3. APPROVAL OF MINUTES - REGULAR MEETING - JANUARY 9, 1980 -
Motion by Commissioner Tomerlin, seconded y Commissioner
Kibodeaux to approve the minutes of the regular meeting of
January 9, 1980, as presented. Motion carried by the following
vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

4. CONSIDER AWARDING BID - ONE MILLION GARBAGE BAGS - There was
a brief discussion regarding the bids received. Motion by
Commissioner Cline, seconded by Commissioner Simons to accept
the recommendation of the Public Works Director and award the
bid for the garbage bags to the low bidder, Sunbelt Plastics
in the amount of 42.5G per pound; reserving the right to go to
the next low bidder should Sunbelt Plastics refuse to send a
certif ied weight ticket with each shipment. A copy of the
recommendation is attached and made a part of these minutes.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

5. CONSIDER APPROVING PROPOSED ORDINANCE NO. 780-UU - ORDINANCE
GRANTING A SPECIAL USE PERMIT FOR BLOCKS 333 AND 334, LA PORTE,
HARRIS COUNTY, TEXAS, FOR LIGHT INDUSTRY TO ALLOW REPAIRS,
SANDBLA'ST'ING-AND PAINTING, FABRICF,TION, AND STORAGE OF TRAILERS -
(JACK B. KELLEY) - After the proposed ordinance was read 1n full,
motion by Commissioner Kibodeaux, seconded by Commissioner Cline
to approve Ordinance No. 780-UU as read. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

6. CONSIDER APPROVING PROPOSED ORDINANCE NO. 780-W - ORDINANCE
REZONING BLOCKS 726 AND 727, LA PORTS, HARRIS COUNTY, TEXAS,
FROM "C" APARTMENT AND COMMERCIAL TO LIGHT INDUSTRIAL (PIERSIDE
INDUSTRIES) - After the proposed ordinance was read in full,
motion by Commissioner Simons, seconded by Commissioner Cline
to approve Ordinance No. 780-W as read. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF
LA PORTS ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF
THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN

7. CONSIDER FORMAL ACCEPTANCE OF FAIRMONT PP,RK WEST, SECTION V -
• The Administrator referred to the memo from the City Inspector
recommending acceptance of Fairmont Park West, Section V by
City personnel. All tests have been made and approved. A copy
of the memo is attached and made a part of these minutes. The
Administrator recommended formal acceptance by the City.
Motion by Commissioner Kibodeaux, seconded by Commissioner Cline
to accept Fairmont Park West, Section V. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

8. ADMINISTRATIVE REPORTS - A. The Administrator stated that during
the rain of the past few days, we have experienced excessive
infiltration into our sanitary sewer system and we have a group
of citizens present that have been affected more severely. There
will be an agenda item at the work shop to address the Commission
on January 30, 1980. Further stating that he felt most of the
Commission was aware of the situation because of the problems that
we have been having for some time.

8. ADMINISTRATIVE REPORTS (CONTINUED)
B. The Administrator requested an executive session concerning
legal matters regarding the trip to Washington and the Justice
Department.

9. COUNCIL ACTION - A. Commissioner Kibodeaux asked if any cost
figures were available for the sanitary sewer problem? The
Administrator stated that the Public Works Director had a meeting
scheduled with one of the local contractors, the next day, to
get cost estimates worked up.
Commissioner Kibodeaux asked P4r. Burks to tell the citizens what
we would be doing on the sewer problem.

Mr. Burks stated that he had been working with the citizens for
the past few days. There is one section of line that has been
dug up four times, the section of line where the houses back up
to Spencer on Old Orchard. The cost is too great to continue
to repair and we need to replace that line. He further stated
that this was an old concrete line which occasionally caves in
even without the rain.
The Administrator stated that there were two sections of line having
a problem: Piney Brook towards Farrington between Catlett and
Old Orchard. This line was slipped line some years ago.
Commissioner Kibodeaux asked the Attorney if this could be considered
as an emergency? The Attorney stated, "Yes."
Commissioner Kibodeaux stated that he would like to see if we could
get the money and go ahead with this work so that the people could
get some relief.
Commissioner Cline asked how we would stand with the grant that is
supposed to come through on this, if we spend the money out of the
budget, can we get it back.
Commissioner Kibodeaux stated that we could not get it back. He
had already discussed this with the Engineer.

The Administrator stated that we have two million dollars authorized
in sewer bonds. We initially sold $150,000 sewer bonds, to pay
for engineering costs and design work. We can use those bond funds
to pay for the repair of relaying these lines. However, that would
not be reimbursable by the E.P.A, under the grant structure.

9. COUNCIL ACTION (CONTINUED)
The E.P.A. is going to pay 75~ of the total rehabilitation.
There is approximately $600,000 worth of rehabilitation. If
we go ahead and do this work prior to the grant being received,
then we will not be reimbursed that 75~.
Commissioner Simons asked what we were talking about in the
time sequence? About one year.
The Administrator stated that we will be submitting our plans
to the Texas Department of Resources about the 1st of March.
It was the consensus of opinion of the Commission that the work
needed to be done now.
Commissioner Kibodeaux stated that he had some funds in the
Water/Sewer Improvement Fund, but did not have enough.
Commissioner Cline stated that she felt that we had tried to
hold off but with so much rain could no longer wait.
• The Administrator stated that over the ast few
p years, we had
tried to patch and make do, without spending a great deal of
money, pending receipt of the grant. He further stated that
repair would be enormous should the Commission determine that
this is one that can't wait.
Mayor Meza stated that he felt that the Commission felt that this
was necessary; just talking about it was not going to get the job
done. He further stated that we should get the price that it
would cost to do the project; inform the Commission, and they
can then take action.
B. Commissioner Tomerlin asked about action on the "OWNER'S
CERTIFICATE OF ACCEPTANCE". It was determined that was handled
and authorized by formal acceptance of Fairmont Park, West,
Section V.
C. Commissioner Cline requested an Executive Session for Saturday,
January 26, 1980, at 2:00 P.M. for a debriefing on the trip to
Washington. An Executive Session will be held at 2:00 P.M., on
January 26, 1980.

SUBJECT: Accepting Bids on Garbage Bags
My recommendation concerning the bids on garbage bags is that we
accept the low bid of Sunbelt Plastics of 42.5G per lb. I also
recommend that we reserve the right to go to the next low bidder
should Sunbelt Plastics refuse to send a certified weight ticket
with each shipment.
The next low bidder was Poly-Amercia Inc. at 50~ per lb.
Should we have to go to the next low bidder because of any de-
fault of Sunbelt Plastics then the City should sue for the diff-
• erence in price per lb.

REQUEST TO REZONE BLOCKS 333 AND 334,
LA PORTE, FROM "C" APARTMENT AND COMMERCIAL,
TO LIGHT INDUSTRY - JACK B. KELLEY, INC.
Planning & Zoning Commission met December 4, 1979, to consider the
above request.
The purpose of the request was to allow repairs such as sandblasting
and spray painting to be done to trailers. The requirements of the
State of Texas regarding such operations are so strict that, if
the process is in compliance with state regulations, there should be
no noxious fumes, dust, or particles emitted from the facility. It
would be policed by the State to insure compliance.
The Planning & Zoning Commission does not recommend rezoning to our
present industrial classification, because we feel that some uses
• permitted in that classification are not suited to this location.
Our recommendation is to issue a special use permit to allow repair,
sandblasting and painting, fabrication, and storage of trailers on
Blocks 333 and 334, La Porte, subject to meeting State and City
regulations.
We request a joint public hearing regarding the special use permit.

OCTOBER 23, 1979
The Planning and Zoning Commission recommends rezoning of Block 727
from Commercial to Light Industrial. Since the City does not
presently have such a classification, the recommendation must be
to rezone to Industrial, with use limited to light industry.
At the present time the property bears a.Commercial classification,
with a special use permit to allow light industry similar in nature
to container repair operations.
The Planning and Zoning Commission does not wish to discourage an
experienced company such as Pierside Industries, Iric., from
operating in the City of La Porte. We feel that the "know-how" of
• this company will set an example for similar industries to follow.
~~e have been assured that the location will not cause any traffic
hazard or nuisance to neighboring properties.
It is reasonable to expect that such a firm will not complete purchase
of the property, nor make needed improvements to the property under the
temporary and limiting terms of a special use permit.
We therefore recommended rezoning to Industrial, with use limited to
light industry.

Dear Mr . Iiudgens;
The purpose of this letter is to introduce you to Piersi.de
Industries, our operation, and our proposed relationship with
the City of LaPorte.
Piersi_de Industries is presently negotiating the purchase
of 2 adjoining parcels of land wi_thi.n the LaPorte City limits.
Ore parcel _s zoned industrial, the other is zoned commercial.
This letter is our request to change the zoning of the commercial
parcel to i.rdu~tri_al, so that we may conduct eur business, cahich i~:
1. The repair of oceanic cargo containers and chassis.
?.. The storage of said containers and chassis upon
completion of the repairs.
The repair of steel units involves cutting away the damaged
area with torches and arc welding new patches or panels in its
Place. In some instances damages may be repaired by simple hand
hammering. The cut and welded areas are finished by priming and
painting with spray cans.
On aluminum units the damaged areas are cut away with saws,
holes are drilled, and new aluminum parts are riveted into place
with pneumatic hammers. A third type of container is the fiberglass
reinforced plywood unit. ~1gai.n the damages are cut away with saws,
a new panel is inserted and glassed into place. The patch is then
sanded and Painted. From this description you can see the
Parallel between our business and an auto body repair shoe, the
only difference being, our bodies are larger and our finishes
aren't nearly as exacting.
Once the repairs are accomPl.ished, the unit would be stacked
on our yard, until the owner ca 1. ].s for it. At that time, the
o`,mer or lessee of the container, anal or chassis, would dispatch
a truck to our location and the needed units would then he trans-
ported away.

SUBJECT' Acceptance of Fairmont Park, West, Section 5
•
On January 15, 1980, a joint walk through inspection was made of Fairmont Park,
West, Section 5.
City Officials making this inspection were- R.L. Caldwell, Louis Tabar,
Chacko Thomas, C.L. Hollaway and David Paulissen. Others making the inspection
were Bob Parks of Park and Smyer and Sandy Clark of McKey Construction Co.
This was the second inspection of section 5, A11 problems found at the first
inspection had been remedied. It should be noted that this is one of the
cleanest and most wu1~ done sub-divisions that we have inspected.
We have received copies of all the Concrete tests and all passed, also all
the hydrostatic tests of the water system have passed.
PJe have the bacteriological test results and they too are all in order.
It is the recommendation of the City Personnel present that Fairmont Park,
West, Section 5, be accepted by the City of La Porte.
