OF THE
LA PORTE CITY COUNCIL - LA PORTE, TEXAS
DECEMBER 17, 1980
l. Meeting called to order by Mayor Meza at 7:00 P.M.
Members of the City Council Present: Mayor J. J. Meza,
Councilman John Tomerlin, Councilman I. J. Kibodeaux,

2. The invocation was given by Councilman Kibodeaux.
3. Mayor Meza asked if there was anyone present who wished to
submit a bid on the Certificates of Obligation. No one came
forward. Mayor Meza declared bidding closed.
Mayor Meza asked that the bid received on the Certificates of
Obligation be read by David Fetzer of Moroney, Beissner, the
City's financial advisors.
The bid was submitted under the terms and conditions of the
"Official Notice of Sale" dated December 3, 1980, of
$800,000 City of La Porte, Texas, Certificates of Obligation,
Series 1980. Attached was a certified check from Bayshore
National Bank of La Porte, in the amount of $16,000 which
represents a Good Faith Deposit and which also was submitted
in accordance with the terms set forth in the "Official Notice
of Sale." Bayshore National Bank and First City Bank of La
Porte jointly bid 7.75% on the $800,000. of Certificates
maturing 1982 through 1991.
Motion was made by Councilman Kibodeaux, seconded by Coun-
. cilman Tomerlin to accept the bid as submitted jointly by
Bayshore National Bank and First City Bank of La Porte of
7.75% on the $800,000. Certificates of Obligation. The motion

carried, 3 ayes and 1 nay.

Nays: Councilwoman Cline
Cline asked to qualify her reason for her position in this
matter. She stated she was not opposed to the sale of the
Certificates of Obligation, she is opposed to the amount
since the Council had, she thought, designated funds out of
the budget last year and then had allocated funds in this
year's budget for the Service Center. She felt there was
only a need for approximately $500,000. to be sold.
City Attorney Askins read: AN ORDINANCE AUTHORIZING THE
ISSUANCE, SALE AND DELIVERY OF THE CITY'S CERTIFICATES OF
OBLIGATION, SERIES 1980, IN THE AGGREGATE PRINCIPAL AMOUNT
OF $800,000, PROVIDING THE DETAILS RELATING THERETO AND DE-
CLARING SAID ORDINANCE EFFECTIVE IMMEDIATELY UPON ITS ADOPTION.
Motion was made by Councilman Simons to pass and adopt Ordi-
nance No. 1241 as read by the City Attorney. Seconded by
Councilman Tomerlin. The motion carried, 3 ayes and 1 nay.

Nays: Councilwoman Cline
. 4. The minutes of the Regular Council Meeting of December 3,
1980, were presented for approval. Councilwoman Cline asked
that an addition be made to item 3 to indicate that the bids
received were for two tractors and two mowers. Councilwoman
Cline made a motion to accept the minutes of the December 3,
1980, meeting as corrected. The motion was seconded by Council-
man Simons. The motion carried, 3 ayes and 0 nays, 2 abstain.
Ayes: Councilwoman Cline, Councilman Simons, Mayor Meza
Nays: None
Abstain: Councilmen Tomerlin and Kibodeaux due to their ab-
sence from the December 3 meeting.
5. A recommendation by the Engineering firm of Busch, Hutchison
and Associates, Inc. , and Public Works Director Hodge con-
cerning the bids received on November 19 for the La Porte
Public Works Facility Job Number 79-2154 were reviewed by
Council. Motion was made to accept and award the bid sub-
mitted by Lee Rowe Construction Company of Houston, alternate
V in the amount of $776,850.00 by Councilwoman Cline. Seconded
by Councilman Simons. The motion carried, 4 ayes and 0 nays.

woman Cline, Councilman Simons
Nays: None
Councilwoman Cline questioned the 180 days stated in the con-
. tract. Corbin stated the 180 days is working days, not
calendar days.

6. Mayor Meza stated the City has received authorization from the
Environmental Protection Agency to award bids on E.P.A. Step
III Construction Grant, Contracts I, II, III and IV, Project
No. C-481176-03-0.
Motion was made by Councilman Kibodeaux to award the Contract
I for the Sanitary Sewer Plant to Brown Couch, Inc. , of
Richmond, Texas, for $2,994,000.00. Seconded by Councilwoman
Cline. The motion carried, 4 ayes and 0 nays.
Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman
Cline, Councilman Simons
Nays: None
Motion was made by Councilman Tomerlin to award Contract II
for Gravity Sewer Mains to E. P. Brady, Inc. , of Euless,
Texas, bid amount of $1,020,109.50. The motion was seconded
by Councilwoman Cline. The motion carried, 4 ayes and 0 nays.

Nays: None
Motion was made by Councilwoman Cline to award Contract III
for Lift Station Facilities to Big M Constructors, Inc. , of
Houston, Texas, bid amount of $189,537.00. The motion was
. seconded by Councilman Tomerlin. The motion carried, 4 ayes
and 0 nays.

Cline, Councilman Simons
Nays: None
Motion was made by Councilman Simons to award Contract IV, for
Rehabilitation of Sewer Collection System, to Tinker Industries,
Houston, Texas, bid amount of $1,033,539.90. Motion was sec-
onded by Councilman Tomerlin. The motion carried, 4 ayes and
o nays.
Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman
Cline, Councilman Simons
Nays: None
7. Council considered the recommendations by Public Works Director
Hodge on the 15 foot winged mower, stating Hyco Equipment Comp-
any has submitted the low bid in the amount of $7,190.00 and
meets the specifications set by the City.
Motion was made by Councilman Kibodeaux to accept and award
the bid for the 15 foot winged mower to Hyco Equipment Co.
Motion was seconded by Councilwoman Cline. The motion carried,
4 ayes and 0 nays.

8. Council considered the recommendations by Public Works
Director Hodge on the two tractors bids received December 3,
1980. Hodge recommended Hyco Equipment Co. as the low bid-
der, meeting specifications on the larger of the two tractors.
Because the larger tractor bids are below the estimated cost
giving a back up tractor to pull the 15 foot winged mower.
Motion was made by Councilman Tomerlin to award the bid for
two tractors to Hyco Equipment Co. for two Model JD401-B
tractors at a cost of $23,368.00. Seconded by Councilman
Kibodeaux. The motion carried, 4 ayes and 0 nays.

Cline, Councilman Simons
Nays: None
Council considered Hodge's recommendation to accept the bid
submitted by Jim Ball International for two pull type rotary
mowers.
Motion was made by Councilman Tomerlin to award the bid to
Jim Ball International for two Cyclone 60, pull type rotary
mowers at a cost of $2,687.60. ' .
Seconded by Counc11man Kibo-
deaux. The motion carried, 4 ayes and 0 nays.

Nays: None
9. Council considered recommendation by Fire Chief Sease con-
cerning overhead doors for Fire Station #3 opened December 10,
1980. Only one bid was received. Sease stated the bid met
bid specifications and was within the budgeted amount.
Motion was made by Councilman Simons to award the bid for 4
overhead doors for Fire Station #3 to Hodges Overhead Door,
Inc., of Highlands, Texas, for $3,400.00. Seconded by
Councilwoman Cline. The motion carried, 4 ayes and 0 nays.
Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman
Cline, Councilman Simons
Nays: None
10. Council considered the recommendation by Fire Chief Sease
concerning bids received December 10, 1980, for 1,000 feet of
4" fire hose. The low bid from Texas Firefighters of $4,880.00
did not meet the specifications advertised. Sease recommended
the next low bidder, Fire Fox Corporation, be awarded the bid;
their bid was within the budgeted amount.
Motion was made by Councilman Simons to award the bid for 1,000
feet of 4 inch fire hose to Fire Fox Corporation of South
. Houston, Texas, in the amount of $5,300.00. Seconded by Council-
man Kibodeaux. The motion carried, 4 ayes and 0 nays.

II. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING A PORTION OF TEXAS AVENUE; AND PROVIDING AN EF-
FECTIVE DATE HEREOF.
Motion was made by Councilman Tomerlin to pass and approve
Ordinance No. 1242, closing that portion of Texas Avenue
between the south right-of-way line of South K Street and
the north right-of-way line of South L Street and lying and
being situated between Blocks 1120 and 1122 but retaining
a 16 foot easement as discussed. The motion was seconded by
Councilman Kibodeaux. The motion carried, 4 ayes and 0 nays.
Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman
Cline, Councilman Simons

12. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING ALL OF THE ALLEY IN BLOCK ELEVEN HUNDRED TWENTY-
TWO (1122) , IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS.
Motion was made by Councilwoman Cline to pass and approve
Ordinance No. 1243, vacating the alley in Block 1122 for
Roy Kaylor. Seconded by Councilman Simons. The motion carried,
4 ayes and 0 nays.

Nays: None
13. City Attorney Askins read: AN ORDINANCE AMENDING CHAPTER 25,
SECTION 33, OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE,
DEFINING AND CREATING THE OFFENSE OF NEGLIGENT COLLISION;
PROVIDING THAT PROOF OF NO INTENT SHALL NOT BE REQUIRED; CON-
TAINING EXCEPTIONS; PROVIDING THAT ANY PERSON VIOLATING THE
TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDE-
MEANOR AND SHALL UPON CONVICTION BE FINED NOT TO EXCEED TWO
HUNDRED DOLLARS ($200.00) ; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilwoman Cline to adopt Ordinance No.
1244 as read by the City Attorney. Seconded by Councilman
Simons. The motion carried, 4 ayes and 0 nays.

14. Council considered a request by Dan Tarpey of 620 South Lobit,
to make a trailer van a part of a permanent structure at this
address. Attached to these minutes are memos concerning this
request from Planning and Zoning and Code Enforcement. Council
discussed this structure at length. Cline stated she felt
. the only way to clean this matter up was to grant the variance
and require the builder to comply with all City codes.

Motion was made by Councilwoman Cline to grant the request
for variance by Dan Tarpey. Councilman Tomerlin stated he
would second the motion in order to bring the matter to a
vote. The motion was tied, 2 ayes and 2 nays.
Ayes: Councilman Tomerlin, Councilwoman Cline
Nays: Councilman Kibodeaux, Councilman Simons
Mayor Meza cast a nay vote and the motion to grant the vari-
ance wad defeated.
Councilman Tomerlin originally cast a vote "nay" but changed
his vote in light of his second.
15. Council considered the need for fill material at the Public
Works Service Center site. Public Works Director Hodge stated
the area needs approximately 10,000 square yards of fill to
raise the site to a 17.1 elevation. Hodge said he had made
arrangements with the County to get the needed fill material
from the County land fill at no charge; however, we must do
our own loading and hauling. Hodge brought to the Council's
attention the fact that the contract for the Service Center
has been awarded and the contractor anticipates going to work
within 30 days. Since Public Works has a deadline on the
. July 27, 1979 flood grant, all their equipment and manpower
is tied up on that project.
Hodge presented price quotations from several trucking firms
and requested that the Council declare this an emergency and
award the work (trucking and loading) to Hardy Trucking of
Baycliff.
Price quotes as follows:
Daniels Trucking - 3 trucks - 15 cu. yd. load - $25.00
La Porte, Texas 18 cu. yd. load - $27.00
Loading - .55 per cu. yd. hauled
Barker Trucking - $27.00 per hour
Houston, Texas
Hardy Trucking - $20.00 per load - 15 cu. yd. load
Baycliff, Texas .50 per cu. yd. for loading
Motion was made by Councilman Tomerlin declaring an emergency
and awarding the fill work for the Service Center site to
Hardy Trucking of Baycliff for $20.00 per 15 cu. yd. load,
plus .50 per cu. yd. for loading. The motion was seconded by
Councilman Kibodeaux. The motion carried, 4 ayes and 0 nays.

City Manager Hudgens pointed out to Council that Harris
County has been more than generous in giving the fill
material for the Service Center to the City.
16. Administrative Reports:
Dave Corbin made a visual presentation to the Council on the
progress being made on the water line installations along
Barbour's Cut Boulevard and the east side of town. Corbin
said the project is well underway and should be completed
shortly after the first of the year ('81) .
Hudgens asked for a brief executive session to discuss a legal
matter.
17. Council Action:
Councilman Kibodeaux asked about progress on water well #2 in
Fairmont Park? Hodge informed him the screen being placed
inside the damaged screen is being set and the work is going
well.
Councilman Kibodeaux wished everyone a "Merry Christmas."
. Councilwoman Cline asked if the City needed a Resolution con-
cerning the Fairmont Parkway Construction Project? Mayor Meza
brought those not present at the meeting with Commissioner
Fonteno up to date on the completion of Fairmont Parkway.
Council directed Hudgens to have the needed Resolution pre-
pared and mailed.
Councilman Simons commended Stan Sherwood for the beautiful
Christmas decorations around City Hall. The Council agreed
it is a job well done.
Councilman Simons wished everyone a "Merry Christmas."
Mayor Meza adjourned the Council into executive session at
8:20 P.M.
Council reconvened at 8:35 P.M.
Motion was made by Councilman Simons to purchase light blue
Blazers for the entire Council and the Mayor with the City logo
on the pocket. The motion was seconded by Councilman Kibodeaux.
The motion carried, 3 ayes and 1 nay.

As you know, the City Charter requires public advertisement of the sale of the
City's bonds. This requirement is being met for the sale of the City's Certificates
of Obligation to build a new service center by advertisement in the Bayshore Sun
and in the Texas Bond Reporter.
We have also prepared, and enclose copies herewith, an "Official Notice of Sale"
e and "Official Statement" describing the Certificates of Obligation and the financial
circumstances of the City in connection with the offering of These Certificates sche-

that they arrive at the City Hall, La Porte. Texas. not later than 7:00 p.m.. CST. December 1'1, 1.980.
For convenience of bidders, bids may be delivered to Moroney, Beissner . Co., Ine., Suite 1865 Post Oak
Central, 2000 South Post Oak Road, Houston. Texas 77056, agent for the City; and if delivered not later than
5:00 p.m.. CST, December 17. 1980. will be deemed to have been delivered to the City in accordance with the
terms and conditions of the "Official Notice of Sale." Bids so delivered win not be opened except by the City
Councll of the City of La Porte and will not be opened prior to 7:00 p.m., CST. December 17, 1980.
No Bid from the Financial Advisors
Under the terms of the contract with Moroney. Beissner . Co.. Ine., Financial Advisors to the City, it is
agreed and understood that Moroney, Beissner . Co., Ine. shall not be permitted to purchase any .securities

Type of Bids and Interest Rates
e All bids must be submitted on the "Official Bid Fonu" enclosed herewith Without Change. The Certificates will
be sold in one block, all or none, at a price of not less than par and accrued interest. Bidders are requested
to specify the rate or rates of interest that the Certificates will bear. However, nor more than six separate
rates or five changes in coupon rates will be considered. Coupon rates must be in multiples of 1/8 or 1/20 of
1', The spread between the highest and lowest coupon rates named may not exceed 2\10 rate. AU Certifi- '
cates maturing on the same date must bear interest at one and the same rate. Bids providing for zero or sup-
plemental coupons will not be considered. No Bid will be considered If It results In a "net effective Interest
rate" In excess of 7 3/11' per annum determined in accordance with Art. 717K-2, V .A. T .C.S.. as ammended.
Tax Exempt Status of Certificates .
All bids are accepted on the condition that the tax exempt status of the interest on These Certificates is not
changed prior to the date on which These Certificates are presented for delivery.
Award of Sale
For the purpose of awarding the Certificates, the interest cost of each bid will be computed by detenuining, at
the coupon rate or rates specified therein, the total dollar amount of all interest on the Certificates from the
date of the Certificates to their respective maturities, and deducting therefrom the premium bid, if any. In
the event of an error in interest cost calculations, the coupon rates named in the "Official Bid Form" will gov":
ern. The City agrees to either award These Certificates to the bidder whose bid on the above computation .
produces the lowest interest cost to the City and is in strict accordance with the tenus and conditions of this:

Good Faith Deposit
Each bid must be secured by a Good Faith Deposit in the form of a Bank Certified or Bank Cashier's check in
the amount of $16,000 payable to the City of La Porte, Texas. The Good Faith Deposit may accompany the
"Official Bid Fonu" or it may be submitted separately; if submitted separately, it shall be made available to
the payee prior to the opening of the bids and shall be accompanied by instructions of the bank on which drawn,
which authorizes its use as a Good Faith Deposit by the successful bidder who shall be named in such instruc-
tions. The check of the successful bidder will be retained by the City to assure performance of the contract on
the part of such bidder. In the event the successful bidder should fail or refuse to ta'ke up and pay for the'

Printed Certificates and leqal Opinion
The City will furnish, without cost to the purchaser, printed Certificates on lithographed borders and a tran-
script of certain certified proceedings had incident to the authorization and issuance of the Certificates. The
successful bidder will be furnished, without cost. the unqualified approving opinion of the law firm of Baker.
Botts, Houston, Texas, to the effect that, based upon an examination of such transcript. the Certificates are
valid and legally binding obligations of the City payable (unless paid from other sources) from ad valorem taxes
levied upon all taxable property within the City, within the limits prescribed by law, and to the effect that the
interest on the Certificates is exempt from present Federal income taxation under existing ststutes, regulations,
published rulings and court decisions. Such opinion is expected to be reproduced on the back panel of the
Certificates over a certification by the fscsimile signature of the City Secretary. attesting that the opinion was
dated as of the date of delivery of and payment for the Certificates and that the copy Is . true and w.. .._1
copy of the original opinion; however, the failure to print such opinion on any Certificate shaD not constitute
cause for a fallure or a refusal by the purchaser to accept delivery of and pay for the Certificates. The legal
fee to be paid Baker . Botts for services rendered in connection with the issuance and sa1e of the Certificates
is calculated on the basis of a percentage of the Certificates actually issued. sold and delivered, and payment of

cite, among other thinga. that no litigation of any nature has been tiled or Is now pending to restrain or en-
join the issuance or delivery of These Certificates or interest coupons. or which would affect that provision made
for their payment or security, or in any manner questioning the proceedings or authority concerning the issuance
of These Certificates and interest coupons, and that so far as is known and believed no such litigation is threat-

Delivery of Certificates
These Certificates will be tendered for delivery to the purchasers at the City National Bank. Austin. Texas. It
is anticipsted that the Certificates will be presented for delivery on or before January 21, 1981. If. however,
Certificates are presented for delivery in accordance with these terms and conditions on or before February 4.
1981, then the purchaser agrees to accept delivery of and make payment for These Certificates In immediately
avallable funds within five (5) business days of notification of the specific date set for delivery. If for any rea-
e son the City is unable to make delivery on or before February 4. 1981, then the successful bidder wiD be given

e "THE TAX RELIEF AMENDMENT"
To the Constitution of the State of Texas
The electorate of the State of Texas approved at a general election held on November 7, 1978 "The Tax Relief
Amendment. " This amendment was proposed by the 65th Legislature of the State of Texas when it adopted
H.J .R. 1 in its second called session. "The Tax Relief Amendment" amends Article VIII of the Texas Constitu-
tion. The following briefly describes those provisions in "The Tax Relief Amendment" applicable to the City:
1.) Removes intangible personal property from the constitutionally required tax base, but allows
the Legislature to provide by statute for the taxation of such property.
2.) Exempts from taxation household goods and personal effects not held or used for the production
of income and authorizes the Legislature to exempt all or part of that personal property which
is immune from forced sale for debt.
3.) Requires that taxation of open-space land devoted to farm or ranch purposes be on the basis
of its productive capacity and grants the Legislature the authority to provide by general law
for taxation of open-space land devoted to timber production on the basis of its productive
capacity. Grants the Legislature the authority to provide by general law for eligibility limi-
tations under this section and to impose sanctions in furtherance of the taxation policy of this
section.
4.) Authorizes an exemption from ad valorem taxation of an amount of not less than $3,000 of the
market value of residence homesteads for certain disabled citizens and persons 65 years of
age or older.
5.) Exempts from coverage of the provisions of this amendment outlined in item 4.) above. the
ad valorem tax previously pledged for the payment of debt if it would impair the obligation
of the contract by which the debt was created.
6;) Requires all political subdivisions to conduct truth in taxation hearings; requires public notifi-
cation when tax increases are contemplated; and, requires notice to individual taxpayers when
property values are increased
7.) Provides for limiting the rate of growth in State spending to the reate of growth of the State's
economy.
8.) Prohibits State-wide appraisal of real property for ad valorem tax purposes and requires ad-
. ministrative and judicial enforcement of uniform standards and procedures for appraisal of
property on the county level.
The 66th Legislature of the State of Texas adopted House Bill 1060 on May 28, 1979 which implements the provi-
sions of "The Tax Relief Amendment" as outlined above. The City's January 1. 1980 total consolidated assessed
valuation is $366.726,568 after granting $5,206,170 of exemptions, including the homestead exemptions. as provid-
ed for in "The Tax Relief Amendment." The City's Tax Assessor-Collector advises that im'plementation of the
agriculture and teimber use valuations will have no impact on the City's total assessed valuation.
House Bill 18, "Truth in Taxation." was also enacted by the 66th Legislature and became effective January 1.
1979. The statute requires notice to be given and public hearings to be held prior to the adoption of a tax rate
which is more than 3% greater than an "effective Rate' Calculated purusant to the Statute. Under the provisions
of the statute. the tax rate necessary to pay debt service on bonds is a component of the "effective rate"
calculated pursuant to the statute and, therefore. will not result in a tax rate greater than said "effective
rate. " The statute also requires the Tax Assessor-Collector to give written notice to each property owner whose
property value has been increased by more than $100 above its value in the preceding year. Among other mat-
ters. such notice must include a statement of the amount of taxes that will be imposed on the basis of new
value if neither the tax rate nor the ratio of assessment in effect for the preceding year is reduced.
Senate Bill 621. "Property Tax Code." was also enacted by the 66th Legislature of the State of Texas. and
signed into law by the Governor on June 13. 1979. and is applicable to all taxing umts in the State. including
the City of La Porte. The "Property Tax Code." generally effective January 1. 1982, will require. among
other things. that a single central appraisal board within each county appraise all taxable property for purposes
of ad valorem tax assessments by all taxing units except the county itself.
The City's ad valorem tax. which is pledged to the payment of the Certificates, is currently imposed at a
rate determined by the members of the City Council based on the assessed valuation of property in the City as
initially established by the City's Tax Assessor and approved or modified by the Board of Equalization. The
appraisal district (and an appraisal review board) has the responsibility for establishing the tax roUs for politi-
cal subdivisions within the county, with: certain exceptions (not including the City.) Those roUs must be used
by the City in establishing its tax rate. The Code requires an update of appraised values not less frequently
than every five years. and the City has the right to obtain more frequent appraisals. at its expense. Effec-
tive January 1. 1982. the Code will prohibit the City from increasing its tax rate (exclusive of increases for
debt service) without a prior public hearing and gives the voters of the City the right of referendum to repeal
any such increases in excess of 5\ per annum.
e The City's Tax Assessor-Collector cannot predict the precise effect that the enactment of the "Property Tax
Code" wiD have on the City's ability to assess and collect ad valorem taxes, but does not believe the effect
will be materially adverse.

TAX RATE LIMITATIONS
The City of La Porte is a Home Rule Charter City with a maximum authorized rate for all purposes of $2,50
per $100 Assessed Valuation. This maximum tax rate is imposed both by the Constitution of the State of Texas

. THE INDUSTRIAL ZONES
e In 1958 the City of La Porte created an Industrial Zone adjacent to the City which presently encompases
approximately 5,500 acres of land north of Highway 225 and borderingthe Houston Ship Channel. The
City annexed sufficient land to completely encircle this Industrial Zone, protecting this Zone from annexa-
tion by any other municipality. The City entered into contracts with all of the Industries located in the
Zone whereby the City annexed a portion of the total value of each industry with the remainder constitut-
ing protected Industrial Districts. In addition to the Industrial Zone north of Highway 225, which is re-
ferred to as the "Battleground Industrial District," the City contains an Industrial Zone on its south side
originally created in 1970 encompassing approximately 2,500 acres of land which is referred to as the "Bay-
port Industrial District." These Industrial District Contracts are authorized by Texas State Statutes.
The City and the industries listed below, many of which have come to the Industrial Zones since the origi-
nal contracts, are presently under contracts which extend to January 1, 1987, Under the terms of the
current contracts, the City annexed 25% of the value of each industry on which the industry pays full
City Tax each year, The remaining 75% of total value constitutes the protected Industrial Districts on
which the industries make payments to the City each year in lieu of taxes. These annual in lieu payments
are in an amount which, when added to the full City taxes on the annexed portion, equals 45% of what the
City's taxes on the industry would be if 100% of the industry were in the City.
Under the City Charter and State Statutes, the City of La Porte has the authority simply by ordinance of
the City Commission to annex additional areas, In the past, the City, in order to encourage industrial
development in the area, has annexed a strip surrounding the industries identified herein and executed
contracts with each separate industry as described above, It is anticipated that the present contracts
which expire on January 1, 1987 will be renewed for an additional seven year period, at which time the
City will expand its annexation to again include at least 25% of all taxable values in the industrial area,
The City, of course, has the right to renegotiate their contracts in 1986 on any basis acceptable to the
City and industry; however it would be highly unlikely that the percentage to be annexed would be less

TO ISSUE CERTIFICATES OF OBLIGATION
Pursuant to the provisions of The Certificate of Obligation Act
of 1971, as amended (Art. 2368a.l, V.A.T.C.S.), NOTICE IS HEREBY
GIVEN that the City of La Porte, Texas, proposes to issue up to
Eight Hundred Thousand Dollars ($800,000) in aggregate principal
amount of Certificates of Obligation of said City, bearing interest
at such rate or rates as may be permitted by law at the time of
issue and maturing serially or otherwise in installments over a
period of not exceeding ten (10 ) years from the date of issue, all
as may be fixed by the City Council, for the purpose of paying the
cost of constructing and equipping a Public Works Center Building
e and related facilities, all of which Certificates of Obligation will
be payable solely from ad valorem taxes upon all taxable property
within the City. The City proposes to authorize the issuance of
said Certificates of Obligation at the regular meeting place of the

ORDINANCE EFFECTIVE IMMEDIATELY UPON ITS ADOPTION.
WHEREAS, pursuant to the provisions of The Certifi-
cate of Obligation Act of 1971, as amended (Art. 2368cL 1,
V.A.T.C.S. ), the City of La Porte, Texas, caused notice to
be published of the City's intention to issue up to $800(000
in aggregate principal amount of its certificates of Obliga.'
tion, payable solely from ad valorem taxes, for the purpose
e of constructing and purchasing a public works service center;
and
WHEREAS, no petition of any kind has been submitted
to the City Secretary of the City of La Porte, or to any
member of the City Council thereof, or to any officers of
the City whatsoever protesting the issuance of Certificates
of Obligation for such purpose unless the issuance thereof
is approved at an election called, held and concluded in the
manner provided by law for bond elections; and
WHEREAS, this city Council hereby affirmatively
finds and declares that the City of La Porte is fully autho-
rized and empowered to issue its Certificates of Obligation
for the purpose of constructing and purchasing a public
e works service center; and
WHEREAS, the City Council desires to authorize the
issuance of Certificates of Obligation so as to obtain funds
for such purpose; there~ore,
BE IT ORDAINED BY ~~~ CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1: That in order to obtain funds for the
purpose of constructing and purchasing a public works service
e center, there shall be, and there is hereby ordered to be,
issued under and by virtue ~f the Constitution and laws of
the State of Texas, certificates of obligation of the city

of La Porte, Texas, in the total principal sum of $800,000
to be known as' "CITY OF LA PORTE, TEXAS, CERTIFICATES OF
OBLIGATION, SERIES 1980."
Section 2: That said certificates shall be dated
November 1, 1980, shall be numbered consecutively from 1
through 160, shall be in the denomination of $5,000 each and
shall mature and become due and payable serially without
option of prior redemption on February 1 in each of the
years and in the amounts specified in the following schedule:

Section 3: That said certificates shall bear
interest from their dates until maturity at the rate of
7 3/4% per annum, with such interest to be evidenced by
interest coupons payable on August 1, 1981, and semiannually
thereafter on each February 1 and August 1 until the principal
sum is paid in full.
Section 4: The seal of said City may be impressed
on each of said certificates, or in the alternative a facsimile
of such seal may be printed on said certificates. The
certificates may be manually signed by the Mayor and City
e Secretary, or in the alternative may be executed by the
imprinted facsimile signatures of the Mayor and City Secretary
of the City, and execution in the latter manner shall have
the same effect as if such certificates had been signed by
the Mayor and City Secretary in person by their manual
signatures. Inasmuch as such certificates are required to
be registered by the Comptroller of Public Accounts for the
State of Texas, only his signature (or that of a deputy

required to be manually subscribed to said certificates in

connection with his registration certificate to appear
thereon, as hereinafter provided.
Section 5: That the principal of and interest on
said certificates shall be payable to bearer, in lawful
money of the United States of America, without exchange or
collection charges to the bearer, upon presentation and
surrender of proper certificate or interest coupon, as the
case may be, at Bayshore National Bank, La Porte, Texas, or
at the option of the bearer, at First City Bank of La Porte,
La Porte, Texas, which banks shall be the paying agents for
e said certificates.
Section 6: The certificates, including the form
of Registration Certificate of the Comptroller of Public
Accounts of the state of Texas, and the form of interest
coupons, shall respectively be in substantially the form set
forth in Exhibit A attached hereto and made a part of this
ordinance for all purposes.
Section 7: That to provide for the payment of the
interest on said certificates as it accrues and to provide a
sinking fund for the redemption of said certificates at
maturity or a sinking fund of 2% (whichever amount shall be
greater) , there shall be and there is hereby levied for the
current year and each succeeding year thereafter while said
e certificates or interest thereon shall remain outstanding
and unpaid, a sufficient tax on each one hundred dollars'
valuation of taxable property in said City, adequate to pay
such interest and to pr~vide for such sinking fund, after
full allowance has been made for delinquencies and costs of
collection; said tax shall be assessed and collected each
year and applied to the payment of said interest and to
e provide for such sinking fund, and same shall not be diverted
to any other purpose. The taxes so levied shall be paid
into a fund known as "SPECIAL CITY OF LA PORTE, TEXAS,
CERTIFICATES OF OBLIGATION FUND, SERIES 1980," which is

hereby established for the payment of the obligations herein
authorized. The Council hereby declares its purpose and
intent to provide and levy a tax legally and fully sufficient
for such certificates, it having been determined that the
existing and available taxing authority of the City for such
purpose is adequate to permit a legally sufficient tax in
consideration of all other outstanding obligations.
Section 8: The sale of said certificates to
Bayshore National Bank, La Porte, Texas, and First City Bank
of La Porte, La Porte, Texas, at the price of par and accrued
e interest to date of delivery is hereby confirmed. Delivery
of the certificates shall be made to said purchaser as soon
as may be after the adoption of this ordinance, upon payment
therefor in accordance with the terms of sale.
Section 9: That the City hereby covenants with
the purchasers and any subsequent holders of said certificates
that the City will not make any use of the proceeds of said
certificates which will cause said certificates to be or
become "arbitrage bonds" within the meaning of Section
103(c) of the Internal Revenue Code of 1954, as amended, or
any regulations promulgated thereunder, and that the City
will otherwise comply with the pertinent provisions of said
Section 103(c) and regulations in order that said certificates
e will not be or become "arbitrage bonds" thereunder.
Section 10: The Mayor of the City shall be and he
is hereby authorized to take and have charge of all necessary
orders and records pending investigation by the Attorney
General of the State of Texas, and shall take and have
charge and control of the certificates herein authorized,
pending their approval by the Attorney General, registration
by the Comptroller of Public Accounts, and delivery to the
e purchasers thereof.

Section 11: That this Ordinance shall become
effective and be in full force immediately upon and after
its adoption.

purpose of constructing and purchasing a public works service

the State of Texas, including The Certificate of Obligation
Act of 1971, as amended, and in accordance with an ordinance

JOB NUMBER 79-2154
On Wednesday, November 19, 1980, we received and opened three bids on the referenced
project. The attached tabulation shows the order of the bidders as well as the
e possible combinations of the Alternate bids that were taken. Lee Rowe Construction
Company of Houston is the low bidder in all the combinations of alternates. The
combinations range in cost from a low of $723,400.00 to the maximum of $776,850.00
which is within + 3 1/2% of our estimate of $750,000.00.
Lee Rowe is a substantial contractor having many years of experience in this type
of work. They are currently doing some construction work for the La Porte 1.S.D.
wi th wh ich the d is trict is we 11 pleased.
It is our recommendation that they, as low bidder, be awarded the contract for this
work with whatever combination of alternates is stipulated.

On November 5, 1980, bids were received and opened on the City of La Porte E.P.A.
Construction Grant Projects. After tabulation of bids on all four contracts,
the low bidders were as follows:
e Contract I - $2,994,000.00 - Brown Couch, Inc., Richmond, Texas
Contract II - $1,020,109.50 - E.P. Brady, Inc, Eu1ess, Texas
Contract III - $ 189,537.00 - Big M Constructors, Inc., Houston, Texas

Hyco Equipment Company is the low bidder, meeting specifications on the
larger of the two tractors. Because the larger tractor bids are below
our estimated cost, I want to recommend that we buy two of these tractors.
This will give us a back up tractor to pull the 15' wing type mower. It
will require that we throw out the bids on the small tractor. The cost of
the two larger tractors is $23,368.
Jim Ball International is the low bidder, meeting the specifications on the
two pull type rotary mowers. I am recommending the low bid in the total
amount of $2,687.60.
Hyco Equipment Company is the low bidder, meeting specifications on the 15'
wing type mower. I recommend the low bid in the amount of $7,190.00.

It is requested by the undersigned with the filing of this application that Texas
Avenue, (unimproved) between K and L Streets and with an eastern boundry along
Block 1121 and with a western boundry along Block 1122, be closed. This street
is to be closed so that Blocks 1122 and 1121 be contiguous. With this street closed,
the design and layout of buildings for an apartment project will be enhanced
and the land will be used more efficientl y.

Dear Mrs. Waters,
Entex, Inc. does not have any natural gas mains located
in said described alley or said described portion of
Texas Ave. We hereby release and abandon our rights
e to the aforedescribed alley, providing similar releases
are obtained from the other utility companies having
the right to the said alley and Texas Ave.
In no way shall such,a release affect Entex,s title to,
interest in, or right of use of the other property in the
area.

AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
TEXAS AVENUE: AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portion of Texas Avenue,
in the City of La Porte, to vacate, abandon, and permanently
e close that portion of Texas Avenue: and
WHEREAS, the City Council of the City of La Porte has
determined, and does hereby find, determine and declare that
the hereinafter described portion of Texas Avenue is not suita-
ble, needed, or beneficial to the public as a public road or
street, and that the closing of the hereinafter described
portion of Texas Avenue is for the protection of the public
and for the public interest and benefit, and that the hereinafter
described portion of said Texas Avenue should be vacated,
abandoned, and permanently closed:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
e Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175,.of the Revised Civil Statues of the Sta te
of Texas, 1925, the hereinafter described portion of Texas
Avenue is hereby permanently vacated, abandoned, and closed by
the City of La Porte, to-wit:
That portion of Texas Avenue between the
south right-of-way line of South "K" Street
and the notth right-of-way line of South "L"
Street, and lying and being situated between
Blocks Eleven Hundred Twenty (1120) and
Eleven Hundred Twenty-two (1122), TOWN OF
OF LA PORTE, Harris County, Texas:
SUBJECT TO:
The City of La Porte expressly retains a
drainage easement, 16 feet wide, across
that portion of Texas Avenue described by
metes and bounds on Exhibit "A" attached
e hereto, incorporated by reference herein,
and made a part hereof for all purposes.

that this meeting has been open to the publ ic as required by
law at all times during which this ordinance and the subject

acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting

AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY
IN BLOCK ELEVEN HUNDRED TWENTY-'lWO (1122), IN THE TOWN OF
LA PORTE, HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Eleven Hundred Twenty-
two (1122) of the Town of La Porte has never been opened or
used as a public thoroughfare, and the public utilities now
. making use of such alley have all given their written consent
for its closing; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. The alley located in Block Eleven Hundred

THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE
DEEMED GUILTY OF A MISDEMEANOR AND SHALL UPON CONVICTION BE
FINED NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) ~ FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW ~ AND PROVIDING AN EFFECTIVE
DATE HEREOF.
e BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Section 25-33, "Negligent Collision," Chapter
25, TRAFFIC, of the Code of Ordinances of the City of La Porte,
is hereby amended, and shall hereafter read as follows, to-wit:
"Section 25-33. Negligent Collision.
"(a) If any driver or operator of a veLicle upon any
public street, highway, or upon any drive in a public park
or upon any privately owned access ways or parking areas
prov ided by business establ ishments, without charge, for the
convenience of their customers, clients or patrons, but not
upon privately owned residential property or the property of
any garage or parking lot for which a charge is made for
storage or parking of motor vehicles, within the corporate
limits of the City of La Porte, shall with negligence, cause
damage to or collide with any other vehicle of any kind what-
soever, or with any other property, resulting in a total
damage to an apparent extent of fifty dollars ($50.00) or more,
_ within the said corporate limits of the City of La Porte, he
.., shall be deemed guilty of negligent collision.
" (b) Proof of no intent on the part of any operator of
any vehicle charged with an offense under this section to
collide with any other vehicle or with any other property
shall be no defense to any charge filed under the authority
of this section.
" (c) Nothing contained in this section shall authorize
the prosecution of any person for the violation of the same
while such person is operating any Fire Department or Police
Department vehicle of the City in the performance of his duty,
provided that it shall not be necessary in any complaint,
action or proceeding under this section to negative this
exception but the same shall be provided by the defendant by
way of defense.
"(d) A person acts with criminal negligence, or is
cr iminally negl igent, with respect to circumstances surround-
ing his conduct or the result of his conduct when he ought to
be aware of a substantial and unjustifiable risk that the
circumstances exist or the resul t will occur. The risk must
be of such a nature and degree that the failure to perceive
it consti tutes a gross deviation from the standard of care
that an ordinary person would exercise under all the circum-
e stances as viewed from the actor's standpoint."

Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public
e at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
thereof.
Section 3. Any person, as defined in Section 1.07(27),
Texas Penal Code, who shall violate any provision of the
ordinance, shall be deemed guilty of a misdemeanor and upon
e conviction shall be punished by a fine not to exceed Two Hundred
Dollars ($200.00) .
Section 4. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Secretary
shall give notice of the passage of this ordinance by causing
the caption hereof to be published in the official newspaper
in the City of La Porte at least twice within ten (10) days
after the passage of this ordinance.

SUBJECT: Request for Variance, Dan Tarpey
Mrs. Tarpey met with Planning and Zoning on December 1,
1980, to request a variance to allow construction of a storage
shed which will incorporate a van-type truck trailer. The
trailer would be enclosed within a metal building with none of
the trailer exposed except the rear doors. The shed would be
located in the rear yard at 620 South Lobit, Block 2, Lots 21
and 22.
Planning and Zoning considers such a structure to be ac-
ceptable if it is built according to the plans submitted, and if
the building is situated on the lot according to the restric-
tions governing accessory buildings.
e Planning and Zoning requests a public hearing to consider
this request for variance. Our preliminary recommendation is
to grant such variance.

As you know, the elevation for the new Public Works facility needs
to be raised with fill dirt. Permission has been obtained from Harris
County Commissioners Court to remove 10,000 cubic yards of material from
the Harris County Landfill for this purpose, at no cost,
The contractor for the new Public Works facility wants to start as
soon as possible, His first priority will be to lime stabilize the en-
tire site before any actual construction begins, For this reason, the
site needs to be brought up to grade now,
However, due to the deadline of the Federal Flood project, primari-
~~~eet work, our five dump trucks are involved in finishing this pro-
J ct,
For these reasons, I have asked for price quotation from Travis
Hardy Trucking of Baycliff, Less Barker of Houston, & Daniels Trucking
of La Porte, Daniels Trucking has three trucks and can not provide the
hauling service for us as quickly as we need the job completed, Daniels
quote is 15 cubic yard load $25, 18 cubic yard load $27, and loading 55~
per cubic yard. Barker Trucking wants to do the hauling for $27 an hour,
The hourly rate is not advantagious to the City over the long run, There
are too many problems with supervision of working hours, Hardy Trucking
quoted a price per load of ($20.00) twenty dollars and 50~ per cubic yard
for loading. Estimated Cost of hauling and loading is $20,000, I request
that we declare this an emergency and award the work to Hardy Trucking of
Baycliff,
