3. ADMINISTER OATH OF OFFICE TO NEWLY ELECTED OFFICIAL - The
oath of .office was administered to John TomerliTn, newly
elected Commissioner, Position No. 1, by Mayor Meza.

Commissioner Tomerlin introduced his wife, Jean, then expressed
appreciation to those supporting him and for the confidence shown
in him. He further stated his concern that he had run unopposed
and there was not more interest in that position; and would
continue to work for the next two years.

4. APPROVAL OF MINUTES - REGULAR MEETING - APRIL 4, 1979, AND
SPECIAL MEETING - APRIL 11, 1979 - Motion by Commissioner
Cline, seconded by Commissioner Simons to approve the minutes
of the regular meeting of April 4, 1979 and the special meeting
of April 11, 1979, as presented. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Cline, and Simons.
NAYS: None.

5. ACCEPT BIDS - REPAIRS- TO MUNICIPAL SWIMMING POOL - The following
bid was opened and read aloud:

Baytown, Texas 77521 $15,997.50
There tntas a brief discussion regarding the bid for the repairs
to the swimming pool. Estimates had been from $9,000.00 to
$16,000.00 for the needed repairs, but no money had been budgeted.
Motion by Commissioner Tomerlin, seconded by Commissioner Simons
to accept the bid from H. B. Hamilton in the amount of $15,997.50
provided that the bid meet all specifications and said amount be
allocated from the General Fund Contingency. Motion carried by
the following vote:

6. ACCEPT BIDS - PURCHASE OF ONE MOSQUITO FOGGER - The following
bids were opened and read aloud:

Tomerlin that the bids be accepted for tabulation and recom-
mendation. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Cline, and Simons.

• 7. CONSIDER APPROPRIATING FUNDS IN THE AMOUNT OF $10,086.61
TO PAY DELINQUENT TAX ON PARK LAND (22.652 ACRES 'BAY POINTE')
TO BE P,PPROPRIATED FROM THE REVS UE SHARING FUNDS - Motion by
Commissioner Tomerlin, seconded by Commissioner Cline to appro-
priate $10,086.61 from the Revenue Sharing Funds to pay delinquent
tax on the park land (22.652 acres at Bay Point). Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Cline, and Simons.
NAYS: None.

8. CONSIDER OFFER TO PURCHASE LOTS 13 THROUGH 16,-BIACK 69, TOWN
OF'LA PORTE,'AND'LOTS''2'1'AND 22, BLOCK 38`, BAY FRONT ADDITION -
FRED WESTERGREN - Motion by Commissioner Simons, seconded by
Commissioner Tomerlin to accept the offer of purchase from
Mr. Fred Westergren for the following tax acquired properties:
Lots 13 through 16, Block 69, La Porte - $6,330.40
Lots 21 and 22, Block 38, Bay Front - $1,336.24
Total amount $7,666.64
Motion carried by the following vote:
• AYES: Commissioners Tomerlin, Cline, and Simons.
NAYS: None.
Copies of the offers are attached and made a part of these
minutes.

9. DISCUSS TAXI CAB RATES AND CONSIDER APPROVING PROPOSED ORDINANCE
NO. 1151 - ORDINANCE`APPROVING RATES FOR LA PORTE fiAXI COMPANY -
The Administrator read t e rates that had een agreed upon or
requested by the La Porte Taxi Company. After a brief discussion,
Oak Park was deleted from the list because it is in La Porte city
limits.
After the proposed ordinance was read in full, motion by Commissioner
Cline, seconded by Commissioner Tomerlin to approve Ordinance No.
1151 as read. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE PRESCRIBING RATES FOR LA PORTE TAXI
COMPANY; CONTAINING A SAVINGS CLAUSE AND A REPEALING CLAUSE;
PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE
SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION
SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS
($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE
OFFENSE; AND PROVIDING AN EFFECTIVE DATE HEREOF.

10. CONSIDER APPROVING PROPOSED ORDINANCE NO.~11S2 - ORDINANCE
APPOINTING MAYOR PRO-TEM - After a brief discussion regarding
the appointment of the Mayor Pro-Tem for either a six-month
or one year term, motion by Commissioner Cline, seconded by
Commissioner Tomerlin that action on this proposed ordinance
be postponed for a full Commission. Motion carried by the fol-
lowing vote:
AYES: Commissioners Tomerlin, Cline, and Simons.
NAYS: None.

11. ADMINISTRATIVE REPORTS - The City Administrator stated that
the bids for weed mowing would be accepted and brought before
the Commission on May 16, 1979, at 7:00 P.M.
The City Administrator appraised the Commission of a situation
involving an application for closing the alley in Block 13,
Bay Front, of Mr. Bryan Bertram, and the fact that since it
was not officially closed, a sanitary sewer line had been run
through the alley because of a utility extension agreement with
Mr. Pilkinton. This decision was based on two alternatives.
Going through the alley would save the Pilkintons approximately
$2,000.00. A copy of the Administrator's memorandum is attached
and made a part of these minutes.
After some discussion, the item was directed to be placed on the
next work shop agenda.

12. COUNCIL ACTION - Commissioner Tomerlin requested an executive

for Apri 25, 1979, beginning at 6:00 P.M, to discuss personnel.

Commissioner Simons that the meeting be adjourned. Motion
carried by the following vote:

The 22.652 acre tract of land that the city purchased for a
park from Texas Commerce Bank has delinquent taxes owed on it.
The contract called for the City of La Porte to pay all delinquent
taxes on the property.

A SAVINGS CLAUSE AND A REPEALING CLAtTSE; PROVIDING THAT ANY PERSON
VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEE^'IED GUILTY OF A
MISDED9EANOR AND iJPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE
THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL
BE DEEMED A SEPARATE OFFENSE.; AND PROVIDING AN EFFECTIVE DATE HEREOF.
