3. APPROVAL OF MINUTES - REGULAR MEETING - FEBRUARY 20, 1980 -
Motion by Commissioner Cline, seconded by Commissioner Tomerlin
to approve the minutes of the regular meeting of February 20,
1980, as presented. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

4. CONSIDER AUTHORIZING MAYOR TO EXECUTE AGREEMENT WITH HARRIS
COUNTY FOR RURAL FIRE PROTECTION - Motion by Commissioner
Tomerlin, seconded by Commissioner Kibodeaux to table this
item for further study before authorizing the Mayor to execute
the agreement with Harris County for rural fire protection.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

5. CONSIDER AWARDING BIDS FOR MISCELLANEOUS EQUIPMENT AND VEHICLES -
Recommendations from the Chief of Police were distri uted recom-
mending that the bids for Police vehicles be awarded as follows:
Two staff vehicles, Jay Marks, the low bidder, in the amount of
$13,046.56; One I. D. Van, Jay Marks, the low bidder, in the
amount of $6,266.67; Four patrol vehicles, Joe Camp Ford, because
of past service problems encountered with the Dodge vehicles and
dealership, in the amount of $7,212.17 each, total $28,848.68.
Motion by Commissioner Kibodeaux, seconded by Commissioner Cline
to award the bids as recommended by the Police Chief to: Jay Marks
Chevrolet in the amount of $13,046.56 for two staff vehicles; to
Jay Marks Chevrolet in the amount of $6,266.67, for one I.D. Van;
and to Joe Camp Ford, in the amount of $28,848.68 for four patrol
units. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.

6. CONSIDER AUTHORIZING 32 STREET LIGHTS - GLEN MEADOWS, SECTION
TWO - It was determined that the advance fee had been paid by
the developer for 32 street lights.
Motion by Commissioner Tomerlin, seconded by Commissioner Cline
to authorize 32 street lights for Glen Meadows, Section Two.
Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

7. CONSIDER ADOPTION OF 1979 EDITIONS OF THE SOUTHERN 'STAN'DARD
BUILDING, PLUMBING, MECHANICAL, GAS AN DWELLING CODES AND
SMOKE DETECfiION ORDINANCE - Upon the recommendation of the
City Administrator, it was moved by Commissioner Cline,
seconded by Commissioner Kibodeaux that consideration of
adoption of the 1979 editions of the codes be postponed until
the next regular Commission meeting. Motion carried by the
following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

8. CONSIDER ADOPTION OF ORDINANCE GRANTING DISABI'I;ITY EXEMPTIONS -
PROPOSED ORDINANCE`N0. 1190 - After the proposed ordinance was
read in full, motion by Commissioner Cline, seconded by Com-
missioner Tomerlin to adopt Ordinance No. 1190 as read. Motion
carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.

CAPTION: AN ORDINANCE AMENDING CHAPTER 23, "TAXATION", OF THE
CODE OF ORDIANNCES OF THE CITY OF LA PORTE, BY EXEMPTING FIFTEEN
THOUSAND DOLLARS ($15,000.00) OF THE ASSESSED VALUE OF RESIDENCE
HOMESTEADS OF DISABLED ADULTS AND PERSONS SIXTY-FIVE (65) YEARS
OF AGE OR OLDER FROP4 ALL AD VALOREM TAXES LEVIED BY THE CITY OF
LA PORTE FROM AND AFTER JANUARY 1, 1980; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.

• 9. ADMINISTRATIVE REPORTS - The Administrator spoke of the memo
that had been distributed from the Board of Inspection requesting
consideration be given to appropriating funds for demolition
of buildings located at 222 South Y Street and 1212 Bayshore
Drive. The owners of these properties have consented to have
the City demolish these buildings.
When the program was instituted no funds were budgeted to pay
for demolition and it was the intention to have Council budget
from the General Fund Contingency as they occurred. Both
owners have agreed to sign a promissory note. The signed
note has been received from Mr. Roy Rodriguez, Jr., for the
building at 222 South Y and we expect to receive an answer
from Mrs. William Smith for the building at 1212 Bayshore
Drive. The staff requested that Council appropriate $2,900.00
from the General Fund Contingency to the Code Enforcement
budget to have these buildings demolished.
Prices were taken by sealed quotes. Two were received from
Robert Daniel and U. S. Williams Demolishing Co. U. S.
Williams was the low quote, The Administrator requested that
the Council authorize the appropriation of these funds and
demolition of the buildinga at 1212 Bayshore Drive would not
be authorized until the signed promissory note was received.
Motion was made by Commissioner Cline, seconded by Commissioner
Kibodeaux to appropriate $2,900.00 from the General Fund
Contingency to proceed with the demolition of the property
at 222 South Y and 1212 Bayshore Drive. Motion carried by
the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, and Cline.
NAYS: None.
The Administrator stated the general contractors for City
Hall have been in replacing the wall paper and ceiling tile.
The Administrator spoke of having some serious negotiations
regarding the repairing of the sound system, and that
everything was moving along. In addition there is a
meeting scheduled for Friday with the P. G. Bell staff to
discuss the matter further.
The Administrator requested an executive session for litigation
and personnel.
COUNCIL ACTION - Commissioner Tomerlin expressed his thanks
and appreciation to Commissioner Kibodeaux for his negotiations
on behalf of Parks and Recreation for the poles. The City
obtained more poles than expected.

regarding Rural/Urban Fire Protection in Harris County.
Please complete the necessary information and return
the agreement to the Harris County Fire Marshal's
Office as soon as possible.
Based on 1979 statistics each fire department will
receive an amount using the formula below:
Base Rate $ 4,200.00
Structural Fire (per run) 30.00
Non-Structural Fire (per run) 15.00
Emergency Response (per run) 5.00
Mutual Aid (per run) ~ 25.00

AGREEMENT
THE STATE OF TEXAS ~
COUNTY OF HARRIS ~
THIS AGREEh1ENT, made and entered into by and between HARRIS COUNTY,
a body corporate and politic under the laws of the State of Texas, hereinafter
sometimes called "County", acting herein by and through its County Judge duly
authorized to so act by an Order of the Harris County Commissioners Court, and
the City of LaPorte a municipal corporation duly
organized and existing under the laws of the State of Texas, hereinafter some-
times called "City", acting herein by and through its Mayor duly authorized to
so act by an Ordinance duly passed by the City.
WITNESSETH:
• WHEREAS, Harris County desires to provide fire fighting and fire
protection services to certain unincorporated areas of Harris County as here-
inafter designated; and
4JHEREAS, the City of LaPorte is
willing to furnish fire fighting and fire protection services to said unin-
corporated areas of Harris County for the considerations hereinafter provided;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in considera-
tion of the mutual covenants, agreements and benefits to both parties, it is
AGREED as follows:
I.
During the term of this agreement, the City agrees to furnish fire
fighting and fire protection services to the unincorporated areas adjoining
• the corporate limits of this City designated by zone number 33-34 on the
official fire protection zone map of Harris County, to which reference is here
made.
II.
Harris County agrees to pay the sum of $ 5,170.00
to the City for fire fighting and fire protection services to the unincorporated
areas of :iarris County pursuant to Paragraph I of this agreement. The County
• agrees said sum is to be paid to the City within thrity (30) days after the
execution of this contract.

III.
The term of this agreement shall be one (1) year beginning January
1, 1980, and ending December 31, 1980,
IV.
It is hereby agreed and understood that the fire fighting and fire
protection services to be furnished by the City under this agreement shall
include but not be limited to the following: Answering all-calls for help
and assistance in extinguishing fires in the area designated in Paragraph I
of this agreement; furnishing fire fighting personnel, equipment and supplies
to fight all fires within the said area; and answering all calls and furnishing
fire fighting personnel, equipment and-supplies to protect persons and prop---
• erty within the said area which are endangered by fires to adjacent areas;
provided, that the above described personnel, equipment and supplies are not
otherwise engaged in fire fighting within the City.
V.
The City shall observe and comply with all Federal, State, County
and City laws, rules, ordinances and regulations in any manner affecting the
conduct of the services herein provided and performance of all obligations
undertaken by this agreement.
VI.
It is expressly understood that the County has the maximum sum of
$ 5,170.00 specifically allocated to fully discharge its obligation
under this agreement and it is expressly understood that in no event shall the
County be obligated to pay this City more that the said surn of $ 5,170.00
• under the terms and provisions of the agreement.
VII.
It is further agreed that in the performance of all obligations
undertaken by this agreement, the City has the right to supervise, manage,
control and direct the performance of fire fighting and fire protection services;
the County shall look to the City for results only and the County shall have no
right at any time to direct or supervise the City or its agents or employees in
the performance of such services or as to the manner, means or method in which
the services are performed.

VIII.
The City agrees to deliver to the Fire Marshal of Harris County,
a certified copy of the ordinance authorizing the City to enter into this
agreement within five (5) days after the execution of this agreement.
IX.
The City agrees to furnish the Fire Marshal of Harris County, not
later that the fifth (5th) day of each month, a monthly report listing the
total number of runs made into the unincorporated areas of Harris County for
the previous month and such other information relating to fire fighting and
fire prevention services of the City as may be requested by Fire Marshal of
Harris County. Said report shall be made on the form provided by the Harris
County Fire Marshal and shall be signed and certified by an official of the
City.

encumberanced to purchase this in 1980. The bids received on this vehicle
at the council meeting of Feb 27, 1980 were as follows:

Vinson Dodge 7 377.31
Alternatives to the bid included were: None
After evaluating the bids, I recommend that the bid of Jay Marks
Chevrolet be accepted in the amount of $6,266.67. Jay Marks was the o
bidder on this vehicle.

Alternatives to the bid included were: None
After evaluating the bids, I recommend tha the bid of Jay Marks
• Chevrolet be accepted in the amount of $6523.28 each or $13,046.5 Jay
Marks Chevrolet was the low bidder on these vehicles.

Joe Camp Ford bid over the Vinson Dodge bid because of past service problems
encountered with the Dodge Vehicles and dealership.

Re: Glen Meadows, Section Two Street Light Agreement
Dear Ms. Goyer:
Enclosed is a check for the 32 street lights in the above
mentioned subdivision. Please proceed with obtaining the street
light contract with Houston Lighting & Power Co. so that we may
have lights at the earliest possible moment for our residents in
the Section. We are already receiving reports of vandalism and
burglaries and we feel that street lights would be a great asset
to deter some of this crime.
If you need any additional information, please do not hesitate

SU6JcCT: Adoption of 1979 codes.
The Inspection Department has reviewed the 1979 editions of the Standard
Codes.
We,have reviewed the Building Code with Paul Hickenbottom and he is in
agreement, that cae should adopt the Code.
We have discussed the Building, Plumbing, Mechanical, Gas and Dwelling
- Codes for 1979 and feel we should adopt them.
We will appreciate your reviewing the enclosed Ordinance with the
City Attorney and present same to Commission for formally amending
Ordinance no. 1060.
If at some future point in time we discover any unwanted provisions
in these codes we will instigate amending procedures.

ORDINANCE NO. 1190
AN ORDINANCE AMENDING CHAPTER 23, "TAXATION," OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, BY EXEMPTING FIFTEEN THOUSAND
DOLLARS ($15,000.00) OF .THE ASSESSED VALUE OF RESIDENCE HOME-
STEADS OF DISABLED ADULTS AND PERSONS SIXTY-FIVE (65) YEARS OF
AGE OR OLDER FROM ALL AD VALOREM TAXES LEVIED BY THE CITY OF
LA PORTE FROM AND AFTER JANUARY 1, 1980; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTEo
Section 1, Section 23-3, Chapter 23, "Taxation," of the
Code of Ordinances of the City of La Porte, Texas,' is hereby
amended to read as follows, to-wit:
"TAXATION10
• "Seca 23-3. Exception to payment of Ad Valorem Taxes.
From and after January 1,. 1980, Fifteen Thousand Dol~
lars.($15,000.00) of the assessed value of residence home
steads of an adult who is disabled for purposes of payment
of disability insurance benefits under Federal Old-Age,
Survivors and Disability Insurance, or is sixty-five (65)
years of age or older shall be exempted from ad valorem
taxes levied by the City of La Porte; provided, however,
that any person desiring the right of exemption shall first
complete and file with the Tax Assessor-Collector of the
City of La Porte a sworn statement stating his name, age,
and the legal description of said residence homestead; if
disabled, a copy of Social Security disability certificam
tion; and, provided further, that no residence homestead
shall be entitled to more than one residence homestead
tax exemptiono"
Section 2. This Ordinance shall take effect ar~d be in
force from and after its passage and approval.
Section 3. The City Commission officially finds, deter---
• mines, recites and declares that a sufficient written notice of
the date, hour, place and subject of this meeting of the City
Commission was posted at a place convenient to the public at the
City fall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at ali
• times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The

The Charter Revision Committee, at a meeting on February 14, 1980,
gave its final approval to revisions to the proposed Home Rule
Charter districting plan, and districting map. Copies of each
are attached to this letter.
The Charter Revision Committee recommends approval of the proposed
Home Rule Charter, as amended, by the City Commission, and its
submission to the voters at an election in August, 1980.

SUBJECT: Amending Smoke Detector Ordinance ~~1093.
It has become necessary to ask that this Ordinance be
amended since its passage September 19, 1977, for the following
reasons:
I am requesting that Section 1 be amended because this
Ordinance was made a part of the 1976 Edition of the Standard
Buildi~.g Code with no saving clause, and when the 1979 Edition
of the Standard Building Code is adopted, this Ordinance will
have to be re-adopted.
I am requesting that-Section 1 be amended to include 1976
Edition, or currently enforced building code., heretofore adopted.
In Section 1 Paragraph 2, I am requesting this amendment to
also include duplex and boarding house, since these were
inadvertently left out of the-first Ordinance.
Location of smoke detector section has been more clearly
defined because of the response'~from installers that the present
Ordinance was too vague.
Final approval is a new section. I am requesting this section
be included for clarification of responsibility.
I am requesting that Section 2 be amended to include the words
duplex and townhouse complex, which were inadvertently left out
of the first Ordinance.
I am requesting that Section 3 be amended to include boarding
house ar~d duplex, because again, they were left out of the first
Ordinance.
I am requesting that Section 4 be amended to exclude two-family
dwellings.
Section 5 stays the same.

I am requesting that Section 7 be amended to include the
following sentence. Each violation and each day the violation(s)
continues shall constitute separate and individual offenses, and
