Meza; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and Tom C. Simons. MEMBERS OF-THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: J. R. Hudgens, City Administrator; Margie Goyen, City Clerk; Robert Hall, Assistant Chief of Police; Joe Sease, Fire Chief; Stan Sherwood, Director of Parks & Recreation; Paul Hickenbottom, Fire Inspector. • -OTHER CITY OFFICIALS ABSENT: Knox Askins, City Attorney; H. APPROVAL OF MINUTES - REGULAR MEET'IN'G - APRIL 30, 1979 - SPECIAL MEETING - MAY 9, 1979 - Motion by Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the regular meeting of April 30, 1979, and the special meeting of May 9, 1979, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 4. ACCEPT BIDS - MOWING PRIVATE PROPERTY - The following bids were opened and read aloud: W. L. BROWN 915 Hackberry La Porte, Texas 77571 $3.95 per lot FRED MC DOUGAL 608 E. Main • La Porte, Texas 77571 $5.00 per lot There was a brief discussion regarding the previous performance of W. L. Brown, as contract mower. It was determined that the only problem being experienced was an administrative problem and not performance. Motion by Commissioner Cline, seconded by Commissioner Kibodeaux since were are in the mowing season and due to the past performance to award to the bid for mowing private property to W. L. Brown in the amount of $3.95 per lot. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 5. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE RECEIVED ON JUNE 6, 1979, AT 7:OD P.M., FOR ONE WET TYPE BORING MACHINE - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to ratify authorizing advertising and accepting bids to be received on June 6, 1979, at 7:00 P.M., for one wet type boring machine. Motion carried by the following vote. • AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • Regular Meeting 5/16/79 3 6. CONSIDER APPROVING BOND FOR COMPLETION OF GLEN MEADOWS, SECTION II - Motion by Commissioner Tomerlin, seconded by Commissioner Cline to approve a bond in the amount of $240,697.00 which sum is to be applied toward the installation and/or com- pletion of Glen Meadows, Section Two, paving, drainage, and utilities in .accordance with specifications, rules and regulations. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • 7. .CONSIDER APPROVING PROPOSED ORDINANCE NO. 1155 - ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 690, TOWN OF LA PORTE, (DOUGLAS F. LATIMER, JR.) - After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1155 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK SIX HUNDRED NINETY (690), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. + + + 8. CONSIDER APPROVING PROPOSED RESOLUTION NO. 79-5 - RESOLUTION SUPPORTING COUNTY AND PORT BOND ISSUE - The City Commission wished to go on record in support of the bond issue for Harris County. After. the proposed resolution was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve Resolution No. 79-5 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • CAPTION: RESOLUTION ENDORSING ALL PROPOSITIONS FOR HARRIS COUNTY CAPITAL IMPROVEMENTS LISTED ON MAY 22, 1979, BALLOT. u + + + • Regular Meeting 5/16/79 4 9. ADMINISTRATIVE REPORTS - A. The Administrator stated that we had closed the acquisition of the Public Works Property this morning; he will call Busch, Hutchison to start preparing plans and specifications for extension of utilities and staking the street right-of-way. B. He called Dallas and spoke. to Terry Turner regarding the E.P.A.. Grant; stating that all problems have been corrected and we should hear something in the next week or ten days. C. He talked with Dr. Virgil Stover of Texas A & M regarding the work being done on the Zoning and Subdivision Ordinances. Dr. Stover will be in town and would like a joint meeting with the Commission and Planning & Zoning Commission, to make a report on their progress and ask for guidance from the Commission. The meeting was set for May 30, 1979, beginning at 5:00 P.M. + + + 10. COUNCIL ACTION - Commissioner Simons stated that there were • two pieces of property in this town that had been an eye-sore for years. The owner has been brought before Court and just pays his fine, and the property is still an eye-sore. He further stated that he had had six different people contact him regarding these properties. He had pictures taken of the properties, and passed them around. The two locations are 501 W. Tyler and 301 N. 6th, belonging to Dolphus Merritt. The Commission was of the opinion that these properties were health hazards, fire hazards, and other hazards. There was some discussion about the possibility of condemning the property. The Administrator was of the opinion that we could not condemn the property. It was determined that the Council asked that the ordinance be inforced. The individual had been brought to court, paid his fine, and then let go. The ordinance states that each day is a separate offense, but it is not enforced. The violations still continue. The Commission wants the mess cleaned up. Commissioner Cline requested an executive session. Commissioner Tomerlin asked about the conditions of our officer injured during the recent train car accident. It was determined that La Porte Officer Jack. Maxwell was home; Lomax officer Jackie Williams was also at home; both released from the hospital and doing much better. • + + + • Regular Meeting 5/16/79 5 11. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:25 P.M. The meeting reconvened at 7:38 P.M. + + + 12. The East orie-half (E.l/2) of the Block, Lots 17 through 32, is owned by Mr. Ronnie 5t. Clair. We would like to request the City of La Porte to close the alley in this block. • I enclose my check for $100.00 payable to the City of La Porte, for application fee, and I enclose a xerox copy of my Deed and Title Policy. I am requesting Mr. St. Clair to also furnish a copy of his Deed and Title Policy, and Mr. St. Clair and I have entered into an agreement, by which he has agreed that I may have all of the sixteen feet (16') of the alley if it is closed. He does not care to have any of the alley, and is willing to waive all rights. I will pay all expenses for the closing of the alley. I have a lien on the property to Bayshore National Bank of La Porte, and they have signed this letter to indicate their agreement to the alley being closed. Important because every area of Harris County needs better roads, improved flood control, more parks, and recreational and public service facilities. WHEREAS, the massive population growth of Harris County has placed a substantial strain on County roads, flood control, parks and public service facilities; and WHEREAS, Harris County Commissioners Court has called a Capital Improvements bond election to be held May 22, 1979; and WHEREAS, the road and bridge, park, public service facility, flood control and Port of Houston bonds are vital to the con- tinued prosperity of all Harris County residents whether they reside in unincorporated areas or within municipalities; and WHEREAS, civic leaders, community groups and concerned citizens have been and will continue to be involved in the planning and completion of all County bond improvements; and WHEREAS, voter approval of all of the County bond proposi- tions will not require an increase in the present County tax • rate.
