Meza; Commissioners I. J. Kibodeaux, Virginia Cline, and Tom C. Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioner John Tomerlin. OTHER CITY OFFICIALS PRESENT: J. R. CONSIDER APPROVING MINUTES - REGULAR MEETING DF DECEMBER 5, 1979 - Commissioner Cline stated that she felt that the minutes should be clarified on item 4 - Approval of Minutes- Regular Meeting of November 28, 1979, and Emergency Meeting of December 3, 1979 -.because Commissioner Tomerlin did vote on November 28, 1979, but did abstain from voting on the December 3, 1979 meeting because he was out of town. Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve the minutes of the December 5, 1979, meeting with the correction: Item 4 - Approval of Minutes "Motion by Commissioner Cline, seconded by Commissioner Simons to approve the minutes of the regular meeting of November 28, 1979, and the emergency meeting of December 3, 1979, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. • Commissioner Tomerlin abstained from voting on the minutes of the meeting of December 3, 1979, because he was out of town and did not attend the meeting." AUDIT REPORT FOR FISCAL YEAR ENDING SEPTEMBER 30, 1979 - Mr. Eugene Hovey, C.P,A. - Mr. Hovey was recognized and addressed the Commission for an audit report for the fiscal year ending September 30, 1979. P4r. Hovey stated that we had had another good year, but have many needs and objectives that have not been achieved. Mr. Hovey then went through each schedule of the Audit, giving a synopsis. Mr. Hovey stated that a separate Revenue Sharing Audit and Firemen's Pension Fund Audit were being done and would report at a later time. • Mr. Hovey stated that there was no management letter as in the past, showing credit to the Mayor, Commission and staff; showing the City's good sound financial condition and expressed his appreciation for the opportunity to present the audit. • • Regular Meeting 12/19/79 3 4. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1180 - ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK ELEVEN HUNDRED TWO (1102), IN THE TOWN OF LA PORTS, HARRIS COUNTY, TEXAS - It was determined that all the supporting information and checks had been received, fee value, $7,920.00, Mr. John Kiibler, Jr. After the proposed ordinance had been read in full, motion by • Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1180 as read. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK ELEVEN HUNDRED TWO (1102), IN THE TOWN OF LA PORTS, HARRIS COUNTY, TEXAS. (MR. JOHN KIIBLER, JR.) + + + 6. CONSIDER APPROVING PROPOSED ORDNANCE NO. 1181 - ORDINANCE VACATING, ABANDONING P,ND CIASING P; PORTION OF THE INTERSECTION OF PARK AVENUE AND SAN JACINTO AVENUE;'AND PROVIDING AN EFFECTIVE DATE HE'RE'OF - After the proposed ordinance was read in ull, Commissioner Cline asked the Attorney if he felt that the fact that the portion of intersection being closed by the City of La Porte would be enough reference in the future, to be under- stood that the City did this, and that the property owner was not required to buy it? The Attorney was of the opinion that that • fact should be noted in the minutes. • i • Regular Meeting 12/19/79 6. CONSIDER APPROVING PROPOSED ORDINANCE NO. 1181 - ORDINANCE VACAT'IN'G, ABANDONING AND CLOSING A PORTION OF THE INTERSECTION OF PARK AVENUE AND SAN JACINTO AVENUE (CONTINUED Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance 1181 as read and that the minutes reflect that this ordinance was being passed at this time to correct what was felt to be an error or omission, at the time that San Jacinto and Park Avenue were paved, and the City government, at that time, did not take the action to straighten out the configuration of the block, therefore the payment by the property owner was waived. Everyone had assumed over the years that that had been closed. The buildings had been there since 1932, and this ordinance has been done at this time to correct that oversight. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABADIDONING AND CLOSING A PORTION • OF THE INTERSECTION OF PARK AVENUE AND SAN JACINTO AVENUE; AND PROVIDING AN EFFECTIVE DATE HEREOF. (EVELYN CRAIG). + + + 7. CONSIDER APPROVING RESIGNATION OF REPRESENTATIVE AND ALTERNATE REPRESENTATIVE TO HOUSTON-GALVE'STQN AREA COUNCIL (COMMISSI'ONER CLINE, REPRESENTATIVE AND COMMISSIONER TOMERLIN, ALTERNATE REP- RESENTATIVE) - As previously discussed in work shop, motion by Commissioner Kibodeaux, seconded by Commissioner Simons to designate Commissioner Virginia Cline as representative and Commissioner John Tomerlin as alternate representative to the Houston-Galveston Area Council. NO. 1182 - ORDINANCE ESTABLISHING CONSTRUCTION SPEED ZONES-FROM THE SOUTHERN PACIFIC RAILROP,D UNDERPASS TO LOOP 2.01 - After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Simons to approve Ordinance No. 1182 as read. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. CAPTION: AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF SH 146 WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTE, TEXAS, AND PROVIDING THAT ANY PERSON VIOLATING THE PROVISIONS OF THIS ORDINANCE SHALL UPON CONVICTION BE FINED IN ANY SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • 9. Motion by Commissioner Kibodeaux, seconded by Commissioner Cline to amend the motion to authorize preparation of plans and specifi- cations for the 16th Street Sewer Line, and the payment to come • from the Utility Extension Fund. DISCUSS AUTHORIZING EXECUTION OF A CONTRACT WITH PRECINCT ONE, HARRIS COUNTY, FOR STREET MAINTENANCE AND CONSTRUCTION DUE TO REVISIONS OF HOURLY RATES FOR LABOR AND EQUIPMENT - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to table indefinitely execution of a contract with Precinct One, Harris County since the City has never signed a contract them and will not do so now. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. + + + 16. ADMINISTRATIVE REPORTS - The Administrator requested that the Commission consider authorizing amending the contract with Fairmont Joint Venture to do additional work at the intersection of Farrington and West Main. He stated that he had talked with the Engineers of Glen Meadows Subdivision, and they have agreed verbally, and am awaiting for something in writing, if the City will pave the other side up to the first intersection,. we are already paving with the radius, about 40-feet, they have said verbally that they would pay up to 50~ of the cost, not to exceed $6,000.00, and requested authorization from the Commission when confirmation was received in writing, to amend our contract, and pave the first street in Glen Meadows. There was a brief discussion regarding the costs and the fact that it should not increase the City's cost any. There was a brief discussion regarding the number of lots; the size of the lots; the fact that $12,000.00 has been budgeted. • • Regular Meeting 12/19/79 16. ADMINISTRATIVE REPORTS (CONTINUED) Commissioner Cline asked why D2ischer amount. The Administrator was of the beneficial to the sale of their lots. 8 Harris wanted to pay this opinion that it would be Mayor Meza was of the opinion that that would be better than having to angle across with black top. There was a brief discussion regarding the other entrance to the airport on the North side of Farrington; whether or not gasoline trucks would be going into the airport. The Adminis- trator was of the opinion that there would be some gasoline trucks going in there. The gasoline trucks would be only going to the first corner. There was a discussion regarding the fact that $12,000.00 had been budgeted. The Administrator stated that he had talked with Ted Bogren of Municipal Engineering working for Mischer Harris and approval should be forth coming. • There was a discussion regarding improving the intersection for signalization. Commissioner Cline stated that if this would only be to the first intersection, then what happens on further back. It was determined that would be done as funds bacame available. It was moved by Commissioner Cline, seconded by Commissioner Simons to authorize the Administrator to amend the contract with Fairmont Joint Venture, after a committment in writing had been received from Mischer Harris for their 50$ participation. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. -0- B. The Administrator recommended that the Commission consider canceling the January 2, 1980, meeting due to the holidays and the fact that we had no business for that date, and schedule the regular meetings to be on the 9th and 23rd of January and the work shops to be on the 16th and 30th of January, 1980. • • • • Regular Meeting 12/19/79 9 16. CANCEL MEETING OF JANUARY 2, 1980 - Motion by Commissioner Cline, seconded by Commissioner Simons to cancel the regular meeting of January 2, 1980 and have the regular meetings for January on January 9, 1980 and January 23, 1980, and the work shops to be on January 16, 1980 and January 30, 1980. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Cline, and Simons. NAYS: None. + + + C. In the interest of safety, it is desirable to establish a reduced speed zone for posting along sections of the roadway during construction operations and we are hereby requesting that the zone be established by Council action at your regular meeting. Attached are two copies of a sample ordinance containing the recommended zone. This draft is so written that it is automatically canceled upon completion of the project. Prior to City authorizing the City's engineer to prepare plans and specifications Owner will deposit with City in escrow a sum of money based on and equal to the City engineer's estimated project-cost in conformance with Section 4, less esti- mated construction, construction staking and inspection costs. Thereafter, City will authorize the City engineer to prepare plans and specifications for said extension(s). Upon completion of plans • and specifications City will place the project for bid. When bids are received they shall be tabulated by the City and a copy of said tabulation shall be provided to Owner. Thereafter, Owner shall deposit with City in escrow a sum equal to the amount bid by the lowest responsible chosen bidder, plus a sum equal to the estimated construction staking and inspection fees if applicable. When said deposit has been made by Owner, City shall execute a contract for said extension(s). It is agreed and understood that the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the project that result from circumstances beyond the control of City. (6) City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage connection charge for water and/or sewer service against said property belonging to Owner. Owner shall be responsible for all other customary charges. (7) Upon execution of this agreement and compliance with terms herein, City agrees to begin the preparation of engineering plans and construction specifications for said extension(s), and to begin construction thereof as soon as tre same may be let for contract as herein provided. The project was and one lift station, the lift station Polk. into a contract with C. D. inch sanitary sewer line zg line, south to Polk and to include seven manholes to be built at 16th and In August 1979, I received a phone call from a plum.ber,.hzred by Tex-A-Mation Engineering, to tie into their tap. He told me that the manhole at Barbours Cut was full of water. I sent a crew out to see what the problem was. The crew called me out on the job and we discovered that the manhole at Barbours Cut and 16th Street had a false bottom. The manhole now must maintain a certain amount of head in order for the sewer to flow south to the lift station as it was intended. The problem is shown in the drawing provided. Flowline "C" is what was actually installed. As is shown in the drawing, the flow from station 6 + 65 to 11 + 25 is reversed. There should have been a 20% grade from the manhole at Barbours Cut to the lift station at Polk, as indicated by flowline "A" in the drawing. As indicated by flowline "B", I propose to re-Iay the line from station 0 + 00 to 11 + 25 using the existing manholes. A falle bottom will have to be poured in the manhole at Barbours Cut. The change was accepted very well. Better than 95% of the people responding were in favor of converting to the bag system. Over 60a/o of those responding to our request to turn their questionaires favored the plastic bag system. I found the bag system to be .sons. After the garbage had sightly garbage cans sitting the street. Less garbage wa men scattered less or hardly ared to the cans. very favorable for several rea- been collected there were no up- on the curb or blowing out into s scattered because the pick-up none with the bag system as comp- • This system will completely eliminate complaints about Sanit- ation personnel damaging cans, running over them, leaving the lids off or not completely emptying the cans. The Sanitation personnel perfer the plastic bags because they are cleaner and eaiser to handle. With the plastic bag system the bags are always closed. With the paper bags, people over- fill them and are unable to close them properly. Should they turn over they spill garbage and if it is raining the bag gets water inside and out which tears more easily. The cost of the plastic bags compared to the paper should be enough reason to choose the plactic bag system over the paper bag system without the reasons I have listed. As you know the plastic bags cost about 4 as much as the paper bags. I suggest we go with the plastic bag system and do it now. I also suggest we go out for bids on plastic bags as soon as poss- ible in order to implement the new system. I suggest for those who want to use the paper bags that the City have them available for purchase. The purpose of the request was to allow repairs such as sandblasting and spray painting to be done to trailers. The requirements of the State of Texas regarding such operations are so strict that, if the process is in compliance with state regulations, there should be no noxious fumes, dust, or particles emitted from the facility. It would be policed by the State to insure compliance. The Planning & Zoning Commission does not recommend rezoning to our present industrial classification, because we feel that some uses permitted in that classification are not suited to this location. • Our recommendation is to issue a special use permit to allow repair, sandblasting and painting, fabrication, and storage~of trailers on Blocks 333 and 334, La Porte, subject to meeting State and City regulations. We request a joint public hearing regarding the special use permit. I was advised by Mr. Kendle this morning that we would have to put anew engine in it now. This would cost about $4,500.00. I had hoped to get by this year and buy a new one next year. Since this machine is a 1973 model, I do not recommend spending this much money on it. We have other problems with the machine as well and would probably continue to have problems with it. The Water Division must have a backhoe at once in order to try to stay up with the many ,taps that come in each week. They are • behind now because the machine has been in the shop.
