979 - Motion by Commissioner Cline, seconded by Commissioner
Tomerlin to approve. the minutes of the Regular Meeting of
May 16, 1979, the Special Meeting of May 23, 1979, and the
Special Meeting of May 30, 1979, as presented. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

5. CONSIDER OFFER TO PURCHASE TAX PROPERTY - BLOCK 72, LOTS 12,
AND 13, BAY FRONT ADDITION -' FRED WESfiERGREN, IN THE AMOUNT
OF $1,156.00 - There was a brief discussion: The City's
tax, P & I would be $1,006.21; Harris County's tax, P & I
would be $149.69; the School was not a party to the suit.
The Tax Assessor-Collector's recommendation for acceptance
of this offer, in the amount of $1,156.00, is attached and
made a part of these minutes.
Motion by Commissioner Tomerlin, seconded by Commissioner
Kibodeaux to accept the recommendation of the Tax Assessor-
Collector and approve the offer of purchase for tax property,
Block 72, Lots 12 and 13, Bay Front Addition, by Fred Westergren
in the amount of $1,156.00. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

• 6. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1156 - ORDINANCE
VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 350,
TOWN OF LA PORTE - JOHN COURVILLE - It was determined that
all the necessary paper work had been completed for the closing
of the alley in Block 350. The check in the amount of $4,080.00
for the easement value had been received.
After the proposed ordinance was read in full, motion by Com-
missioner Cline, seconded by Commissioner Simons to approve
Ordinance No. 1156 as read.. Motion carried by the following
vote:
AYES: Commissioners Tomerlin,. Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF
THE ALLEY IN BLOCK THREE HUNDRED FIFTY (350), IN THE TOWN OF

7. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1157 - ORDINANCE
VACATING, ABANDONING AND CLOSING A PORTION OF THE ALLEY IN
BLOCK 185, TOWN OF LA FORTE - H. BARYON HILL - It was
determined that all the necessary paper work had been
completed; the check in-the amount of $1,630.20 for the
easement value had been received.
After the proposed. ordinance was read in full, motion by
Commissioner Kibodeaux, seconded by Commissioner Tomerlin
to approve Ordinance No. 1157 as read. Motion carried by
the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING A
PORTION OF THE ALLEY IN BLOCK ONE HUNDRED EIGHTY-FIVE (185),
IN THE TOWN OF LA FORTE, HARRIS COUNTY, TEXAS. (Situated
between Lots Six to Thirteen, inclusive on the west side,
and Lots Fourteen to Twenty-One, inclusive, on the east side.

8. CONSIDER APPROVING PROPOSED ORDINANCE N0. 115$ - ORDINANCE
VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 13, BAY
FRONT ADDITION - BRYAN BERTRAM - It was determined that all
the paper work had been completed, but the check for the
easement value in the amount of $813.23 had not been received.
Motion by Commissioner Tomerlin, seconded by Commissioner
Cline that this item be tabled. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

9. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS ON BOND
PROJECTS TO BE RECEIVED AT 7:00 P.M., ON JUNE 27:, 1979 -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to ratify authorizing advertising and accepting bids
• for a 16" Water Main on Spencer Highway from Water Well No. 5
to Valley Brook Drive. Motion carried by the following vote:

NAYS: None.
Commissioner Cline was of the opinion that more water projects
were going to be advertised for bidding. It was determined
that additional easements were needed for the 16" Water Main
on New Highway 146 and 12" Water Main on McCabe Road Extensions;
therefore, they would be bid at a later date.

10. CONSIDER AUTHORIZING ACCEPTING CONTRACT BY SOUTHERN AVIONICS,
OF BEAUMONT, TEXAS, FOR INSTALLATION OF A LOW F'RE'QUENCY NON-
- DIRECTIONAL RADIO BEACON (TEXAS AERONAUTICS COMMISSION) -
Motion by Commissioner Simons, seconded by Commissioner Cline
to authorize accepting the contract by Southern Avionics of
• Beaumont, Texas, for the installation of a low frequency non-
directional badio beacon with the Texas Aeronautics Commission.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
A copy of the contract is attached and made a part of these
minutes.

11. ADMINISTRP,TIVE REPORTS - The Administrator reported that he had
attended the Texas City Manager's Conference in Corpus Christi
Friday, Saturday, Sunday, Monday, and Tuesday, June 1 thru
June 5, 1979; The Managers' Development Seminar was Friday and
Saturday; the General Conference for Texas City Managers was
Sunday through Tuesday. Municipal Problems across the state
were discussed; felt it was most beneficial to the City.
The Administrator requested an executive session to discuss
personnel matters.

11. ADMINISTRATIVE REPORTS - (CONTINUED)
There was a brief discussion regarding the Harris County
.Community Development Grant; engineering work has been begun
for the street work for the $200,000.00 grant; proposed projects
for future grants were recommended by Harris County Community
Development as follows: Covered Patio over North Side Basket-
ball Court; Renovate South Side Civic Center; H.U.D. Rehabilitation
Grants for home improvement might be administered in La Porte;
handling and monitoring loans, Harris County will administer
paper work; our Inspection Department will do inspections for
repairs. H.U.D. Office out of Dallas will make determinations
regarding the loans.
First Annual City Picnic - The Administrator reminded the
Commission of the first Annual City Picnic to be held on
June 16, 1979, at Port Haven Marina. Games will include Bingo,
Penny Find, Sack Race, Vollyball and Dunking Booth. The
picnic will be hosted by the Department Heads. He invited
the Commission to drop by. The first activities will begin
at 11:00 A.M. and last until 5:00 or 6:00 P.M. A dance with
live music will begin at 8:00 P.M. at the Firemen's Hall.

12. COUNCIL ACTION - A. Commissioner Tomerlin stated that he would
be in town while the other officials would be gone to the seminar
in San Angelo.
B. Commissioner Cline stated that S. McKey was requesting
payment for his street work for the Boothe Homes Streets. The
street work was satisfactory, but she had some questions regarding
the ditches. Mr. McKey felt the ditches were Boothe's responsibility
for cleaning.
The Administrator stated that the ditch cleaning would be resolved
before payment was made to McKey Equipment & Construction.
C. Mayor Meza informed the Commission that we had received
one signed Industrial Agreement from Big Three.
D. The Attorney asked if everyone had received their copy
of the Peveto Bill. There was a brief discussion regarding
the Peveto Bill. The Administrator stated that there were
few comments on it at the City Managers' Seminar because of
so many rural cities. Mayor Meza felt it passed because so
many smaller cities rely on the County already.

14. ACCEPT BIDS FOR $1,400,000.00 GENERAL OBLIGATION BONDS,
SERIES 1979 - Mayor Meza asked if there was anyone wishing
to submit additional bids on the bond sale. There was no
one else. At 7:30 P.M., Mayor Meza declared the bidding closed.
David Fetzer, fiscal agent, was recognized to open the bids.
Mr. Fetzer stated that all bids would be on the standard bid
form and he would read only the pertinent numbers. The following
bids were opened and read aloud:

Representatives of Moroney Beissner began to verify the bids.
Mr. Fetzer stated that the bid of First City National Bank of
Houston in the amount of 5.339189 interest was correct and the
best bid. He stated that in his opinion, it was an outstanding
bid and recommended the acceptance.
Motion by Commissioner Kibodeaux, seconded by Commissioner Simons
to accept the recommendation of Mr. Fetzer and award the bid for
the sale of $1,400,000.00 General Obligation Bonds, Series 1979,
• to the low bidder, First City National Bank of Houston, at the
interest rate of 5.339189$, for a NIC in the amount of $691,425.00.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, Simons, and
Mayor Meza.
NAYS: None.
There was a brief discussion regarding the excellent response;
the improved rating, Moody's "A" and S & P's "A+"; and Baytown's
bonds selling for 5.43.
Moroney Beissner will send letters of appreciation to all the
bidders on the behalf of the City.
The Commission expressed appreciation to Moroney Beissner representatives,
and Mr. Dick Richards of Baker & Botts for their hard work.

15. CONSIDER. APPROVING PROPOSED ORDINANCE NO. 1158 - ORDINANCE
AUTHORIZING THE ISSUANCE AND SALE OF $1,400,000.00 GENERAL
OBLIGATION BONDS, SERIES 1979 - After the. proposed ordinance
was read, motion by Commissioner Kibodeaux, seconded by
Commissioner Simons to approve Ordinance No. 1158 after
correcting page 5, last word of first paragraph, change
Council to "Commission". Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, Simons, and
Mayor Meza.
NAYS: None.
CAPTION: ORDINANCE AUTHORIZING THE ISSUANCE, SALE AND
DELIVERY OF THE CITY'S $1,400,000 GENERAL OBLIGATION BONDS,
SERIES 1979, PROVIDING THE DETAILS RELATING THERETO AND
DECLARING THAT SAID ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY
UPON ITS ADOPTION.

16. DISCUSS PARK FOR GLEN MEADOWS AND ACCESS TO SAME - Mr. Ted
Bogren was recognized and presented a letter to the Commission
from the Mischer Corporation assuring the Commission that they
intend to pave, with a standard curb and gutter section, the
entire length of Farrington Drive to the boundary of the park
property. But, due to both engineering and economic factors,
this construction must be phased and is to be completed at the
time that Section 4 is constructed. They plan to construct a
gravel road from the north limit of Section 2 to the south
limit of the proposed park. At the time that Section 4 is
developed, the street will be completed with curb and gutter.
There was a general discussion regarding the park, access and
egress to same; whether there should be a major thoroughfare
by the park, etc.
After a brief discussion, motion by Commission Cline, seconded
by Commissioner Tomerlin to accept the recommendation of the
Inspector, Mr. Ben Talburt, and accept the first three streets
of Glen Meadows, Section II. A brief discussion ensued.
Motion by Commissioner Cline, seconded by Commissioner Tomerlin
to amend their motion to accept the underground utilities,
• storm drainage, sanitary sewer, and water, as well as the streets
for the first three streets of Glen Meadows, Section II.

SUBJECT: Bid on Tax Sale Property
Attached to this memo is a bid from Fred Westergren, Jr., for
tax sale property, specifically, Block 72, Lots 12, 13, Bay Front.
The bid is in the amount of $1,156.00. The plat map of the subject
property is attached.
The City of La Porte, took judgment on the above described
property on October 30, 1973. The property was offered for auction
on May 7, 1974, having no other bidders the City of La Porte bid the
property in, to hold in trust for the City of La Porte and Harris
County.
The La Porte Independent School District was not a party to
this suit. A special warranty deed cannot be issued until the
taxes due the school are paid.
The taxes, penalty and interest and costs due the City of
La Porte and Harris County figured for May, 1979, are $1,155.90.
My recommendation is that the bid from Fred Westergren, Jr.,
be accepted.

Gentlemen:
As you requested, I have appraised a strip of land 400' X 16',
being the alley in Block No. 350, City of LaPorte, Harris
County, Texas, from North "G" Street to Barbour's Cut Blvd.,
and is shown on the attached plat.
The purpose of this appraisal was to estimate the Fair Market
Value of said propserty.
In my opinion the highest and best use of Subject property is
for light industrial.
It is my opinion that the property appraised had a Fair Market
Value as of May 18, 1979 of:

16 ft. in Block No. 185 being the alley in said Block that
runs from the Northwest to Southeast, in the City of LaPorte,
Harris County, Texas and is shown on the attached plat.
The purpose of this appraisal was to estimate the Fair Market
Value of said property.
In my opinion the highest and best use of Subject property is
commerical.
it is my opinion that the property appraised had a Fair Market
Value as of May 18, 1979 of
3,344 s/f @ $0.65 s/f = $2,173.60 Fee Value

INVITATION TO BIDDERS
Sealed proposals addressed to the Mayor and City Commission of the City of
La Porte, Harris County, Texas, and marked:
16" WATER MAIN ON SPENCER HIGHWAY FROM WATER WELL N0. 5 TO VALLEY
BROOK DRIVE
in accordance with the Plans and Specifications prepared by Busch, Hutchison
and Associates, Incorporated, and adopted by the City of La Porte, will be
received at the office of the City Clerk, 604 l~Jest Fairmont Parkway, until
7:00 p.m., June 27, 1979 and then publicly opened and read aloud.
Any bid received after closing time will be returned unopened.
The. bidder shall be required to furnish a Bid Surety Bond with his proposal in
the amount of five percent (5%) of the greatest amount bid. The successful
Bidder shall be required to furnish Payment and Performance Bonds, each in
the faithful performance of this contract.
Plans, Specifications and bidding documents may be secured from the office of
Busch, Hutchison and Associates, Inc., 1107 Fleetwood Drive, Baytown, Texas,
upon deposit of $50.00. Deposits will be returned if Plans and Specifications
are returned in good condition within five days after bid opening.
The City reserves the right to reject any and/or all bids,
all formalities and to accept any bid which in the opinion
Commission is most advantageous to the City.

Attached is an executed contract by Southern Avionics, Beaumont,
Texas, for furnishing and installing a Low Frequency Nondirectional
Radio Beacon. Please present it to your governing body for acceptance
and return it to this office after affixing your signature and
attestment. We are withholding the Payment and Performance Bonds
furnished by Southern Avionics.
. After the contract is returned, we will reproduce it, furnishing a
copy to Southern Avionics and returning you the original, together
with the bonds and certificate of insurance coverage.

The CONTRACTOR hereby agrees to commence work within ten (10) days after the date
written notice to do so shall have been given to him, and to substantially complete the same
calendar days

Re: Access to Park in Glen Meadows Subdivision
Dear Mayor Meza:
• Ted Bogren of Municipal Engineering Co., has reported to me
that you have expressed concern about the completion of an access
road to the park property to be dedicated to the City of La Porte
as shown on the plat of Glen Meadows Subdivision, Section Two. The
purpose of this letter is to assure you and the City Council that
we intend to pave, with a standard curb and gutter section, the
entire length of this street (Farrington Drive) to the boundary
of the park property. But, due to both engineering and economic
factors, this construction must be phased and is to be completed
at the time that Section 4 is constructed.
Generally, the factors for consideration are this:
1) The entire subdivision drains from east to west.
a) To install the necessary drainage system,
would be economically unfeasible.
b) To have enlarged the drainage systems
within the boundaries of Sections 1 and
2 would have made lot costs in Sections
1 and 2 prohibitive.
2) Possible changes in the street pattern, from that
shown on the preliminary plat, that may be
reQuired in future planning would make turn-out
locations and therefore concrete curb and gutter
• paving impractical to place at this time.

We, therefore, plan to construct a crushed gravel road
from the north limit of Section 2 to the south limit of the
proposed park, as agreed upon between Jim Box and yourself
some time back. At the time that Section 4 is developed, the
street will be completed with the curb and gutter section.
