City Attorney Askins read AN ORDINANCE DECLARING THE INTENTION OF THE CITY OF LA PORTE TO INSTITUTE PROCEEDINGS TO ANNEX CERTAIN TERRITORY; CALLING A PUBLIC HEARING AT WHICH ALL INTERESTED PARTIES SHALL HAVE AN OPPORTUNITY TO BE HEARD; PROVIDING FOR THE PUBLICATION OF NOTICE OF SUCH HEARING BY THE PUBLICATION OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE HEREOF. A motion was made b Councilman Simons to a rove and adopt Ordinance No. 123 as read, second by Councilman Kibodeaux. The motion carried -ayes and 0-nays. A map prepared by the City Attorney's office, showing City of La Porte voting precinct boundries and polling places, was submitted for Councils consideration. A motion was made by Councilman Simons to table this item until such time as the • City Council and the School Board have a workshop to make some joint decisions in this matter. The motion was second by Councilman Kibodeaux, motion carried 4-ayes and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons Nays: None 8. City Attorney Askins read a resolution authorizing the execution of an agreement between the City of La Porte and the La Porte Independent School District.' Motion was made by Councilman Simons to table any action on thi's item until such time as the Council and School Board have a joint worksho on October 9, 1980. The motion was second by Councilman Kibodeaux. The motion carried 4-ayes and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons. Nays: None g. Motion was made by Councilman Kibodeaux to award 'the Contract for construction of the Fairmont Park Civic Center to Lynn Watkins Construction Co. for , 90.00, this motion is subject to the 7.5 ton air conditioner Awned by the City being in good repair and usuable for the Civic Center site. The motion was second by Councilman Tomerlin, motion carried 4-ayes and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons Nays: None • Stan Sherwood, Park Director, was authorized by the Council to have the Air Conditioner checked out by a knowledge.~h~.e firm to decide the condition of the unit. 10. Motion was made by Councilman Cline to approve the utility Regular Meeting 10-1-80 Pg. 3 r~ ~_~ • extension agreement for Claudell Scott-Block 327, Lots 3,4, 5,6,7, and 8, Town of La Porte. The motion was second by Councilman Simons, motion carried 4-ayes and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons Nays: None 11. Administrative Reports - None 12. Council Action: Councilman Simons requested a shot Executive session on personnel. 13. Mayor Meza recessed the meeting into an execut.~ve session on personnel at 7:58 P.M. At 10:37 P.M. the Council returned to the Council table to reconvene the Regular Meeting of October 1, 1880. and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons Motion was made b Councilman Simons not to fill th'e'position of Assistant City Manager under the 19 0= l Budget, the motion was second by Councilman Kibodeaux. The motion carried 4-ayes Request was made by Councilman Simons that City Manager Hudgens • leave word at all times when he leaves the building as to where he is going and where he can be reached. The Council agreeded this would be good practice. Councilwoman Cline questioned why water bills were not mailed out as usual on the 1st day of the month. Discussion followed concerning the new cycle billing program. Motion was made by Councilman Simons to continue for the 1980-81 period to budget Code Enforecment out of the Engineering Depart- ment but the Code Enforecment will remain a seperate department reporting to the City Manager and working under his direction. The motion was second by Councilta~.oman Cline. The motion carried 4-ayes and 0-nays. Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons Nays: None Council requested the weekly departmental reports be reduced to one summary of major projects and that these be received by Council bi-weekly or as necessary. Meza, Mayo ~ ~ 4 ORDINANCE NO. /~~Z AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE ALLEY IN BLOCK SEVEN HUNDRED NINETY (790), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. WHEREAS, the hereinafter described portion of said alley in Block Seven Hundred Ninety (790) of the Town of La Porte has never been opened or used as a public thorough-fare, and the public utilities now making use of such alley have all given their written consent for its closing; and WHEREAS, the City Council of the City of La Porte has C determined and does hereby find, determine and declare that • the hereinafter described portion of the said alley is not suitable, needed, or beneficial to the public as a public alley, and should be vacated, abandoned and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. That that portion of the alley located in Block Seven Hundred Ninety (790) of the TOWN OF LA PORTE, Harris County, Texas, described as follows, to-wit: Being that portion of the alley in Block Seven Hundred Ninety (790), TOWN OF LA PORTE, Harris County, Texas, situated between Lots Ten (10) through Sixteen (16), both inclusive, on the west side, and Lots Seventeen (17) through Twenty-three (23), both inclusive, on the east side, and being sixteen feet (16') wide and one hundred seventy-five feet (175') in depth, • is hereby permanently vacated, abandoned and closed by the City of La Porte. See attached map. The alley easement serving Lots 1 through 9, and 24 through 32, should be maintained in order to provide future service for any development that may take place. WHEREAS, on June 30, 1980, Houston Lighting & Power Company (HL&P) filed with the City of La Porte, Texas a request for an increase in rates to be charged within the City • in the amount of $214 Million per year on a system-wide basis; and WHEREAS, the City suspended the effective date of such proposed rate increase for 120 days beyond August 5, 1980; C and WHEREAS, the City Council, having reviewed the • Company' s rate filing package and supporting testimony as well as the Final Order of September 15, 1980 of the Public Utility Commission of Texas regarding the same rate application in Docket No. 3320, is of the opinion that a lesser increase in rates should be approved for HL&P; and WHEREAS, the City Council finds approved by the Final Order in Docket No. revenues that are adequate to the Company rates that are just as reasonable to both Company; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL O: LA PORTE, TEXAS: that the total increase 3320 will provide and will result in customers and the THE CITY OF Section 1. That the City Council of the City of La Porte orders the Houston Lighting & Power Company to file rate schedules to be effective within the City of La Porte identical to those rate schedules filed with and approved by the Public Utility Commission of Texas pursuant to the Commission's Final Order in Docket No. 3320. Section 2. The rates set forth on such rate schedules are those under which said Company shall be authorized to render electric service and to collect charges from its customers for the sale of electric power and energy within the City of La Porte • until such time as said rate schedules may be changed, modified, amended or withdrawn as provided by law, but shall not be in excess of rates approved by the Public Utility Commission for any other municipality pursuant to the rate filing of HL&P on June 30, 1980. Section 3. The rate schedules filed by Houston Lighting & Power Company shall be effective from and after final passage of this ordinance arxd shall apply to each customer of iiL&P within the City of La Porte for electricity consumed after the date of filing with the City, which date shall not be prior to October 1, 1980 and may not be charged for electricity consumed prior to such date. ( Section 4.
