MINUTES - REGULAR MEETING
OF THE
LA PORTE CITY COMMISSION - LA PORTE, TEXAS
JUNE 4, 1980
1. Meeting called to order by Mayor Meza at 6:00 P.M.
MEMBERS OF THE CITY COMMISSION PRESENT: Mayor J.J. Meza,
Commissioner Tomerlin, Commissioner Kibodeaux, Commission-
er Simons, and Commissioner Malone.
MEMBERS OF THE CITY COMMISSION ABSENT: Commissioner Cline.
OTHER CITY OFFICTALS PRESENT; James R. Hudgens, City Ad-
ministrator; Betty Waters, City Clerk; Knox Askins, City
Attorney; H.F. Freeman, Police Chief; Paul Hickenbottom,
Fire Marshal; David Paulissen and Ben Talburt, Code En-
forcement; David Hutchinson, Engineering.

RECOMMENDATION OFFERED BY PLANNING AND ZONING TO.APPROVE
THE GRANTING OF A VARIANCE TO ALLOW MR. T.W. CONROY TO
ERECT THE BUThDING TO THE P OPERTY LINE AT 1906 ROSCOE,
seconded by Commissioner Simons, motion carried 3--ayes
and 0-nays.

9. City Administrator Hudgens reported the changes in the
sewer project required by E.P.A. have been made by Busch,
Hutchinson & Associates and have been returned to the
E.P.A. Offices, We are now waiting for funding.
Commissioner Tomerlin stated he would not be present for
the June 11 meeting.
Commissioner Kibodeaux reported on the Seminar in Browns-
ville. He stated he felt the most informative session
was conducted by Commissioner Virginia Cline. The Mayor
and Commissioners who attended the Seminar all had very
favorable reports.
Motion to adjourn by Commissioner Kibodeaux, seconded by
Commissioner Simons, there being no further business the
meeting was duly adjourned at 7:05 P.M.

ORDINANCE NO. 1217

AN ORDINANCE PROHIBITING THE CONSUMPTION, OR POSSESSION WITH INTENT
TO CONSUME, OF ALCOHOLIC BEVERAGES ON PROPERTY OWNED OR LEASED BY
OR TO THE CITY OF LA PORTE OR THE LA PORTE INDEPENDENT SCHOOL-
DISTRICT; AUTHORIZING SPECIAL EVENT PERMITS; PROVIDING THAT -"ANY
PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY.
OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT
MORE THAN TWO HUNDRED DOLLARS ($200.00); FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. A person commits an offense if he consumes or
possesses with intent to consume an alcoholic beverage in or on
any real property owned by or leased by or to the City of La Porte
or the La Porte Independent School District.
Section 2. The Director of Parks and Recreation may issue

special permits for non-commercial events, (such as wedding recep-
tions, private parties, and similar gatherings, but not including
athletic events), for a fee of Five Dollars ($5.00) per day, per-
mitting consumption of alcoholic beverages in or on any real prop-
erty owned by or leased by or to the City of La Porte.
Section 3. Any person, as defined in Section 1.07(27), Tex as
Penal Code, who shall violate any provision of this ordinance,
shall be deemed guilty of a misdemeanor and upon conviction shall
be punished by a fine not to exceed Two Hundred Dollars ($200.00).
Section 4. The City Commission officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Commission was
~~ posted at a place convenient to the public at the City Hall of
the City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this ordi-
nance and the subject matter thereof has been discussed, considered
and formally acted upon. The City Commission further ratifies,
approves and confirms such written notice and the contents and
posting thereof.

Section 5. This Ordinance shall be effective fourteen (14)
days after its passage and approval. The City Clerk shall give
notice of the passage of this ordinance by causing the caption
hereof to be published in the official newspaper in the City of
La Porte at least twice within ten (10) days after the passage of
this ordinance.
