• MINUTES - REGULAR MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS SEPTEMBER 5, 1979 7:00 P.M. MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza; Commissioners Kibodeaux, and Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioners Tomerlin and Cline. OTHER CITY OFFICIALS PRESENT: J. R. Hudgens, City Administrator; Margie Goyen, City Clerk; H. F. Meza. + + + 1. CALL TO ORDER- Mayor Meza called the meeting to order. + + + 2. INVOCATION - COMMISSIONER TOM C. SIMONS - The invocation was given by Commissioner Tom C. PUBLIC HEARING - PROVIDE CITIZENS THE OPPORTUNITY TO COMMENT ON THE USE OF REVENUE SHARING ENTITLEMENT MONIES, THE OVERALL BUDGET AND THE RELATIONSHIP OF ENTITLEMENT MONIES TO THE OVERALL BUDGET FOR THE FISCAL YEAR 1979-1980 - BEGINNING OCTOBER 1, 1979 - Mayor Meza opened the public hearing. The City Administrator reviewed the proposed budget department by department. He ..stated that the budget was based on the same tax rate as last year, 91 cents per $100.00 evaluation., and recommended no tax increase. The Administrator complimented the Commission on the time they spent on the budget. Evelyn Kennedy was recognized and asked how soon the funds would be available for the park land to place the old depot on? The Administrator stated that the tax statements would be mailed on October l; some. money would come in then and some of the tax money would come in just before they become delinquent on February 1. It was. determined that budgeted funds .would. be appropriated as of October l and the money should be available after December for the park land. • Mayor Meza asked if there was anyone else desiring to speak? He asked Mrs Riley if she had any comments? Mrs.. Eugenia Riley stated that she had not been able to follow as the Administrator reviewed it and she was looking through it now. Mayor Meza commented that the budget as presented, without a tax increase, he wished to compliment the Commission and the Department Heads for their wise and conservative spending. Commissioner Kibodeaux stated that he liked the proposed budget. Commissioner Simons complimented the Administrator and the Department Heads for all their work on the budget; as well as the Mayor and Commissioners and .the fact there was no tax increase; he liked that best. Mrs. Eugenia Riley asked where the Revenue Sharing money was going to be spent? The Administrator stated that there was a Contingency Fund of $120,000. A contribution to the Capital Improvement Fund in the amount of $45,000, to match a Title V Grant for remodeling • at the Nutrition Center had been made. From the Capital Improve- ment Fund, $20,000 had been set aside to match the Community Development Agency Grant for improvements to the North Side Park. • • Regular Meeting 9/5/79 3 3. It was determined that a special meeting would be held on September 12, 1979, to adopt the budget and set the tax rate. APPROVAL OF MINUTES - REGULAR MEETING - AUGUST 15, 1979 - - SPECIAL MEETING - AUGUST 27, 1979 - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve the minutes of the regular meeting of August 15, 1979, and the special meeting of August 27, 1979, as presented. Motion carried by 'the following voter AYES: Commissioners Kibodeaux and Simons; Mayor Meza. NAYS: None. + + + 5. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1167 - ORDINANCE VACATING', ABANDONING AND CLOSING 'THE ALLEY IN BLOCK 13, BAY FRONT ADDITION (BRYAN BERTRAM) -After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 1167 as read. Motion carried by the following vote: AYES: Commissioners Kibodeaux and Simons; Mayor Meza. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK THIRTEEN (13), BAYFRONT ADDITION TO THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. • (Appraised value paid $813.23.) + + + • • Regular Meeting 9/5/79 4 6. CONSIDER AWARDING BID - REPAIR TO ROOF AT MAIN FIRE STATION - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to accept the recommendation of the Fire Chief and award the bid for the repair to the roof at the Main Fire Station to Davis Brothers, The Roofing Company, of Houston, in the amount of $5,121.00.. Motion carried by the following vote: AYES: Commissioners Kibodeaux and Simons; Mayor Meza. NAYS: None. + + + 7. DISCUSS REQUEST FOR VARIANCE FOR FENCE FOR FRONfi YARD - LOTS 25, 26, 27, AND 28, BLOCK 1?, TOWN OF LA PORTE - MRS. MARY P. FOX Motion by Commissioner Kibodeaux, seconded by Commissioner Simons that action on this item be tabled until the next regular meeting when we have a full Commission and the Attorney has finished his report. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1035-A - ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, SECTION 6-18, CONCERNING PERMISSIBLE FEES AND CHARGES FOR THE TOW- ING OF VEHICLES IN THE CLTY OF LA PORTE"; PROVIDING THAT THE STAN- DARD'CHARGE FOR A NORMAL TOW WILL"NOT EXCEED THIRTY-SEVEN DOLLARS AND FIFTY CENTS ( 37.50) - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 1035-A as read. ADMINISTRATIVE 'REPO'RTS - A. The Administrator informed the Commission of a memo from the Code Enforcement Office regarding the status of repairs to the house located at 1915 Crescent View Drive, (Block 1, Lot 1, Crescent Shores) Matthew Greco; stating that the building was secure and they will continue to watch the building repairs closely and will continue to report back to the Commission. A copy of the memo is attached and made a part of these minutes. B. The Administrator stated that he had .spoken to the Superintendent of Schools, Robert Williams, and they had tentatively scheduled a joint work shop for October 2, 1979, at 7:00 P.M. + + + Commissioner Simons suggested that the City be the host for the joint meeting since the School was host at the last meeting. COUNCIL ACTION - Mayor Meza stated that he had received a letter from the County Attorney stating that they would like to renew their lease agreement for the Health Clinic. B. Mayor Meza stated that he would like to appoint Commissioners Tomerlin and Cline to the Committee to study possible consolidation of Lomax with La Porte. Lomax's Committee consists of Alderman Rex Car and Alderman J. B. Womack. + + + 12. CITY OF LA PbRTE ° INTER-OFFICE MEMORANDUM • T0: Planning and Zoning Commission DATE : July 17, 1979 FROM: Inspection Department SUaJ ECT: Fence located at 310 South 4th Street On July 3, 1979, David Paulissen of this Department was informed of a fence that was constructed in the front yard at 310 S. 4th Street. In making an inspection of the property later that day, Mr. Paulissen found the fence to be in violation of Ordinance 780, sec. 13-205 #3. He also found the fence was constructed without a Building Permit. In making personal contact with the owner, Mrs. Fox, Mr. Paulissen informed her of the violation and that she would have to remove the fence. Mrs Fox said she would like to appeal. She was told how to do so. The only other front yard fences in the area was put up some time ago and may have been up before the Ordinance went into effect. MARY FOX) A new chain link fence ha.s been installed at the above referenced property. The owners, James and Mary Fox, have requested a variance to allow the fence to remain in the front yard. Freeman, Jr., Chief of Police SUBJECT: Wrecker Charges After checking with wrecker companies and Police Departments in the area, I find the charges ranging from $27.50 in Deer Park and Pasadena to $35.00 in Baytown and Houston, with the highest charges being $37.50 in the Clear Lake area. There has been no request for an increase from the Wrecker Association for wrecker charges since May, 1976 even though there has been a constant rise in fuel costs, price~of equipment; wages, and insurance costs since May of 1976. ' Because of operational cost as stated I recommend the La Porte Wrecker • Association be granted their request to raise their charges within the City Limits of La Porte from $27.50 to $37.50 leaving all other charges as listed in the May, 1976 ordinance, ~E1035. Many times we get up moxe than once during the night.To pick up the vehicle,then in a few shoat hours up again to release vehicle when owner is released.Thexefore our proposals are as follow in this order: .' 1.Decrease the liability from 10-20-10 to 10-20-5.The latter being what the State requixes.The additional $5,000 the City Ordinance xequixes us to have has to be written on a seperate policy with the cost being well over $200 a Year. 2.Increase our present $27.50 towing fee to $37.50,this is what the surrondin~° • axeas are now charging.Wo have had no increase since 1976. 3.Increase our storage fee from the present $3.00 a day to $4.00 a day after the first 24 hours.This again is what the surronding axeas are now chaxging~ All other fees as stated on the wrecker slip will xemain the same. 4.Limit the amount of h'reckers in the city.We now have 7 active Wreckers. Thank You • B.C. Mc call Ordinance 1035 page 18 • Sec. 6-18.- Permissible fees and charges. (A) (1) The standard charge fora "normal tow" from the scene of the accident in the city limits of La Porte to the place of business of the wrecker operator, or other location in the city limits of La Porte, in- structed by the owner, will not exceed twenty-seven and 50/100 dollars ($27.50). This charge will apply either day or night, holidays or Sundays.. If the owner of the vehicle being towed requires the vehicle to be moved or transferred after the vehicle has been towed to a location specified in a wrecker ticket, there may be an additional charge of fifteen dollars • ($15,00). For transferring the vehicle within the city limits, a normal tow is defined as picking up the vehicle or moving and towing the vehicle from the street to a location. There will be no addi- tional charges to disengage one vehicle from another, as this will be considered part of a normal tow when the vehicles are mcved from the street. (2) An additional charge may be made for the following additional labor that is not required in a normal tow, to-wit: (a) An additional charge, not to exceed ten dollars ($10.00), may be made for a ditch pull and/or roll- • over in those cases where two separate pulls with the wrecker's winch line are actually required. (b) An additional charge, not to exceed five dollars ($5.00) may be made for disengaging and removing the drive shaft; or for other exceptional labor. (3) A charge not to exceed fifty dollars ($50.00) may be made when it is required to "airplane" a wrecker vehicle; i.e., to completely pull the wrecked • Ordinance 1035 , Page 19 . vehicle upon the wrecker. This charge shall be all inclusive, and no other charge may be imposed when it is made. (4) Except in the event of an airplane charge, the maximum charge for any and all tows from the scene of an accident in the city limits shall be forty- two dollars and fifty cents ($42.50). (5) A charge not to exceed three dollars ($3.00) per day may be made for the storage of wrecked vehicles. A "day" shall mean a twenty-four (24) hour period beginning at the time the vehicle enters the storage yard. • (B) Every holder of an auto wrecker permit and those tow- ing vehicle permit holders that are eligible to be summoned to scenes of accidents shall utilize an official wrecker ticket provided by the City of La Porte containing the following information: (1) Name and address of wrecker company. (2) Time and location of accident. (3) Place to which vehicle is to be towed. (4) Description of vehicle and general description of parts of vehicle that have been damaged. (5) Itemized list of service to be performed, charges for each, and total charges. (6) Places for signature of auto owner or other • person (including a police officer) authorizing tow of vehicle. (7) One copy of the wrecker ticket is to be given to the customer, and one copy is to be given to the investigating police officer. (C} It shall be unlawful and a violation of the terms and ' provisions of this chapter for any person to pay or • ~~ receive any remuneration not specifically provided for in this chapter. LEGAL NOTICE At 7:00 P.M. on September~l9, 1979, the City Commission of the City of La Porte will conduct a public hearing in the Council Chambers of City Hall, located at 604 West Fairmont Parkway. The. purpose o~ this hearing is to provide citizens the opportunity to comment on the proposed new Home Rule Charter for the City of La Porte and proposed boundary lines for districts for election of Councilpersons under the proposed revisions to the home Rule Charter of the City of La Porte. The following are the proposed districts and their boundary lines: DISTRICT A: The area bounded by East "A" Street., Broadway, • Little Cedar Bayou, Galveston Bay, and the eastern city limits. DISTPICT B: The area bounded by West "B" Street, the Southern Pacific railway, the southern city limits, Galveston Bay, Little Cedar Bayou, and Broadway.
