HomeMy WebLinkAbout1980-08-08 Special Called Meeting• • • MINUTES - SPECIAL CALLED MEETING OF THE LA PORTE CITY COMMISSION - LA PORTE, TEXAS AUGUST 8, 1980 Meeting called to order by Mayor Meza at 3:30 P.M. MEMBERS OF THE .CITY COMMISSION PRESENT: Mayor J.J. Meza, Commissioner Simons, Commissioner Malone, Commissioner Cline, Commissioner Kibodeaux. MEMBERS OF THE CITY COMMISSION ABSENT: Commissioner Tom- erlin. OTHER CITY OFFICIALS PRESENT: James R. Hudgens, City Adminis- trator; Betty Waters, City Clerk; Knox Askins, City Attorney; H.F. Freeman, Police Chief; Paul Hickenbottom;;David Paulissen, Chief Inspector, Stan Sherwood, Parks & Recreation; Jerry • Hodge, Public Works Director; Robert Hall, Assistant Police Chief. OTHERS PRESENT: Jim Chapman, Bayshore Sun. Mayor Meza stated this emergency meeting has been called to review hurrican prepardness plans with Civil Defense Coordina- tor and to consider the Proclaimation by Governor Clements for a 14 day postponement of elections to be held on August 9 by cities along the Gulf Coast. City Administrator Hudgens reviewed plans with each Department Head and went over a check list of equipment and supplies. A decision was made by Mayor Meza to hold over 30 public works people and request that they bring their families to the Nutri- tion Center for the duration of the emergency. City Attorney Askins read an Ordinance declaring an emergency due to Hurrican Allen, and postponing the specail charter elec- tion from August 9, 1980 until. August 23, 1980; finding com- pliance with the open meetings law; providing a savings clause; and providing an effective date hereof. Mayor Meza poled the City Commission as to their feelings. • Commissioner Malone stated he felt the election should be de- layed due to the fonfussion and uncertainty the citizens of La Porte find themselves in at the present time. • Special Called Meeting - 8/8/80 • Page 2 Commissioner Simons stated he felt the election should be post- poned because of the large number of citizens leaving town. Commissioner Cline stated she was in favor of postponing the election to the 23rd of August to give everyone a chance to get back home and get their mind back on civic matters. Commissioner Kibodeaux stated he felt the election should be postponed because at this time no matter what the outcome of the election it wouldn't be a true picture of the peoples choice. Mayor Meza stated he felt the storm would not present any threat to the La Porte area however he would yield to the concensus of the Commission and entertain a motion. A motion was made by Commissioner Kibodeaux to adopt Ordinance No.1223 as read by the City Attorney. The motion was seconded by Commissioner Simons. The motion carried 3-ayes and 0-nays. AYES: Cinnussuibers Kibodeaux, Cline, Simons. NAYS: None The City Clerk was directed to .publish the Ordinance 3 times in total, to post the Ordinance at all three polling places and the City Hall. She was alson directed to contact the Secretary of States office and all election judges as to the new date for the election. Absentee voting will begin again on Monday August 11 and continue thru August 19th at 5:00 P.M. Motion to adjourn by Commissioner Cline, seconded by Commis- sioner Simons. Motion carried 3-ayes and 0-nays. There being no further new business the meeting was duly ad- journed at 4:55 P.M. Meza, Mayor Page 3 s~ • ~ ~ ~~ ORDINANCE NO. 1~~~_ AN ORDINANCE DECLARING AN EMERGENCY DUE TO HURRICANE ALLEN, AND POSTPONING THE SPECIAL CHARTER ELECTION FROM AUGUST 9, 1980 UNTIL AUGUST 23 1980; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The Governor of Texas has issued a proclamation, delegating authority to the Texas Secretary of State, to enact rules and regulations concerning the postponement of election in Texas coastal counties, including Harris County. The Texas ~ Secretary of State has promulgated Rule 004.30.01.221, grantry.t~g C: permissive authority to local governmental units, to postpone elections called for August 9, 1980, for not more than fourteen (14) days. ~~ Section 2. Pursuant to the authority granted by the Secre- tary of State, the City Commission of the City of La Porte de- Glares an emergency, and hereby orders that the special charter election, heretofore ordered for the 9th day of August, 1980, ---- shall be postponed, and is hereby ordered to be Yield on the 23rd day of August, 1980. ~` Section 3. Except as amended by this Ordinance, Ordinance (~ 1216 shall remain in full force and effect. '~ Section 5. The City Commission of the City of La Porte hereby finds, determines and declares that, due to the imminent threat created by Hurricane Allen, a state of emergency exists within the City of La Porte. Section 6. The City Commission officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Commission was .posted at a place convenient to the public ~_. • ~ Ordinance No. 1223 , Page 2. at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and C that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Commission further ratifies, approves and confirms such written notice and the contents and posting- thereof. Section 7.
