Meza; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: None. OTHER .CITY OFFICIALS PRESENT: J. R. Simons. + + + 3. APPROVAL OF MINUTES - REGULAR MEETING - OCTOBER 17, 1979 - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the minutes of the regular meeting of October 17, 1979, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. ABSTAINED: Commissioner Cline stated that she would abstain since she was not present at the meeting of October 17th. + + + • 4. ACCEPT BIDS - MISCELLANEOUS ITEMS OF CONSTRUCTION AT THE LA PORTS NUTRITION CENTER - There were no bids received for the miscellaneous items of construction at the La Porte Nutrition Center. One bid was received for floor covering only which was returned unopened to M & M Construction. After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Cline to authorize the City Administra- tor to negotiate for the miscellaneous items of construction to complete the finishing of the Nutrition Center. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • Regular Meeting 11/7/79 5. ACCEPT BIDS - FURNISHING AND INSTALLING A PASSENGER ELEVATOR AT THE LA PORTE NUTRITION CENTER - The following bids were opened and read aloud: GULF COAST ELEVATOR COMPANY P. 0. Box 1431 Pearland, Texas 77581 $19,978.00 SCHINDLER HAUGHTON ELEVATOR CORP. 5151 Mitchelldale St., Suite B-11 Houston, Texas 77092 $27,500.00 MONTGOMERY ELEVATOR COMPANY 30 Twentieth Street $28,222.00 Moline, Illinois 61265 Alternate - $ 2,190.00 -0- 3 The Administrator requested consideration in authorization to award the bid to the low bidder provided that the bid met all specifications. • Motion by Commissioner Simons, seconded by Commissioner Tomerlin to accept the recommendation of the City Administrator and award the bid for furnishing and installing a passenger elevator to the low bidder, Gulf Coast Elevator Company, in the amount of $19,978.00 subject to the approval of the Engineer. A copy of the Engineer's recommendation is attached and made a part of these minutes. + + + 6. CONSIDER APPROVING UTILITY EXTENSION AGREEMENT- MR. BRUCE-ANGEL - The Administrator stated that e had had another request for utilities that might join in with Mr. Angel on the extension of utilities. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the Utility Extension Agreement with Mr. Bruce Angel. A copy of the agreement and the proposed extension is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. PROPOSED ORDINANCE NO. 1173 - AN ORDINANCE AMENDING THE PROVISIONS OF THE CODE OF ORDINANCES CONCERNING DEMOLITION OF BUILDINGS AND OTHER STRUCTURES; PROVIDING THAT EACH NON-OWNER APPLICANT SHALL FILE A FIVE HUNDRED DOLLAR ( 500.00) CASH BOND; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT MORE THAN TWO HUNDRED ($200.00); PROVIDING FOR SEVERABILITY; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF - Based on the recommendation of the Board of Inspection, motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1173 as read. CAPTION: AN ORDINANCE AMENDING THE PROVISIONS OF THE CODE OF ORDINANCES CONCERNING DEMOLITION OF BUILDINGS AND OTHER STRUCTURES; PROVIDING THAT EACH NON-OWNER APPLICANT SHALL FILE A FIVE HUNDRED DOLLAR ($500.00) CASH BOND; PROVIDING THAT ANY PERSON VIOLATING • THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS- DEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT MORE THAN TWO HUNDRED ($200.00); PROVIDING FOR SEVERABILITY; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 8. CONSIDER AUTHORIZING STREET LIGHTS TO BE LOCATED ON "L" STREET "P" STREET, AND IOWA STREET - Motion by Commissioner Cline, seconded by Commissioner Simons to authorize three street lights to be located on "L" Street, "P" Street, and Iowa Street. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1174 - AN ORDINANCE SETTING MINIMUM FINES FOR TRAFFIC VIOLATIONS FOR CITY OF LA PORTE MUNICIPAL COURT - After the proposed ordinance was read in full, there was a discussion regarding the need to add: Following too close to emergency vehicle - $35.00; Increase: Failure to follow truck route from $20.00 to $35.00; Change: Destruction of City Property and Personal to: Destruction of City Property or Private Property. Motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1174 as amended. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE ADOPTING A SCHEDULE OF MINIMUM FINES FOR TRAFFIC VIOLATIONS FOR THE CITY OF LA PORTE MUNICIPAL COURT; AUTHORIZING THE PRINTING OF SUCH SCHEDULE OF MINIMUM FINES ON THE REVERSE OF THE VIOLATOR'S COPY OF TRAFFIC CITATIONS; AND PROVIDING AN EFFECTIVE DATE HEREOF. • + + + 10. ADMINISTRATIVE REPORTS - A. The Administrator stated that he had received a proposal from Ray Farias of the Baptist Church to purchase the pews from the old City Hall at a price of $2.00 each. There was a brief discussion regarding the Charter requirement regarding competitive bidding and the fact that you can not donate City property. After further discussion authorization was given to advertise an auction to be held at 10:00 A.M., November 28, 1979, at the old City Hall, to auction off the pews and any other miscellaneous items in the old City Hall and jail. B. There was a brief discussion regarding the Greco property and the fact that no progress had been made on the remodeling permit; however, there is still a 30-day time limit remaining on the permit. C. The Administrator stated that there had been two Utility • Extension Agreements requested for Bay Plumbing and Fred Westergren and the Public Works Director would like to schedule • Regular Meeting 11/7/79 6 10. ADMINISTRATIVE REPORTS (CONTINUED) the work to be done in house. It was determined that each of the lines would be approximately 130 feet. Bay Plumbing, on Polk; and Fred Westergren's building on the corner of 9th Street and West Madison. Motion by Commissioner Kibodeaux, seconded by Commissioner Cline to approve the Utility Extension Agreements with Bay Plumbing and Fred Westergren, and authorize the Public Works Director to schedule the work to be done in house. Copies of the Utility Extension Agreements are attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 11. COUNCIL ACTION - A. Commissioner Cline stated that she had • attended the T.M.L. Convention in Houston and felt that the session had been very good; however, most of her time had been taken up by the Clear Lake City Coalition Group. The only session she was able to attend was because she was moderating. B. Mayor Meza complemented Commissioner Cline on her moderation and the excellent job she had done. C. Commissioner Simons felt that a good time had been had by all. D. The Administrator informed the Commission that he and Dave Corbin were going to Austin on Thursday to meet with the Texas Department of Water Resources regarding the E.P.A. Grant; with the B.O.R. and Texas Aeronautics Commission. + + + 12. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 - TON AND PERSONNEL) - Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin that the meeting recess for an executive session. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:31 P.M. When said deposit has been made by Owner, City shall execute a contract for said extension(s). It is agreed and understood that the deposited escrow amount made by O~•;ner does not relieve Owner from paying for any unforseen costs and/or cost overruns in file project that result from circumstances beyond the control of City. (6) City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage conrlcction charge for water and/or sewer service against said property belonging to Owner. Owner shall be responsible for all other customary charges. (7) Upon execution of this agreement and compliance with terms herein, City agrees to begin file preparation of engineering plans and construction speci~ications for said extension(s), and to begin construction thereof as soon as file same may be let for contract as herein provided. City shall require the contractor under such contract to diligently pursue the construction of the . project to completion. ' ~, e • CITY OF LA PORTE INTER-OFFICE MEMORANDUM • T0: JIM HUDGENS, CITY ADMINISTRATOR FROM: BOARD OF INSPECTION SUBJECT: ORDINANCE NO. 1146 - CASH BONDS DATE: OCTOBER 15, 1979 When Ordinance No. 1146 was passed, April 4, 1979, w~ the Board of Inspection, had requested in Section 8-147 of said Ordinance, a $250.00 cash bond from the owner of the building when they were the contractor. Since the passage of this Ordinance we have found the $250.00 cash bond required of the owner of the building, when they were the contractor, to have caused undue hardships. Therefore, the Board of Inspection is~requesting this requirement of Section 8-147 of Ordinance No. 1146 be deleted. Section 8-147 as revised would read as follows: "AT THE TIME OF MAKING AN APPLICATION FOR A PERMIT UNDER THIS DIVISION, WHERE THE APPLICANT IS THE OWNER AND CONTRACTOR OF THE BUILDING TO BE DEMOLISHED, NO' CASH BOND IS REQUIRED. WHERE THE PERSON MAKING APPLICATION IS A CONTRACTOR AND NOT THE OWNER OF THE BUILDING TO BE DEMOLISHED, A FIVE HUNDRED DOLLAR ($500.00) CASH BOND IS REQUIRED. THE BOND SHALL BE CONDITIONED THAT THE PRINCIPAL, IF GRANTED A PERMIT, WILL ACCOMPLISH SUCH DEMOLITION IN STRICT ACCORDANCE WITH THE TERMS OF THIS ARTICLE, AND WILL PAY TO THE CITY ANY EXPENSE INCURRED BY IT IN ELIMINATING FIRE HA7,ARDS OR OTHER CONDITIONS CREATED BY SUCH DEMOLITION WHICH ARE DETRIMENTAL TO THE PUBLIC WELFARE. SUCH BOND SHALL BE MADE PAYABLE TO THE CITY AND SF3ALL INURE TO THE BENEFIT OF ANY PERSON DAMAGED OR INJURED, IN ANY MANNER, BY THE PRINCIPAL OBLIGOR BY REASON OF SUCH DEMOLITION, EXCEPT THE AGENTS, SERVANTS OR EMPLOYEES OF THE PRINCIPAL OBLIGOR." • • ORDINANCE NO. AN ORDINANCE AMENDING THE PROVISIOPdS OF THE CODE OF ORDINANCES CONCERNING DEt4OLITION OF BUILDINGS AND OTHER STRUCTURES; PROVID- ING THAT EACH NON-OWNER APPLICANT SHALL FILE A FIVE HUNDRED DOLLAR ($500.00) CASH BOrID; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A P4IS- DEt'[EANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); PROVIDING FOR SEVERABILITY; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMt4ISSI0N OF THE CITY OF LA PORTE: Section 1. Section 8-147 of the Code of Ordinances, City of La Porte, Texas, is hereby amended to read as follows: "Section 8-147. Applicant's bond. • "At the time of making an application for a permit under tizis Division, the applicant shall file with the build- ing inspector, a five hundred dollar ($500.00) cash bond, except that where the applicant is the owner of the property, no bond shall be required. The bond shall be conditioned that the principal, if granted a permit, will accomplish such demolition in strict accordance with the terms of this article, and will pay to the City any expense incurred by it in eliminating fire hazards or other conditions created by such demolition which are detrimental to the public welfare. Such bond shall be made payable to the City and shall inure to the benefit of any person damaged or injured, in any manner, by the principal obligor by reason of such demolition, except the agents, servants or employees of the principal obligor." Section 2. If any section, sentence, phrase, clause, or any part of any section, sentence,~phrase, or clause, of this ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Commission • to have passed each section, sentence, phrase or clause, or part theereof, irrespective of the fact that any other section, sentence, phrase or clause, or part ttlereof, may be declared invalid. Section 3. Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of this ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). • Each day any violation of this ordinance shall continue shall constitute a separate violation. • C: -2- • section 4. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Clerk shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance Section 5. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. State Statute and our municipal ordinances establish, as you are aware, a maximum fine of $200.00 for all offenses over which municipal courts have original jurisdiction.
