1. Meeting called to order by Mayor Meza.
Members of the City Council Present: Mayor J. J. Meza;

Councilwoman Virginia Cline; Councilman Tom Simons;
Councilman Norman L. Malone.
Members of the City Council Absent: None.

• Motion was made by Councilman Kibodeaux to refer all bids to
the firm of Busch, Hutchison for tabulation, second by Council-
man Simons. The motion carried 4 ayes and 0 nays.

4. Mayor Meza called to order a joint public hearing of the City
Council and Planning and Zoning. It was established that a
quorum of both bodies was present. Mayor Meza stated this
hearing is to consider a request for re-zoning Outlots 450
and 451 from R1 (residential) to commercial. He asked if
there were any person present who wished to speak for or
against the rezoning of said properties. No one came forward.
Michael Powers addressed the Council to state his request in
person.
Pat Muston, Chairwoman for Planning and Zoning, read the
Commission's recommendation favoring the rezoning.
City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING
THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN
DESCRIBED• AND PROVIDING AN EFFECTIVE DATE HEREOF.
• Motion was made by Councilwoman Cline to pass and approve
Ordinance No. 780 ZZ, changing the classification of Outlots
450 and 451 from R1 to Commercial. The motion was seconded
by Councilman Simons. The motion carried 4 ayes and 0 nays.

Mayor Meza stated the second petition to be publicly heard
at this joint public hearing was a request to re-zone 4.562
acres out of the Richard Pearsall Survey from Commercial to
Industrial by Marco Equipment Company. The City Secretary
stated all interested parties have been notified and public
notice given in the newspaper. Mayor Meza asked if there
was anyone present wishing to make a statement concerning
the rezoning. No one came forward.
Pat Muston, Chairwoman for Planning and Zoning, read the
recommendation for rezoning from Planning and Zoning.
City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING
THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN
DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilman Kibodeaux to pass and approve
Ordinance No. 780 AAA, changing the 4.562 acres out of the

mercial to Industrial zoning classification. The motion was
seconded by Councilman Tomerlin. The motion carried 4 ayes

The public hearing was adjourned and Mayor Meza recessed the
meeting briefly at 8:05 P.M.
The regular meeting of the La Porte City Council reconvened
at 8:10 P.M.

held on October 5, 1980. The motion was seconded by Council-
man Kibodeaux. The motion carried 3 ayes and 0 nays and

READING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF
LA PORTE, AND EXTENDING THE BOUNDARY LIMITS OF THE SAID CITY
OF LA PORTE, TEXAS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
Motion was made by Councilwoman Cline to pass and approve
• Ordinance No. 1235, second by Councilman Tomerlin. The motion
carried 4 ayes and 0 nays.

7. Motion was made to award the Contract for demolition of certain
dangerous buildings to U. S. Williams in the amount of $22,750.00
as recommended by the Board of Inspectors, by Councilman Tomerlin.
Seconded by Councilman Kibodeaux. The motion carried 4 ayes and
0 nays.

8. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE NO.
780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilman Simons to pass and approve
Ordinance No. 780 BBB point public hearing duly held on
October 22, 1980, and all required notice having been sent)
as requested by Roy D. Kaylor for Block 1160. The motion was
seconded by Councilwoman Cline. The motion carried 3 ayes and
0 nays and 1 abstain.

• 9. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING A PORTION OF CRESCENT DRIVE, IN CRESCENT SHORES
SUBDIVISION IN THE CITY OF LA PORTE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
A motion was made by Councilman Simons to pass and approve
Ordinance No. 1236 as read. The motion was seconded by
Councilman Kibodeaux. The motion carried 4 ayes and 0 nays.

Nays: None
10. Mr. William Jehle, Project Manager for Union Carbide Corpora-
tion, requested the de-annexation of the property north of
State Highway 225 and West of Strang Road, more commonly known
as the Cockburn Estate property, and to designate this property
as part of the Battleground Industrial District of La Porte,
Texas. Union Carbide wishes to acquire the site to build an
industrial gas plant.
Motion was made by Councilman Tomerlin authorizing the Mayor
to write a letter (letter is a part of these minutes) agreein
to certain things discussed at the October 22nd meeting and
fully stated in the attached letter. The motion was seconded
by Councilman Kibodeaux. The motion carried 4 ayes and 0
nays.

11. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 1000 OF THE CITY OF LA PORTE, TEXAS, DESIGNATING THE AREAS
WHERE BEER FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND
PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING
AND CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF PREMI-
SES SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTHORITY; PRO-
VIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS
HEREIN DESIGNATED; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilwoman Cline to pass and approve
Ordinance No. 1000H establishing 710 Park Drive as an on
premises site for sale of beer. The motion was seconded by
Councilman Tomerlin. The motion carried 4 ayes and 0 nays.

12. City Attorney Askins read: AN ORDINANCE DETERMINING TO GRANT,
PROVIDING FOR AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS
MUNICIPAL RETIREI`~ENT SYSTEM: "UPDATED SERVICE CREDIT" IN SAID
SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH
SYSTEM IN THE EMPLOYMENT OF THE CITY OF LA PORTE, ELECTING
AND PRESCRIBING THE EFFECTIVE DATE OF SUCH UPDATED SERVICE
• CREDITS, AUTHORIZING AND PROVIDING FOR ALLOWANCE OF INCREASES
IN MONTHLY BENEFITS PAYABLE BY TEXAS MUNICIPAL RETIREMENT
SYSTEM TO RETIRED EMPLOYEES AND TO BENEFICIARIES OF DECEASED
EMPLOYEES, UNDER CURRENT SERVICE ANNUITIES ARISING FROM SERVICE

Motion was made by Councilwoman Cline to pass and approve
Ordinance No. 1237 as read. The motion was seconded by Council--
. man Kibodeaux. The motion carried 4 ayes and 0 nays.

13. A joint election agreement between the City of La Porte and
the La Porte Independent School District, the City of Morgan's
Point, the City of Shoreacres and the Bayshore Municipal Utility

District was read by City Attorney Askins. A letter was intro-
duced received from the City of Shoreacres withdrawing from
the agreement. Lengthy discussion followed concerning the
City of Morgan's Point's election process.
Motion was made by Councilman Tomerlin to accept the agreement
as presented and asking the City of Morgan's Point to stipulate

for a self-propelled pneumatic tired roller to Fogle Equip-
ment Co. at bid price of $23,950.00 as recommended by the
Director of Public Works. The motion was seconded by Council-
man Simons. The motion carried 4 ayes and 0 nays.

15. Mr. Melton Kuhn, Vice President of Big Three Industries, Inc.,
appeared before Council in reply to numerous complaints re-
. ceived concerning noise emitted by the Big Three Plant on
Fairmont Parkway. Mr. Kuhn introduced Dennis Mucha, Safety
Director and Sid Peters, Logistics Manager. Mr. Kuhns stated
new silencers have been ordered, these devices have been custom
built and were ordered on September 22, 1980. They have been
shipped on October 31 and should be received on November 7.
The plant will be down for approximately 12 to 24 hours while
the silencers are being installed and they should be in opera-
tion by the 15th of November. Mayor Meza and the Council
thanked Mr. Kuhn for his cooperation and for taking time to
appear before the City of La Porte Council.
16. The City Council discussed setting a date for Public Hearing
under the Public Utility Regulatory Act of 1978.
Motion was made by Councilman Tomerlin to set June 24, 1981
as a date for Public Hearing under the Public Utility Regula-
tory Act of 1978. The motion was seconded by Councilman Simons.
The motion carried 4 ayes and 0 nays.

17. Administrative Reports:
City Manager Hudgens reported he had had a telephone call from
• Gary Anderson, Administrative Assistant with the Texas Municipal
Retirement System, stating the TMRS Legal Council has prepared
an ordinance that will grant prior service credit to the La Porte
employees who previously served with the City of Lomax.

City Manager Hudgens requested a short executive session to
discuss a contractual matter.
18. There was no Council action at this time.
19. The Council adjourned into Executive Session at 8:50 P.M.
The Council returned to the Council table at 9:20 P.M.
Motion was made by Councilman Simons authorizing the Mayor to
sign a service contract with the firm of Hugh L. Landrum and
Associates, Inc., for 1981, 1982 and 1983. The motion was
seconded by Councilman Tomerlin. The motion carried 4 ayes
and 0 nays.

There being no further business to be brought before the
Council, the meeting was duly adjourned at 9:30 P.M.

Dear Mr. Jehle:
This letter is to confirm the consensus of the LaPorte City
Council at its meeting of October 22, 1980, concerning the
request contained in your letter of September 30, 1980.
The City of La Porte is agreeable to the following:
1) That the property known as the Cockburn
Estate Property as described in your letter,
be included in the Battleground Industrial
District of the City of La Porte, Texas.
2) That the City of La Porte enter into an
Industrial District contract with Union
Carbide Corporation, on the City's Standard
Form of Industrial Agreement, copies of which
have previously been furnished to you and to
•.your attorney, Mr. Frank Hubert, Jr. of
Baker and Botts, with the addition of the
language proposed by Mr. Hubert in his letter
to Knox. W. Askins, La Porte City Attorney,
of October 20, 1980,-with further addition
of "industrial waste" to paragraph (2) (c).
3) As to your request for disannexation, it is
.the practice of the City of La Porte, in
connection with Industrial District Agree-
ments, that 25% of the value of the industrial
facility remain annexed to the City of La Porte.
The selection of the portion to remain annexed
is a matter which should be worked out between
you and the City of La Porte's Tax Engineering
Consultant, Mr. Hugh Landrum, whose address
and telephone number are as shown below.

If you will have your attorney prepare the Industrial District
Contract on the forms which have been provided, attaching the
added language and the legal description of the plant site,
and have the same signed by appropriate corporate officials
of Union Carbide Corporation, and forward it to us, we will
have it executed by City of La Porte officials.
It has been a pleasure working with you on this matter, and
we look forward to having Union Carbide Corporation in our
Battleground Industrial District. If we may be of any further
assistance, please advise.

RESOLUTION NO. 80-10
A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND THE LA PORTE INDEPENDENT SCHOOL DISTRICT
PROVIDING FOR JOINT ELECTIONS, AND AUTHORIZING THE ESTABLISHMENT
OF ELECTION PRECINCTS AND POLLING PLACES.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
approves and designates voting precincts for its annual joint
elections with the La Porte Independent School District, as more
fully described on Exhibit "A", attached hereto, and as shown
on a plat attached hereto as Exhibit "B", both of such Exhibits
being incorporated by reference herein, and made a part hereof
for all purposes.
Section 2. The City Council of the City of La Porte hereby
approves the Joint Election Agreement with the La Porte Independent
School District, a copy of which is attached to this resolution
and made a part hereof, and the Mayor is authorized to sign such
Agreement, and the City Secretary is authorized to attest the
signing of such Agreement, on behalf of the City of La Porte.

JOINT ELECTION AGREEMENT
This Agreement made and entered into by and between the CITY
OF LA PORTE (hereinafter referred to as "La Porte"); the LA PORTE
INDEPENDENT SCHOOL DISTRICT (hereinafter referred to as "District");
the-CITY OF MORGAN'S POINT (hereinafter referred to as "Morgan's
Roint"); the CITY OF SHOREACRES (hereinafter referred to as
"Shoreacres"); and the BAYSHORE MUNICIPAL UTILITY DISTRICT (herein-
after referred to as "B.M.U.D."), each being bodies corporate and
politic in Harris County, Texas,

I.
This Agreement is made and. entered into under the authority
granted by Article 2.O1c, Texas Election Code, which provides authority
for joint elections of political subdivisions.
II.
The term of this Agreement shall be for the annual election on
the first Saturday of April, 1981, and each year thereafter. A
party hereto may thereafter cancel and withdraw from this agreement
by six (6) months' written notice to the other parties hereto.
III.
• For and in consideration of the premises, and the mutual cove-
nants herein contained, the parties agree to conduct, on the first
Saturday in April of each calendar year during the term hereof, a
joint election for the election of officers of their respective
governing bodies, at common polling places hereinafter designated.
IV.
La Porte shall be responsible for conducting joint absentee
• balloting, which shall be conducted at the La Porte City Hall,
604 W. Fairmont Parkway, La Porte, Texas; for arranging for the

rental of voting machines; the appointment and employment of election
officers and clerks; obtaining of poll lists, tally lists, return
forms, and other necessary election materials; and, generally, shall
assume responsibility for the conduct of the joint election in each
of the nine (9) designated election precincts.
V.
The parties agree to pro-ratably share the common expenses of the
joint election, including rental of facilities and election machines,
and employment of election clerks in each of the nine (9) precincts,
and like expenses, such expenses to be shared pro-ratably based upon
the number of precincts used by a party. The parties will each pay
• their individual ex enses for such matters as
p printing of their
ballots to be placed on the election machines, and the publication
of legal notices. The parties shall each individually canvass their
respective election results. La Porte shall pay the legal expense
for a joint filing with the United States Department of Justice,
Voting Rights Division, for approval of the election precincts and
polling places.
VI.
No party hereto shall charge rental for the use of any of its
buildings or facilities for the joint election.
VII.
The ballots of each party shall be separately placed on the
• machine for voting, and only legal residents of a party shall be
allowed to vote for its officers. However, more than one ballot may
be placed on the same machine, with appropriate. "blocking locks" for
non-residents.
VIII.
The initial voting precincts for the joint elections to be held
under this Agreement, and until amended by further agreement of the
parties, with the approval of the United States Department of Justice,
• Voting Rights Division, are hereby established by the parties as

IX.
A plat showing the boundaries of the precincts is attached
hereto as Exhibit "A", incorporated by reference herein, and made a
part hereof for all purposes.
X.
La Porte shall pay all common expenses of the election, and
shall furnish each other party hereto an itemized invoice for its
respective pro-rata share thereof, within thirty (30) days from
the date of the election.
XI.
Run-off elections, as necessary, shall be held in like manner
as the regular joint election, under the terms hereof. Provided,
however, a party hereto not required to hold a run-off election,
shall not be required to share in the cost of such run-off election.
XII.
This Agreement shall become effective as to a party upon passage
of a resolution approving same by its governing body.

AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
finds, determines and declares that heretofore, to-wit, on the
5th day of November, 1980, at 7:00 P.M., a joint public hearing

was held before the Planning and Zoning Commission, and the City
Council, of the City of La Porte, Texas, pursuant to due notice,
to consider the question of the possible re-classification of
the zoning classification of the hereinafter described parcel
of land. There is attached to this Ordinance as "Exhibit A,"
and incorporated by reference herein and made a part hereof for
all purposes, a copy of "Notice of Public Hearing" which the
City Council of the City of La Porte hereby finds was properly
mailed to the owners of all properties located within two hundred
feet (200') of the properties under consideration.
C Section 2. The Publisher's Affidavit of ublication of

notice of said hearing is attached hereto as "Exhibit B," incor-
porated by reference herein and made apart hereof for all purposes.
Section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session
on November 5, 1980, to consider the changes in classification
which were the subject of such joint public hearing. The City
Council of the City of La Porte is in receipt of the written
recommendations of the City of La Porte Planning and Zoning Com-
mission, by letter dated November 5, 1980, the original of which
letter is attached hereto as "Exhibit C," incorporated by ref-
erence herein, and made a part hereof for all purposes.

Section 4. The City Council of the City of La Porte hereby
accepts the recommendation of the City of La Porte Planning and
Zoning Commission, and the zoning classification of the herein-
after described parcel of land, situated within the corporate
limits of the City of La Porte, is hereby changed in accordance
therewith, and the zoning classification of said parcel of land
C shall hereafter be "District C--Apartment and Commercial District."
The description of said parcel of land re-zoned is as follows,
to-wit:

Harris County, Texas.
Section 5. All ordinances in conflict herewith are repealed,
to the extent of conflict only.

AN ORDINANCE ANNEXING ON FINAL READING THE HEREINAFTER DESCRIBED
TERRITORY TO THE CITY OF LA PORTE, AND EXTENDING THE BOUNDARY
LIMITS OF THE SAID CITY OF LA PORTE, TEXAS; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF T,A PORTE:
Section 1. The City of La Porte has heretofore adopted a
Home Rule Charter granting the Council the power by ordinance to
fix the boundary limits of the City of La Porte and to provide
for the extension of said boundary limits, and the annexation of
C additional territory lying adjacent to the City. This annexation
proceeding is conducted pursuant to the authority granted by said
Home Rule Charter; by Article 1175, Revised Civil Statutes; and
by Article 970a, Revised Civil Statute:.
Section 2. The City Council of the City of La Porte hereby
finds, determines and declares that the hereinafter described
territory is adjacent and contiguous to tt.e present city limits
of the City of La Porte, and lies within the exclusive extra-
territorial jurisdiction of the City of La Porte, and that the
annexation of said territory to the City of La Porte will pro-
f mote the general health, safety and welfare of persons residing
within the City and within the hereinafter described territory.
Section 3. The City Council of the City of La Porte has
heretofore, on October 1, 1980, passed and approved Ordinance
No. 1234 , declaring its intention to institute rocee '

to annex the hereinafter described territory. A public hearing
was called, and was held on October 22, 1980, at which public
hearing all interested parties were given an opportunity to be
heard. Notice of such public hearing was given by publication
of Ordinance No. 1234 in The Bayshore Sun on October 9,
.1980, said newspaper having general circulation in the Cit of

serving the City and on the City's tax roll where the right-of-
way thereof was included in the territory to be annexed. Such
notices and such hearing were all in conformity with the yiunicipal
Annexation Act of 1963, Article 970a, Vernon's Annotated Texas
Statutes, as amended.
Section 4. The City Council of the City of La Porte hereby
institutes annexation proceedings as to the following described
territory, and the same is hereby declared annexed to the City of
La Porte, Texas, and the boundary limits of the City of La Porte,
Texas, be, and the same are hereby, extended to include the follow-
ing described territory within the city limits of the City of
La Porte, and the same shall hereafter be included within the
territorial limits of the City of La Porte, and the inhabitants
thereof shall hereafter be entitled to all rights and privileges
of other citizens of the City of La Porte, and they shall be
bound by the acts, ordinances, resolutions and regulations of
the City of La Porte. The territory to be so annexed is the same
territory as described in said Ordinance No.

Section 5. Should any section or part of this ordinance
be held uncontitutional, illegal or invalid, or the application
thereof ineffective or inapplicable as to any territory, such
unconstitutionality, illegality, invalidity or ineffectiveness
of such section or part shall in nowise affect, impair or inval-
idate the remaining portion or portions thereof, but as to such
remaining portion or portions the same shall be and remain in
full force and effect; and should this ordinance for any reason
be ineffective as to any part of the area hereby annexed to the
City of La Porte, such ineffectiveness of this ordinance as
to
any such part or parts of any such area shall not affect the
effectiveness of this ordinance as to all of the remainder of
such area, and the City Council hereby declares it to be its
purpose to annex to the City of La Porte every part of the area
described in Section 4 of this ordinance, regardless of whether
any other part of such described area is hereby effectively
annexed to the City. Provided, further, that if there is included
within the general description of territory set out in Section 4
C of this ordinance to be hereby annexed to the City of La Porte
any lands or area which are presently part of and included within
the limits of the City of La Porte, or which are presently part
of and included within the limits of any other city, town, or
village, or which are not within the City of La Porte's juris-
diction to annex, the same is hereby excluded and excepted from
the territory to be hereby annexed as fully as if such excluded
and exceptaed area were expressly described herein.
Section 6. This ordinance shall not repeal, impair, modify,
or in anywise affect any other annexation ordinance or ordinances
of the City of La Porte, but such other ordinance or ordinances
shall remain and continue to be effective, wholly unaffected in
any way. or manner by the passage of this ordinance.

AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
CRESCENT DRIVE, IN CRESCENT SHORES SUBDIVISION IN THE CITY OF
LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by the record owners of all of the property abutting
hereinafter described portion o?: Crescent Drive, in Crescent
Shores Subdivision in the City of La Porte, to vacate, abandon,
and permanently close that portion of Crescent Drive; and
WHEREAS, the City Council of the City of La Forte has
determined, and does hereby find, determine and declare that
. the hereinafter described portion of Crescent Drive is not
suitable, needed, or beneficial to the public as a public road
or street, and that the closing of the hereinafter described
portion of Crescent Drive is for the protection of the public
and for the public interest and benefit, and that the hereinafter
described portion of said Crescent Drive should be vacated,
abandoned, and permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175, of the Revised Civil Statues of the State

AN ORDINANCE AMENDING ORDINANCE N0. 1000 OF THE CITY OF LA PORTE,
TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVID-
ING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER
FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING
SOURCE OF AUTHORITY; PROVIDING THAT NO LICENSE SHALL BE ISSUED
EXCEPT FOR THE AREAS HEREIN DESIGNATED; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
WHEREAS, the City of La Porte desires to regulate the
closing hours for the sale of beer by retailers selling beer
for consumption on premises in accord with provisions of Article
667-10-1/2 of the Penal Code of the State of Texas.

• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. In addition to the locations specified in Sec-
tion 1 of Ordinance No. 1000, passed and approved by the City
Commission of the City of La Porte on August 19, 1974, the sale
of beer shall also be permitted during the hours set by the
general laws of the State of Texas at the following location
by a retailer selling beer for consumption on premises, to-wit:
Lots Five (5) through Nine (9), BEACH
PARK, both inclusive, Harris County,
Texas, located at 710 Park Drive,
C La Porte, Texas, known as "hoe's
Mexican Restaurant."
Section 2. The sale of beer at said location shall be
• permitted only in connection with the sale of food.
Section 3. Except and to the extent amended hereby, Ordi-
nance No. 1000 shall remain in full force and effect.
Section 4. The City Council officially find, deter.-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
• City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,

FOR ALLOWANCE OF INCREASES IN MONTHLY BENEFITS PAYABLE BY
TEXAS MUNICIPAL RETIREMENT SYSTEM TO RETIRED EMPLOYEES AND TO

. TAKING THE COST OF ALLOWING ANY SUCH EMPLOYEE CREDIT IN SUCH
SYSTEM FOR ALL SERVICES TO WHICH SUCH EMPLOYEE HAD BEEN ENTITLED
AT DATE OF SUCH WITHDRAWAL, WITH TFiE EFFECT AS IF ALL SUCH SER-
VICE.HAD BEEN PERFORMED AS AN EMPLOYEE C)F THIS CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF LA PORTED TEXAS:
Section 1. Initial Allowance of Updated Service Credits.
(a) On the terms and conditions set out in Section XVII of
Article 6243h, Vernon's Texas Civil Statutes, as amended 1975,
each member of Texas Municipal Retirement System who has current
service credit or prior service credit in said System in force
and effect on the 1st day of January, 1981, by reason of service
in the employment of the Gity of La Porte, shall be and is hereby
allowed "updated service credit" (as that term is defined in said
act) in an amount that is 1008 of the "Base Updated Service Credit"
of the member, calculated as provided in said act. The updated
• service credit hereby allowed shall be in lieu of and in substitu-
tion for all Prior Service Credits, Special Prior Service Credits,
and Antecedent Service Credits, if any, heretofore, allowed such
member by reason of service with the City of La Porte.
• (b) In accordance with the provisions of said act, the de-
posits required to be made to the Texas Municipal Retirement System
by employees of the several participating departments on account of
current service shall be calculated from and after the date afore-
said on the full amount of such person's earnings as an employee
of the City.

• (c) Subject to approval of the Board of Trustees of Texas
Municipal Retirement System, the updated service credits hereby
granted shall be and become effective the 1st day of January, 1981.
Section 2. Initial Increases in Annuities in Effect.
(a) Pursuant to Section XVIII of Article 6243h, Vernon's
Texas Civil Statutes as amended and subject to approval by the
Board of Trustees of Texas Municipal Retirement System as provided
in said act, the City of La Porte hereby elects to allow and to
provide for payment of the increases below specified in all monthly
benefits payable by Texas Municipal Retirement System after the
1st day of January, 1981 to retired employees and to beneficiaries
of deceased employees of this City under current service annuities
• and prior service annuities arising from service of such employee
to this City, and in effect prior to the date last above mentioned.
(b) Each such monthly benefit for the month of January, 1981,
and each month thereafter shall be increased by 50~ above the
amount of the regular benefit (as distinguished from any supplemental
or distributive benefit) in effect for the month of December, 1980.
Section 3. Adoption of Plan Provisions of Section XX, V.T.C.S.
Article 6243h.
Pursuant to Section XX of Article 6243h, Vernon's Texas Civil
Statutes, as amended, the City of La Porte, adopts the following
plan provisions affecting participation of its employees in the
Texas Municipal Retirement System:
(a) Each person who becomes an employee of any participating
department of this City and who is not already a member of the
• Texas Municipal Retirement System shall become a member of the
System as a condition of employment, provided such person is then
under sixty (60) years of age;
(b) Any member, after one (1) year from the effective date
• of membership, shall be eligible for service retirement who has
attained the age of fifty (50) years and has completed twenty-five
(25) years of creditable service with this City or who has attained
the age of sixty (60) years and has completed at least ten (10)
years of creditable service with participating municipalities which
have adopted the plan provisions of this section, or who has become

eligible for service retirement under any other applicable pro-
vision of Article 6243h, Vernon's Texas Civil Statutes;
(c) The membership of any member who has completed at least
ten (10) years of creditable service with this City and other par-
ticipating municipalities which have adopted the plan provisions
of Section XX of Article 6243h, Vernon's Texas Civil Statutes
shall not terminate because of absence from service; and
(d) Any person who is an employee of a participating depart-
ment of this municipality at the effective date of this ordinance,
but who at the date of his employment was under sixty (60) years
of age but did not become a member of Texas Municipal Retirement
System because he was then above the maximum age then prescribed
• by law for initial membership in the System, shall become a member
of the System at the effective date of this ordinance, unless he
has already become a member under other provisions of the governing
act, and shall be allowed prior service credit for each month of
creditable service performed for this municipality subsequent to
the date such person was precluded from membership and prior to
the effective date of his membership. Such prior service credit
shall be calculated using the same percentage of the base prior
service credit as was most recently used in calculating Prior
Service Credits or Updated Service Credits in said System for cur-
rent member employees of this City.
(e) The rights, credits and benefits hereinabove authorized
shall be in addition to the plan provisions heretofore adopted and
• in force at the effective date of this ordinance pursuant to the
Act governing said System.
(f) These provisions shall become effective on January 1,
1981, provided it has previously been determined by the Actuary
• for the System that the additional obligations herewith undertaken
can be funded within the period prescribed by the Act above cited,
and will not result in probable depletion of this City's account
in the Prior Service Accumulation Fund of the System.

• Section 4. Participation in the Supplemental Death Benefits
Fund.
(a) The City of La Porte hereby elects to participate in the
Supplemental Death Benefits Fund of the Texas Municipal Retirement
System beginning on the first day of January, 1981, following
written notification to the System of the adoption of this ordinance,
for the purpose of providing in-service death benefits in the
amounts and on the terms provided for in Section XIX of the TMRS
Act (Article 6243h, Vernon's Texas Civil Statutes as amended) for
each of the City's employees who are members of said System, and
for the purpose of providing post-retirement death benefits as
provided in said Section XIX for annuitants whose last covered
employment was as an employee of this City.
• (b) The City of La Porte is hereby authorized and directed
to notify the Director of the System of adoption of this ordinance,
and of the participation of the City in said Fund.
(c) Participation of the above mentioned employees and annui-
tants in the Supplemental Death Benefits Fund shall be effective
January 1, 1981.
Section 5. Adoption of Provisions Allowing for "Buy-Back"
o Previously Forfeited TMRS Service.
(a) Pursuant to subsection 8 of Section VI of Article 6243h,
Vernon's Texas Civil Statutes, as amended, the City of La Porte
hereby elects to allow any member of Texas Municipal Retirement
System who is an employee of this City on the 5th day of November,
1980, who has terminated a previous membership in said System by
• withdrawal of deposits while absent from service, to deposit with
the System in a lump sum the amount withdrawn, plus a withdrawal
charge of five percent (5~) of such amrn~r=t for each year from date
of such withdrawal to date of redeposit, and thereupon such member
shall be allowed credit for all service to which the member has
been entitled at date of termination of the earlier membership,
with like effect as if all such service has been rendered as an
employee of this City, whether so rendered or not. The City of
La Porte agrees to underwrite and hereby assumes the obligations
arising out of the granting of all such credits, and agrees that
all such obligations and reserves required to provide such credits

shall be charged to this City's account in the Municipality Prior
Service Accumulation Fund. The five percent (5~) per annum with-
drawal charge paid by the member shall be deposited to the credit
of the City's account in said Municipality Prior Service Accumula-
tion Fund; and the deposits of the amount previously withdrawn by
the member shall be credited to his individual account in the
Employees Savings Fund of the System.
(b) This provision shall become effective on the 5th day of
November, 1980, which is a date on or after the date set forth in
Section 5, above.

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the Mayor and City Commission of the City of La Porte, Texas,
are concerned that all taxable properties within the City be taxed on a fair
and equitable basis, and that the values be updated periodically, and
WHEREAS, there has not-been a revaluation of all properties since 1978,
now
THEREFORE, the Mayor and City Commission of the City of La Porte, Texas,
have determined that it would be wise and to the best interest of said City that
all taxable real property and land within the City that are subject to appraisal
• for City taxes, and/or "in lieu of taxes" payments, be appraised by experts
skilled in the matter of making such appraisals for tax purposes; said experts
to compile current appraisals on all the aforementioned properties and furnish
data and information to the City's Tax Assessor-Collector and Board of Equalization
for the purpose of equalizing the values of such properties as compared with other
property valuations in said City for tax purposes for the tax year 1981 and to up-
date the appraisals of industrial properties subject to Industrial District
contracts for the tax years 1982 and 1983; said data and information to be made
available in respect to all of such properties properly and lawfully coming before
the Board of Equalization for said years; for consideration in the equalization
of values upon renditions made by the owners thereof and/or upon renditions and/or
assessments made by the Tax Assessor-Collector of the City of La Porte, Texas,
• where the owner or owners may fail to render same; and
WHEREAS, the City of La Porte has employed the firm of Hugh L. Landrum &
Associates, Inc., of Houston, Harris County, Texas, for tax appraisal services for
the City since 1967; and
WHEREAS, the Mayor and City Commission of the City of La Porte, Texas,
find that the firm of Hugh L. Landrum and Associates, Inc., has performed the
• services called for in prior contracts in a completely satisfactory manner, and
have adequately demonstrated their skills and expertise in the matter of making
appraisals for tax purposes; and

WHEREAS, the firm of Hugh L. Landrum and Associates, Inc., has proposed
to the City of La Porte, Texas, that a new contract be entered into between that
firm and the City of La Porte, said contract to cover a complete reappraisal of
all taxable real property and land, and the gathering and compiling of informa-
tion relating to the values of the properties above identified as of January 1,
1981, and to up-date the industrial property values subject to Industrial District
contracts as of January 1, 1982, and January 1, 1983, and make this information
available to the City Tax Assessor-Collector and the Board of Equalization to be
used as they may see fit in determining the values which should be assigned to
said properties properly coming before them for consideration and within its
• jurisdiction for tax purposes in the City of La Porte, Texas, for each of the
years 1981, 1982 and 1983, for the sum of FORTY-FOUR THOUSAND DOLLARS ($44,000.00)
per year for each of the calendar years 1981, 1982 and 1983.
IT IS THEREFORE AGREED by and between the City of La Porte, Texas, acting
herein by its duly authorized Mayor and City Commission, FIRST PARTY, and the firm
of Hugh L. Landrum and Associates, Inc., of Houston, Harris County, Texas, SECOND PARTY
as follows:
THE SECOND PARTY AGREES TO:
1. Inspect, measure as necessary, classify, and appraise all residential and com-
mercial buildings within the City of La Porte for tax year 1981.
2. Inspect and appraise all taxable lots and acreage within the City for the tax
year 1981.
• 3. Inspect and appraise each industrial plant located within the City of La Porte,
or either of the Industrial Districts for City taxes and "in lieu of taxes"
payments for each of the years 1981, 1982 and 1983.
4. Inspect and appraise all utilities, railroads, and pipelines located within
the City as necessary for City taxes or "in lieu of taxes" payments for each of
the years 1981, 1982 and 1983.
• 5. Prepare a permanent record card on each parcel of land included in Item 2
above for the City tax office. These records will contain the property
description, recommended land valuation, and how determined, a dimensional
sketch of any improvements on the land, complete with details of construction,
recommended values for the improvement and how determined, and any other data
pertinent to the particular property.

6. Assist the Tax Assessor-Collector in setting up records on the above proper-
ties, achieving equalization throughout the taxing jurisdiction, and meeting
deadlines and legal requirements for each of the years 1981, 1982 and 1983.
7. Prepare recommended City assessments and "in lieu of taxes" payments for each
industrial plant within the City's Industrial Districts in accordance with the
current Industrial District agreements between the various industries and the
City. This will be done for tax years 1981, 1982 and 1983.
8. Work with the Tax Assessor-Collector, the Board of Equalization, the Mayor,
and the City Commission to promote harmony and understanding.
9. Sit with the Board of Equalization at their meetings as necessary and make
• available information relating to property values which may be used by
them as they see fit in determining the values which should be assigned to
properties coming before them.
THE SECOND PARTY also agrees that in the event the recommended values
are protested by the owners or representatives of the property, SECOND PARTY
will furnish expert testimony at their own expense in the District Court of Harris
County, Texas.
IT IS FURTHER UNDERSTOOD by both parties hereto, that the record cards
mentioned in Item 5 above will become the exclusive property of the City of
La Porte, and the City may sell or share this information with any other taxing
jurisdiction as they may see fit.
FOR AND IN CONSIDERATION of the skilled services, technical knowledge,
~ and experience of SECOND PARTY in the performance of the obligations devolving
upon such party hereunder; and in consideration of the information given and
assistance given to the City of La Porte, Texas, the Tax Assessor-Collector and
the Board of Equalization in undertaking to value and equalize the values of pro-
perties properly coming before the Board of Equalization for the years 1981, 1982
and 1983, for consideration at its equalization hearings; FIRST PARTY AGREES and
obligates itself to compensate SECOND PARTY by payment to SECOND PARTY the sum
of FORTY-FOUR THOUSAND DOLLARS ($44,000.00) for each of the calendar years, 1981,
1982 and 1983, equal payments to be made quarterly upon the submission of a statement
by SECOND PARTY to the City. The City shall also furnish all materials and supplies
required for this work that are to remain the property of the City of La Porte, Texas.

THE EXECUTION OF THIS CONTRACT is authorized by proper resolution duly
adopted by the City Commission of the City of La Porte, Texas, and entered upon
the minutes of such Commission.
