• • MINUTES - REGULAR MEETING • OF THE LA PORTE CITY COMMISSION - LA PORTE, TEXAS AUGUST 20, 1980 1. Meeting called to order by Mayor Meza at 7:00 P.M. MEMBERS OF THE CITY COMMISSION PRESENT: Mayor J.J. Meza, Commissioner John Tomerlin, Commissioner I.J Kibodeaux, Commissioner Virginia Cline, Commissioner Tom Simons, Commissioner Norman Malone. MEMBERS OF THE CITY COMMISSION ABSENT: None OTHER CITY OFFICIALS PRESENT: City Administrator James R. Hudgens; City Clerk Betty T. Waters; City Attorney Knox As- kins; Police Chief Herb Freeman; Public Works Director Jerry Hodge; Chief Inspector David Paulissen; Fire Marshal Paul Hickenbottom; Parks Director Stan Sherwood. • OTHERS PRESENT: Jim Chapman and David Martindale of the Bay- shore Sun, Mr. & Mrs. Andres Trevino, Mr. & Mrs. Fred Wester- gren . 2. The invocation was given by Mayor Meza. 3. MOTION WAS MADE BY COMMISSIONER TOMERLIN TO APPROVE THE MIN- UTES OF THE MEETTNG OF AUGUST 6, T980 9S PRESENTED. The mo- tion was seconded by Commissioner Simons. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None 4. MOTION WAS MADE BY COMMISSIONER KIBODEAUX TO ACCEPT THE MIN- UTES OF THE SPECTAL CALLED MEETTNG OF AUGUST 8, 1980 AS PRE- SENTED. The motion was seconded by Commissioner Simons. Com- missioner Cline called the Mayor's attention to the fact that the minutes reflect a statement he has made and the Bayshore Sun another. Mayor Meza stated the minutes are correct. The motion carried 3-ayes and 1-abstain. AYES: Commissioners Kibodeaux, Cline and Simons. NAYS: None ABSTAIN: Commissioner Tomerlin • 5. Mayor Meza stated the next order of business is to consider certain ordinances concerning City of La Porte E.T.J. REGULAR MEETING 8_/80 Page 2 • City Attorney Askins advised he felt there was a need at this time for a brief executive session for legal counciling. Motion was made by Commissioner Tomerlin to adjourn into ex- ecutive session to consult the City's Attorney on a legal matter. The motion was seconded by Commissioner Simons. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None City Commission went into executive session at 7:10 P.M. City Commission returned to the Council table at 7:20 P.M. A motion was made by Commissioner Cline to postpone any action on the ordinances concerning City of La Porte E.T.J. until such time as proof of ownership is supplied to La Porte by City of Pasadena concerning track 2 and track 3 of the pro- posed annexation. The motion was seconded by Commissioner Simons. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None • 6. MOTION WAS MADE BY COMMISSIONER SIMONS TO GRANT A REQUEST FOR VARIANCE TO-BUILD A CARPORT AT 312 SAN JACINTO (LOTS 1112, BLOCK 219). The request was made by Mr. Andres Trevino. The motion was seconded by Commissioner Cline. The motion carried 3-ayes and 1 nay. AYES: Commissioners Kibodeaux, Cline and Simons. NAYS: Commissioner Tomerlin 7. MOTION WAS MADE. BY COMMISSIONER CLINE TO GRANT A REQUEST FOR VARIANCE ON THE-FRONT BUTLDING LTNE FOR LOTS 5 and 6. BLOCK 7 OF SYLVAN BEACH ADDITION FOR DAVID TUTT. The motion was seconded by Commissioner Tomerlin. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None 8. Action on Mr. Kiibler's request for an alley closing was der layed at his request to the next regular meeting of the City Commission. 9. MOTION WAS MADE BY COMMISSIONER SIMONS TO ADOPT A LIST OF STREETS TN THE LOMAX ADDTTTON TO BE USED AS A PRTORTTY LIST FOR THE UP-- COMING PAVING PROJECT UTILIZING THE $1,430,000 IN BOND FUNDS • VOTED BY LOMAX IN FEBRUARY 1980 FOR STREET IMPROVEMENT. Santa Anna 28. West Plainbrook 29. West Fieldcrest The motion was seconded by Commissioner Kibodeaux. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None 10. Administrative Reports: City Administrator Hudgens asked authorization from the City Commission to proceed to advertise for bids on the Lomax sewer project #1288-80. A MOTION WAS MADE. BY COMMISSIONER KIBODEAUX TO RECEIVE BIDS ON THE 10TH DAY OF SEPTEMBER, 1980 AND AWARD THE BTD ON THE-17TH DAY OF SEPTEMBER 1980 FOR THE LOMAX SEWER PROJECT #1288-80. The motion was seconded by Commissioner Simons. The motion carried 4-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux, Cline and Simons. NAYS: None City Administrator Hudgens made the Commission aware of the need to service citizens along the. south side of North H Street REGULAR MEETING 8 ~/80 Page 4 • from Big Island Slough west to Underwood Road. Hudgens stated the extenstion of the sewer line on the north side of Creek- mont some 425 feet more or less would handle this problem. This matter met with Commission approval, Hudgens was authoriz- ed to proceed with the sewer line. 11. Council Action: COMMISSIONER MALONE commended Public Works Director Hodge for his work on the streets. COMMISSIONER SIMONS thanked Public Works for the job they have done on the streets. COMMISSIONER CLINE asked that Ordinance #404C be revised and up-dated at the next Work Shop. COMMISSIONER KIBODEAUX stated he had received several very nice comments on the streets. COMMISSIONER TOMERLIN gave his new office phone number ~ 8806670. 12. City Attorney Askins requested a brief executive session. The Commission reconviened at 8:59 P.M. Motion by Commissioner • Kibodeaux to adjourn at 8:59 P.M. The motion was seconded by Commissioner Simons.. There being no further new business the meeting was duly adjourned. Meza, Mayor Ci C1 k • • ORDINANCE NO. ,~o7a-~ AN ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF THE INTENTION OF THE CITY OF LA PORTE, TEXAS, TO ISSUE CERTIFICATES OF OBLIGATION AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Pursuant to the provisions of The Certificate of Obligation Act of 1971, as amended (Art. 2368a.1, V.A.T.C.S.), the City Council of the City of La Porte directs the City Secretary of the City of La Porte to cause to be published, in its issues of , 1980, and , 1980, in the Bayshore Sun, the official newspaper of the City of La Porte, the "Notice of the Intention of the City of La Porte, Texas, to Issue Certificates of Obligation" in the form attached hereto as Exhibit "A", which is incorporated by reference herein and made a part hereof for all purposes. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as requited by law at ail times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. City Secretary City of La Porte, Texas Publish: 1980 1980 CJ July 8, 1880 To: Mayor and City Commissioners From: Planning & Soning Commission Subject: Request for variance to build carport 312 San Jacinto--Andres Trevino (Lots 11 & 12, Block 21g) P~Rr. & Mrs Andres Trevino appeared before the P. & Z. Commission on July 7, with a request for a variance to build a carport at their home at 312 San Jacinto. Their home is so situated that there is no access to the back yard by vehicles. They own two late model automobiles which must be parked under overhanging branches of the neighbor's pecan trees. In considering the request, Planning.&:Zoning took into consideration the 100 foot right-of-way existing on San Jacinto. This wide right-of-way would provide ample space between the house and street, even though the carport would be within 5 feet of the front property line. We request a public hearing on this request for variance and provided that it is not objectionable to neighboring property owners, recommend that the variance be granted. Tutt. Planning and Zoning Commission met July 7 to consider a request for a variance on the front building line on property owned by Mr. Robert E. Tutt. Mr. Tutt's son, David Tutt, was in attendance. ~ ~ -- - ~ - - - - - - - --- - - - The rear of the subject property abuts city owned right- of-way for Cedar Lane. Cedar Lane is non-existent, and the waters from Little Cedar_Bayou have eroded the bank and claimed much of the city owned property. Mr. Tutt wishes to construct a home on his property which will be as far away as possible from the damaging effects of erosion and the dangers of flooding presented by Little • Cedar Bayou. The other homes on that block (except for one) are all within about 9 feet of the property line. Mr. Tutt wisrles to place the new home in line with three existing homes on adjacent properties. Planning & Zoning considers that such palcement would not be detrimental to that particlular pocket neighborhood, and would in fact be consistent with existin; homes. Planning & Zoning requests a public hearing to consider Mr. Tutt's request for variance. Isle recommend approval of such request.
