MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: J. R. Hudgens, City Administrator; Margie Goyen, City Clerk; Knox Askins, City Attorney; Gail Hamilton, Assistant City Attorney; H. F. Meza. + + + • • • Minutes - Reconvening September 19, 1979 2 Meeting on September 26, 1979 1. CALL TO ORDER - Mayor Meza called the meeting to order. + + + 2. RECONVENE PUBLIC HEARING WITH CHARTER REVISION COMMITTEE TO PROVIDE CITIZENS .THE OPPORTUNITY TO' COMMENT ON THE PROPOSED NEW HOME RULE CHARTER FOR THE CITY OF LA PORTE AND THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED" REVISIONS TO THE HOME RUT~E CHARTER OF THE CITY OF LA PORTE - Mayor Meza reopened the public hearing and asked for a breakdown of Whites, Blacks .and Browns for the proposed four district plan. They are as follows: DISTRICT A 2,420 WHITES 84 BLACKS 3'09 BROWNS 2,813 TOTAL DISTRICT B 2,165 WHITES • 221 BLACKS 317 BROWNS 2,703 TOTAL DISTRICT C 1,687 WHITES 894 BLACKS 237 BROWNS 2,818 TOTAL DISTRICT D 2,668 WHITES 58 BLACKS 88 BROWNS 2,814 TOTAL GRANT TOTAL 8,940 WHITES 1,257 BLACKS 951 BROWNS 11,148 Copies of the above was made available for anyone that wished a copy. A copy is attached and made a part of these minutes. Mayor Meza asked Mrs. Eugenia Riley if she had a proposed map for district lines? • • • Minutes - Reconvening September 19, 1979 3 Meeting on September 26, 1979 2. RECONVENE PUBLIC HEARING WITH CHARTER REVISION COMMITTEE (CONTINUED) A. Mrs. Eugenia Riley was recognized and expressed appreciation to the Commission for the opportunity to consider revising the proposed districts. Mrs. Riley presented a map and made a presentation on the proposed districts asking for six districts. Mrs. Riley stated that they were asking for only one. Colored person; asking in good faith; further stating that she was .not threatening, but would go to the Justice Department if the six districts were not proposed. Mrs. Riley stated that the needs of the North Side were not the same as the needs of Fairmont Park. After a general discussion, Mrs. Riley requested that the map she had presented be studied .and .then returned to her to take. to the Justice Department, if necessary. Mrs. Riley thanked the Commission and was seated. • Mayor Meza asked for Commission comments. Commissioner Kibodeaux asked for an opportunity to meet with the Charter Revision Committee to review the proposed district lines as presented by Mrs. Riley Commissioner Cline stated that she thought that Gail Hamilton, Assistant City Attorney, had some figures to present, that should be of interest. Ms. Hamilton addressed the Commission and stated that from the 1979 election results of the number of persons that vote, if the City were divided into six districts, there would be approximately 201 in each district to vote and it would take 101 votes to win. That would be if the voting was equal in each district. There was no way to tell how the voting turn out would be. Commissioner Cline stated that with the four district and two at large positions, the two at large would not be looking at districts but the entire City. Commissioner Tomerlin expressed concern, stating as proposed for six districts, you would only be voting for two people. RECONVENE PUBLIC HEARING WITH CHARTER REVISION COMMITTEE (CONTINUED) Mrs. Riley asked what the need to change the Charter for other than Mr. Pfeiffer's opinion that it needed to be done? There was a brief discussion regarding this and the. closed door sessions after the meetings. Mayor Meza addressed the comment'iclosed door" sessions, by stating that the only things that were discussed behind closed doors in executive sessions were personnel matters and legal matters. Mrs. Riley stated that she felt there was no need to stay and discuss the matter any further but she would do everything in her power to keep the Charter Revision from passing. Mr. Rufus Smith was recognized and asked what was the City doing? He was of the opinion that the Commission should thank the Black people for their efforts in trying to make a better working situation and felt that the Commission should not turn down the • proposed six district proposal. Mr. Kenneth. Doughty spoke to Mrs. Riley about her comment on what goes on behind "closed doors" by stating that she was judging and the Whites were judging. He also .felt there should be a Black. on the Commission so that the Black people would have representation.. Commissioner Tomerlin reminded everyone that the Charter as presented would have to be voted on by the people. Robert Smith, 734 S. BlackwelJ_, stated that after talking with the Administrator and Commissioners-felt that. we were all missing the boat and spinning. our wheels. He was upset., felt we should all quit fussing and present-the Charter. He further asked what the timetable was for submitting the proposal to the Justice Department? Ms. Hamilton stated that the Charter had already been submitted. The districting proposal should already have been sent and we were already approximately 30 days behind schedule; the Voting Rights Act states that the Justice Department must approve all things which will effect voting. Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to meet with the Charter Revision Committee at 6:00 P.M. on October 3, 1979, to further discuss the proposed districts. • • Minuted - Reconvening September 19, 1979 5 • Meeting on September 26, 1979 2. ADMINISTRATIVE REPORTS - None. + + + 4. COUNCIL ACTION - None. + + + • 5. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - (E), (F), AND (G) - (LEGAL, LAND ACQUISITION AND PERSONNEL) - Motion by Commissioner Cline, seconded by Commissioner Simons that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline., and Simons. NAYS: None. The meeting recessed at 8:27 P.M. The meeting reconvened at 11:00 P.M. + + + 6.
