APPROVAL OF MINUTES - REGULAR MEETING - MARCH 5, 1980 - Motion by Commission Tomerlin, seconde by Commissioner Cline to approve the minutes of the regular meeting of March 5, 1980, as presented. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Cline. NAYS: None. Commissioner Simons abstained from voting for approval of the minutes of the meeting of March 5, 1980, as he was not present for the meeting. + + + 4. CAPTION: AN ORDINANCE AMENDING THE 1979 EDITION OF THE STANDARD BUILDING CODE, OR CURRENTLY ENFORCED BUILDING CODE, AS AMENDED, AND ALSO KNOWN AS THE BUILDING CODE OF THE CITY OF LA PORTE; BY AMENDING SECTION 1127, FIRE DETECTION SYSTEMS, REQUIRING AND REGULATING SMOKE DETECTORS; PROVIDING A SEVER- ABILITY CLAUSE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETING LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. .7 + + + 8. It has become necessary to ask that this Ordinance be amended since its passage September 19, 1977, for the following reasons: I am requesting that Section 1 be amended because this Ordinance was made a part of the 1976 Edition of the Standard Building Code with no saving clause, and when the 1979 Edition of the Standard Building Code is adopted, this Ordinance will have to be re-adopted. I am requesting that Section 1 be amended to include 1976 Edition, or currently enforced building code, heretofore adopted. In Section 1 Paragraph 2, I am requesting this amendment to • also include duplex and boarding house, since these were inadvertently left out of the first Ordinance. Location of smoke detector section has been more clearly defined because of the response`'from installers that the present Ordinance was-too vague. Final approval is anew section. I am requesting this section be included for clarification of responsibility. I am requesting that Section 2 be amended to include the words duplex and townhouse complex, which were inadvertently left out of the first Ordinance. I am requesting that Section 3 be amended to include boarding house and duplex, because again, they were left out of the first Ordinance. FIRE DETECTION SYSTEMS. Every newly constructed dwelling and every newly constructed dwelling unit within an apartment house, condominium, duplex, townhouse, and every guest room in a hotel, motel, or boarding house, and every basement or cellar within such dwellings shall be provided with an Underwriters Laboratories Incorporated rated or Factory Mutual approved smoke detector, which may be either 120-volt A.C. or battery operated. Care shall be exercised to insure that the installation of all smoke detectors herein required will not interfere with the operating characteristics of the detector. Audibility of the alarm. When activated, all the detectors herein required shall provide an audible alarm recognizable as such when sleeping room(s) door(s) is completely closed." SECTION 2. FINAL APPROVAL 1. Final approval for all smoke detector location(s) • herein required for all new and existing construction shall be the responsibility of the Fire Marshal or his duly authorized representative. 2. Final approval and inspection for all smoke detector installation(s) herein required for all new and existing construction shall be the responsibility of the chief building inspector or his duly authorized representative. SECTION 3. LOCATION OF SMOKE DETECTORS Unless otherwise specified herein, a smoke detector shall be mounted on the ceiling or wall in the hallway(s) giving • access to the room(s) used for sleeping purposes. If the detector is mounted on the wall, the complete unit shall not be located lower than twelve (12) inches from the ceiling. 1. Dwelling(s) or guest room(s) without interior hallways. In dwelling(s) or guest room(s) without interior hallway(s) giving access to a sleeping room(s), the detector shall be centrally located on the ceiling of the main room. Exception: Where main rooms have a cathedral-type ceiling, the detector shall be placed on an individual basis to insure the placement will not interfere with the proper operation or periodic .testing. 2. Two- story or studio-type dwellings. Two-story or studio-type dwellings where sleeping rooms are on an upper level, the detector shall be placed in the center of the ceiling directly at the top of the stairway landing. • 3. Multi-level sleeping rooms. Where sleeping rooms are located on two or more levels, two or more detectors shall be required and shall be placed in the locations herein designated. 4. Enclosed common hallways. In hotels, motels, and boarding houses where guest rooms open into a common enclosed hallway(s) or in apartments, condominiums or townhouses where dwelling entranceways open into enclosed common hallway(s), smoke detector(s) shall be placed in said hallway(s) on the ceilings at distances that will insure the audibility of the alarm to the occupants. Where common rooms are shared in hotels, motels, boarding houses, apartments, condominiums, or townhouses, a smoke detector shall be centrally located on the ceiling in such room(s). SECTION 4. Every dwelling unit within an existing condominium, duplex, townhouse complex, and every basement or cellar within such dwellings within the City of La Porte shall • meet the requirements of this Ordinance, as amended, within five years. The time shall begin November 1, 1977. SECTION 5. Every dwelling unit within an existing apartment house, and every guest room in a hotel, motel, or boarding house, and every basement or cellar within such dwellings within the City of La Porte shall meet the requirements of this Ordinance, as amended, within five years, with a minimum of (20%) of the total number of dwelling units having smoke detectors installed each year. The owner or operator of each apartment house, boarding house, hotel, motel, anal the owner or operator of each dwelling unit in a duplex, condominium and townhouse situated within the City of La Porte shall, annually, not later than November 1 of each year file a sworn and motorized affidavit with the Fire Marshal of the City of La Porte certifying that each said smoke detector has been tested within the last sixty (60) days prior to the issuance of the affidavit and is in operable condition. SECTION 7. Smoke detectors must be installed in existing one-family dwellings as specified herein when: Interior alterations, repairs, or additions are made reQuiring that a building permit be obtained from the code enforcement division. SECTION 8. If any section, paragraph, subdivision, clause, • phrase, or provision of this Ordinance shall be judged invalid or unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or portion thereof, other than the portion so decided to be invalid or unconstitutional. SECTION 9. In addition to and cumlative of all other penalties, the City shall have the right to seek injunctive relief for any and all violations of this Ordinance. SECTION 10. Ordinance No. 1039 is repealed as of the effective date hereof. SECTION 11. Any person as defined in Section 1.07 (27), Texas Penal Code, who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). AGREEMENT • BETWEEN OWNER AND ENGINEER FO R PROFESSIONAL SERVICES THIS AGREEMENT made as of day of • 1980, by and between the CITY OF LA PORTE, -TEXAS (hereinafter called the OWNER) and O'D'IALLEY AND CLAY, INC., (hereinafter called the ENGINEER, WITNESSETH, that whereas the OWNER intends to have a DRAINAGE STUDY made of the CITY OF LA PORTE in accordance with the BASE PROPOSAL submitted by the ENGINEER dated January 19 80 , and INTERNATIONAL AERIAL MAPPING COMPANY' s proposal to the ENGINEER dated January 10, 1980, both made a part of this agreement. NOW THEREFORE, the OWNER and the ENGINEER in consideration • of their mutual covenants herein agree in respect of the performance of professional engineering services by the ENGINEER and the payment for those services by the OWNER, as set forth below. SERVICES OF THE ENGINEER GENERAL The ENGINEER will perform the ENGINEERING SERVICES including Field Surveys and Control, Aerial Photography and Mapping, Study Preparation and FINAL DRAINAGE STUDY REPORT as set forth herein. The various operations and development of the STUDY will be accomplished in accordance with the ENGINEER'S BASE PROPOSAL dated January 19 80 , and the INTERNATIONAL AERIAL DIAPPING COMPANY'S PROPOSAL dated January 10 , 19 80 . COMPENSATION For preparing the DRAINAGE STUDY as set forth above, the OWNER agrees to pay the ENGINEER a professional engineering fee in the amount of FORTY FIVE THOUS AND SEVEN HUNDRED DOLLARS ($45,700.00) . • • • 1. Payment on the lump sum fee shall be made for the separate phases upon completion as follows: a. Completion of Horizontal and Vertical Ground Control, Aerial Photography and Contact Prints submitted to CITY ... $10,300.00 b. Completion of Aerial Mapping with copy of paper manuscripts submitted to CITY ... $12,000.00 c. Final Topographic Maps on mylar submitted to CITY ... $12,000.00 d. Completion of DRAINAGE STUDY and submitted to CITY ... $11,400.00 Approximately Eight Months will be required to complete the DRAINAGE STUDY. GENERAL CONSIDERATIONS A. ARBITRATION. • 1. All claims, disputes and other matters in question arising out of, or relating to, this Agre~nrent or the breach thereof shall be decided by arbitration in accordance with the Construction Industry Aribration Rules of the American Arbitration Association then obtaining. This agreement so to arbitrate shall be specifically enforceable under the prevailing arbitration law. 2. Notice of the demand for arbitration shall be filed in writing with the other party to this Agreement and with the American Arbitration Association. The demand shall be made within a reasonable time after the claim, dispute or other matter in question has arisen. In no event shall the demand for arbitration be made after the time when institution of legal or equitable proceedings based on such claim, dispute or other matter in question would be barred by the applicable statute of limitations. 3. The award rendered by the arbitrators shall be final, and judgment may be entered upon it in any court having juris- diction thereof. B. INSURANCE. The ENGINEER will secure and maintain such insurance as will protect him from claims under workmen's compensation acts, • • claims for damages because of b~ injury, sickness or disease, or or of any person other than his damages because of injury to or including loss of use resulting ~dily injury including personal death of any of his employees employees, and from claims for destruction of tangible property therefrom. C. SUCCESSORS AND ASSIGNS . The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other paety of this Agreement and to the partners, successors, executors, administrators and assigns of such other party, in respect to all covenants of this Agreement; except as above, neither the OWNER nor the ENGINEER will assign, sublet or transfer his interest in this Agreement without the written consent of the other. Nothing herein shall be construed as creating any personal liability on the part of any officer or agent of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. Topographic Mapping, La Porte, Tex. area and our telephone conversations 2 - 4 & 7 January 1980 Gentlemen: In accordance with referenced telephone conversations, we are furnishing the subsequent proposal to complete topographic map manu- • scripts at a scale of 1" = 100' with 2 foot contours and one foot supple- mentary contours, covering approximately 7000 acres in the La Porte, Texas area as delineated on quad map furnished by you and received at our office on 9 January 1980. These topographic mapping requirements will be accomplished in accordance with our standard procedures to provide . topographic map manuscripts at the indicated scale and contour interval, meeting all criteria for National Map Accuracy Standards. In this connection, we propose to complete aerial photographic coverage with an RC8 Precision Mapping_.camera at a scale of 1" = 500', with 60% FOL and 30% sidelap to provide stereo model coverage of the project area. Subsequent to the completion of these operations, we will initiate field survey requirements to provide necessary horizontal and vertical control for subsequent aerotriangulation procedures. In this con- nection, vertical control points will be establis'ed to provide a minimum of two vertical field points along each flight line not exceeding athree-model span. Horizontal control points will be similarly established along each flight line to provide two points per model not exceeding afour-model span. These data will be accomplished by conventional traverse procedures for the horizontal control and differential levels for the vertical control, uti- lizing one second optical reading theodolites and Hewlett Packard Distance Measuring equipment for the traverse requirements and Ziess self-leveling • levels with Philadelphia rods for the differential leveling requirements. • • O'Malley and Clay -page 2 - January 10, 1980 Houston, Texas Traverse requirements for this project will emanate from and tie to _ monumented stations in the area, provided such stations exist. Otherwise, these traverse requirements will be completed as closed loops to provide an unadjusted closure not to exceed 1:15, 000. Level lines will emanate from and tie to established BM's to provide a minimum of third order closures. Subsequent to the completion of these field survey operations, we will prepare film diapositives from the original aerial photography and will drill-mark, with our Wild Pug Instrument, a minimum of six points per model, together with the photo-identifiable field control on these dia- positives. These data will be measured on a Mann Comparator interfaced with an Autotrol Digitizer and an IBM Keypunch to provide necessary infor- mation for reduction of these control data by fully analytical aerotriangula- tion requirements, utilizing the US Coast and Geodetic Survey Reduction Program. These adjusted data will provide the indicated minimum of six horizontal and vertical points for each stereo model to be utilized in scaling and leveling these data for t'ne subsequent compilation of topographic mapping information on B8S and/or Kelsh Plotters. In connection with the indicated contour interval, this mapping project is designed to provide a two foot contour interval to meet National Map Accuracy Standards. Except along • embankments, drains and similar type features where contours will be closely spaced, we will compile intermediate contours at one foot intervals. These intermediate contours will be depicted by a dash symbol on the final manu- scripts. Manuscripts will contain a 500 foot grid on the State Plane Coor- dinate System, if possible, or on an assumed datum in the event monumented horizontal control stations are not located within the area of mapping opera- tions. Manuscripts will be prepared to contain approximately three stereo models each, with an overall image area on each manuscript of approximately 32" x 54". Manuscripts will be finalized in pencil and will be photo-reprodu- cible for re-formatting into standard sheets by conventional photographic procedures if desired. All planimetric detail visible in the aerial photography and compatible with the final scale of 1" = 100' will be shown on these manu- scripts with conventional map symbolization. These plats are the total of the original Section 5. F.H.A. rejected the original Section 5, as more than 100 of the total number of lots were within 300 feet of the sewage treatment plant. Upon their advise the Original Section 5 was separated into two sections with Section 5 removing the lots F.H.A. objected to and Section 6 con- taining these lots. Section 6 will not be submitted to F.H.A. for their approval, but the homes will be built with conventional or V.A. loans.
