• ~ MINUTES - REGULAR MEETING • OF THE LA PORTE CITY COUNCIL - LA PORTE, TEXAS SEPTEMBER 3, 1980 1. Meeting called to order by Mayor Meza at 7:00 P.M. MEMBERS OF THE CITY COUNCIL PRESENT: Mayor J.J. Meza, Councilman John Tomerlin, Councilman I.J. Kibodeaux, Coun- cilman Tom Simons, Councilman Norman Malone. MEMBERS OF THE CITY COUNCIL ABSENT: Councilwoman Virginia Cline. OTHER CITY OFFICIALS PRESENT: City Manager, James R. Hudgens; Assistant City Secretary Betty Blackmon; City Attorney Knox Askins; Police Chief Herb Freeman; Public Works Director Jerry Hodge; Chief Inspector David Paulissen; Fire Chief Joe Sease; Fire Marshall Paul Hickenbottom; Parks and Rec~ reation Director Stan Sherwood. Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to accept the bids for tabulation. Motion carried 3~ayes and Oc-nays. AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. 4. Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve the Minutes of the Regular Meeting of August 20, 1980 as presented. The motion carried 3-ayes and 0-nays. Motion by Commissioner Simons, seconded by Commissioner Tomerlin to approve ORDINANCE NO.T226 AUTHORIZING THE SALE OF CERTIFICATES OF OBLIGATION TO FINANCE THE SERVICE CENTER. The motion carried 3-ayes and 0-nays. AYES: Commissioners Tomerlin, Kibodeaux and Simons. NAYS: None • 14. ADMINISTRATIVE REPORTS: City Manager Hudgens reported on a letter from Don Ford request ing the City of La Porte to supply water to the northwest corner of Underwood Road and Spencer Highway, the property being in the City of Deer Park. The Councilmembers agreed to follow the policy of only suppling utilities to our jurisdiction. City Manager Hudgens reported that our contractor for the non- directional beacon for the airport is in and the beacon should be installed by Monday or Tuesday, September 8th or 9th. The grant was obtained in 1979. 15 COUNCIL ACTION: Commissioner Kibodeaux read parts of a report stating work which had been completed by the Water & Sewer Department. Commissioner Simons requested a brief executive session. The acceptance of bids for repairs to the elevated water tank on Fourth Street were postponed until September 17th at 7:00 P.M. dt~e to a mix-up. • Motion by Commissioner Simons, seconded by Commissioner Tomerlin to cancel the regular meeting September 17, 1980 as this date conflicts with the Chamber of Commerce salute to Industry,, The September 17th meeting to be combined with the meeting o~ Se~temr- ber 24, 1980. The Council reconvened at 9:15 P.M. The Council authorized a $5,000.00 increase in the City Manager's salary effective September 1, 1980. In addition the Council stated. that the City Manager's performance and salary would be reviewed on December 1, 1980 and June 1, 1981. Motion made by Councilman Tomerlin, seconded by Kibodeaux. Motion carried 3-ayes and 0-nays. AYES: Councilmembers Tomerlin, Kibodeaux, and Simons. NAYS:. None Motion by Councilman Simons, seconded by Councilman Kibodeaux to adjourn at 9:30 P.M. Motion carried 3-ayes and 0-nays. AYES: Councilmembers Tomerlin, Kibodeaux and Simons. Box 1115 LaPorte, Texas 77571 Re: Final Plat Submittal Fairmont Park East Sections, One, Two, Three and Four Gentlemen: Enclosed are three (3) copies of the final plats of Fairmont Park • East, Sections 1, 2, 3, and 4 for your final review and consideration for approval at your August 4th meeting. ~~ The final plats have been prepared in accordance with the Preliminary Master Plat which received your previous approval. I have attached also a copy of the Preliminary Master Plat to each of the sets. We have submitted detailed water, sewer, street and drainage plans to the respective City departments for their review and final approval. I will forward a sepia of the final plats after receiving the street numbers from the City Tax Office. These are currently under area review. East Sec.I, I•I, III, 8 IV. After reviewing the plans on Friday, there were problems with water lines and also some needed information missing. We respectfully request that~Planning 8 Zoning Commission table this matter until we have had time to meet with the engineers on the project and work out the problems and the missing information. Talburt • • • ` • ORDINANCE NO. ~~ `'' AN ORDINANCE AMENDING THE CODE OF ORDINANCES BY REPEALING SECTIONS 8-71 THROUGH 8-104, BOTH INCLUSIVE (CHAPTER 8, ARTICLE VII, HOUSE MOVING) AND BY ADDING SECTION 8-18 PRESCRIBING AMOUNTS AS REQUIREMENTS FOR BONDS FOR THE MOVING OF BUILDINGS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFEC- TIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF I,A PORTE: Section 1. Chapter 8, Article VII, (Sections 8-71 through 8-104, both inclusive) of the Code of Ordinances of the Cite of La Porte is hereby repealed. Section 2. The Code of Ordinances of the City of La Porte is hereby amended by adding Section 8-18, as follows: "Section 8-18. Moving of Buildings - Bond. The building inspector is instructed to prescribe the amount of One Thousand Dollars ($1,000.00) as the requirement for bonds executed in accordance with Southern Standard Building Code, Section 2204.4, provisions concerning moving of buildings." Section 3. The Code of Ordinances of the City of La Porte is hereby amended by adding SECtion 8-19, as follows: • "Section 8-19. Moving of Buildings - Liability Insurance. The holder of a permit for the moving of a building shall be required to carry liability insurance in the fallowing sums: (1) The minimum sum of .f ift_y thousand dollars ($50,000.00) for injury or death of one person, or one hundred thousand dollars ($100,000.00) for injury or death to more than one person from any one accident; and (2) The minimum sum of twenty-five thousand dollars ($25,000.00) for property damage for any one accident. Such policy shall contain a provision obli- gating t:he insurer to give written notice of cancellation, not less than ten (10) days prior to the date of such cancellation, ~ to the building inspector. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of th?.s meeting of the City Council was posted at a place convenient to the public at the City H~11 of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 6. Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of this ordi- nance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Each day any violation of this ordinance shall con- tinue shall constitute a separate violation. Section 7. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. • • . We have no records indicating it has ever been cleaned. At this time the tank is functionin at about 25% of its original capacity. This decreases the capacity of the plant and increases the problem with treatment. With the overload problem that presently exists treatment is difficult enough without this added burden. Coastal Vacuum Tank Service has made a proposal to the City of La Porte to clean the areation tank with two large vacumm trucks for $4,150.00 (Four Thousand One Hundred Fifty and no/100) We have contacted several W41`~.r" other companies and they want bid on the job because it is toDsmall. I recommand we sign a contact with Coastal Vacuum Tank Service for $4,150.00 for this Service. Funds for the project will Head to come from Water & Sewer contingency. U
