LA PORTE CITY COMMISSION, LA PORTE, TEXAS
JUNE 27, 1979

MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza;
Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and
Tom C. Simons.
MEMBERS OF THE COMMISSION ABSENT: None.
OTHER CITY OFFICIALS PRESENT: J. R. Hudgens, City Administrator;
Margie Goyen, City Clerk; Knox Askins, City Attorney; Joe Sease,
Fire Chief; Stan Sherwood, Parks & Recreation Director; Paul Hickenbottom,

1. CALL TO ORDER - Mayor Meza called the meeting to order.

2. CONSIDER ACCEPTANCE OF E. P. A. STEP II GRANT OFFER - The
Administrator stated that the E. P. A. Step II Grant Offer
in the amount of $208,800.00 for the preparation of construction
drawings and specifications - sewage treatment plant expansion
and collection system improvements had been received.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to accept the E.P.A. Step II Grant Offer in the amount
of $208,800.00. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

3. ADMINISTRATIVE REPORTS - None.

• 4. COUNCIL ACTION.- Commissioner Cline. informed the Commission of
a conference on Implementing Property Tax Reform and Related
Legislation (Peveto Bill): to be held in Austin on July 13, 1979,
from 9:00 A.M. to 5:00 P.M., at the L. B. J. Library; further
suggesting that as many as could go, should go. If there were
several of the officials going, suggested that they drive up.
Mayor Meza informed the Commission of a telephone call from
Mr. Don Carpenter of Southwestern Bell Telephone, informing him
of a state-wide rate increase. Written notification will be
delivered tomorrow.

Motion by Commissioner Tomerlin, seconded by Commissioner
Kibodeaux that the meeting recess for an executive session.
Motion carried by the following vote:

NAYS: None.
The meeting recessed at 6:50 P.M.
The meeting reconvened at 6:59 P.M.

6. ADJOURNMENT - Motion by Commissioner Simons, seconded by Commis-
sioner Cline that the meeting adjourn. Motion carried by the
following vote:

a. General Conditions:
The grantee covenants and agrees that it will expeditiously initiate and timely complete the project work for which
assistance has been awarded under this grant, in accordance with all applicable provisions of 40 CFR Chapter I, Subpart
B. Tlie grantee warrants, represents, and agrees that it, and its contractors, subcontractors, employees and representatives,
will comply with: (1) all applicable provisions of 40 CFR Chapter I, Subchapter B, INCLUDING BUT NOT LIMITED
TO the provisions of Appendix A to 40 CFR Part 30, and (?) any special conditions set forth in this grant agreement or
any grant amendment pursuant to 40 CFR 30.425.
b. Special Conditions:
1. Payment Schedul e
Payment may be requested for the Federal share of allowable costs
incurred. Payments should be submitted in accordance with the
following schedule.

2. The grantee agrees to submit to the Environmental Protection Agency
an approvable User Charge System and Industrial Cost Recovery System
as required by 40 CFR 35.935-13 and 35.935-15 of Federal Register,
Vol. 43, No. 188, dated September 27, 1978.
3. The grantee agrees to comply with the public participation program
regulations 40 CFR 25 and 40 CFR 35.917 as published in Federal Register,
Vol. 44, No. 34, Part V and Part VI, dated February 16, 1979, as they apply
to the adoption proceedings of the User Charge and the Industrial Cost
Recovery Systems.

NOTE: The Grant. Agreement must be completed in duplicate and the Original returned to the Grants Administration
Division for (leadqu:lrters grant awards and to the appropriate Grants Administration Office for state and local awards
within 3 calendar weeks after receipt or within any extension of time as may be granted by EPA.
Receipt of a written refusal or failure to return the properly executed document within the prescribed time, may result
in the automatic withdrawal of the grant offer by the Agency. Any change to the Grant Agreement by the grantee sub-
seyucnt to the document being signed by the EPA Grant Award Official which the Grant Award Official determines to
materially alter the Grant Agreement shall void the Grant Agreement.
