Meza; Commissioners John Tomerlin and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioners I. J. Kibodeaux, and Commissioner Virginia Cline. OTHER CITY OFFICIALS PRESENT: J. R. Mayor Meza informed the audience that Commissioner Cline was on vacation and Commissioner Kibodeaux was in the hospital, thus explaining their absence. + + + 3. APPROVAL OF MINUTES - REGULAR MEETING OF OCTOBER 3, 1979, AND SPECIAL MEETING OF OCTOBER 10, 1979 - Motion by Commissioner Simons, seconded by Commissioner Tomerlin to approve the minutes of the regular meeting of October 3, 1979, and the special meeting of October 10, 1979, as presented. CONSIDER DECISION OF HEARINGS FOR DEMOLITION OR REPAIR OF DANGEROUS BUILDINGS - (CONTINUED) Motion by Commissioner Tomerlin, seconded by Commissioner Simons to continue with the demolition of .the buildings located at 412 West Main, 110 North 3rd, 312 North 6th, 215 North 6th, 423 North 5th, 520 West Tyler and 518 West Tyler. Motion carried by the following vote: AYES: Commissioners Tomerlin and Simons, and Mayor Meza. NAYS: None. + + + 5. CONSIDER AWARDING BID - POLICE BUILDING ROOF - There was a brief discussion regarding the fact that 15,000.00 had been budgeted for the roof of the Police Building. Motion by Commissioner Simons, seconded by Commissioner Tomerlin to award the bid for the Police Building Roof • to Rudy's Roofing Company in the sum of $10,740.00, as recommended by the Chief of Police. A copy of the recom- mendation it attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin and Simons, and Mayor Meza. NAYS: None. + + + 3 6. CONSIDER AWARDING BID - REMODELING THE UPSTAIRS OF THE BUILDING LOCATED AT 911 S. EIGHTH (NUTRITION CENTER) - Motion by Commissioner Tomerlin, seconded by Commissioner Simons to table this item until the Attorney could make a recommendation. Motion carried by the following vote: AYES: Commissioners Tomerlin and Simons., and Mayor Meza. NAYS: None. + + + • Regular Meeting 10/17/79 4 7. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1172 - ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF STATE HIGHWAY 146 EAST FRONTAGE ROAD WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTS FROM BARBOUR'S CUT BOULEVARD TO NORTH "L" STREET - After the proposed ordinance was read in full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Ordinance No. 1172 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, and Simons, and Mayor Meza. NAYS: None. CAPTION: AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF STATE HIGHWAY 146 EAST FRONTAGE ROAD WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTS, TEXAS, AND PROVIDING THAT ANY PERSON VIOLATING THE PROVISIONS OF THIS ORDINANCE SHALL UPON CONVICTION BE FINED IN ANY SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00): AND PROVIDING AN EFFECTIVE DATE HEREOF . • + + + 8. CONSIDER AUTHORIZING WORKING WITH FEDERAL DISASTER RELIEF AGENCY FOR GRAP~'I' FUNDS TO REIMBURSE -THE CITY 'FO'R EXPENSES INCURRED FOR DAMAGES TO PUBLIC PROPERTY DURING THE FLOOD OF JULY, 1979 - The Administrator stated that items 8 and 9 were pertaining to the same thing and could have been only one item; there had been $12,000.00 damage to the Fairmont Park Sewer Plant; $12,000.00 damage to pumps and motors, and still no figure on the damage to the roads and highways. The Public Works Department is still working on the estimates for damages to the. roads, and grant funds are available to reimburse the City for expenses incurred for damages to public property during the flood. Motion by Commissioner Simons, seconded by Commissioner Tomerlin to authorize working with the Federal Disaster Relief Agency for grant funds to reimburse the city for expenses incurred for damages to public property during the flood of July, 1979. CONSIDER APPROVING PROPOSED RESOLUTION NO. 79-8 - RESOLUTION DESIGNATING CITY ADMINISTRATOR AS LA PORTE'S LOCAL AGENT FOR DISASTER RELIEF - After .the proposed resolution was read 1n full, motion by Commissioner Tomerlin, seconded by Commissioner Simons to approve Resolution No. 79-8 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, and Simons, and Mayor Meza. NAYS: None. CAPTION:- A RESOLUTION AUTHORIZING THE CITY ADM MAKE APPLICATION FOR A GRANT FOR THE PURPOSE OF FEDERAL FINANCIAL ASSISTANCE UNDER THE DISASTER LAW 288, 93RD CONGRESS); TO SIGN THE ACCEPTANCE MADE; AND TO SIGN ANY OTHER NECESSARY DOCUMENTS SAID GRANT ON BEHALF OF THE CITY OF LA PORTE. + + + LNISTRATOR TO OBTAINING CERTAIN RELIEF ACT (PUBLIC OF THE GRANT, WHEN REQUIRED TO COMPLETE • 10. ADMINISTRATIVE REPORTS - A. The Administrator stated that the garbage truck had been down and would ask the Public Works Director to make a report. The Public Works Director stated that we had had a lot of down time on the garbage truck and the mechanics were working over- time. The problem seems to be in the limit switch which handles the dumping and loading apparatus; and they are replacing the bearings with a heavier bearing. B. The Administrator stated that we have another garbage truck in the current budget. The law now allows cities to lease/purchase. We are in the process of trying to locate a new truck. There is a minimum two week bid time and then we have to wait for the delivery. C. The Administrator mentioned the microphones,-stating that only one worked and asked for the Commission to authorize him to negotiate for a more functional system, and with approval would trade in the present system and get a more functional system at no additional cost. Commissioner Simons asked to see the proposed system before giving approval. • + + + C~ • Regular Meeting 10/17/79 6 11. COUNCIL ACTION - A. Commissioner Tomerlin stated that there would be a meeting on Monday, October 22, 1979, beginning at 7:00 P.M., at the Lomax City Hall, to receive a report from the Joint Committee on Consolidation between La Porte and Lomax. B. Mayor Meza stated that the Harris County Mayors' & Councilmen's Association meeting would be held at Angelo's Fishermans Warf, on Thursday, October 18, 1979, and would be in conflict with the Chamber of Commerce Steak Cook-Out. As President of the Harris County Mayors' & Councilmen's Association, he would have to preside at the meeting and would not be able to attend the Chamber Steak Cook-Out. He further stated that the Association was working very well together this year and felt that they had accomplished a lot. • 12. CONSIDER AWARDING BID - REMODELING THE UPSTAIRS OF THE BUILDING LOCATED AT 911 S. EIGHTH (NUTRITION CENTER) - Mayor Meza stated that in the executive session they were discussing the acceptance of the low bid, as negotiated by the staff. If we would have not accepted this tonight, we would have had to go out and rebid, and would have taken a process of approximately three weeks. In doing so, we would have lost a grant of $45,000.00.. So, the staff, in order to keep this money from evaporating out of our hands, negotiated a bid with the low bidder, deleting certain items from the bid, which were: -$6,000.00 for carpet; -$4,000.00 for ceiling, -$2,500.00 for cabinets, -$3,000.00 store front, -$2,500.00 elevator shaft, -$1,000.00 electrical service - design change, ending with a total of $51,000.00; besides that there was -$2,000.00 for using less expensive light fixtures in the design change, which brought it to a total of $49,000.00 negotiation bid price. • Regular Meeting 10/17/79 7 6. CONSIDER AWARDING BID - REMODELING THE UPSTAIRS OF THE BUILDING LOCATED AT 911 S. EIGHTH (NUTRITION CENTER) (CONTINUED) Mayor Meza stated that if it was agreeable with Mr. James Arthur of Arthur Construction Company, he would sign a letter that will be addressed to Mr. Arthur, reference the City of La Porte Job No. 79-2123, Nutrition Center Remodeling: 'flear Mr. Arthur: Your firm has submitted a bid of $70,000.00 to the City of La Porte on the above referenced job. The City of La Porte requests your consent to the deletion of the items shown on the attached schedule, from this job, resulting in a contract price of $49,000.00. The City of La Porte will waive the filing of a surety bond, provided, no money will be paid to you, as contractor, until completion and acceptance of the work by the City. If this letter accurately states your understanding of our • agreement, please note your agreement and acceptance by signing and returning a copy of this letter, retaining a copy for your files. Meza, Mayor (For the City Commission)" It was moved by Commissioner Tomerlin, seconded by Commissioner Simons to negotiate with the low bidder., Arthur Construction Company, Mr. James Arthur, to reduce the scope of the work, and reduce the contract price to $49,000.00, in accordance with the letter agreement, with attached schedule, attached to these minutes, and, if accepted by the contractor, to let the contract to Arthur Construction Company for $49,000.00, job to be finished no later than December 31, 1979. CONSIDER AWARDING BID - REMODELING THE UPSTAIRS OF THE BUILDING LOCATED AT 911 S. EIGHTH (NUTRIT-ION CENTER) (CONTINUED) There was a brief discussion regarding the holidays that would fall within the 60-day period and that there would not be 60- working days. It was determined that the completion date would have to be by December 31, 1979, in order to get the grant. The grant is Harris County Area Aging. It was moved by Commissioner Tomerlin, seconded by Commissioner Simons to authorize readvertising for bids for items deleted from the original bid on the Nutrition Center, to be opened November 7, 1979, at 7:00 P.M. Motion carried by the following vote AYES: Commissioners Tomerlin, and Simons, and Mayor Meza. NAYS: None. • + + + 12.
