APPROVAL OF MINUTES - REGULAR MEETING - NOVEMBER 7, 1979, AND SPECIAL EMERGENCY MEETING OF NOVEMBER 14, 1979 - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the minutes of the regular meeting of November 7, 1979, and the special emergency meeting of November 14, 1979. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. ABSTAINED: Commissioner Cline abstained from voting on the minutes of the special emergency meeting because she was not present. + + + 4. CONSIDER APPROVING ON FIRST READING - PROPOSED ORDINANCE NO. 1175 - AN ORDINANCE GRANTING A CABLE TELEVISION FRANCHISE - After the ordinance caption was read in full and the entire ordinance summarized by the Attorney, motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1175 on first reading. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1176 - ORDINANCE DETERMINING AND FIXING THE SCHEDULE OF RATES TO BE CHARGED FOR CABLE TELEVISION - After the proposed ordinance was read in full, motion by Commissioner Kibodeaux, seconded by Com- missioner Tomerlin to approve Ordinance No. 1176 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE DETERMINING AND FIXING THE SCHEDULE OF RATES TO BE CHARGED BY KIP-LEE CATV, INC., d/b/a/ LA PORTE CABLE TELEVISION, IN THE CITY OF LA PORTE, TEXAS; PROVIDING A PROCEDURE FOR DISCONTINUANCE OF SERVICE; PROVIDING A PROCEDURE FOR THE CHANGING OF SUCH RATES; AND PROVIDING AN EFFECTIVE DATE HEREOF. Mr. Lester Kamin was recognized and expressed appreciation for being awarded the franchise for the cable television. Commissioner Cline had a question regarding the charges. Mr. Kamin stated that the company would bill the customers for their charges. + + + 6. CONSIDER MAKING A DECISION REGARDING DANGEROUS BUILDINGS LOCATED ON THE FOLLOWINGPROPERTTES: BLOCK 85, LOTS 1 THRU 5, BAY FRONT BLOCK 93, LOTS 17 AND 18, LA PORTE BLOCK 85, LOTS 17 AND 18, LA PORTE BLOCK 88, LOTS 31 AND 32, LA PORTE BLOCK 35, LOTS 23 AND 26, BAY FRONT Commissioner Tomerlin asked if the status had changed on any of the properties since the public hearing? The Assistant Fire Marshal stated that correspondence had been received from Mrs. F. J. Wilson and her son stated that they wished the building to be demolished and another letter stating that they did not want the building demolished (Block 35, Lot 23 and 26, Bayfront Addition). He further stated that another letter had been written by him to see how the Wilsonls were going to take care of the property. . . . . e Regular Meeting 11/28/79 4 6. CONSIDER MAKING A DECISION REGARDING DANGEROUS BUILDINGS (CONTID.) The Fire Marshal stated that correspondence had been received from Mr. Joe Pattillo (Block 85, Lots 17 and 18, La Porte) authorizing the City to demolish his building and he will pay upon presentation of invoice. No correspondence has been received from Mr. Wonder Sims (Block 93, Lots 17 and 18, La Porte) and none from Mrs. L. B. Walker (Block 85, Lots 1 thru 5, Bayfront). Ms. Ruthie M. Bernard (Block 88, Lots 31 and 32, La Porte) is in the process of demoliting her building. The Administrator stated that it was the recommendation of the staff to proceed with demolition of the buildings and it could be stopped at any time. Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to continue with the process for demolition of the dangerous buildings. RATIFY AUTHORIZING ACCEPTANCE OF PLANNING GRANT FOR THE ENVIRONMENTAL IMPACT ASSESSMENT REPORT FROM THE F.A.A. IN THE AMOUNT OF $13,146.00 - Motion by Commissioner Simons, seconded by Commissioner Tomerlin to ratify authorizing acceptance of a planning grant for the Environmental Impact Assessment Report from the F.A.A. in the amount of $13,146.00. RATIFY AUTHORIZING $3,287.00 FROM THE GENERAL FUND CONTINGENCY TO FUND CITylS 20% PORTION OF THE ENVIRONMENTAL IMPACT ASSESS- MENT REPORT - Motion by Commissioner Simons, seconded by Com- missioner Tomerlin to ratify authorizing $3,287.00 from the General Fund Contingency to fund the cityls 20% portion of the Environmental Impact Assessment Report. Motion carried by the following vote: AYES: NAYS: Commissioner Tomerlin, Kibodeaux, Cline, and Simons. None. + + + 9. CONSIDER APPROVING REQUEST FOR VARIANCE FOR CAR PORT FOR LOTS 11 AND 12, BLOCK 252, LA PORTE - C. D. BOYLE - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve the request for a variance for a car port for Lots 11 and 12, Block 252, La Porte, 623 Kansas, C. D. Boyle. A copy of the recommendation from the Planning & Zoning Commission is attached and made a part of these minutes. . Motion carried by the following vote: AYES: NAYS: Commissioners Kibodeaux, Cline, and Simons. Commissioner Tomerlin opposed granting variances to the ordinance. + + + 10. CONSIDER APPROVING PRELIMINARY PLAT OF GLEN MEADOWS, SECTION III - All the necessary approvals as well as Planning & Zonings recom- mendation for approval have been received. Pat Muston, Chairman of the Planning & Zoning Commission stated that after approval there was second thoughts because of the nearness of the airport, the traffic pattern, etc. It was determined that this section would not be just next to the airport. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the preliminary plat of Glen Meadows, Sec~ion III. CONSIDER ACCEPTING OFFER OF PURCHASE FOR BLOCK 31, LOT 11, LA PORTE ADDITION - MICHAEL HICKS - IN THE AMOUNT OF $740.00 - The Administrator stated that there had been a clarification memo prepared regarding the bid on tax property, Lot 11, Block 31, La Porte Addition; stating that when the suit was filed on two parcels. La Porte Independent School District was served and intervened in the suit. However, the School did not enter an amount due for taxes on Block 31, Lot 11. As a result this does not appear in the judgment. In consulting with the Tax Attorney, Mr. John Coolidge, he stated that if the School did not make this parcel of property a part of their intervention, the school looses the tax due on this property. Motion by Commissioner Simons, seconded by Commissioner Cline to accept the offer of purchase for Block 31, Lot 11, La Porte Addition from Mr. Michael Hicks in the amount of $740.00. RATIFY AUTHORIZING PARTICIPATION WITH FAIRMONT PARK JOINT VENTURE IN CONSTRUCTION OF FARRINGTON BOULEVARD IN THE AMOUNT OF $58,847.00. ($53,000 FROM CAPITAL IMPROVEMENT FUND AND $5,847 FROM THE CAPITAL IMPROVEMENT CONTINGENCY FUND) - Motion by Commissioner Tomerlin, seconded by Commissioner Simons to ratify authorizing participation with Fairmont Park Joint Venture in construction of Farrington Boulevard in the amount of $58,847.00. $53,000.00 from the Capital Improve- ment Fund and $5,847.00 from the Capital Improvement Contingency Fund. DISCUSS CHARTER REVISION - Motion by Commissioner Tomerlin, seconded by Commissioner Simons to authorize the prepared statement regarding the Charter Revision be inserted in the minutes. Motion carried by the following vote: AYES: NAYS: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. None. liThe City of La Porte is currently governed by a Commission-- people elected to oversee particular areas of city services. Commissioner Tomerlin oversees health, recreation and sanitation; Commissioner Kibodeaux - Water and Sewer; Commissioner Cline - Public Works; and Commissioner Simons - Fire and Police. . This form of government was developed around the turn of the century and was widely used in the early 19001s. In recent years, practically all Texas cities have abandoned the commission form of government in favor of more modern forms. The reason is that government by commission can cause taxpayers to spend more money on administration -- each commissioner is responsible for his or her area and there can be duplication of effort and expenditures. The current Commission has attempted to minimize such by appointing a City Administrator but it nevertheless remains a fact that because of our current charter, each Commissioner is responsible to the people for particular areas of city services and must spend funds accordingly. In the summer of 1977, the Commission determined that the City of La Porte would be governed more efficiently and more economically by a Council-Manager form of government. In that form of government, the Council acts as a policy-making board, overseeing the work of the City, and the City Manager is responsible to the Council for the every-day running of City business. A Charter Revision Committee was established to study the situation and recommend revisions to our current Charter. The Committee determined that the Charter itself needed to be streamlined and modernized, in addition to the change in the method of government. . The Committee proposed extensive revisions to some areas of the old Charter while deeming that many areas had stood the test of time and left them lias is". The effort they put forth has been of great benefit to the City and is very much appreciated. The process of changing our Charter has not been a hasty one. The current Charter has lasted over 30 years, and we hope that the new one will be as lasting. Speed is a luxury we cannot afford in such an endeavor-- rather, we have attempted to properly address all issues and have sought the input of all members of our community. . e . Regular Meeting 11/28/79 8 13. DISCUSS CHARTER REVISION (CONTINUED) - Prepared Statement (Continued) One of the areas to be changed is the method of election of the representatives of the people. When such a change is contemplated, the Voting Rights Acts of 1975 requires "pre- clearance" from the United States Justice Department -- that is... before we make the change we must ask if we can do it the way we want to. When a proposed change is submitted to Justice, a 60-day period begins, during which the Attorney General must decide whether to disapprove the change, or to "offer no objection at this time." If Justice requests additional information, a new 60-day waiting period begins upon their receipt of the information. In preparation for our submission to Justice, citizens went door-to-door conducting a census. The results were tallied and charted on maps. This has been time consuming, but necessary in order to document our plan for the needed changes. We have now already made two separate submissions to Justice, both of which are pending approval. . The first involves the concept of a council-manager form of government with four single-member districts, two counci1persons at-large and the mayor. Both the Committee and the Commission held public hearings on this plan and it was received by Justice on August 13. In response to an informal request, we sent additional information on September 28. They formally requested additional information at the end of the 60-day period, which we supplied, beginning a new 60-day period. This is the last delay that Justice is allowed to make on this submission. We should receive an answer by January 3, 1980. The second submission assumes approval of the first submission and proposes specific district boundary lines. Several public hearings were held on the placement of the lines and the submission was made on October 26. Justice will have until December 26 to reply, if their response is positive. However, they can, as on the first submission, request additional information and thereby delay as long as until March 5, 1980. Since we must have Justice Department preclearance approval before our election, it is practically impossible to have a charter election in January of 180, as planned. The Commission has moved judiciously and with all appropriate speed. We are now simply waiting on the Federal bureaucracy." . + + + . . . . e Regular Meeting 11/28/79 9 14. BAG SYSTEM - Mr. Jimmy Ray Spradling stated the Bag System being studied at the present time in Fairmont Park was working out really well and he would like to see it remain. He stated that he preferred the plastic garbage bags. He felt that the Commission had made a good choice. + + + 24. As it is apparent you are now handling your mother's affairs, I would like to take this opportunity to outline what has transpired in the past year concerning your mother's property located here in La Porte. On April 6, 1979, your mother sent a letter to the City of La Porte Tax Assessor (please find copy enclosed) asking that the taxable value of the structure located at Block 35 on Lots 23-24, be set at nil value. The Tax Assessor, after,~evi~wing her request, set the value at $60.00. ($60.00 is the physical value used by the Tax Assessor to show on the tax roll that there is a structure on a property, but that it does not have any taxable value.) On September 5, 1979, the Board of Inspection made a dangerous building inspection of the structure at the previously listed location. After making the inspection, it was the unanimous opinion of the Board that the structure was dangerous, and recommended that it be demolished. '. J. e e e e e e e On October 8, 1979, the La Porte City Clerk sent your mother (by Certified Mail) a copy of the Board's dangerous building report, along with a cover letter. The cover letter stated, in part, that if certain requirements were not met within a predetermined length of time, a public hearing would be held, and the date of such hearing. On November 14, 1979, (since no repair progress schedule had been negotiated by your mother with the building official as required), the City of La Porte Commission held the scheduled public hearing. At the hearing the Board of Inspection introduced their report and your mother's response to their report, After hearing the evidence presented, the Commission voted to uphold the Board's recommendation that the structure was dangerous, and must be demolished. The Commission also requested at this hearing that I write your mother in regards to their decision and find out how she would prefer to handle the demolition. On November 15, 1979, I wrote your mother as requested, and I received your reply to that letter on November 21, 1979. In your reply you stated in part: 1. We do not want it demolished. 2. We have torn off the porch that was ~angerous. 3. We have contracted to have a new roof put on. The Board of Inspection must point out at this time that: 1. You do not have a remodeling permit as required. 2. You have never negotiated a repair in progress schedule as required, 3. When repairs to existing structure cost in excess of fifty percent of the physical value are made, the building shall be made to conform to the requirements for new structures. e e e e Because of the extensive amount of work that the acceptable codes state will be required to be done if the structure is to be saved from demolition, I would recommend that you and your mother come to La Porte and meet with the Board of Inspection so a time- table can be set and permits be taken out. The Sponsor shall: Begin accomplishment of the Planning Project within 30 days after acceptance of this Offer, with failure to do so constituting just cause for termination of the obligations of the United States here- under by the FAA; e a. b. Sponsors shall submit for FAA approval prior to their execution all private party or public body contracts to do all or any part of the Planning Project. These contracts shall include applicable terms and conditions as specified by the FAA, 11. The FAA reserves the right to disapprove the Sponsor's employment of specific consultants and their subcoll- tractors to do all or any part of the Planning Project and further reserves the right to disapprove the proposed scope and cost of the professional services. 12. The FAA reserves the right to disapprove the use of professional level employees of the Sponsor when such em- ployees are designated by the Sponsor to do all or part of the Planning Project. 13. All published material such as reports, maps, and other documents prepared in connection with the Planning Project and planning work activities shall contain a standard notice that the material was prepared under an Airport Mas ter Planning Grant provided by FAA. The Sponsor shall make these documents available (Master or System) for examination by the public. In addition, no material prepared in connection with the Planning Project and planning work activities shall be subject to copyright in the United States or in any other country. The FAA shall have unrestricted authority to publish, disclose, distribute, and otherwise use, in whole or in part', any reports, data, or other materials prepared with Airport Planning Grant funds. 14. The Sponsor agrees to conduct the Planning Project in compliance with all the requirements imposed by or pur- suant to Title VI of the Civil Rights Act of 1964 and by Part 21 of the Regulations of the Office of the Secretary of Transportation, as amended. The Sponsor agrees that neither the approval of the Planning Application nor the tender of this Offer nor the approval of the final airport mas ter planning report constitutes an assurance or commitment, (master or system) express or implied, by the FAA, that any airport development or unit thereof shown in the planning developed as part of this Planning Application will be approved for inclusion in any pending or future Airport and Airway development Program under the Airport and Airway Development Act of 1970. 16. The Grantee agrees to effectuate the purposes of Section 30 of the Airport and Airway Development Act of 1970, as amended, by assuring that minority business enterprises shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with federal funds provided under this Agreement. For purposes of this provision, "minority business enterprises" means a business enter- prise that is owned by, or is controlled by, a socially or economically disadvantaged person or persons. Such disadvantage may arise from cultural, racial, religious, sex, national origin, chronic economic circumstances or background or other financial causes. Such persons may include, but are not limited to, Blacks not of Hispanic origin; persons of Hispanic origin; Asians or Pacific Islanders; American Indians and Alaskan natives. Commissioner Tomerlin oversees health, recreation and sanitation; Commissioner Kibodeaux -- Water and Sewer; Commissioner Cline Public Works; and Commissioner Simons -- Fire and Police. This form of government was developed around the turn of the century and was widely used in the early 1900's. In recent years, practically all Texas cities have abandoned the commission form of government in favor of more modern forms. The reason is that govern- ment by commission can cause taxpayers to spend more money on admin- istration -- each commissioner is responsible for his or her area and there can be duplication of effort and expenditures. The current Commission has attempted to minimize such by appointing a City Administrator but it nevertheless remains a fact that because of our current charter, each Commissioner is responsible to the people for particular areas of city services and must spend funds accordingly. In the summer of 1977, the Commission determined that the City of La Porte would be governed more efficiently and more economically by a Council-Manager form of government. In that form of government, the Council acts as a policy-making board, overseeing the work of the City, and the City Manager is responsible to the Council for the every-day running of City business. A Charter Revision Committee was established to study the situation and recommend revisions to our current Charter. The Committee determined that the Charter itself needed to be streamlined and modernized, in addition to the change in the method of government. e e e The Committee proposed extensive revisions to some areas of the old Charter while deeming that many areas had stood the test of time and left them "as is". The effort they put forth has been of great benefit to the City and is very much appreciated. The process of changing our Charter has not been a hasty one. The current Charter has lasted over 30 years, and we hope that the new one will be as lasting. Speed is a luxury we cannot afford in such an endeavor -- rather, we have attempted to properly address all issues and have sought the input of all members of our community. One of the areas to be changed is the method of election of the representatives of the people. When such a change is contem- plated, the Voting Rights Acts of 1975 requires "preclearance" from ~ the United States Justice Department -- that is . before we make the change we must ask if we can do it the way we want to. When a proposed change is submitted to Justice, a GO-day period begins, during which the Attorney General must decide whether to disapprove the change, or to "offer no objection at this time." If Justice requests additional information, a new GO-day waiting period begins upon their receipt of the information. In preparation for our submission to Justice, citizens went door-to-door conducting a census. The results were tallied and charted on maps. This has been time consuming, but necessary in order to document our plan for the needed changes. We have now already made two separate submissions to Justice, both of which are pending approval. e -2- e e ~ The first involves the concept of a council-manager form of government with four single-member districts, two councilpersons at-large and the mayor. Both the Committee and the Commission held public hearings on this plan and it was received by Justice on August 13. In response to an informal request, we sent additional information on September 28. They formally requested additional information at the end of the 60-day period, which we supplied, beginning a new 60-day period. This is the last delay that Justice is allowed to make on this submission. We should receive an answer by January 3, 1980. The second submission assumes approval of the first submission and proposes specific district boundary lines. Several public e hearings were held on the placement of the lines and the submission was made on October 26. Justice will have until December 26 to reply, if their response is positive. However, they can, as on the first submission, request additional information and thereby delay as long as until March 5, 1980. Since we must have Justice Department preclearance approval before our election, it is practically impossible to have a charter election in January of '80, as planned. The Commission has moved judiciously and with all appropriate speed. The Planning and Zoning Commission recommends rezoning of Block 727 from Commercial to Light Industrial. Since the City does not presently have such a classification, the recommendation must be to rezone to Industrial, with use limited to light industry. At the present time the property bears a-Commercial classification, with a special use permit to allow light industry similar in nature to container repair operations. The Planning and Zoning Commission does not wish to discourage an experienced.company such as Piers ide Industries, Inc., from operating in the City of La Porte. We feel that the "know-how" of this company will set an example for similar industries to follow. We have been assured that the location will not cause any traffic hazard or nuisance to neighboring properties. It is reasonable to expect that-such a firm will not complete purchase of the property, nor make needed improvements to the property under the temporary and limiting terms of a special use permit. We therefore recommended rezoning to Industrial, with use limited to light industry. In some instances damages may be repaired by simple hand hammering. The cut and welded areas are finished by priming and p~inting with spray cans. On aluminum units the damaged areas are cut away ,.,ith sa\'ls, holes are drilled, and nmV' aluminum parts are riveted into place with pneumatic hammers. A third type of container is the fiberglass reinforced plywood unit. Again the damages are cut away with saws, a new panel is inserted and glassed into place. The patch is then sanded and painted. From this description you can see the parallel between our business and an auto body repair shop, the only difference being, our bodies are larger and our finishes aren't nearly as exacting. Once the repairs are accomplished, the unit would be stacked on our yard, until the owner calls for it. At that time, the owner or lessee of the container, and or chassis, would disnatch a truck to our location and the needed units ~,'7ould theT1 be trans- ported a"ray. 1. HUDGENS SUBJECT: PARTICIPATION WITH FAIID10NT PARK JOINT VENTURE ON CONSTRUCTION OF FARRINGTON BOULEVARD In an earlier action by Council the City agreed to participate with Fairmont Joint Venture in the construction of the remaining portion of Farrington Boulevard. That construction/participation did not include concrete apron access points to the parking lot of the baseball complex. The following is the estimated cost to add these improvements: Adjust Drainage Inlets - 2 ea. @ $510.00,= 7" Class A Reinforced Concrete - 163 sy @ 16.15 sy = Excavation 130 cy @ 2.40 cy = $1,020.00 $2,632.43 312.00 $3,964.45 396.45 Plus 10% Engineering Fee $4,360.90 Also, in this years Capital Improvement Fund $12,000.00 was budgeted to construct an apron, and crossover on Farrington ~n the North side of West Main. The estimated cost to complete the concrete portion of this project is as follows: 7" Class A Reinforced Concrete 130 sy @ 16.50 sy = $2,099.50 Excavation 50 cy @ 2.40 cy = 120.00 Curbing 25 If @ 2.00 If = 50.00 Dowels 50 ea @ 2.00 ea = 100.00 $2,369.50 Plus 10% Engineering Fee 236.95 $2,606.45 Since there is sufficient monies in the Capital Improvement Fund Budget for the additional work and the concrete portion of the latter project it is recommended that the Council authorize this work to be added to the existing contract of Fairmont Park Joint Venture.
