Mayor Meza asked if there was anyone present who wished to submit a bid for the demolition of dangerous buildings, no one came forward, therefore Mayor Meza declared the bid time closed. Ordinance No. 780 T,aW was read by City Attorney Askins, AN ORDINANCE AMENDING ORDINANCE 780, PROVIDING THAT SHIPPING CONTAINER STORAGE AND REPAIR FACILITIES ARE A USE FOR WHICH A SPECIAL PERMIT MAY BE GRANTED IN AN INDUSTRIAL DISTRICT PROVIDING THAT FREIGHT TERMINALS ARE A USE FOR T,dHICH A SPECIAL PERMIT MAY BE GRANTED FOR USE IN AN INDUSTRIAL DISTRICT; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF SHALL BE FINED IN ANY SUM NOT MORE THAD1 TWO HUNDRED DOLLARS (200.00); FINDING CONMPLIANCE WITH THE OPE1~I MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Administrative Reports: Public taorks Director Hodge submitted a request for authoriza- tion to proceed to advertise for bids on two tractors with mowers. Motion was made by Councilman Simons authorizing bids to be taken for two tractors with mowers for Public Wroks. The motion was second by Councilman Kibodeaux. The motion carried 2 ayes and 0 nays. Owner further agrdes to pay all engineering fees for survey, design, contract documents, bidding, construction staking, and construction inspection. . (5) Subject to the provisions q~f. this agreement, City hereby agrees to construct and install said..extension of its utility • main(s) according to the plans and specifications to be prepared by City's engineer. Prior to City authorizing the. City's engineer to prepare plans and specifications Owner will deposit with City in escrow a sum of money based on and equal to the Ca_ty engineer's estimated project cost in conformance with Section 4, less esti- mated construction, construction staking and inspection costs. Thereafter, City will authorize the City engineer to prepare plans • and specifications for said extension.(s) . Upon completion of plans and specifications City will place the project for bid. When bids are received they shall be tabulated by the City and a copy of said tubuiation shall be provided to Owner. Thereaf ter, Owner shall deposit with City in escrow a sum equal to the amount bid by the lowest responsible chosen bidder, plus a sum equal to the .~- estimated construction staking and inspection fees if applicably. When said deposit has been made by Owner, City shall execute a ~`- contract for said extension(s). It is agreed and understood thdxt the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the'~~ project that result from circumstances beyond the control.of City. (6) City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage connection charge for water and/or seeder service against said property belonging to Owner. Owner shall be responsible for all other customary charges. • (7) Upon execution of this agreement and compliance with terms herein, City agrees to begin the preparation of engineering plans and construction specifications for said extension(s), and to begin construction thereof as soon~as tl-.e same may be let for contract as herein provided. PLT Job No. 1294 Dear Mr. Williams: With reference to your letter of July 4, 1980 requesting • The following criteria shall be met during construction within the City limits of La Porte. a permit to construct a 10-Inch C02 Pipeline for Air Products & Chemicals, Inc., I am hereby recommending full approval of your project as submitted to the City of La Porte. 1. The Contractor must notify the City of La Porte Pub- lic Works Department 24 hours prior to the crossing of any city utility with the pipeline. 2. All crossings of streets, Street R.O.W., and improved R.O.W. must be scheduled a minimum of 24 hours in ad- vance with the City Public Works Department. 3. All street crossings shall be bored and cased and the bore must be inspected and approved by the City Con- struction Inspector. • 4. Any damages to city facilities, utility pipelines, streets. etc. shall be reported immediately and re- paired at no cost to the City. Repairs must be in- spected and approved by the City Construction Inspec- tor, S. Engineering A review meeting was held 9-11-80 with the following people in attendance: Jerry Hodge, Chacko Thomas, & D.A. Paulissen. Below are the items that were discussed. 1. The Contractor must notify the City of La Porte 24 hours prior to any crossing of any city utility with the pipeline. The notice is required because the City must locate said utility for the contractor. 2. The minimum ground cover requirements must be in accordance with the City Pipleine Ordinance ~~915. In review of the profiles, these requirements have been met. 3. The City Council of the City of La Porte has received an application dated July 14, 1980, from Air Products and Chemicals, Inc., requesting a permit under Section 18-A-3 of Ordinance No. 915, being Chapter 18-A of the Code of Ordinances C of the City of La Porte, to construct a ten-inch (10") nominal C • diameter carbon dioxide gas pipeline crossing the City of La Porte, all as shown on said application. The application of Air Products and Chemicals, Inc., has been reviewed by the City':; Director of Public Works, who has found that said application meets all re- quirements of said Ordinance No. 915, and has recommended its approval. Section 2. The City Council of the City of La Porte hereby approves the application of Air Products and Chemicals, Inc., dated July 14, 1980, and this Ordinance shall constitute a permit C to Air Products and Chemicals, Inc., to lay and construct said C pipeline within the City of La Porte, all in conformance with the requirements of said Ordinance No. 915. Gail Hamilton, assistant City Attorney, was asked to draw up such an ordinance for your consideration. We think the peculiar aspects of the geographical location of our City call for special precautions involving the disposal of toxic or radioactive wastes. The entire Bay Area will no doubt flood under hurricane conditions, the subsidence will continue along with shifting of the soil, and the proximity of the water table to the surf ace of the earth are factors which must be considered. Our location is delicate; we do not wish to risk the health and • safety of our citizens by permitting the dumping of hazardous wastes within our boundaries. Planning & Zoning recommends that City Council adopt the ordinance excluding such waste sites from the City of La Porte.
