LA PORTE CITY COUNCIL - LA PORTE, TEXAS
NOVEMBER 19, 1980
1. Meeting called to order by Mayor Meza.
Members of the City Council Present: Mayor J. J. Meza;
Councilman John Tomerlin; Councilman I. J. Kibodeaux;
Councilwoman Virginia Cline; Councilman Tom Simons.
Members of the City Council Absent: Councilman Norman
L. Malone.
Other City Officials Present: City Manager James R. Hudgens;
City Attorney Knox Askins; City Secretary Betty T. Waters;
City Engineer John Joerns; Police Chief H. F. Freeman;
Director of Public Works Jerry Hodge; Fire Marshal Paul
Hickenbottom; Parks Director Stan Sherwood; Chief Inspector
David Paulissen.
• There were 22 additional persons present.
2. The invocation was given by Councilman Tomerlin.
3. Mayor Meza called fox bids to be submitted on the City of
La Porte Service Center. There being no further bids to be
received, Mayor Meza declared the time to receive bids
closed.
City Manager Hudgens opened and read the bids received:

Motion was made by Councilwoman Cline to refer bids to
Engineering for tabulation, Council to consider their
recommendation on December 17, 1980. The motion was seconded
by Councilman Tomerlin. The motion carried 4 ayes and
0 nays.

4. In reviewing the minutes of the November 5, 1980, Council
Meeting, Councilman Simons stated those minutes did not
reflect that a correction had been made in the minutes con-
cerning the Mayor's vote. Councilwoman Cline requested
the minutes to reflect her reason for abstaining was her
absence from that meeting. Councilman Tomerlin stated he,
too, wished to have the minutes of the November 5 meeting
to reflect his reason for abstaining from voting on the
minutes of October 15 was his absence from that meeting.
Motion was made by Councilman Tomerlin to approve the
minutes as corrected. Motion was seconded by Councilman
Kibodeaux. The motion carried 4 ayes and 0 nays.

5. City Attorney Askins read: AN ORDINANCE VACATING, ABANDON-
ING AND CLOSING ALL OF THE ALLEY IN BLOCK 173, TOWN OF
LA PORTE.
A motion was made by Councilman Simons to pass and approve
Ordinance No. 1238. Seconded by Councilman Tomerlin. The
motion carried 4 ayes and 0 nays.

City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING ALL OF THE ALLEY IN BLOCK 171, TOWN OF LA PORTE.
A motion was made by Councilman Simons, seconded by Council-
man Tomerlin to pass and approve Ordinance No. 1239. The
motion carried 4 ayes and 0 nays.

6. City Attorney Askins read: AN ORDINANCE AWARDING AND ALLOW-
ING PRIOR SERVICE CREDIT IN THE TEXAS MUNICIPAL RETIREMENT
SYSTEM TO ALL EMPLOYEES OF THE CITY OF LA PORTE WHO WERE
EMPLOYEES OF THE CITY OF LOMAX ON THE DATE OF ITS CONSOLIDA-
TION WITH THE CITY OF LA PO RTE FOR THE NUMBER OF YEARS
SERVICE SUCH EMPLOYEES HAD WITH THE CITY OF LOMAX PRIOR TO
SUCH CONSOLIDATION.
A_ motion was made by Councilman Simons to pass and approve
Ordinance No. 1240 as read. The motion was seconded by
Councilman Kibodeaux. The motion carried 4 ayes and 0 nays.
Ayes: Councilmen Tomerlin, Kibodeaux, Cline, Simons
Nays: None
• 7. Motion was made by Councilman Kibodeaux to approve the tax
sale of Lots 13 thru 24, Block 422, to Hope T. Taylor, sub-
ject to total amount bid covering all costs and fees genera-
ted by the sale including taxes due. The motion was seconded

by Councilman Simons. The motion carried 4 ayes and
0 nays.

8. A request was made by Public Works Director Hodge to purchase
a three-side mower. The cutting range of this mower is
15 feet. After purchase of the self-propelled pneumatic
tired roller from Fogle Equipment there is $8,869.00 unen-
cumbered out of the allocated funds. The cost of a 15'
mower should fall well within this amount.
Motion was made by Councilman Kibodeaux to receive bids on
a 15 foot mower on December 10, 1980. The motion was sec-
onded by Councilman Tomerlin. The motion carried 4 ayes
and 0 nays.

9. Administrative Reports
Dave Corbin introduced Sure Flow representatives, who
showed a T.V. film of the sanitary sewer line in Fairmont
• Park. There was lengthy discussion concerning effective
methods that might be utilized to relieve the sewer prob-
lems in the area. Dave Corbin reported he hoped the cost
of repairs for the area could become a part of the renova-
tion undertaken by the EPA Project.
Public Works Director Hodge introduced Larry Barron with
Layne Texas. Mr. Barron discussed the work being done by
Layne Texas on Fairmont Park Water Well #2. After discussing
and drawing diagrams of the work being done, Mr. Barron
stated he felt the Council had chosen the best and cheapest
route to lengthen the life of the well. He stated the cost
would be between 32 and 35 thousand by the time they are
through. The cost of a new well would run around $200,000.
H. Carlos Smith gave a progress report on the Lomax Bond
projects. He stated the sewer project is 97~ complete and
as of the 17th day of November the Lomax Addition has been
off the Deer Park sewer line. The water project will be
complete in about 10 days and the street project should be
complete and ready to bid by the second week in December.
There was some discussion by Council concerning the existing
residences in La Porte who do not have access to sanitary
sewer. Councilman Tomerlin asked how much money was in the
• Sewer Improvement Fund? He was told that as of this date
there was $139,000 in that fund. Councilman Tomerlin re-
quested an estimated cost for providing service to those
residences of La Porte presently not serviced by sanitary
sewer. Hodge stated he would attempt to provide the re-
quested information by next workshop.

Public Works Director Hodge reported on his plan for the
delivery of garbage bags this next year.
Chief Inspector Paulissen reported on the progress being
made on the demolition of dangerous buildings.
Public Works Director Hodge introduced Mr. Rick Wagner,
the new water superintendent for the City of La Porte.
Hodge also reviewed the upcoming Emergency Planning Seminar
and invited the Council to take part.
10. Council Action
Councilman Kibodeaux reported on the Texas Municipal League
Conference in Dallas, November 8 through the 11th. He
enjoyed the individual sessions.
Councilwoman Cline reported she had enjoyed the busy few
days even though she had not gotten to participate with the
others from La Porte, as she would have liked to, since she
was obligated to so many affairs as a Board Member.
Councilman Simons reported there was much to learn and do
• at TML and he had a very enjoyable trip.
11. At the request of City Manager Hudgens, the Council ad-
journed into executive session at 8:37 P.M. to discuss
contractural matters involving land.
Council returned to the Council table at 9:27 P.M. There
being no further business to be brought before Council,
Mayor Meza entertained a motion to adjourn.
12. Motion was made by Councilman Kibodeaux to adjourn the
meeting at 9:30 P.M. The motion was seconded by Councilman
Tomerlin. The meeting was duly adjourned at 9:30 P.M.

AN ORDINANCE VACATING ABANDONING AND CLOSING ALL OF THE
ALLEY IN BLOCK ONE HUNDRED SEVENTY-THREE (173), IN THE TOWN
OF LA PORTE, HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block One Hundred Seventy-Three
(173), in the Town of La Porte, has never been opened or used
as a public thoroughfare, and the public utilities now making
use of such alley have all given their written consent for
its closing; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed;
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. The alley located in Block One Hundred Seventy-
Three (173) in the Town of La Porte, Harris County, Texas, is
hereby permanently vacated, abandoned and closed by ,the City
of La Porte.
Section 2. This Ordinance shall take effect and be in
force from and after its passage and approval.

Dear Jim:
In accordance with your request, our Legal Counsel has prepared an ordinance that will
grant Prior Service Credit to the City of La Porte's employees who previously had
served with the City of Lomax. Once this ordinance is approved, we will appreciate
receiving a copy for our files.
According to the information furnished to me by Dortha Gray, the former Lomax em-
ployees listed below became La Porte employees. I have also shown the date of their
first TP1RS deposit, according to our records.

Assuming the City of La Porte adopts the enclosed ordinance, each of these employees
would need to make back deposits to TMRS to reflect that they became members of the
System May 1, 1980 (the first day of the month following the consolidation of La Porte
and Lomax). In the case of all of the employees shown, except Pls. Haskins, each em-
ployee would need to make 7% deposits for the months May, June and July. Ms. Haskins
would need to make a 7% deposit for May, since she began making deposits to the System
in June. These deposits would need to be shown on a "supplemental" monthly report and
forwarded to our office along with the City's matching funds. This will give all of
these employees current service credit beginning May 1, 1980; the Prior Service Credit
granted by the City will cover each employee's period of employment with the City of
Lomax prior to May 1, 1980. It will be mandatory for these back deposits to be made
before the Prior Service Credit will be granted to these employees.

AN ORDINANCE AWARDING AND ALLOWING PRIOR SERVICE CREDIT IN THE
TEXAS MUNICIPAL RETIREMENT SYSTEM TO ALL EMPLOYEES OF THE CITY
OF LA PORTS WHO WERE EMPLOYEES OF THE CITY OF LOMAX ON THE DATE
OF ITS CONSOLIDATION WITH THE CITY OF LA PORTS FOR THE NUMBER OF
MONTHS OF SERVICE SUCH EMPLOYEES HAD WITH THE CITY OF LOMAX
PRIOR TO SUCH CONSOLIDATION.
WHEREAS, on April 28, 1980, the City of Lomax, Texas, was consolidated
with the City of La Porte, Texas, and all persons who were employees of the City of
Lomax on that date were offered employment by the City of La Porte, and certain
of ,such employees accepted employment with the City of La Porte upon
consolidation; and
WHEREAS, the City of La Porte is a municipality participating in the
• Texas Municipal Retirement System under and by virtue of Article 6243h, Vernon's
Texas Civil Statutes, as amended, and has elected to have all of its employees and
departments participate in said System, and the former employees of the City of
Lomax who have become employees of the City of La Porte have therefore become
members of said System; and
WHEREAS, Section VI 1(b) of Article 6243h, Vernon's Texas Civil Statutes,
as amended, provides that the governing body of a participating municipality may by
ordinance direct that each of its employees who was serving as an employee of a
public entity to which the municipality has become the successor, shall be awarded
and allowed prior service credit for the total number of months prior to date of
participation during which such employee was employed by such predecessor
governmental unit; and
• WHEREAS, the governing body of the City of La Porte, Texas, finds that it
will be in the public interest to award and allow such prior service credit to those
employees who were employees of the City of Lomax on the date of consolidation;
now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTS:

Section 1. The City of La Porte, Texas, by its City Commission, hereby
elects to award and allow prior service credit (as that term is defined in
Article 6243h, Vernon's Texas Civil Statutes, as amended) to each of its employees
who was serving as an employee of the City of Lomax, Texas, on April 28, 1980 (the

date of its consolidation with the City of La Porte), for the total number of months
prior to April 28, 1980, during which such employee was employed by the City of
Lomax.
Section 2. The City Secretary is hereby directed to furnish to the Board of
Trustees of the Texas Municipal Retirement System a certified copy of this
Ordinance and such other and further information as may be required by said System
to grant such prior service credit to said employees.
Section 3. The City Commission officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place and subject of this
meeting of the City Commission was posted at a place convenient to the public at
the City Hall of the City for the time required by law preceding this meeting, as
• required by the Open Meetings Law, Article 6252-17, Vernon's Texas Civil Statutes,
as amended; and that this meeting has been open to the public as required by law at
all times during which this ordinance and the subject matter thereof has been
discussed, considered and formally acted upon. The City Commission further
ratifies, approves and confirms such written notice and the contents and posting
thereof.
Section 4. This ordinance shall be effective immediately upon its passage
and approval.

arrangements for the relocation of these facilities and have

After doing so, the Public Works Department of the City
of La Porte has no objections to the request of Bayshore

173 between South 7th and South 8th, from Fairmont parkway
to West "I" Street.
• The City of La Porte has no facilities located in the

Dear Ms. Goyen:
On May 10, 1979, Southwestern Bell Telephone Company
received an inquiry from the City of LaPorte concerning the abandon-
ment of an alley in Block No. 173, Town of LaPorte, Harris County,
Texas. We replied to this inquiry in a letter dated May 16, 1979,
in which we stated that the alley would need to remain open in
order to provide Southwestern Bell access to an aerial telephone
cable within the boundaries of the alley. Since this letter corre-
spondence, Southwestern Bell Telephone Company has been contacted
by representatives of Bayshore National Bank in LaPorte, and
they have agreed to pay for the cost of rerouting the aerial
cable. Under this agreement, Southwestern Bell has no objections to
abandonment of Block No. 173.

This aerial cable provides facilities for service to the LaPorte
Police Administration Building at 915 S. gth street and an office
building at 903 S. gth street.
Southwestern Bell Telephone Company will require that the alley
in Block No. 173 remain open to provide access to the above aerial
cable for maintenance purposes.

The above referenced property was filed on for delinquent taxes
in April of 1972, judgment was taken on October 29, 1973. This
property was offered at auction on May ?, 1974, as there were
no bidders the property was bought in by the City of La Porte
to be held in trust for sale at a later date. The property was
advertised for bids to be accepted on December 20, 1976, again
there were no bidders.
The La Porte Independent School District was served with the
intent to file suit and did not intervene.
I have received by letter .a bid on behalf of Mrs. Hope Q. Taylor,
whose deceased husband Paul A. Taylor was the owner of record
• at the time of suit. The bid submitted was $2,114.64. The
amounts due are as follows:

SUBJECT: Request for bids of a ee=side mower
Since the City of La Porte has taken over all the mowing
- at the Airport, it has become almost impossible to keep it
mowed° with our present equipment. There is approximately 300
acres at the Airport. When the Federal Aviation Adm-inistration
-conducted their inspection, they noted that, the Airport needed
mowing.
With a three-side mower, our mowing would be simplified.
The cutting range of this mower is fifteen (15) feet. Our .cut-
ing range of our present mowers is five (5) feet. Also, on some
' of the street right-of-ways, this mower could be used.
.When we went out for bids on
tired roller, we had $32,819.00
of the bid from Fogle Equipment
• $8,869.00 still encumbered. The
approximately $8,000.00.
