OF ABSENTEE VOTING; PROVIDING FOR NOTICE; PROVIDING FOR FILING
DEADLINE AND FILING FEES FOR CANDIDATES; PROVIDING FOR THE
HOLDING OF A JOINT ELECTION WITH THE LA PORTE INDEPENDENT
SCHOOL DISTRICT; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF -
The Attorney read the caption of Ordinance No. 1184, added the
names of election judges and alternates as follows: Election
Precinct No. l: Lou Lawler, Presiding Judge; D. O. Laird,
Alternate Presiding Judge; Election Precinct No. 2: Janet Graves,
Presiding Judge; Ed Ferguson, Alternate Presiding Judge; and
Absentee Voting Clerk, Lou Lawler; and corrected Section 7,
establishing the deadline for a candidate to make application
to have his name appear upon the ballot, to Wednesday, March 5,
1980.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to repass Ordinance No. 1184 as corrected. Motion carried
• by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY
OF LA PORTS; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESIG-
NATING ELECTION PRECIf1CTS AND POLLING PLACES; PROVIDING FOR

BE IT ORDAINED BY THE CITY COT4MISSION OF THE CITY OF LA PORTS:
Section 1. An election shall be held within the corporate
~~ limits of the City of La Porte, Texas, on the 5th day of April,
• 1980, such day being the first Saturday in April, 1980, between
seven o'clock (7:00) A.M. and seven o'clock (7:00) P.f4., for
the purpose of electing a Commissioner of said City for Position
No. 2, a Commissioner of said City for Position No. 4, and a
Mayor of said City. Arun-off election, if necessary, shall
be held on April 26, 1980, between the same hours. Said elec-
tion, and said run-off election, if necessary, shall be held
in conjunction with a Trustee's election to be held on the
same date(s) by the La Porte Independent School District, and
C the appointed officials who shall be appointed to conduct the
La Porte Independent School District election, will also be
allowed to conduct the City official election for the City of
La Porte.

Section 2. Said election shall be held a
t each of the
following voting places within said City, and the following
named persons are hereby appointed as officers of said election,
to-wit:
Election Precinct No, l: All voters living in such Pre-
cinct No. 1 (consisting of that portion of the City of La Porte
which is located east and north of the Southern Pacific Rail-
road) shall vote at the La Porte Senior High School Student

Student Lounge, which is located at Park Street and East Fairmont
Parkway in the City of La Porte, Texas, with the following
election officers:

Election Precinct No. 2: All voters living in such Precinct
C No. 2 (consisting of that portion of the City of La Porte which
• is located west and south of the Southern Pacific Railroad)
shall vote at the Baker School Cafetorium, which is located at
t•]est t4ain Street and Underwood Road, La Porte, Texas, with the
following election officials:

The Presiding Judge at each of the above specified polling
places shall appoint as many clerks as he or she deems neces-
sary for the proper conduct of said election at said polling
place, provided that at least two clerks shall be appointed
in each case.
Section 3. Voting at said election, including absentee
• voting, shall be by the use of voting machines and the ball
ots
of said elections shall conform to the Texas Election Code, as
amended.
Absentee voting shall be conducted by a clerk for absentee
voting, namely, LOU LAWLER , and the place
at which the absentee voting shall be conducted is designated
as the Administration Building, La Porte Independent School
i District, 301 East Fairmont Parkway, La Porte, Texas, to which

address ballot applications and ballots voted by mail may be
mailed. Said clerk shall keep said office open for absentee
voting during his regular working hours and in any event for
at least eight (8) hours on each day which is not a Saturday,
a Sunday, or an official State holiday.
Section 4. That all election raterials including notice
of the election, ballots, instruction cards, affidavits and
other forms which voters may be required to sign and all absentee
C voting materials shall be printed in both English and Spanish,
• or Spanish translations thereof shall be made available in the
circumstances permitted and in the manner required by law.
Section 5. The City Clerk of the City of La Porte shall
forthwith issue Notice of said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE
. SUPd, which is hereby found and declared to be a newspaper of
general circulation in said City, not less than ten (10) days
nor more than thirty (30) days prior to the date of the said
election.

Section 6. Upon a candidate tendering his application on
the form prescribed, the City Clerk shall furnish to such candi-
date all information relative to the qualifications for the
office being sought; the method of placing the candidate's name
on the ballot; the amount of the required filing fee; and any
other pertinent information concerning said election.
Section 7. The deadline for a candidate to make applica-
tion to have his name appear upon the ballot for such election,
is hereby designated and established as 5:00 o'clock P.M.,
Wednesday, March 5, 1980. No application shall be accepted
for filing prior to February 5, 1980. The filing fee for each

candidate for the office of Commissioner is hereby established
as Fifty Dollars ($50.00), and the filing fee for each candi-
date for the office of Mayor is hereby established at the sum
of One Hundred Dollars ($100.00). The filing fees shall be
used to defray the cost of the election, and said fees shall
be prorated and any surplus shall be refunded to said candi-
dates. As an alternative to paying a filing fee, a candidate
may obtain a place on the ballot by filing a petition as pro-
vided for in City of La Porte Ordinance No. 968, passed and
approved October 1, 1973, codified as Section 9-3 of the Code
of Ordinances of the City of La Porte.
Section 8. Said election shall be held in accordance with
the provisions of the City Charter of the City of La Porte, and
the general election laws of the State of Texas governing
general and municipal elections, so far as same may be applicable
thereto.

Section 9. Immediately after said election, the officers
holding the same shall make and deliver the returns of the
results thereof and the accompanying records for use in the
official canvass to the City Commission of the City of La Porte,
and the City Commission shall canvass said returns at the
earliest practicable time, and shall, immediately after can-
vassing the returns, declare the results of the election. The
Mayor shall immediately thereafter deliver to the candidate
for whom the majority of votes has been polled for each respec-
tive office, a certificate of election. Such elected officials
shall assume their duties within ten (10) days thereafter,
Sundays excluded, upon their taking the oath of office.

Section 10. The City Commission of the City of La Porte
hereby authorizes reimbursement to the La Porte Independent
School District, for one-half (1/2) of the common expenses
of the joint election(s).
Section 11. Each and every provision, paragraph, sen-
tence and clause of this Ordinance has been separately con-
sidered and passed by the City Commission of the City of
C La Porte, Texas, and- each said provision would have been
• separately passed without any other provision, and if any
provision hereof shall be ineffective, invalid or unconstitu-
tional, for any cause, it shall not impair or affect the
remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 12. This Ordinance shall be in effect immediately
upon its passage and approval.
Section 13. The City Commission officially finds, deter-
C mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meetin of the

City Commission was posted at a place convenient to the public
at the City Hall of the City for the time required by law
• preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The City Commission further ratifies, approves
and confirms such written notice and the contents and posting
thereof.

SEA ORDENADA POR LA COMISION DE LA CUIDAD DE LA PORTE:
Seccion 1. Una eleccion se celebrara dentro de las
fronteras de la Ciudad de La Porte, Tejas, el 5 de abril, 1980,
este dia siendo el primer sabado de abril, 1980, entre las horas
de las 7 de la manana y las siete de la tarde. El proposito
• de esta eleccion es de eligir un comisario para el puesto numero 2,
un comisario para el puesto numero 4 y un alcalde para la dicha
Ciudad. En caso de empate, otra eleccion se celebrara el 26 de
abril, 1980, durante las mismas horas. Dicha eleccion, y tambien
la eleccion en caso de empate, se celebrara al mismo tiempo Como
una eleccion para escoger unos fiduciarios para el distrito
escolar independiente de La Porte. Todas las elecciones emplearan
los mismos oficiales o jueces de eleccion.
Seccion 2. Dicha eleccion tendra lugar en los siguientes
lugares de votacion en dicha Ciudad, y las_personas siguientes
oficialmente son los jueces:

Pacific) daran sus votos en la cafeteria de la escuela Baker Jr.
High, ubicada entre Las Galles West Main Street y Underwood Road,
La Porte, Tejas, con Los siguientes jueces:

El senor CAROL GRABBE , juez alternate

La juez principal en cada uno de Los ya mencionados lugares
de votacion nombraran tantos ayudantes Como se crea necesarios
para llevar a Cabo de una manera eficaz y apropiada~dicha eleccion
en dicho Lugar. Dos ayudantes tienen que ser nombrados en cada
caso.
Seccion 3. La votacion en dicha eleccion sera por medio de
maquinas de votar, y Las boletas de dichas elecciones corresponderan
a el codigo de elecciones de Tejas, Como se halla modificado.
Una dependienta, LOU LAWLER sera la encargada del

votar en la eleccion temprana (para ellos que no pueden votar
a la fecha regular). E1 Lugar para esta eleccion sera el edificio
administrativo del distrito escolar independiente, 301 East Fairmont
Parkway, La Porte, Tejas, y a esta direction se deben enviar Las
aplicaciones para conseguir boletas y Las boletas que ya estan
completas. Dicho dependiente quardara abierta dicha oficina de
votar para Los votos ausentes durante sus horas normales de trabajo,
y en todo caso por to menos 8 horas cada dia si no es sabado, domingo,
ni un dia de vacation official del estado de Tejas.
. Seccion 4. Que todos Los materiales de la eleccion, incluyendo
Las noticias de la eleccion, Las boletas, Las tarjetas de
instrucciones, Las declaraciones juradas, y Las otras formas que
necesiten la firma del votante y todas Las formas para Los votantes
que tengan gue votar en adelante por ausencia se veran en ingles
y en espanol, o traducciones estaran disponibles segun la ley.

Seccion 5. E1 dependiente municipal de La Porte dares, sin

demora, noticia de dicha eleccion por causar que aparezca una
parte substantial de esta ordenanza en el BAYSHORE SUN, to cual
es debidamente hallado y declarado el periodico de circulation
general de esta ciudad, en no menos de 10 dias ni en no mess de
30 dias antes de la fecha de dicha eleccion.
Seccion 6. Al dar un candidato su aplicacion en la forma
correcta, el dependiente municipal tiene que dar a tal candidato
toda la informacion en cuanto a less calificaciones de la oficina
deseada; el metodo de poner el nombre del candidato en la boleta,
el costo pares aplicar por la oficina; y cualquier otra informacion
tocante a dicha eleccion.
Seccion 7. La ultima hora pares la cual un candidato pueda

aplicar pares que aparezca su nombre sobre less boletas de tal
eleccion es less 5 de la tarde, miercoles, el 5 de marzo, 1980.
Ninguna aplicacion sera aceptada antes del 5 de febrero, 1980.
E1 honorario pares cada candidato pares la posicion de comisario
es debidamente declarado ser cincuenta dolares ($50.00). E1
honorario pares cada candidato pares la posicion de alcalde es
debidamente declarado ser cien dolares ($100.00). Este honorario,
o sea costo, se usara pares disminuir el costo de la eleccion, y
dichos costos de los candidatos se cuotizaran y si se queda algo,
esto se devolvera a los candidatos. En vez de pagar honorarios,
un candidato puede obtener un lugar sobre la boleta por dar una
petition Como provisto en la ordenanza municipal de La Porte
nu. 968, parades y aprobada el primer dies de octubre, 1973,
codificada como la section 9-3 del codigo de ordenanzas de la
ciudad de La Porte.
Seccion 8. Dicha eleccion se celebrara de acuerdo con less
provisioner de la cartes municipal de La Porte, y con less leyes
generales electorales del estado de Tejas que gobiernan less
elecciones generales y municipales.

Seccion 9. Inmediamente despues de dicha eleccion, los
• oficiales o jueces entregaran los resultados y las copiers oficiales
a la comision municipal de La Porte para que ester los pueda
contar y verificar. La comision tiene que contar los resultados
tan pronto posible, y entonces, sin demora ninguna, declarar
los resultados oficiales de la eleccion. Entonces el alcalde
inmediatamente entregara al candidato recibiendo una mayoria de
los votos un certificado de eleccion. Los nuevos eligidos tomaran
sus lugares oficiales dentro de 10 dias, no inclusive los domingos,
al prestar juramento de sus posiciones.
Seccion 10. La comision municipal de La Porte3a permiso
para un reembolso al distrito escolar de La Porte para la mitad
(1/2) de los gastos comunes de la (s) eleccion(es) acoplada(s).

Seccion 11.
Cada provision, parrafo, frase, y clausula de
ester ordenanza ha sido separadamente considerado por su propio
merito, y pasado por la comision municipal de La Porte, Tejas, y
cada provision hubiera sido aprobada sin cualquier otra provision,
y si alguna provision cualquiera sea inefectiva, invalida, en
contra de la constitucion, no obstante la razon, esto no danara
ni afectara la parte restante, ni ninguna otra parte, pero
cualquier porcion valida se quedara efectiva como si hubiera sido
pasada sola.
Seccion 12.
Estes ordenanza ester en efecto inmediatamente
al ser pasada y aprobada.
Seccion 13.
La comision municipal oficialmente halla,
determiner, reciter, y declarer que suficientes noticias escritas
de la fecha, la hora, el lugar, y el sujets de ester session de
la comision municipal se han exibidos en un lugar conveniente
al publico en la cases consistorial de ester Ciudad de acuerdo
con el tiempo requerido por la ley, como requerido por la ley
de las sessiones abiertas, articulo 6252.17, las leyes civiles
anotadas de Tejas; y que ester session ha estado abierta al
publico como requiere la ley durante todos los tiempos durante
los cuales ester ordenanza y la materia que ester discute han
• sido discutidas, consideradas, y formalmente actuadas. Mas, la
comision municipal confirma, aprueba, y confirma tales noticias
escritas, su contenido, y su exibicion.
