• MINUTES - REGULAR MEETING OF THE LA PORTE CITY COMMISSION - LA PORTE, TEXAS AUGUST 6, 1980 1. Meeting called to order by Mayor Meza at 7:00 P.M. MEMBERS OF THE CITY COMMISSION PRESENT: Mayor J.J. Meza, Commissioner John Tomerlin, Commissioner I.J. Kibodeaux, Commissioner Virginia Cline, Commissioner Tom Simons. MEMBERS OF THE CITY COMMISSION ABSENT: Commissioner Norman Malone. OTHER CITY OFFICIALS PRESENT: James R. Hudgens, City Admin- istrator; Betty T. Waters, City Clerk; Knox Askins, City At- torney; Stan Sherwood, Parks and Recreation; Joe Sease, Fire • Chief; Jerry Hodge, Public Works Director. OTHERS PRESENT: Patt K. Mikowski, Bayshore Sun. 2. The invocation was given by Commissioner Kibodeaux. 3. Motion was made by Commissioner Tomerlin to approve the minutes of the Regular Meeting of July 16, 1980 as presented. The motion was seconded by Commissioner Kibodeaux. The motion carried 4- ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None 4. Motion was made by Commissioner Tomerlin to approve the minutes of the Special Called Meeting of July 30, 1980. The motion was seconded by Commissioner Cline, the motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None 5. RESOLUTION N0.80-7 was read by the City Attorney. A RESOLUTION AUTHORIZING MAYOR MEZA TO FILE AN APPLICATION FOR A GRANT TO BULKHEAD LITTLE CEDAR BAYOU PARK. • A MOTION WAS MADE BY COMMISSIONER KIBODEAUX TO APPROVE RESOLU- TION N0.80-7. The motion was seconded by Commissioner Tomerlin. The motion carried 4-ayes and 0-nays. REGULAR MEETING. 816/80 • G AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None Page 2 6. RESOLUTION N0.80-8 SUPPORTING COUNTY COMMISSIONER BASS IN HIS EFFORTS TO ACQUIRE FEDERAL FUNDS FOR A HIKE AND BIKE PATH; was read by the City Attorney. A MOTION WAS-MADE BY COMMISSIONER CLINE AND SECONDED BY COMMISSIONER TOMERLIN TO ACCEPT RESOLU- TION N0.80-8. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None 7. Motion was made by Commissioner Cline to accept the bid sub- mitted by Lynwood Anderson of $1,867.42 for Lot 21, Block 59, City of La Porte. City of La Porte-------.---560.48 County of Harris--------1,306,94 Total 1,867.42 The motion was seconded by Commissioner Kibodeaux. The motion carried 4-ayes and 0-nays. • AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None 8. Motion was made by Commissioner Simons to approve the utility extention agreement for: Jack Bouslog Block 726 Lots 26-30 Gus Brieden Block 726 Lots 11-14 Police Assoc. Block 726 Lots 1-6 The motion was seconded by Commissioner Tomerlin. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux., Cline and Simons. NAYS: None 9. Mr. Ray Kaylor and Mike Goodwin were not present to address the City Commission concerning restrictions set forth in Ordinance No. ?80EE, Section 4(c) for Block 1160. They had earlier agreed to proceed to Planning & Zoning for a re-zoning of the property. 10. Administrative Reports: (a) City Administrator advised the Commission of the plans set in motion in preperation for the approaching Hurrican • Allen. (b) City Administrator advised Commission the Customer Service Department is set up to start cycle billing for water and sewer. REGULAR MEETING 8/6/80 ,Page 3 • (c) City Administrator read a memo from TML inviting the City of La Porte to join in their opposition of the rate increase request by Southwestern Be11 Telephone. The City Commission agreed to appropriate funds from the Gen- eral Fund Contingency to appose the rate increase. (d) Dave Corbin of Bush, Hutchinson and Associates Engineer- ing firm reported to City Commission thay are now ready to advertise for bids on the miscellanious water lines (extensions and replacements). August 27th was set as the date to receive bids until 7:00 P.M. (e) Fred Beck of Smith Engineers presented a progress report on the water, sewer and street improvements for the Lomax area. He requested the Commission to set a priority listing for the surfacing of Lomax streets. 11. Council Action: Commissioner Tomerlin requested a short executive session. Commissioner Kibodeaux introducted Jerry Hodge, the new Public Works Director, to those present. Commissioner Cline asked that a date be set for the Commissions budget workshop. After discussion Suday, August 24th at 8:00 A.M. was set for the City Commission to work on the 1980-81 • budget. City Attorney Askins read a letter from Cablevision asking the Commissions consideration of an amendment to the franchise which would p~ rmit the "office" to be located at Underwood and Carlow. After discussion Askins was directed to write a letter advising Mr. Clester this met with the City Commis- sioners approval. 12. Mayor Meza adjouned into a closed executive session to discuss personnel at 7:20 P.M. Mayor Meza reconvened the meeting at 9:00 P.M. Motion was made by Commissioner Kibodeaux to adjourn the meeting, second- ed by Commissioner Simons. The meeting was duly adjourned at 9:05 P.M. Meza, Mayor .7 Page 4 • • • • RESOLUTION N0. 80-7 WHEREAS, on this the 14th day of June, 1980 the La Porte City Commission, Harris County, Texas did authorize the filing of applications and required permits for financial assistance under Section 308 (d) 4 of the Coastal Energy Impact Program. WHEREAS, funds are available from the Office of the Governor of the State of Texas for environmental/ recreational acquisition and construction projects within the coastal zone of Texas; and . WHEREAS, the Mayor and City Commission of the City of La Porte, Texas, has received and reviewed and is desirous of submitting applications for financial assistance under the Coastal Energy Impact Program, being for the purpose of constructing bulkhead structures at Little Cedar Bayou Park; and WHEREAS, funds requested being in the amount of X274,850.00 with no local funds being required. NOW, THEREFORE, BE IT RESOLVED that said applications, together with all required permit applications and required documentation are hereby approved, and that the Mayor is hereby authorized to file said applications_ and to further provide any additional information which may be required by the Office of the Governor to evaluate said applications . Meza, Mayor ATTEST: Ci Clerk -" - ~. .,. ;~ ~,, , , . . ~~ • ~ ~ RESOLUTION N0. ~b-~ WE THE CITY COT~ZISSION OF THE CITY OF LA PORTE, HARRIS COiJNTY, TEXAS DO HEREBY DECLARE AND SUPPORT COMMISSIONER TOM BASS IN HIS EFFORTS TO BUILD A HIKE AND BIKE TRAIL TO ENRICH THE HEALTH AND WELL BEING OF OUR CITIZENS WHEREAS, Harris County Precinct One proposes to build a Hike and Bike Trail, approximately 5.5 miles in length, and , WHEREAS, the proposed trail will connect the existing trail on Bay Area Boulevard to the existing trail on Kirby Boulevard, and WHEREAS, the proposed trail will also connect four major Harris • County Parks, Bay Area Park, Armand Bayou Park Clear Lake Park and the new Clear Lake Park extension, and WHEREAS, such a trail will provide both commuting and recreational opportunities for the residents of the La Porte-Bayport Industrial complex, and WHEREAS, Citizens of La Porte have expressed an on-going interest in a Hike and Bike Trail for this area and feel such a trail would be a major benefit to area residents, NOW, THEREFORE, BE IT RESOLVED, .t hat the City Commission of the City of La Porte, Texas hereby expresses its full support and endorses this Precinct One project. ~_ Cit Porte _ _ ,,, J . This property was offered at auction on May 7, 1974, as there were no bidders the property was bought in by the City of La Porte to be held in trust for sale at a later date. The property was advertised for bid on December 20, 1976, again there were no bidders. The La Porte Independent School District was served with the intent to file suit and did not intervene. Mr. Lynwood Anderson has submitted a bid for $1,868.00. The • amounts due are as follows: The City of La Porte $ 560.48 County of Harris 1,306.94 Total X1,867.42 Therefore it is my recommendation the bid from Mr. Anderson be accepted. " W I T N E S~-S E T H • (1) All references to "Utility Main(s)" hereunder shall,. for tre purposes of this agreement, refer to 240 ft. of ~i_inch ~_ n R S nifiarv 4ewPr Main ~ (2) Owner is the owner of certain property in the City of La Port`, Harris County, Texas, identified as 1. F. S. Jack Bouslog Block 726 Lots 26-30 2. Gus Brieden Block 726 Lot 11-i4. 3. Police Assoc. Block 726 Lot 1-6 • Cit, 's utility ~;ai.^.s c?o not prese:~tly extend to said property. 0~.~::cr has requested City to extcad utility mains to Owner's said property. r • (3) City hereby agrees to construct and install an extensio~ of its utility main(s) to said property co;:iczencinr, at the nearest existing utility main(s) of ~ufficicnt size and capacity. Thence along/thru City of La Porte rights-of-way ancijor easements to said Owner's propcrtl~. Providc:cl, however, that should City not possess all necessary rights-of-way anti/or casc;aents to complete said extension(s) , Owner shall be solely resL~onsil~le for o~taini•ng said additional rights-of-way and/or easements at no cost to City. (4) Owner agrees to pay all cots related to the construc- tion and installation of said line(s) including necessary appur- tenances in conformance with City's standards and specifications for said line(s). Owner further agrees to pay all engineering fees for survey, design, contract documents, bidding, construction staking, and construction inspection. (5) ~ Subject to the provisions of this agreement, City hereby agrees-to construct and install said extension of its utility main(s) according to the plans and specifications to be prepared by City's engineer. Prior to City authorizing the City's engineer to prepare plans and specifications Owner will deposit witl: City in escrow a sum of money based on and equal to the City engineer's estimated project cost in conformance with Section 4, less esti- mated construction, construction staking and inspection costs. Thereafter, City will authorize the City engineer to prepare plans and specifications for said extension(s). Upon completion of plar~ and specifications City will place the project for bid. V:hen bids are received they shall be tabulated by the City and a copy of said tabuiatinn shall be provided to Owner. Thereafter, Owner shall deposit with City in escrow a sum equal to the amount bid by the lowest responsible chosen bidder, plus a sum equal to the estimated construction staki.;ig and inspection fees if applicable. When said deposit has been made by Owner, City shall execute a contract for said extension(s). It is agreed and understood that the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the project that result from circumstances beyond the control of City.
