3. APPROVAL OF MINUTES - REGULAR MEETING - FEBRUARY 21, 1979,
AND SPECSAL MEETING - FEBRUARY 24, 1979 - Motion by Commissioner
Cline, seconded by Commissioner Simons to approve the minutes of
the regular meeting of February 21, 1979, and the special meeting
of February 24, 1979, as presented. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

4. RATIFY APPROVING $4,500.00 FROM GENERAL FUND CONTINGENCY FOR
WORK AT BASEBALL FIELD BEHIND SOUTHSIDE CIVIC CENTER - Motion
by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to
ratify approving $4,500.00 from the General Fund Contingency
for work at the baseball field behind the Southside Civic Center.
Motion .carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.

5. CONSIDER-APPROVING RATES OF'BUSCH`HUTCHISON ENGINEERING CONTRACT
REGARDING SURVEYING - Motion by Commissioner Simons, secondec by
Commissioner Kibodeaux to approve the rates of the Busch Hutchison
Engineering Contract regarding surveying as follows:

7. CONSIDER APPROVING REQUEST FOR 'ON PREMISE LICENSE FOR DADDY
CRAFT'S BAR-B-SUE, 803 WEST MAIN, 8 FEET OF LOT 19, AND ALL
OF LOT 20, BLOCK 58, LA PORTE ADDITION, HARRIS COUNTY, TEXAS -
ORDINANCE N0. 1000 - F - After the proposed ordinance was read
in full, motion by Commissioner Kibodeaux, seconded by Commissioner
Cline to approve Ordinance No. 1000-F, granting an on-premise license
for Daddy Craft's Bar-B-due, 803 West Main, as read. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAY5: None.
CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 1000 OF THE CITY
OF LA PORTE, TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CON-
SUMPTION ON THE PREMISES MAY BE SOLD AND PROHIBITING THE SALE
ELSEWHERE; PROVIDING FOR HOURS OF OPENING AND CLOSING; PROVIDING
SALE OF BEER FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED;
DEFINING SOURCE OF AUTHORITY; PROVIDING A SAVINGS CLAUSE;
PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS
HEREIN DESIGNATED; AND PROVIDING FOR AN EFFECTIVE DATE.

Motion by Commissioner Simons, seconded by Commissioner Cline
to make the La Porte Capital Improvements Bond Committee a
standing advisory committee to the Commission. Motion carried

9. ADMINISTRATIVE REPORTS - The City Administrator requested an
executive session to discuss personnel and land acquisition.

10. COUNCIL ACTION - Commi'ss'ioner Cline - Opening of "F" Street -
There was a brief discussion regarding opening of "F" Street;
the possibility of opening "F" Street from 4th Street to 8th
Street; what the water supply was; and the need to check for
water and hydrant flow.

Mayor Meza - Model Rocketry - Mayor Meza stated that he had
received a letter rom Richard Bishop regarding a rocketry
meeting. There was a brief discussion regarding the insurance
that the group had, but the fact that it was not a school
curriculum. The Fire Marshal's office will report back regarding
a controlled meeting.
City Administrator - Property Closing - The Administrator
stated that the property closing for the 22.65 acres of park
• land would be Friday at 12:00 noon. He asked that the Commission
members that could, be present for picture taking, reminding them
that the land was sold to the City substantially less than market
value.
Commissioner Cline - informed the Commission of attending a meeting
which was not City Business, but had attended a meeting in Austin
with Mr. Cline, who was sent by the Commissioners Court regarding
fire works in unincorporated areas in Harris County. Harris County
would like to be able to control the sale of fire works in unin-
corporated areas in some way. Commissioner Cline suggested that
all cities in Harris County should support this. As vice-president
of Region 14 of TML, she felt that it would be a project that
might be a worthwhile project for presentation by the Directors of
TML. She further stated that when they got out of their meeting,
they were told .that this bill would be dead as soon as it reached
the Senate because of the money behind it. Since Harris County
has no inforcement to prevent the sale of fire works in unin-
corporated areas, it makes it doubly hard on cities.
There was a brief discussion regarding problems involved with
fire works.
Mayor Meza stated that he had talked with the area mayors
regarding cooperation and support to give to the County when
• they are trying to get things done.

11. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 -
(E), (F), AND (G) - (LEGAL, LAND ACQUISITION AND PERSONNEL) -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Tomerlin that the meeting recess for an executive session. Motion
carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
The business was concluded at 7:12 P.M.
MR. RUFUS SMITH - asked to be recognized by the Commission.
Mr. Smith informed the Commission that he was running for
position No. 7 on the School Board and asked for the City's
endorsement if possible.
The meeting recessed at 7:18 P.M.
The meeting reconvened at 10:59 P.M.

12. ADJOURNMENT - Motion by Commissioner Kibodeaux, seconded by
Commissioner Tomerlin that the meeting adjourn. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
The meeting adjourned at 11:00 P.M.

BUSCH, HUTCFIISON & ASSOCIATES, IfdC. SECTION VI, PARAGRAPH D (1)
Compensation for engineering services set forth in the referenced document is
listed at specific hourly rates for various types of work. No provision is
made for increasing these rates to cover increased salaries paid to employees
and increased salary costs such as FICA, Health and Workman's Compensation Insur-
ance and State and Federal Unemployment Taxes. There have also been dramatic
increases in the cost of surveying equipment and maintenance, and automobile
operation and maintenance.
In analyzing our salary cost we find that the rates provided for in the
contract are actually less than a breakeven amount. Our efforts to hire and
keep good employees in surveying have resulted in increased salaries by 30%-
40~ since the inception of the contract. The surveying rates are the only
area of concern since the other set rates still adequately cover salary costs
and provide for overhead and profit.
We respectfully request your consideration of an amendment to the contract to
show the following change in field party hourly rates:

SUBJECT: Pool Filters
B ~ B Pools of Baytown, have finished their inspection.
The filter walls are in good condition. The splash plate
is rusted out and needs to be replaced. Also the laterals
are plugged up and need to be removed and cleaned. It is
their opinion that if this is done and the tanks are
replaced with gravel and sand, they should be good for another
•
ten years.
I would like to advertise for bids to rework-pool
filters. This is a budgeted item, and because fo the time
required in doing this job, bids are needed as soon as
possible.

FEBRUARY 12, 1979
As you are aware, the City has an ordinance which designates the
wet area~for on premise consumption. A request has been received
from Mr. Albert L. Craft for a beer on premise license for Daddy
Craft's Bar-B-Que, 308 West Main Street. At the present time, this
location is a dry area. If the Commission wishes to allow beer to
be sold at this location, an ordinance designating this location as
a wet area will be necessary.

CONSUMPTION OFF PREPIISES SHALL NOT BE AFFECTED; DEFINING SOURCE
OF AUTHORITY; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT NO
LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN DESIGNATED;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of La Porte desires to regulate the closing
hours for the sale of beer by retailers selling beer for consump-
tion on premises in accord with provisions of Article 667-10-1/2
of the Penal Code of the State of Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COP9MISSION OF THE
CITY OF LA PORTE:
Section 1. In addition to the locations specified in
Section 1 of Ordinance No. 1000, passed and approved by the City
Commission of the City of La Porte on August 19, 1974, the sale
of beer shall also be permitted during the hours set by the
general laws of the State of Texas at the following location by
a retailer selling beer for consumption on premises, to-wit:
The East Eight Feet (E.8') of Lot Nineteen (19),
all of Lot Twenty (20), Block Fifty-eight (58),
TOWN OF LA PORTE, Harris County, Texas, located
at 308 West Main Street, known as "Daddy Craft's
Bar-B-Que."
Section 2. Except and to the extent amended hereby,
Ordinance No. 1000 shall remain in full force and effect.
Section 3. This Ordinance shall take effect and be in force
from and after its passage and approval.
