1. CALL TO ORDER - Mayor Meza called the meeting to order.

2. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1166 - ORDINANCE
APPROVING THE REVISIONS TO THE HOME RULE CHARTER OF THE CITY
OF LA PORTE AND AUTHORIZING THE CITY ATTORNEY TO SUBMIT THE
PORTIONS OF SUCH WHICH AFFECT VOTING, ALONG WITH SUPPORTING
DOCUMENTATION, TO THE UNITED STATES DEPARTMENT OF JUSTICE FOR
APPROVAL; AND PROVIDING AN EFFECTIVE DATE - Mr. H. P. Pfeiffer,
Chairman of the Charter Revision Committee was recognized and
addressed the Commission, stating that many hours had been spent
in revising .the Charter and felt that they had something good
to present to the people and making changes to meet the current
laws and recommended that the Commission approve the proposed
Charter and ordinance authorizing the City Attorney to submit
it to the Justice Department for approval. There would be
future meetings of the Charter Revision Committee to discuss
drawing of lines for districts. Further, in order to meet the
time tables, we need to proceed. If approved, the information
could be mailed to the Justice Department the next day.
Commissioner Cline apologized for not being able to attend the
Charter Revision Committee meeting held on Monday, due to illness.
However, had some problems with some of the language in the Charter.
Further stating that she felt the Justice Department was not
interested in housekeeping, but if sent, could some of the language
still be changed.
The City Attorney was of the opinion that the Justice Department
was interested in the form of government; the number of officials;
and felt we could change the language and probably have no problem
with the Justice Department.
The Voting Rights Act makes it necessary to get prior approval
from the Justice Department when any changes effecting voting are
made. We propose to have a seven member Council, four by district
and 3 at large with a three year term.
Commissioner Cline asked if we submit the proposed Charter to
the Justice Department and we vote in January, if voted down,
what would we do?
The Attorney stated that we would continue under the old Charter.
Commissioner Cline stated that she felt there was some mis-
information out.
The Attorney stated that the proposed Charter will allow for a
City Manager form of government; the bond sections were re-written.
The solution for the mis-information will be neighborhood meetings.

2. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1166- ORDINANCE

DOCUMENTATION, TO THE UNITED STATES DEPARTMENT OF JUSTICE FOR
APPROVAL; AND PROVIDING AN EFFECTIVE DATE CONTINUED
The Attorney continued by saying that every voter must be notified
of the proposed change and a copy sent to each. We also are
checking with the Justice Department to see whether or not we
have to translate the Charter into Spanish; it will be published
in the paper.
Commissioner Cline stated she still had problem with the language.
The City Attorney stated that we have a tight time schedule
for a January election; the district lines will be submitted to
the Justice Department at a later date.

After-the proposed ordinance was read in full, motion by Commis-
sioner Cline, seconded by Commissioner Kibodeaux to approve
Ordinance No. 1166 as read with the notation that the language
can be discussed at future dates with the Charter Revision
Committee. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.
ABSENT: Commissioner Simons.

Mr. Pfeiffer stated that the Charter Revision Committee would be
more than. happy to meet and discuss any problems or questions
regarding the proposed Charter.

3. CONSIDER APPROVING UTILITIES AND FORMAL ACCEPTANCE OF GLEN
MEADOWS, SECTION II - The City Administrator read the recom-
mendation from the Inspection Department that all tests and
inspections had been made and passed and recommended that Glen
Meadows, Section II be accepted.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Tomerlin to approve the utilities and formal acceptance of
Glen Meadows, Section II be made. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

4. HEARING - DANGEROUS BUILDING - BLOCK 1, LOT 1, CRESCENT SHORES -
MATTHEW L. GRECO 1915 CRESCENT VIEW DRIVE - It was noted
that the Board of Inspection had presented a memo stating that
• a remodeling permit had been taken out for the building located
at 1915 Crescent View Drive, Block 1, Lot 1, Crescent Shores,
owned by Matthew L. Greco. A copy of the memo is attached and
made a part of these minutes.
Commissioner Tomerlin asked if we should continue on with the
proceeding to have the dangerous building demolished.
The Attorney stated that this was not a notification by publica-
tion, so we had not been out that expense.
The Fire Inspector, Paul Hickenbottom addressed the Commission
by stating that the remodeling permit-would be good for 120 days;
if good faith was shown by diligent work, then it could be extended,
if not, we would then proceed with the process for demolition.
Motion.. by Commissioner Tomerlin, seconded by Commissioner Kibodeaux
to table the hearing on the dangerous building, Block 1, Lot 1,
Crescent Shores, (1915 Crescent View Drive), Matthew L. Greco,
owner, with the understanding that a status report would be given
every thirty days. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline.
NAYS: None.

5. ADMINISTRATIVE REPORT - The Administrator informed the Commission
of notification of a grant in the amount of $45,000.00 (1979
Title V Grant). The grant was awarded in the amount of $45,000.00;
the City to match with $15,000.00. These grant funds are for
the aging; they .will be used to complete the Police Building,
improving the Nutrition Center. A copy of the letter of notifi-
cation is attached and made a part of these minutes.
The Administrator commended the Parks & Recreation Director,
Stan Sherwood for his efforts and a job well done.

6. COUNCIL ACTIONS - Commissioner Tomerlin expressed appreciation
to the entire Commission for handling his problems while he was
out of town.

ORDINANCE NO. /
AN ORDINANCE APPROVING THE REVISIONS TO THE HOME RULE CHARTER
OF THE CITY OF LA PORTE AND AUTHORIZING THE CITY ATTORNEY TO
SUBMIT THE PORTIONS OF SUCH WHICH AFFECT VOTING, ALONG WITH
SUPPORTING DOCUMENTATION, TO THE UNITED STATES DEPARTMENT OF
JUSTICE FOR APPROVAL; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the Charter Revision Committee has made its final
recommendation for revisions to the Home Rule Charter of the
City of La Porte and some of such revisions are changes affecting
voting in the City of La Porte;
WHEREAS, Section 5 of the Voting Rights Act of 1965 of the
•
United States, Public Law 89-110, requires submission of all pro-
posals for changes affecting voting prior to making such change;
and
WHEREAS, the passage of this ordinance constitutes final
action on the wording of such changes affecting voting prior to
the election concerning such changes; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The revisions to the Home Rule Charter of the

City of La Porte as submitted by the Charter Revision Committee
are hereby approved as submitted and the City Attorney is hereby
authorized to submit to the United States Department of Justice
all such revisions which will affect voting, along with support-
ing documentation requested by the Department of Justice.
Section 2. This Ordinance shall take effect and be in
force from and after its passage and approval.

SUBJECT : Glen Meadows, Section 11
On July 24, 1979, Jack Burks and R. L. Caldwell from Public Works.
David Paulisseri and myself from the Inspection Department, walked
through the remainder of Glen Meadows, Section 11.
- We found three areas on Crestway that the concrete ,needed repair,
they have all been taken care of.
All test and inspections on sanitary sewer were made and passed.
A11 test and inspection on the water system were made and passed.
All test on sub-street soil and reinforcement were made and passed.
' A11 test and inspections on concrete were made and passed.
It is the opinion of those who made the inspection that Glen Meadows,
Section 11, should be accepted.

Dear Sir : .
A complaint concerning the condition of the building(s) on the
above described property has been filed under City of La Porte Ordi-
~ance No. 1145, Section 8-120, Chapter IX, Code of Ordinances of the
City of La Porte.
Pursuant to a complaint filed by Karl Lyons
an investigation of the premises has been made as required by said
Ordinance, by the Board of Inspection of the City of La Porte. A copy
of the Board's report, as filed by the Board with the City Commission
of the City of La Porte, is attached to this letter and is a part of
this notice. .
As owner of the above described property, you are hereby ordered
by the City Con•.mission of the City of La Porte to be and appear. before
the City Conunission at a public hearing to be helc; at the City Com-
mission Chambers, City Hall, City of La Porte, G04 W. Fairmont Parkway,
La Porte, Texas, at 7:00 o'clock P. .M., on the 8th day of.
August 19 79, and as the same may from time. to time be ad-
journed, to appear and show cause why the building(s) should not be
declared a nuisance, condemned, and ordered repaired or torn down, as
more fully set forth in such notice attached hereto.
This public hearing process need not be carried out if you, the
property ownor, choose to follow one of two alternative courses of
acL-ion. One alternative is simply to have the structure demolished.

,y demolition shall be in accordance with City Ordinances. The
•aecond alternative is to negotiate with the Building Official a
repair progress schedule for your structure. In short, this sched-
ule will indicate the repairs that you need to make within a certain
time period (15 days) in order to begin to satisfy the Board of
Inspection of your good-faith effort to bring your structure up to
Code standards. In cases where structures are dilapidated, the
Board of Inspection will require extensive repair work within the
scheduled time period. Also, new schedules will be advised until
all your repair work is satisfactorily completed. If you do not
complete your scheduled repairs, the Board of Inspection will initi-
ate the public hearing process.
You should also take notice that, should the City of La Porte
have to demolish this building at City expense, a lien will be
filed against the subject property for the amount of the demolition
expenses, and suit to foreclose the lien against the property will
be filed.
The decision is yours. It needs to be stressed, though,, that
you have 10 days from the receipt of this notification to make your
decision. If the Board of Inspection does not receive your response
within 10 days, they will initiate the public hearing process. •

Dear Mayor Meza:
The Houston/Harris County Area Agency on Aging would like at this time to
extend to you a most earnest "congratulations". Your 1979 Title V request
for funds has been granted.
It is our wish that sufficient funds were available to fund each request
as stated in your proposal. However, as we are certain you are aware, the
availability of funds frequently does not correspond with the need.
Therefore, great consideration was taken to disburse the funds in a most
equitable manner.

Dear Mayor Meza:
The City Council of the City of Lomax is in the process of
trying to reach a solution to the pressing problems in our City.
Would you please respond to the following questions which may
assist us in arriving at a reasonable solution which may be satis-
factory to our citizens and in the best interest of our City.
1. Are you interested in annexing Lomax if we,deincorporate?
2. Would you assume a capital improvement bond issue if we
voted one?
3. Would you forego or agree to forego any expansion of the
La Porte Airport if we deincorporated and became a part
of your city?
4. Will or does your Charter agree to provide for an elected
representative from districts and would a district be
created for the Lomax area?
We would appreciate a response as soon as possible to the
above questions.

RE: Your Correspondence dated June 11, 1979
Dear Mayor Malone:
The La Porte City Council has reviewed the questions in
your above referenced correspondence. It is understood and
appreciated that the answers to these and other issues are
important and must be considered by any entity contemplating
a situation of this nature. Because of the complexity and
impact of your contemplated action, simple yes or no answers
to your questions are not possible.
• I would like to suggest that our two Councils convene a
joint meeting to discuss this matter. Following that meeting,
if desirable, I would suggest that a joint committee consisting
of two members of each Council, working with the staff of each
City, begin a joint effort to determine the advantages, dis-
advantages, and alternatives related to the possible annexa-
tion and/or consolidation of Lomax and La Porte. This committee
could then report back to the two Councils on their findings
and recommendations.

earliest convenience so we can set a date and time for the
initial meeting.
