3. APPROVAL OF MINUTES - REGULAR MEETING - MARCH 19, 1980 -
Motion by Commissioner Cline, seconded by Commissioner Tomerlin
to approve the minutes of March 19, 1980 as presented. Motion
carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

4. CONSIDER AWARDING BID - 12" WATER LINE ON MC CABE ROAD AND 16"
WATER LINE ON STATE HIGHWAY 146 - Motion by Commissioner
Kibodeaux, seconded by Commissioner Simons to award the bid
to the low bidder, McKey Construction & Equipment, Inc. -
$256,725.00. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

5. CONSIDER AWARDING BID - SANITARY SEWER ON MAIN STREET FROM
FARRINGTON TO VALLEY BROOK DRIVE - Motion by Commissioner
Simons, seconded by Commissioner Kibodeaux to award the bid
to the low bidder,-McKey Construction & Equipment, Inc. -
$76,095.00. .Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

6. CONSIDER AWARDING BID - 1500 GM PUMPER - Motion by Commissioner
Simons, seconded by Commissioner Tomerlin to award the bid to
5 & L Seagraves Sales, Inc. - $95,245.00, as recommended by
Fire Chief Joe Sease. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

7. CONSIDER AWARDING BID - 5 INCH FIRE HOSE - Motion by Commissioner
Kibodeaux, seconded by Commissioner Simons to award the bid to
Claude Wright_& Assoc. - $5,044.00, as recommended by Fire
Chief Joe Sease. Motion carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simcns.
NAYS: None.

8. CONSIDER APPOINTING BOARD OF EQUALIZATION - Motion by
Commissioner Tomerlin, seconded by Commissioner Simons to
appoint Fred Westergren, Jr., Fred Beck, and Charles D.
Boyle to serve as the Board of Equalization. Motion carried
by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

9. ADMINISTRATIVE REPORTS - David Paulissen of the Code Enforce-
ment Division requested that the City Commission grant a
variance to the Fairmont Park Baptist Church allowing the
Church to move in two portable buildings to be used as
temporary classrooms for a maximum of two years. This request
from the Churcy was approved on March 25, 1980, by the
Planning & Zoning Commission, also approved by the Fairmont
Park Home Owners Association. Motion by Commissioner Kibodeaux,
seconded by Commissioner Simons to allow the variance. Motion
carried by the following vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAYS: None.

10. COUNCIL ACTION - Commissioner Cline reported on a meeting with
Harris County regarding the widening of Fairmont Parkway. The
County should begin engineering work soon, should be let out
for bid by July.
. Commissioner Cline requested an executive session for personnel.

Mayor Meza reported on a letter from the Texas Department of
Water Resources approving the amendment to the Step 1 Facility
Plan for the City of La Porte P~4ain Sewage Treatment Plant.
A letter was received from Kip-Lee CATV as regards progress
being made to provide the City of La Porte with Cable Tele-
vision. The letter stated the project on schedule.

11. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 -
E), (F , AND G - (LEGAL, LAND ACQUISITION, AND PERSONNEL) -
Motion by Commissioner Simons, seconded by Commissioner Cline
to recess to executive session. Motion carried by the follow-
ing vote:
AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons.
NAY5: None.

ORDINANCE NO. 1195
AN ORDINANCE REPEALING SECTION 9 OF CITY OF LA PORTE ORDINANCE
N0. 1187; SETTING THE DATE AND TIME FOR CONSUMMATION OF THE
COpJSOLIDATION OF THE CITY OF LOMAX WITH THE CITY OF LA PORTE;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Section 9 of City of La Porte Ordinance No.
1187, passed and approved February 20, 1980, is hereby repealed.
Section 2. The Mayors of the cities of Lomax and La Porte
shall certify to the Secretary of~~-te, authenticated copies
showing the approval of the qualified voters of the consolidation
of the two cities. The consolidation of the City of Lomax with.
the City of La Porte shall thereupon be held to be consummated
at 12:01 a.m. on Monday, the 28th day of April , 1980.
Section 3. The City Commission officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Commission was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this ordinance and the subject
• ~ matter thereof has been discussed, considered and formally
acted upon. The City Commission further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 4. This ordinance shall be effective immediately
upon its passage and approval.

AN ORDINANCE APPOINTING A BOARD OF EnUALIZATION COP-'iPOSED OF
THREE MEMBERS; SETTING THE DATE OF ITS FIRST MEETING; AND
PRESCRIBING ITS POWERS AND DUTIES; AND DECLARIr,1G AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTS,
TEXAS THAT:
Section 1. There hereinafter named three residents,
each of whom is a qualified voter and real property owner
in the City of La Porte, are hereby appointed to the Board
of Equalization for a one-year term, or until their successors
shall have been appointed:
FRED E. WESTERGREN, JR.

CHARLES D. BOYLE
FRED BECK
Section 2. Such Board of Equalization shall choose
from its membership a Chairman. The City Tax Assessor-Collector
shall be ex-officio Secretary of the Board. A majority of said
Board shall constitute a quorum for the transaction of business.
The Board of Equalization shall hold its first meeting at a
time to be set by it, on the 10th day of March, 1980, or as soon
thereafter as practicable.
Section 3. The Board of Equalization shall have all

of the powers and duties prescribed by Article VIII, Section 76
through 79, both inclusive, of the City Charter of the City of
\~ La Porte.
Section 4. This Ordinance shall be in full force and
effect from and after its passage and approval.

Dear Commissioners,
The Fairmont Park Baptist Church request permission to place two
portable buildings, one 24 x 32 feet and one 12 x 32 feet on our
property at the corner of Farrington and Belfast Rd. These build-
ings are manufactured by Cary-way Portable Building Manufactors and
will be used by the church for class rooms until an additional church
building can be completed,
Our ci~urch is now in the planning stage for a new sanctuary to be
constructed on the sight as soon as possible. After the completion
of the ne~a building, these portable buildings caill be disposed of.
The church has received permission from the Fairmont Park Homes
Association and a copy of their letter is enclosed, If your permission
is granted, we hope to have the building on sight and ready for use in
April, 1980,
