Meza; Commissioners John Tomerlin, Virginia Cline, and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioner I. J. Kibodeaux. OTHER CITY OFFICIALS PRESENT: J. R. Meza. + + + 1. CALL TO ORDER - Mayor Meza called the meeting to order. • + + + • Regular Meeting 10/3/79 2 2. INVOCATION - COMMISSIONER TOMERLIN - Commissioner Tomerlin gave the invocation. + + + 3. APPROVAL OF MINUTES - REGULAR MEE-TINE - SEPTEMBER 19, 1979 - SEPTEMBER 26, 1979 - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve the minutes of the regular meeting of September 19, 1979 and September 26, 1979, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Cline, and Simons. NAYS: None. + + + 4. JOINT DISCUSSION WITH CHARTER REVISLON COMMITTEE AND CONSIDER • APPROVING A DISTRTCTTNG PLAN FOR THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - Mayor Meza stated that the next order of business was the joint discussion with the Charter Revision. Committee and let them review the public-hearing which we had on the redistricting of the City of La Porte. He then asked the Charter Revision Committee Chairman, Mr. H. P. Pfeiffer if he had a quorum of the Charter Revision Committee. It was determined that there was not a quorum of the Charter Revision Committee Mr. Pfeiffer. asked when. the next meeting would be so that the Charter Revision Committee could meet and make a recommendation and have it back to the Commission for their next meeting. Mayor Meza stated that the next meeting would be a work shop on October 10, 1979 and the next regular meeting would be held on October 17, 1979. Commissioner Cline stated that since the Charter Revision Committee had not had an opportunity to meet and review the two different proposals, if they could meet sometime within the next week, couldn't we recess the public hearing until the next week? Mayor Meza stated that we didn't have a public hearing. Commissioner Cline was of the opinion that this was a continuation of the public hearing. It had been continued from week to week. • There was a brief discussion regarding whether or not this was a continuation of the public hearing. • Regular Meeting 10/3/79 3 4. JOINT DISCUSSION WITH CHARTER REVISION COMMITTEE AND CONSIDER APPROVING A DISTRICTING PLAN FOR THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - CONTINUED) Mayor Meza stated that Mrs.. E. Riley had brought her proposed map for districts for six single member districts and the Mayor at I;arge; we had the public hearing; Mrs. Riley was kind enough to leave the map here for everyone to look at. He further stated that he had wanted all the Committee members to review it. Commissioner Simons asked if the Charter Revision Committee had been notified? The City Clerk affirmed, "yes". Mayor Meza stated that he wanted. all the Committee members to be aware of the two different opinions on the maps. Some of the members were not at the public hearing and he wanted them to acquaint themselves with all the public hearing and the discussions and take it all into consideration and then the Charter Revision Committee come back with a recommendation to the Commission. • Mayor Meza then asked if the Commission had any different opinion than this? Commissioner Tomerlin stated that it was his opinion that the public hearing was completed, but that an alternate proposal had been submitted and it was up to the Commission to send it back to the Charter Revision Committee for review and come back with a recommendation. Commissioner Cline stated that the minutes of the special meeting reflected that: "Motion by Commissioner Kibodeaux to meet with the Charter Revision Committee at 6:00 P.M., on October 3, 1979, to further discuss the proposed districting plan". Commissioner Cline stated that if there was further discussion, that would be a continuation of the public hearing. Commissioner Tomerlin stated that he felt that should not be further discussed. Mayor Meza asked if there was any further discussion on this other than referring it to the Charter Revision Committee? Commissioner Cline stated that she knew that Mr. Pfeiffer, Chairman of the Committee, had been out of town the past week on business, • and the Committee should study the two proposals. • Regular Meeting 10/3/79 4 4. JOINT DISCUSSION WITH CHARTER REVISION COMMITTEE AND CONSIDER APPROVING A DISTRICTING PLAN FOR THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CFi'ARTER OF THE CITY OF LA PORTE - (CONTINUED) Mrs. .Riley stated. that she felt sure all of the Committee had been notified. The meeting had been changed from 7:00 P.M. to 6:00 P.M. She 'had seen the delay from time to time. She stated that they were not going to wear out. They were going to stick with. this. She stated that we could start the meeting at 4:00 P.M., but they would be present.. She stated that this was the third week that it had been drawn out. Someone always has to be out of town, or the main persons do. She stated that they would dismiss themselves because they had another meeting to go to. She stated that she felt her map had been clearly studied the past week. It was studied last Wednesday night. She again stated that she felt that this was just to wear them down. Mrs. Riley said, "You might as well make up your mind that we are here. We are here to stay." .Mayor Meza stated that the public hearing was to have citizen input. So that we could be aware of all the citizens input. Mrs. Riley stated that she knew what a public hearing was. She stated that as far as .she was. concerned. that the Commission could just send her a telegram and tell her whether they planned to accept her proposal. She stated that she was not trying to force any body to do any thing. Mrs. Riley stated that she would just roll her map up and go on while they decided what they were going to do. Mr. Rufus Smith asked if this was a public hearing. Mayor Meza and. Commissioner Cline stated "No". Mr. Smith asked if we couldn't try and get a quorum of the Charter Revision Committee. He asked how many more it would take to have a quorum. He stated that he felt that we should go on and get this job done. He stated that he felt that the Charter Revision Committee didn't have to study the proposals. He felt they should act on it tonight. Mayor Meza stated that that was going to be his recommendation; that the Committee go back into the conference room; study the hearing .that we had and come back with a recommendation. But, the Charter Revision Committee does not have a quorum. It was determined that there are thirteen members and there were only five present. • • Regular Meeting 10/3/79 5 4. JOINT DISCUSSION WITH CHARTER REVISION COMMLTTEE AND CONSIDER APPROVING A DISTRICTING PLAN FOR THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - (CONTINUED) Mr. Pfeiffer stated that he wanted to make one thing. clear. He had left town last Wednesday on business and returned on Sunday. Further stating that he was not aware of the map. He said, "I guarantee you one thing, I am not procrastinating, I'm not stalling". He stated that he felt that the entire committee would like to look at everything. They had spent a lot of time on the proposed. revision. He would. call a special meeting and get back with a recommendation. He stated that that was the best thing that he could recommend. Mr. Pfeiffer stated that he would assure the Commission. that there-would be a quorum at the next Charter Revision Committee meeting some way or the other. Evelyn Kennedy was recognized. and stated that she was not sure that she understood. Was Mrs. Riley's proposal different from what the proposed Charter was? Some people were of the opinion • that everyone had to have districts. Then she had heard that it was not necessary to do this. And then the question will it be necessary to have districts in the near future and then someone says yes you will have to have districts. Mrs. Kennedy asked if someone would explain. Mrs. Kennedy asked if we could be spared five minutes to have someone explain. Mayor Meza asked Gail Hamilton to explain. Gail Hamilton stated that the Charter Revision began as a change in the form of government from Commission to Council/Manager form of government. It was the feeling of the Commission and presumably various other members of the community that the Council/Manager form of government would be more efficient. The Council would act as a board of directors and the Manager of the City would be the adminis- trative arm to carry out their wishes. The citizens would be sort of like stock holders. Opposed to now, where each of the Commissioners have specific realms of duties. That was the motivation for begin- ning the change from Commission to Council/Manager form of govern- ment. The. City is under no compulsion to change. It is simply that is was the view that it be studied to see whether or not it would be good for the City. Once having made the decision to go to a Council/Manager form of government, the Federal Law, the Voting Rights Act, is the • compulsion that makes us go to single member districts. • Regular Meeting 10/3/79 6 4. JOINT DISCUSSION WITH CHARTER REVISION COMMITTEE AND CONSIDER APPROVING A DISTRICTING PLAN FOR THE PROPOSED BOUNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - (CONTINUED) Some states are not under the Voting Rights Act, but Texas is. If you are not under the Voting Rights Act, you may do any way you choose, either all at large or all single member districts. Texas has been under the Voting Rights Act since 1975. We have to ask the Justice Department before we make any change that will affect voting rights. It has been the view of the Justice Department, that all at large Councils further racial discrimina- tion; and that single member districts are more likely to allow minority input. The answer to Mrs. Kennedy's question is "Yes, and No". We didn't have to make the first change; but after you decide that you want to go to a Council/Manager form of government you have to go to some portion at large. No that was said wrong, you have to go to some portion. single member. Whether or not we go 4-2-1 or 6-1 is simply at the discression of the Commission, from the recommendation made by the Charter Revision Committee. That is a policy decision of the Commission for our own particular City. Commissioner Cline stated that the City Commission would decide either to go 4-2-1 or 6-1, then they just submit it to the Justice Department. Ms. Hamilton said, "Right". Mrs. Kennedy asked if all the plans submitted would be sent to the Justice Department? Commissioner Cline said, "And let the Justice Department make a decision"? Mrs. Kennedy said, "Right". Commissioner Cline stated that she was of the opinion that we only submit one plan. Either they give you their approval or they reject it. Mrs. Kennedy stated that she was sorry. She had heard so many different things, that she was just confused. She further stated that there were some people that would like to keep the present form of government. She further stated that she was just confused. Commissioner Tomerlin stated that he felt one of the easiest ways to describe this, that which ever one of the districting plans that is submitted, if the Justice Department approved it, and we voted on it, and the citizens turned it down, then we would remain just • as we are. • Regular Meeting 10/3/79 4. JOINT DISCUSSION WITH CHARTER REVISION APPROVING A DISTRICTING PLAN FOR THE P r: 7 AND CONSIDER NDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - (CONTINUED Mrs. Kennedy stated that she had one more question. Has a plan already been sent in to the Justice Department? Commissioner Tomerlin stated that a plan had already been submitted a plan with everything except the district lines. Mayor Meza asked Gail Hamilton to continue with her explanation. Gail Hamilton stated that the point we are at right now is: We have already submitted the portions of the language of the Charter to the Justice Department. to ask for approval and we are suppose to, and unless they use a delay tactic, and they have not indicated that they were going to do that, and if they don't we should have an answer back by October 15th; as to whether or not they have approved our changes in wording. That would be the 4-2-1. That has already been submitted. If it were the Commissions judgement that we should go to the 6-l; then that would have to be resubmitted. That portion has already been submitted as 4-2-1, with no lines drawn, just the concept of four single member districts, two at large and the Mayor at large. Mrs. Kennedy asked if there were any rules and regulations as to how this would be set up? Gail Hamilton stated that we have what we call common law. That means that over the years the courts have made different determina- tions on what is a fair district. If you are going to draw a district, then you have to go by several constraints. One, they need to be pretty close in population, as equal as practical and the other is that they need to be contiguous and they need not to be gerrymandered. That is a little piece here, a little piece there. A citizen from the audience asked if she had heard right, that a proposal had already been sent in and it was her understanding that Mrs. Riley's proposal was for something; then it wouldn't make any difference what she wanted, the proposal had already been sent in. Gail Hamilton stated yes, unless the Commission wanted to change their minds after it has already been sent in. • • Regular Meeting 10/3/79 8 4. Gail Hamilton stated yes, that we had a public hearing on that and no one came. Ms. Patterson stated that she had been to the meetings and she keeps hearing all about the 4-2 plan that has been submitted they they would not have the time. Gail Hamilton stated that the only one that could submit a voting change is the City Commission. Other citizens of the community are allowed to object. It was determined that the meeting on the 4-2 plan was about two to two and one-half months ago. • There was a brief discussion between Ms. Patterson and Ms. Hamilton about the past meetings and the fact that .the last meeting was not on the 4-2 plan, but the drawing of district lines. Ms. Patterson stated that they didn't know anything about the other meetings. Ms. Hamilton stated that it was in the paper. Rufus Smith stated that he was still a littly hazy. He knew what the 4-2-1 plan was but did not know what the 6-1 plan was. Commissioner Cline stated that it was six single member districts and the Mayor at large. Mr. Smith asked what happened to the councilmen at large in Mrs. Riley's proposal. He didn't have any indication that the councilmen at large were to be eliminated. Mrs. Riley stated that she didn't mean to eliminate any, but they said to have six councilmen by district and two councilmen at large was too large,. so she said do you have to have councilmen at large; in order to get representation in there, let's have six single member districts. However, the Committee said that that would be too many people. She stated that she didn't see where it would. Mr. Smith stated that he didn't feel himself that it would be • advantageous to eliminate the councilmen at large. r ~ • Regular Meeting 10/3/79 9 4. JOINT DISCUSSION WITH CHARTER REVISION COMMITTEE AND CONSIDER APPROVING A DISTRICTING PLAN FOR THE PROPOSED BOiJNDARY LINES FOR DISTRICTS FOR ELECTION OF COUNCILPERSONS UNDER THE PROPOSED REVISIONS TO THE HOME RULE CHARTER OF THE CITY OF LA PORTE - CONTINUED Mrs. Riley stated that she felt that she had been on the Committee more than two and one-half .months and she was never in on a meeting where they said, of course she knew that the Charter had been submitted. She was not in on that meeting and did not think that Mr. Daniel was in on the meeting. She stated that this was what they were talking about when there were meetings that they didn't know anything about. She stated that she understood that the Charter had been sent off with the 4-2-1; there is no need for us to come back down here next week and think that you all are going to change your minds; because you are going to take the decision of the majority of the Charter Revision Committee; Mrs. Riley stated that she didn't seen anything for them to do but roll her little map up and ,put it under her arms, and catch a plane and take it to the Justice Department herself. Commissioner Tomerlin moved, and Commissioner Cline seconded the . motion to table items 4 and 5 for further study. Motion carried by: AYES: Commissioners Tomerlin, Cline, and Simons. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1170 - ORDINANCE • APPROVING DISTRICT BOUNDARY LINES - TABLED. + + + • Regular Meeting 10/3/79 10 6. PUBLIC HEARINGS - DANGEROUS BUILDINGS - A. Block 57, E.l/2 Lot l5, all of 18, W.1/2 Lot 19, La Porte - W. V. Sullivan, Estate, 412 West Main - Mr. Talburt stated that he .had met with Mr. Sullivan and that he planned to take out a demolishing permit. Mr. Talburt recommended that the Commission go ahead and make a determination should Mr. Sullivan not come back and get his demolishing permit, then we could proceed. B. Block 58, Lots 11 - 12, La Porte - W. V. Sullivan, Estate, 110 North 3rd - Mr. Talburt stated that he had met with Mr. Sullivan and the Heritage Society had sent a letter requesting consideration to grant an extension on the plan to condemn the building. Mr. Talburt stated that he felt if the Commission finds in favor of the Board of Inspection then the Commission may grant a stay and if a stay was granted, that the Heritage Society be required to make a report in writing every thirty days as to their findings, and if at any time they feel that they will not be able to restore the building, that they report this to the Commission so that the proceedings may continue. There was a brief discussion regarding whether or not the building could be moved. Mr. Talburt was of the opinion that it would be too • costly and not advisable. C. Block 79, Lot 14, La Porte - Ms. Shirley Gay Walker, 312 North 6th - No one was present. The Assistant Fire Marshal, Mr. Hickenbottom stated that the building was being partially demolished but he didn't know by whom. However it was the recommendation of the Board of Inspections that the procedure should continue as though nothing had been done. D. Block 67, Lots 22 thru 24, La Porte - Ms. Idella Price - 215 North 6th - Mr. Hickenbottom stated that there had been no responce from this notice. It had been sent to Detroit. He recommended the building be demolished. E. Block 90, Lots 27 and 28, La Porte - Mrs. Elizabeth Patterson, 423 North 5th - No one present. The Board of Inspection recommended that the City tear down the building and file a lein on the property. F. Block 89, Lots 15 and 16, La Porte - Ms. Geraldine Jones, 520 West Tyler and 518 West Tyler - Mr. Talburt stated that he had been contact by someone about demolishing the buildings, but they did not have the finances to cover the bond. It was the recommendation of the Board of Inspection that the Commission continue with the process. • • Regular Meeting 10/3/79 11 6. CONSIDER APPROVING PROPOSED ORDINANCE NO. 664-I - ORDINANCE ADOPTING NATIONAL ELECTRICAL CODE, 1962 EDITION, 1978 REVISION, AS THE ELECTRICAL CODE OF THE CITY; PROVIDING EXCEPTIONS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW - After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Tomerlin to approve Ordinance No. 664-I as read. Motion carried by the following vote: .AYES:, Commissioners Tomerlin, Cline,. and Simons. • NAYS: None. CAPTION: AN ORDINANCE AMENDING SECTION 32 OF ORDINANCE 664, BY ADOPTING THE NATIONAL ELECTRIC CODE, 1962 EDITION, 1978 REVISION, AS THE ELECTRICAL CODE OF THE CITY OF LA PORTE; PROVIDING EXCEPTIONS PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 8. The shape than before; really intended to Mr. Talburt stated that he had received correspondence from Mrs. Wm. Smith about the property at 1212 Bayshore and would make arrangements to pay out the demolishing if the City would have it done. The Administrator stated that Dave Corbin would update the Commission on the status of the bond projects. Dave Corbin addressed the Commission and stated that: A. The Spencer Highway water line from Water Well No. 5 to Farrington was virtually complete. B. C. 12".Main along McCabe Road west: to Highway. 146, 16" North on Highway 146 to Fairmont - There was. problem requiring easements for utilities; property owners did not want to give easements; there was some consideration to starting on the west side of Highway 146 and then crossing back to the ease side. There was a comment on the easiest way be condemnation. D. Looping of various water lines had just begun. + + + 12. COUNCIL ACTION - Commissioner Tomerlin stated that he and Commissioner Cline had met with Lomax on the possible consolidation and would hope to report back soon. Commissioner Cline asked about the status of the pot hole at the curb at the Post Office. There was some discussion as to whether or not the pot hole was in front of the curb or behind the curb. The Administrator was asked to send a letter to the property owner telling him how the hole started. Mayor Meza stated that we received a letter from the Highway Department requesting the City to approve a construction speed zone for work to be done along Highway 146 frontage road.
