APPROVAL OF MINUTE'S - REG'ULA'R MEETING- JANUARY 24, 1979 - Motion y Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the regular meeting of January 24, 1979, as presented. Motion carried by the following vote: AYES:- Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 4. CONSIDER AP ROVING PROPOSED'ORDINANCE N0. 1144 - ORDINANCE ADOPTING REVISED FIRE CODE - After the proposed ordinance was read in full, mot on by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 1144 as read, • adopting the revised fire code. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPT'I'ON: AN ORDINANCE ADOPTING A FIRE CODE LA PORTE; CONTAINING A SAVING AND REPEALING THAT ANY PERSON VIOLATING THE TERMS OF THIS FINED IN ANY SUM NOT MORE THAN TWO HUNDRED AND EACH DAY OF VIOLATION SHALL BE DEEMED A AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + FOR THE CITY OF CLAUSE; PROVIDING ORDINANCE SHALL BE COLLARS ($200.00) SEPARATE OFFENSE; 5. CONSIDER APPROVING SUPPORT FIRE SERVICE AGGREEMENT WITH HOUSTON PORT AUTHORITY - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Cline to approve the agreement with Houston Port Authority for support fire services. CONSIDER P,PPROVING UTILITY EXTENSION AGREEMENT WITH FRANK MOHN, HOUSTON, INC. - The City Administrator recommended the approval of a utility extension agreement for Frank Mohn, Houston, Inc., to extend an eight inch water line from Sixteenth Street west on Avenue D for a distance of approximately five hundred feet. Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve the utility extension agreement with Frank Mohn, Houston, Inc. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • 7. CONSIDER APPROVING MUTUAL AID LAW ENFORCEMENT AGREEMENT - A ter a rie iscussion regar ing t e mutua ai aw enforcement agreement and the .fact that it had been being considered by numerous municipalities for about two years, motion by Commissioner Simons, seconded by Commissioner Cline to approve the mutual aid law enforcement agreement. A copy of the agreement is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 8. ADDRESS COMMISSION REGARDING BOND ISSUE - MR. JIMMY RAY SPRADLING - 3302 Valleybrook - Mr. Spradling was recognized and addressed the Commission regarding drainage, fire prevention, utilities, street services that have not been improved in many years and no planned progress or planned growth. ADDRESS COMMISSION REGARDING BOND ISSUE (CONTINUED) regarding the upcoming bond election; who the bond election is really for - citizens of La Porte or special interest groups; possible illegal meetings held by the Commission with the City Engineer at his home; with the Fiscal Agent at the Yacht Club; possible illegal or improper acts by offering free water and sewer service to an official; the garbage problem in Fairmont Park involving the contractor dumping too much garbage in the dump; possible grand jury threat, regarding same. Mr. Spradling further stated he felt that the Commission should have had a public hearing for the citizens to bring back recom- mendations for needs for a bond election; why there was a sepa- rate election for the bond election and not held with the annual election in April. The City Administrator explained that the upcoming bond election of 3.25 million dollars would be two million dollars to be spent on sanitary sewer line rehabilitation, and a new plant; and one and one-fourth million would be spent for water. Commissioner Simons stated that in regard to possible illegal • or improper acts by offering free water and sewer service to an official, the offer was made during a time of critical illness but was not accepted. It was determined that the City does try to help citizens during hardship emergencies. Commissioner Cline stated that during her husbands severe illness, the Commission had offered to extend her water and sewer service, which was deeply appreciated but was not accepted; further stated that she did not appreciate the harassment to the Commission; and the fact that the Commission was continually trying to please. Mr. Robert Cline stated that he felt an apology was due him because of the accusation of theft. Mr. Spradling stated that he felt he owed no apology. Commissioner Tomerlin stated that implications of wrong doings had been made and perhaps Mr. Spradling should submit these to the Grand Jury. He further stated that he would be glad to testi- fy before the Grand Jury. Commissioner Tomerlin further discussed the meetings held before he had even been sworn in as an official could have been improper, but were only considered as social events; and no matter how large the bond issue might be, could never correct all the ills of the City. • + + + • Regular Meeting 2/7/79 5 10. ADMINISTRATIVE REPORTS - The Administrator stated that the Com- mission might wish to call a special meeting to canvass the results of the bond election on February 24, 1979, beginning at 7:30 P.M. Motion by Commissioner Simons, seconded by Commissioner Tomerlin to call a special meeting to be held on February 24, 1979, beginning at 7:30 P.M. to canvass the results of the bond election. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The Administrator asked for an executive session to discuss personnel. + + + • 11. COUNCIL ACT-ION - Commissioner Tomerlin stated that he appreciated the interest shown tonight. Commissioner Kibodeaux stated that he appreciated everyone's attendance. Commissioner Simons stated that all citizens are one and when the Commission acts, it is for all and not for any favorite. + + + 12. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - E , (F , AND G - (LEGAL, LAND ACQUISITTION AND PERSONNEL - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:59 P.M. Fire Chief •JLS/cb ~ ~ ~ . .. . ~ ~ ~ ~ • • • ~' CONTRACT THE STATE OF TEXAS X X COUNTY OF HARRIS X This Agreement made and entered into by and between the CITY OF LA PORTE, a municipal corporation of Harris County, Texas, here- inafter referred to as "LA PORTE" and the PORT OF HOUSTON AUTHORITY, a body politic of Harris County, Texas, hrerinafter referred to as "PORT", W I T N E S S E T H: WHEREAS, PORT is in need of certain governmental services for the benefit of the people and property at its Barbour's Cut Terminal; and _ • WHEREAS, LA PORTE is able and willing to provide said govern- mental services to PORT, upon the terms, conditions, and cove- Hants herein contained: NOW, THEREFORE, pursuant to the authority granted by the Interlocal Cooperation Act (Art. 1581h, V.A.T.S.), and in con- sideration of the mutual covenants, agreements, and benefits to both parties , it is hereby agreed as follows A. GENERAL PROVISIONS I. For and during the year beginning on the 1st day of January, 1979, and ending on the 31st day of December, 1979, LA PORTE agrees to furnish to PORT, the fire suppression services herein- • after more specifically described. This agreement shall remain in effect after December 31, 1979, until cancelled by either party hereto giving 30 days written notice to the other party hereto. II. For and in consideration of the governmental services to be provided by LA PORTE to PORT, PORT agrees to pay LA PORTE the monthly sum of $450.00. Such charges to be paid in full by PORT to LA PORTE, on or before the tenth day of the month following • the month in which such services were rendered. • • • -2- III. LA FORTE will, not be liable for loss or damage to person or property arising from or caused by or resulting from alleged negligence of LA FORTE, its officers, employees, or volunteers, in carrying out this contract. PORT agrees to release, and save and hold LA FORTE harmless, from any such claim for loss or damage by itself, or by any person, firm, corporation, or association, in connec- tion with this contract. PORT further agrees to reimburse CITY the fair market value of any of CITY'S equipment damaged or destroyed while engaged in fire suppression services in behalf of PORT hereunder. n U IV. PORT shall provide primary fire suppression service. LA FORTE agrees to provide secondary fire suppression services for real and personal property situated within PORT'S Harbour's Cut Terminal(but not including on-board vessel fires) , for the term of this agreement, upon the terms and conditions herein contained, when, in the judgment of PORT employees, such service is necessary to deal with a specific emergency. V. Sole discretion will rest with the LA FORTE Fire Chief, or his duly authorized assistants, as to the men and equipment that will answer each fire alarm, provided that protection will be adequate (meaning reasonable protection, considering available • men and equipment of LA FORTE'S Fire Department) and sending of men and equipment to protect property within PORT will be sub- • ordinate to requests for, and rendering of, fire protection within LA FORTE. VI. PORT agrees to authorized LA FORTE duly authorized officers the right to inspect property within PORT'S Harbour's Cut Terminal. VII. (4) Owner agrees to pay all costs related to the construc- tion and installation of said line(s) including necessary appur- tenances in conformance with City's standards and specifications for said line(s). Owner further agrees to pay all engineering fees for survey, design, contract documents, bidding, construction staking, and construction inspection. (5) Subject to the provisions of this agreement, City hereby agrees to construct and install said extension of its utility main(s) according to the plans and specifications to be prepared by City's engineer. Prior to City authorizing the City's engineer to prepare plans and specifications Owner will deposit with City in escrow a sum of money based on and equal to the City engineer's estimated project cost in conformance with Section 4, less esti- mated construction, construction staking and inspection costs. ~~ Thereafter, City will authorize the City engineer to prepare plans • and specifications for said extension(s). Upon completion of plans and specifications City will place the project for bid. When bids are received they shall be tabulated by the City and a copy of said tabulation shall be provided to Owner. Thereaf ter, Owner shall deposit with City in escrow a sum equal to the amount bid by the lowest responsible chosen bidder, plus a sum equal to the estimated construction staking and inspection fees if applicable. When said deposit has been made by Owner, City shall execute a contract for said extension(s). It is agreed and understood that the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the project that result from circumstances beyond the control of City. (6) City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage connection charge for water and/or sewer service against said property belonging to Owner. Owner shall be responsible for all other customary charges. (7) Upon execution of this agreement and compliance with terms herein, City agrees to begin the preparation of engineering plans and construction specifications for said extension(s), and to begin construction thereof as soon as t're same may be let for contract as herein provided. City shall require the contractor under such contract to diligently pursue the construction of the • project to completion. (8) In the event that other owners of property abutting the line(s) extended by Owner under this contract, as shown on the plat attached hereto as Exhibit A and incorporated by reference . herein, shall utilize the extended line(s) constructed under this agreement, by making connection thereto under a permit from City within a period of ten (10) years from and after the date City has accepted the construction of said facilities by the contractor, City agrees to collect from said property owners, its prevailing square footage and/or front footage connection fees from said property owners and to reimburse Owner the amount collected from such property owners, until Owner has been reimbursed a maximum total of the sum paid by Owner to the City under the terms of • this agreement, less Owner's own water and/or sewer square footage and/or front footage connection charges. • TN WITNIJSS WIII;RLOi^, the Parties to these present have executed this agreement in several counterparts, each of which shall be . deemed an original, in the year and day first mentioned above.
