional standards for assurance that all finalized data
meet National Map Accuracy Standards in all respects. In this connection
our Quality Control Program is based on a progressive review of data
through each technical work phase combined with an additional technical
review of all finalized data to ensure the maintenance of quality and
accuracy standards throughout the various work requirements of each
project.
Delivery items for the planimetric mapping area will be one
complete set of planimetric maps, scale 1"=100', and an Index to Sheets.

Our fee for the preparation and finalization of data outlined in
this proposal is $37, 975.00.
This project, as proposed, will be completed within 120 days
from date of notice to proceed.

I enclose herewith proposed draft of City of La Porte Ordinance No.
664-H, an ordinance amending the City of La Porte Electric Code.
The new language, based upon the language in the City of Baytown's
comparable ordinance, is as follows:
"To insure proper supervision of electrical work as required
by this ordinance, a Master Electrician may not be employed
or otherwise affiliated with more than one electrical con-
tracting firm. Such employment or affiliation shall be on
a full time permanent basis."
Also, I suggest a delayed effective date of April 1, 1979, so that
there will be plenty of time for the new ordinance to be disseminated
to all of the Master Electricians, so that they can get their business
in order before April 1, 1979.
By copy of this letter, I am requesting Mrs. Goyen to place this
ordinance on the workshop agenda for January 17, 1979, for consider-
ation by the City Commisssion. I am requesting Chairman Pfeiffer of
the Electrical Board to meet with the City Commission on that night,
to express the views of the Board to the City Commission.

AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE 664, BY ADDING A

BY AN ELECTRICAL CONTRACTING FIRM BE EMPLOYED BY ONLY ONE FIRM

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Ordinance No. 664 of the City of La Porte,
popularly known as the "City of La Porte Electrical Code",
heretofore passed and approved on the 18th day of January,
• 1963, is hereby amended, by changing Section 4, which shall
hereafter read as follows:
"Section 4. MASTER ELECTRICIAN. The holders of the
licenses provided for in Sections 2 and 3 shall be known
as Master Electricians.
"All Master Electricians shall be assigned a number
which will be his permanent identification; this assigned
number will appear on the Master Electrician's license
each year when renewed and shall be displayed in his cur-
rent place of business.
"A Master Electrician who is employed as a Master Elec-
trician for a person, firm or corporation shall take out
electrical permits only for that person, firm or corporation,
and shall supervise, direct and control the electrical work
for which the electrical permit is obtained. To insure
proper supervision of electrical work as required by this
ordinance, a Master Electrician may not be employed or other-
wise affiliated with more than one electrical contracting
firm. Such employment or affiliation shall be on a full
time permanent basis.
• "A Master Electrician who is engaged in the electrical
business for himself shall take out electrical permits
for his business only and no electrical permit shall be
taken out by any Master Electrician that he does not super-
vise, direct and control the electrical work for which
the permit was obtained.
"It is hereby intended to prevent a Master Electrician
from securing a permit for the purpose of abating the spirit
and .intent of this Ordinance by entering into any simulated
scheme, transaction or device, whereby electrical work
will be done by persons who are not employees of the Master
' Electrician, or employees of his employer."
• Section 2. Any person, as defined in Section 1.07(27),
Texas Penal Code, who shall violate any provisions of this
ordinance, shall be dEemed guilty of a misdemeanor and upon

conviction shall be punished by a fine not to exceed Two
Hundred Dollars ($200.00), and in case of wilful and contin-
uous violation of the provisions of this Ordinance by any
such person or his or its agent, the City Commission shall
have the power to revoke and repeal all permits and privileges
granted to said person or agent.
Section 3. This Ordinance shall be effective on April 1,
1979, which is greater than fourteen (14) days after its pas-
sage and approval. The City Clerk shall give notice of the
. passage of this ordinance by causing the caption hereof to be
published in the official newspaper in the City of La Porte
at least twice within ten (10) days after the passage of this
ordinance.

SUBJECT: Request for Furniture and Remodeling at the La Porte
Library
Attached is a request from Carole Naegele concerning the
above. The furniture prices were provided by Carole and the
remodeling price was estimated by Moore & Moore Construction.
Our budget does not contain funds to grant this request.
We do, however, have sufficient funds in our General Fund
Contingency to fund the request if Council so desires. This
item will be placed on a workshop agenda in January for dis-
cussion. Carole will be present to participate in the dis-
cussion and answer any questions y-ot~, m~ht have.

Recently the traffic patterns, furniture, and patron usage have been

made within the building. The new arrangement is most satisfactory, but we
lack several articles of furniture and require some remodeling to make the
library a truly modern and convenient facility. •

community information and library publicity in a neat, professional manner.

The library also requires the following alterations to the building:
l.} enclosing the space between the branch librarian's office walls and the
ceiling. The enclosure is needed. to insure privacy during confidential ,
interviews, telephone conversations, and staff meetings. At the present
time, any conversation within the office can be heard throughout the front
Bali of the building. There is also a problem with the air conditioning vent
blowing directly over the wall and into the office during the summer.

SUBJECT: Glen Meadows Section I
The developers of Glen Meadows subdivision have requested
that I write a letter of acceptance for the streets, storm
drainage, water and sanitary sewer and related. appurtenances
constructed in Section I. In reviewing the minutes of previous
Council meetings, no record was discovered that indicated
previous acceptance of the subject utilities.
All of the utilities in the referenced section are in
operation and functioning in an o riate manner. Therefore,
I recommend that Council appro e u ilities in this section
for acceptance.

This Agreement made and entered into by and between the CITY
OF LA PORTE, a municipal corporation of Harris County, Texas, here-
inafter referred to as "LA PORTE" and the PORT OF HOUSTON AUTHORITY,
a body politic of Harris County, Texas, hrerinafter referred to
as "PORT",
W I T N E S S E T H:
WHEREAS, PORT is in need of certain governmental services
for the benefit of the people and property at its Barbour's Cut
. Terminal; and -
WHEREAS, LA PORTE is able and willing to provide said govern
mental services to PORT, upon the terms, conditions, and cove-
nants herein contained:
NOW, THEREFORE, pursuant to the authority granted by the
Interlocal Cooperation Act (Art. 1581h, V.A.T.S.), and in con-
sideration of the mutual covenants, agreements, and benefits to
both parties , it is hereby agreed as follows
A. GENERAL PROVISIONS
I.
For and during the year beginning on the 1st day of January,
1979, and ending on the 31st day of December, 1979, LA PORTE
agrees to furnish to PORT, the fire suppression services herein-
after more specifically described. This agreement shall remain
in effect after December 31, 1979, until cancelled by either
party hereto giving 30 days written notice to the other party
hereto.

III.
LA PORTS will not be liable for loss or damage to person or

property arising from or caused by or resulting from alleged
negligence of LA PORTS, its officers, employees, or volunteers,
in carrying out this contract. PORT agrees to release, and save
and hold LA PORTS harmless, from any such claim for loss or
damage by itself, or by any person, firm, corporation, or
association, in connection with this contract. PORT further
agrees to reimburse CITY the fair market value of any of CITY'S
equipment damaged or destroyed while engaged in fire suppression
services in behalf of PORT hereunder.
IV.
LA PORTS agrees to provide fire suppression services for
real and personal property situated within PORT'S Barbour's
Cut Terminal, for the term of this agreement, upon the terms
and conditions herein contained, when, in the judgment of PORT
employees, such service is necessary to deal with a specific
emergency.
V.
Sole discretion will rest with the LA PORTS Fire Chief, or

his~duly authorized assistants, as to the men and equipment that
will answer each fire alarm, provided that protection will be
adequate (meaning reasonable protection, considering available
men and equipment of LA PORTE'5 Fire Department) and sending of
men and equipment to protect property within PORT will be sub-
ordinate to requests for, and rendering of, fire protection
within LA PORTS.
VI.
PORT agrees to pay LA PORTS for fire protection services,
the amounts, and in the manner, hereinabove specified.
VII.
This agreement has been duly authorized by resolutions
of the governing bodies of the parties hereto.

SUBJECT: Acceptance of Bids
I recommend we accept the bid of Ebeling Manufacturing Co.
(EMKO) of Plainview, Texas in the amount of $39,200.00 over the
other bid of $37,663.63 for the following reasons:
Vehicle:
EMKO met our specifications of 210 horsepower; the other
bidder can only supply 170 horsepower.
EMKO vehicle has a G.V.W. of 32,000 pounds compared to the
other bidder's 27,500 pounds.
EMKO vehicle has a front axle weight of 12,000 pounds compared
to the other bidder's 9,000 pounds.
The above comparisons show that the EMKO vehicle is a heavier
duty vehicle and would meet our needs more effectively.

On the Retrieving Unit itself, both bidders have a one-man
operation. However, I feel the EMKO unit would meet our needs
more effectively because:
EMKO unit has a solid unit that comes straight out from the
bottom to insure a level pick-up. This means less wear on the
hydraulic hoses. The dumpster lifts on a solid frame and has. a
one lever electro-hydraulic operation from the cab and a wind guard
around it to prevent debris from flying out.
An additional factor in purchasing the EMICO unit is that they
can deliver in two weeks. It would take at least 90 days for the
other bidder to deliver.
The other bidder's unit has a hydraulic arm that wears out the
hydraulic hoses by rubbing against them. The pick-up bar slips out
of the chain, which causes a lot of down time. It has four levers
to operate from the cab, which can cause the driver to get confused,
and takes longer for dumpster pick-ups.

CITY OF LA PORTE, TEXAS
• THIS CONTRACT made and entered into this 24th day of
JANUARY 1979 by and between the City of La Porte, Texas
hereinafter referred to as "City"; and, the College of Architecture and Environmental
Design, on behalf of Texas A&M University, hereinafter referred to as "TAMU".
WITNESSETH:

WHEREAS, the City desires to authorize the conducting of an urban
planning intern program utilizing its facilities hereinafter described in Article
2 of this Contract; and
WHEREAS, TAMU desires to carry out such program for the benefit of
faculty and students of TAh1U's Department of Urban and Regional Planning;
NObJ THEREFORE, in consideration of the covenants and agreements herein-
after set forth, it is agreed as follows:
Article 1 - Consideration

1.1 TAMU shall, through appropriate faculty supervision, provide guidance to
students of.the Department of Urban and Regional Planning in their pursuit
of the academic experience described in Article 2 of this Contract.
1.2 The City shall compensate TAMU for expenses incurred on this intern program
in accordance with the terms of Article 3 of this Contract. In no event
shall the City's compensation exceed the fixed sum of eleven thousand eight
hundred dollars ($11,800.00).

Article 2 - Scope of Activities
•
2.1 TAMU
Studentsdesignated by the Head of the Department of Urban and Regional
Planning shall participate in this program in order to fulfill the re-
quirements toward their degree. TAMU activities:
(a) Sketch plan for La Porte and potential annexation areas which will
include the following elements:
- Land Use and Density Plan
- Circulation Plan
- Utility Systems Plan, including Drainage
In connection with this sketch plan a representative analysis of land
uses will be prepared, including mapping of land use in particular areas
• of the city. An economic assessment of development opportunities and of
housing demand by type of dwelling unit will accompany the land use anal-
' ysis.
(b) Subdivision Regulations
Technical provisions fora new subdivision regulation will be drafted.
Graphic illustrations will be provided for proper interpretation of com-
plex engineering standards and specifications.
(c) Zoning Regulations
Technical provisions for a new zoning ordinance will be drafted and
graphically illustrated as needed for proper interpretation. Zoning
map revisions will be suggested as appropriate.
• The instruments prepared under items (b) and (c) above will be presented in a
form suitable for review by the city attorney and in consultation with other

designated city officials.
• (d) Reports
All study elements will be reproduced in black and white by off-set
press and 75 copies provided to the City. P1aps will be prepared at
appropriate scales for the plan elements. Additionally, graphics and
photography may be used as appropriate.
2.2 CITY
As part of this i.nternprogram, the City shall provide the following:
(1) Reproduceable base map for land use documentation not smaller than 1"=600'.
(2) Aerial photos of La Porte and adjacent areas, as available.
(3) Topographic and geologic maps as available.
(4) Traffic count data for streets.
(5) Water distribution: map showing location and size of lines, location
• -and capacity of water storage and of water treatment plant; water usage
data .
(6) Sanitary sewer: map showing location, size line, capacity and current
flow; location and capacity (or slope) of sewage treatment plant; data
on sewage treatment including daily quantities and quality of effluence.
(7) Storm drainage map of existing storm drainage system, if any; location
of critical areas subject to periodic flooding.
(8) Copies of pertinent city codes/ordinances and pertinent planning docu-
ments.
Article 3 - Reimbursement for Costs
3.1 Upon execution of this Contract and in consideration of the services hereunder,

the City shall reimburse TAMU for all reasonable costs incurred under the pro-
visions of this Contract. In no event shall the reimbursement for said costs
• .exceed the fixed sum of eleven thousand eight hundred dollars ($11,800.00)..
3.2 Payment to TAP1U shall be made in four approximately equal consecutive monthly
installments upon receipt of a duly executed invoice and progress report from
TAMU. The first installment shall be due 30 days from the date of this Contract.
3.3 TAMU shall not incur other costs for which reimbursement is to be claimed with-
out written authorization from the City amending this Contract.
3.4 The following schedule indicates an approximate division of expenses relating
to this agreement.
• TAMU reallocation of funds in this section from one budget item
to another shall be at the exclusive discretion of TAMU.
(1) Salaries E Wages $6,500.
(2) Employee Benefits (13.5% of #1) 878.
(3) Expendable Supplies & Materials 567.
(4) Travel 1,380.
(5) Printing Costs 1,400.
(6) Computer Charges 100.

Article 4 -Time of Performance
The activities described in Article 2 above shall commence upon execution
of this agreement and completed within approximately seven calendar months.
Article 5 -Supervision of~Students
Students participating in this project shall be supervised by Professor
Vergil G. Stover, P.E., assisted by Assist. Prof. David L. Pugh, J.D. All
communications concerning the aforementioned intern program shall be di-
rected to the above named supervisor.
Article 6 - Designation of Students
The activities described in Article 2 above shall be performed by graduate
planning interns and other students designated by the Department Head.
