Motion by Commissioner Tomerlin, seconded by Commissioner
Kibodeaux that the meeting recess for an executive session.
Motion carried by the following vote:

4. APPROVAL OF MINUTES - REGULAR MEETING OF NOVEMBER 28, 1979,
AND EMERGENCY MEETING OF DECEMBER 3, 1979 - Motion by Commissioner
Cline, seconded by Commissioner Simons to approve the minutes of
the regular meeting of November 28, 1979, and the emergency meeting
of December 3, 1979, as presented. Motion carried by the following
vote:
AYES: Commissioner Kibodeaux, Cline, and Simons, and Tomerlin.
NAYS: None.
Commissioner Tomerlin abstained, he was not present at
the meeting of December 3, 1979, because he was out of
town.

5. CONSIDER APPROVING FISCAL ADVISOR CONTRACT WITH MORONEY BEISSNER -
Motion by Commissioner Simons, seconded by Commissioner Tomerlin
to approve the fiscal advisor contract with Moroney Beissner. A
copy of the contract is attached and made a part of these minutes.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
6. CONSIDER APPROVING PROPOSED ORDINANCE NO. 915-0 - ORDINANCE
GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NO. 915,
"PIPELINE TRANSPORTATION", BEING CHAPTER 18-A OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, TEXAS; AND APPROVING THE
APPLICATION OF EXXON PIPELINE COMPANY, DATED SEPTEMBER 19, 1979,
TO CONSTRUCT A FOUR -INCH BENZENE PIPELINE, A SIX-INCH BUTANE
PIPELINE, AND A SIX-INCH CRUDE BUTADIENE PIPELINE; AND PROVIDING
AN EFFECTIVE DATE HEREOF - After the proposed ordinance was read
in full, motion by Commissioner Tomerlin, seconded by Commissioner
• Kibodeaux to approve Ordinance No. 915-0 as read. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

7. CONSIDER REZONING REQUEST TO REZONE SEVERAL TRACTS OF LAND OUT
OF THE W. M. JONES SURVEY, ABSTRACT NO. 482, HARRIS COUNTY,
TEXAS (EDDIE GRAY PROPERTIES IN FAIRMONT PARK) FROM RESIDENTIAL
TO "C" APARTMENT AND COMMERCIAL - Commissioner Tomerlin asked
if copies of the plat map showing the proposed rezoning were
available. Both the City Clerk and Mr. Eddie Gray had plat
maps to show the area in question. A copy was placed on the
blackboard so that it could be seen by everyone present.
Commissioner Tomerlin pointed out the property under considera-
tion.
Commissioner Tomerlin stated that there had been some misunder-
standings and objections to the proposed rezoning; looking at
the study A & M had been doing, the proposed plans was in line
with their recommendations; going from residential to multi-
family, then apartments, then commercial. There was a pipeline
dividing the property from Industrial zoned property.
Commissioner Simons asked about the span of the street. It was
determined that it would be 80-foot and none of the homes would be
facing on the thoroughfare and no driveways would be on the thorough-
fare.
is Commissioner Tomerlin stated that he would like to see all the
commercial property designated as commercial property either on
the recorded plat or by stake.
Commissioner Cline stated that she had no objections to the
commercial property, but only without apartments.
Commissioner Kibodeaux stated that he felt the same as Commissioner
Cline.
There was a brief discussion regarding duplex units that already
exist in Fairmont Park and the fact that if duplex were going to
be built, it would have to come before the Commission before
any building permits could be granted.
There was a general discussion regarding drainage and the
concern for draining off into Fairmont Parkway and then to
Big Island Slough.
Mr. Gray stated that the County was short on funds for drainage.
It was determined that the project proposed for that area would
take four to five years; the overall project from five to ten
years.

7. CONSIDER REZONING REQUEST TO REZONE SEVERAL TRACTS OF LAND OUT
OF THE W. M. JONES SURVEY, ABSTRACT NO. 482, HARRIS COUNTY,
TEXAS (EDDIE GRAY PROPERTIES IN FAIRMONT PARK) FROM RESIDENTIAL
TO "C" APARTMENT AND COMMERCIAL (CONTINUED) -
Mr. Gray stated that whatever was built would be in keeping
with the neighborhood; he hoped to attract good builders for
townhomes, patio homes and apartments; have good landscaping
that would give meaning to the area.
Motion by Commissioner Tomerlin, seconded by Commissioner
Simons, based on the recommendation of the Planning and Zoning
Commission, to rezone these properties, after the proposed
ordinance had been read in full. Motion carried by the follow-
ing vote:
AYES: Commissioners Tomerlin and Simons.
NAYS: Commissioner Kibodeaux and Cline.
Mayor Meza voted aye, and broke the tie.
• CAPTION: ORDINANCE NO. 780-TT - AN ORDINANCE AMENDING ORDINANCE
NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;
AND PROVIDING AN EFFECTIVE DATE.
8. ADMINISTRATIVE REPORTS - A. The Administrator stated that
the auditor had finished the office work on the audit draft
and would present it to the staff on Friday and to the Commission
the latter part of December.
B. The Administrator stated that work through Harris County
Community Development for 1st, 2nd and 3rd Streets would be
starting after the first of the year.
C. The Administrator stated that Mr. David Corbin and Roy Young
would update the Commission on the E.P.A. Sewer Project.
Plats were presented to the Commission members showing the
proposed project.
Mr. Corbin stated that there had been delays in getting proposals
• for energy and treatment and the project was about six weeks
behind schedule.

8. ADMINISTRATIVE REPORTS (CONTINUED)
Mr. Corbin stated that the plan was to submit plans and specifi-
cation to the State by March 1st.
Mr. Corbin explained the proposed operation of the plant and
that it was designed so that one basin and one clarifier could
be closed down the the other one operating.
There was a brief discussion regarding the sludge, its possible
usage and the disposal of same; a comparison of truck hauling
to drying beds and the fact that it could not be dumped at the
landfill and the fact that all disposal will be a problem in
the next year.
An estimated project schedule was distributed. A copy is
attached and made a part of these minutes.
Mr. Corbin further stated that they planned to request authori-
zation to go for bids by August lst and the facility would be
under contract by October lst.
• There was a brief discussion regarding the priority list, that
we have been authorized for Step II funding; plan to send
application for Step III by May lst. The cost estimate is
still $3,610,000 plus 10% contingency esclation of $310,000.
Mr. Corbin stated that there was still a problem in the location
of the water line from Fairmont Park to HW 146 and we are exploring
other avenues and the line may be put in the Right -Of -Way of
Fairmont Parkway and HW 146. We have not been able to find any-
thing that says that "L" and'K" Streets have been closed and
are continuing to check.
There was a brief discussion regarding gravity flow of the line.
D. The Administrator requested an executive session to discuss
real estate and personnel.

Gentlemen:
In connection with the future growth of the City of La Porte and the resultant
need for additional borrowing, we propose to act as financial advisors for the City under
the following terms and conditions.
We will stand ready at all times to advise with the City Commission on any
additional bonds or warrants that it proposes to issue, or refunding of outstanding bonds
or warrants, and to make detailed studies of each separate item as presented. In this
connection we will assist the City Commission in determining maturity schedule, interest
rates, optional provisions and the amount of tax levy required.
We agree to periodically submit financial information, as well as general.
•
information, on the City of La Porte to Moody's Investors Service and to Standard &
Poor's Corporation towards the end that the present ratings on La Porte will be extended
to include additional issues of bonds and, of course, improved if possible. We will pay all
costs incident to the preparation of the financial information and general information and
the presentation of this information to the rating agencies, including a trip to New York,
if we feel the trip will be advantageous. However, the City will pay any fees charged by
the rating agencies for issuing their rating.
We will be available at all reasonable times for consultation with the City
Commission and the City Officials on all matters pertaining to the City's financial posi-
tion.
Whenever it has been determined that the City desires to issue any bonds or
• warrants or refunding of outstanding bonds, then the City agrees, at its own expense,
to make available a firm of recognized market attorneys acceptable to us to prepare all
necessary orders and certificates and to issue their legal opinion.
In each case we agree to furnish, at our own expense, the printed bonds or
warrants forms and to pay all usual and customary expenses incidental to the approval
of these bonds by the Attorney General, the registration by the Comptroller of Public
0 Accounts and delivery to the purchaser at a bank in Austin, Texas.

• It is agreed and understood that all bonds be sold on competitive bids and
that the undersigned, or any of its associates,, shall not have any interest; directly or in-
directly, in the sale of any bonds by the City, excepting the fees provided in this con-
tract.
When bonds are ready for sale then in those issues which total $500, 000
or more a printed prospectus shall be prepared and mailed to investment bankers in the
United States dealing in municipal securities. This prospectus shall contain, in sufficient
detail, terms and conditions under which bids will be taken, bid forms, complete financial
statement and adequate general information on the City. If less than $500, 000 of bonds
are to be offered for sale, then substantially this same information shall be prepared in
xerographic form, or some similar method, and submitted to prespective bidders.
• For and in consideration of our services and as reimbursement for expenses
which we will have paid on behalf of the City, the City agrees to pay us a cash fee on all
new issues or refundings, this fee to be in the following amounts:
(a) 3% on the first $50, 000 of Bonds;
2% on the next $200, 000 of Bonds;
1-1/2% on the next $1 Million of Bonds;
3/4 of 1% on the next $1-1/2 Million of Bonds;
1/2 of 1% on all bonds over $2, 750, 000.
(b) In addition thereto, the City agrees to pay us a cash
retainer of five hundred dollars ($500.00) per year,
this retainer to be paid out of current funds and to
• become due and payable on September 1 of each year.
The fees listed in (a) above shall become due and. payable simultaneously
with the delivery of bonds to the purchaser and, in the case of a refunding, when old
bonds have been cancelled and new refunding bonds have been issued in exchange
thereof.
It is agreed and understood that the fees listed in (a) above shall not be
due and payable should the City for any reason be unable to make final delivery on any
• issue of bonds or warrants or to complete any refunding and, in this event, any expenses
which we have incurred shall accrue solely to us.

This contract shall remain in full force and effect for a period of five (5)
years from its date, or in the event an issue is in the process of being completed then
the term shall extend until this issue has been delivered and paid for.

November 8, 1979
I have reviewed the request ma/
e by Exxon Pipeline Co. for three
(3) pipelines to be constru ed.• As stated in the request they
will cross North "D" Stre just west of 26th Street. We have
no utilities in the are of North "D" Street, however, this off-
ice must be notified the lines to be constructed cross Spencer
Hwy. or Fairmont Parkway.
The Water and Wastewater Divisions should have a representative
present at these crossings because we do have utilities in these
areas.
• The Water and Wastewater Divisions should be notified at least
twenty-four hours prior to these crossings.

The Planning & Zoning Commission met with Eddie Gray, developer, and
H. Carlos Smith, engineer, in regard to plans for developing new sections
of Fairmont Park.
We recommend approval of preliminary plans for Fairmont Park, West,
Section V, and for Fairmont Park East, both subject to approval by
City Inspector and City Engineer.
Since the entire area came into the City of La Porte under the provision
of single-family zoning for all annexed areas, these new sections are
presently zoned R-1. The developer requested zoning some peripheral
areas to accommodate multi -family or commercial buildings. A great
deal of planning is evident in the selection of the proposed areas,
and it seems that the overall plan fits in with the general feelings
expressed by members of the City Commission and the Planning & Zoning
Commission concerning the placing of commercial structures and multi-
family dwellings on peripheral zones of subdivisions.
The Planning & Zoning Commission recommends zoning to Commercial
those parcels of land from Fairmont Park, West, Section V, west to
Underwood and south to Fairmont Parkway. Likewise, those parcels of
land from Fairmont Park East, south to Fairmont Parkway, north to
Spencer Highway, and east to the property line.
