APPROVAL OF MINUTES - REGULAR MEETING - APRIL 18, 1979 AND SPECIAL MEETING - APRIL 25, 1979 - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the minutes of the regular meeting of April 18, 1979, and the special meeting of April 25, 1979, as presented. Motion carried by the following vote: 2 AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 4. CANVASS RESULTS OF RUN-OFF ELECTION OF APRIL 28, 1979, AND CONSIDER APPROVING PROPOSED ORDINANCE NO. 1152 - ORDINANCE DECLARING RESULTS OF RUN-OFF ELECTION - The Commission canvas- sed the results of the Run-Off Election. After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve Ordinance No. 1152 as read. Motion carried by the • following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE DECLARING THE RESULTS OF THE RUN--OFF ELECTION HELD IN THE CITY OF LA PORTE ON APRIL 28, 1979, FOR THE ELECTION OF A CITY COMMISSIONER, POSITION NO. 3. + + + 5. CONSIDER AUTHORIZING ACCEPTANCE OF TEXAS AERONP,UTICS COMMISSION GRANT AND APPROPRIATION OF $5,500.00 FRONT THE GENERAL FUND CONTINGENCY 'TO' FUND CITY' S SHARE- FOR N4N-DPI-REC'TIONAL BEACON- The City Administrator stated that the City had been awarded a grant for the construction and installation of a non- directional beacon for the airport; it would be located on the recently acquired property east of Bay Pointe Townhomes; that it would have to be fenced and recommended that the Commission authorize acceptance of the grant and appropriate $5,500.00 from the General Fund Contingency to fund the City share of the project. • • Regular Meeting 4/30/79 3 5. CONSIDER AUTHORIZING ACCEPTANCE OF TEXAS AERONAUTICS COMMISSION GRANT AND APPROPRIATION OF $5,500.00 FROM THE GENERAL FUND CONTINGENCY TO FUND CITY'S SHARE FOR NON-DIRECTIONAL BEACON- CONTINUED - Motion by Commissioner Simons, seconded by Commissioner Cline to authorize acceptance of the Texas Aeronautics Commission Grant and appropriate $5,500.00 from the General Fund Contingency to fund the City's share for the non- directional beacon. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 6. RATIFY AUTHORIZING LETTERS TO BE SENT TO THREE MASTER ELECTRICIANS - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to ratify authorizing letters to be sent to three master electricians: Mr. Joseph W. Logue, Thomas R. Walters, and • Mr. Thomas E. Lewis. Copies of letters informing these masters they are not in compliance with Ordinance No. 664-H, are attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 7. RATIFY APPROVAL OF MINUTE ORDER NO. 75527 - STATE DEPARTMENT OF HIGHWAYS' & PUBLIC TRANSPORTTATION - 'APPROVAT, OF RESOLUTION NO. 79-4 - Commissioner Cline wanted to varify that the City of La Porte would have no financial obligation if the minute order was approved. The City Administrator stated that the Minute Order related to the improvement of Bay Area Boulevard between Fairmont Parkway and Choate Road. He further stated that he had talked with Nancy Gehman of Commissioner Bass's office and she had advised him that Harris County would pay 100 percent of the required matching cost to the state for this improvement. Copies of the administrators recommendation and the minute order are • attached and made a part of these minutes. • • Regular Meeting 4/30/79 4 7. RATIFY APPROVAL OF MINUTE ORDER NO. 75527 - STATE DEPARTMENT OF HIGHWAYS & PUBLIC TRANSPORTATION - APPROVAL OF RESOLUTION N0. 79-4 CONTINUED - Motion by Commissioner Cline, seconded by Commissioner Simons to ratify approval of Minute Order No. 75527 - State Department of Highways & Public Transportation and approving Resolution No. 79-4 approving same, with the understanding that Harris County will pay all costs. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 8. RATIFY AWARDING BID FOR ONE MOSQUITO FOGGER TO HOLIMAN EQUIPMENT COMPANY IN THE AMOUNT OF $3,750.00 - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to ratify awarding the bid for one mosquito fogger to Holiman Equipment Company in the amount of $3,750.00, noting Holiman was not the lowest bid, but • the only bidder meeting the specifications. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 9. CONSIDER APPROVING PROPOSED ORDINANCE NO. 915-N - ORDINANCE GRANTING PIPELINE PERMIT OWNED AND OPERATED BY SOUTH TEXAS PIPELINE COMPANY - Motion by Commissioner Tomerlin, seconded by Commissioner Cline to approve Ordinance No. 915-N, after it had been read in full. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE N0. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS; AND APPROVING THE APPLICATION OF SOUTH TEXAS PIPELINE COMPANY, DATED MARCH 14, 1979, TO CONSTRUCT AN EIGHT-INCH ETHYLENE PIPE- LINE AND A SIX-INCH PROPYLENE PIPELINE; AND PROVIDING AN • EFFECTIVE DATE HEREOF. + + + Regular Meeting 4/30/79 5 10. CONSIDER AWARDING BIDS - UTILITY EXTENSIONS - WATER LINE ON FAIRMONT PARKWAY, SANITARY SEWER ON SOUTH 16TH STREET TO SERVE P.P.G. INDUSTRIES, SANITARY SEWER TO SERVE M. D. ROSE BETWEEN OAK GROVE & SEABREEZE - The Administrator read the recommendation from Busch, Hutchison & Associates recommending that the bid bet awarded to the low bidder, McKey Construction and Equipment in the amount of $50,719.00. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to award the bid for utility extensions to the low bidder, McKey Construction and Equipment in the amount of $50,719.00 subject to each party putting their share of the money in escrow. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1153 - ORDINANCE APPOINTING MAYOR PRO-TEM - After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Simons to read the ordinance appointing the Mayor Pro-Tem for six months, Positions 1 and 3. The Ordinance was read in full. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve Ordinance No. 1153 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: Commissioner Cline, stating she felt there was merit for one-year terms. CAPTION: AN ORDINANCE APPOINTING THE CITY COMMISSIONERS TO TERMS AS MAYOR PRO-TEM OF THE CITY OF LA PORTE, FOR THE PERIOD MAY 1, 1979, THROUGH APRIL 30, 1980, BOTH INCLUSIVE; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • • i f Regular Meeting 4/30/79 6 • 12. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1154 - ORDINANCE APPOINTING PLANNING & ZONING COMMISSION - Commissioner Simons state that he elt the Plann nin g & Zoning Commission had done an excellent job and should all be reappointed. Motion by Commissioner Simons, seconded by Commissioner Cline to approve Ordinance No. 1154 as read. Motion carried as follows: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE APPOINTING THE MEMBERS OF THE CITY OF LA PORTE PLANNING & ZONING COMMISSION, AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 13. CONSIDER INCREASE IN CITY ADMINISTRATOR'S SALARY - Commissioner • Tomerlin stated that following the review, after completion of one years service, moved that the City Administrator's salary be increased by $2,500.00 per year. Motion seconded. by Commis- sioner Cline. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 14. ADMINISTRATIVE REPORTS - The Administrator requested an executive session to discuss legal and contractural matters. + + + • 15. COUNCIL ACTION - Commissioner Cline stated that she was happy to have won her reelection. She stated that she felt the entire Commission had worked together and. had been able to accomplish a number of things. She further pointed out that there was not one single person that could take the responsibility for getting any one thing done. COUNCIL ACTION (CONTINUED) Mayor Meza reminded the Commission that The Administrator, David Fetzer, Commissioner Simons and himself were going to New York for the bond rating on Tuesday and would be returning late Thursday. + + + 16. Hudgens SUBJECT: Grant for Non-Directional Beacon from the Texas Aeronautics Commission (T.A.C.) The City has been awarded a grant for the construction and installation of a non-directional beacon for our airport. Covenants of the grant require: 1. City to provide site for installation. 2. City will pay fifty (50) percent of the cost of the project. 3. City will maintain control. of the air navigational facility for at least twenty (20) years. 4. City has the ability to finance and operate the air • navigational facility. In conversations with the T.A.C. and the F.A.A. we have determined to locate the beacon on the recently acquired property east of Bay Pointe Townhomes. The City will be required upon acceptance of this grant and its installation, to fence the bea- con with a man-proof fence and contract with a Class A radio operator for maintenance of the facility. The T.A.C. share of the project is estimated to be $4,546.50, with the City share to be a like amount plus fencing and legal fees for our attorney's title opinion. Public Works SUBJECT: Equipment Bid Recommendation The bids received on the mosquito fogger at the April 18, 1979 council meeting were follows: Holiman Equipment Public Health Equip, & Supply $3,750,00 $3,000.00 After evaluating the bids, I recommend that the bid of Holiman Equipment in the amount of $3,750.00 be accepted. The City specifications call for a 16 horsepower motor which the Holiman has and the machine from Public Health does not. Specs also call for a pump, C V carbon gears, stainless steel which Holiman has, London Aire has not.
