Members of the City Council Present: Mayor J. J. Meza, Councilman John Tomerlin, Councilman I. J. Kibodeaux, Councilwoman Virginia Cline, Councilman Tom C. Simons, Councilman Norman Malone. Members of the City Council Absent: None Other City Officials Present: City Manager James R. Hudgens, City Attorney Knox Askins, City Secretary Betty Waters, Assist- ant Police Chief Robert Hall, Public Works Director Jerry Hodge, City Engineer John Joerns, Chief Inspector David Paulissen, Fire Chief Joe Sease, Fire Marshal Paul Hickenbottom, Parks Director Stan Sherwood. w Others Present: Carlos Smith and Fred Beck of Smith Engineers; Dave Corbin of Busch, Hutchison Engineers; Mike Johnson of the Bayshore Sun. [aomack. There were some 82 persons present in the Council Chambers. 2. The invocation was given by Mayor Meza. 3. Mayor Meza called for anyone present to submit a bid on the 12 inch Lomax water line to come forward at this time. No one came forward, therefore Mayor Meza declared bidding closed. Mayor Meza stated the bids received on this project would be opened and publicly read at the clost of the public hearing. 4. Motion was made by Councilman Tomerlin to recess the Regular Meeting of the La Porte City Council at 7:02 P.P4.; seconded by Councilman Kibodeaux. ~~- ~ ~ • Minutes, Regular Meeting - January 7, 1981, Page 2 JOINT PUBLIC HEARING LA PORTE CITY COUNCIL AND PLANNING & ZONING COb4MISSION January 7, 1981 Mayor Meza established that a quorum was present of both the Council and Planning and Zoning. Mayor Meza stated this Public Hearing was being held to con- sider the request by the Glenor Corporation to rezone tract 5, 6, 7, and 9 out of the Enoch Brinson League from Commercial to Industial. He asked that those persons present who wished to address the Hear- ing come forward to the microphone and state their name and address. Mayor Meza recognized Frank Muller, 2114 North Highway 146, who spoke in opposition to the rezoning of the tract under consider- ation. Muller stated that at the time his property was annexed into the City he was promised protection from Port related industries. He also related that his property was in the process of being sold. Mayor Meza recognized Fred Hartman of Baytown, who appeared . to represent his wife, Elizabeth Black Hartman, and John Black, owners of the tract of land to the north of the tract being con- sidered for rezoning. Hartman point out that his wife is a native of La Porte and has a deep interest in everything that occurs in the La Porte community. They expressed their extreme confidence in the City Council taking whatever action is in the best interest of the public. Hartman stated at this time the Black property has been sold and is in the hands of a title company for closing. Mayor P4eza recognized Stanley Florance, who spoke as the representative of Glenor Corporation and Trans-Continental Services. Florance spoke of the studies that have been done concerning land use for this tract of land under consideration. He reviewed the proposal by Trans-Continental concerning the schedule of develop- ment and asked that the persons making the decision look favorably at this rezoning request. Mayor Meza recognized Hoyt Gibbs, President of Trans-Continental Services. Gibbs discussed the Trans-Continental project. He stated it was their desire to retain as much of the natural beauty as possible by saving a number of the trees on the 47 acre site. The venture would offer 130 new jobs to the La Porte job market. It would bring in $ in sales tax alone. Gibbs stated they had met with and had commitments from the Texas Highway Depart- ment concerning access roads and there would be caution lights to bring attention to the truck entrance. Gibbs answered questions from the Council concerning taxes and working hours. Mayor Meza recognized Bruce Angel. Angel stated he felt it was to the entire City's best interest to rezone this property to retain • • Minutes, Regular Meeting - January 7, 1981, Page 3 control of the situation; otherwise the Port will buy this site just like others and the City will lose control and taxes. Rufus Smith, 1612 Roscoe, stated he was familiar with this property and he felt its best use would be Industrial; after all, its proximity to industry was such he could see no other use. Harold Pfeiffer, 1519 Brownell, spoke in favor of the project and the rezoning. Bill Signent, Houston, Texas, testified he is the buyer of the L~Iuller and Black property and it was such a beautiful and romantic setting he felt it best suited to a lovely restaurant and maybe a hotel. He also was considering plans for a townhome development at that location. He stated he felt the traffic situa- tion was much like living next to a railroad track, you soon get used to the noise and never hear it. John Sheffield, 1035 Oak Leaf, Shady River, advised the Council he was not a resident of La Porte but he was a builder of apart- ments and townhomes. He stated the site in question and the prop- erty to the north, in his opinion, are not suited for that kind of development. • [nlayne Godan, 1402 Beach Cove, stated he has a container busi- ness at 215 E. Main and there is a dire need for that kind of service in the area. Dorothy Garner, La Porte, advised Council of the noise created by the container storage yards. Garner invited Council to visit her home to see for themselves. Gus Brieden, 218 Garfield, addressed the Council favoring the rezoning of the tract in question. Florence Alworth (no address), stated she was speaking as a conservationist and asked that the site be retained in its present condition. John Quin, 2910 Old Highway 146, stated he was opposed to the rezoning of the Florance property. Kevin Graves, 620 Virginia, advised Council that people do not heed yellow flashing lights such as is proposed for this site. Councilwoman Cline stated the City has been attempting to develop the regional planning prepared by Texas A&M for some time now. This plan cost the City $12,000. She stated she felt it • would be wise for the City Council to postpone any action on this matter for further study. r: • Minutes, Regular Meeting - January 7, 1981, Page 4 Motion was made by Councilwoman Cline to table the rezoning of Tract 5, 6, 7, and 9 for further study. The motion was seconded by Councilman Kibodeaux. Mayor Meza stated the motion and second were out of order and asked that the second be withdrawn to enable Councilwoman Cline to withdraw her motion since the matter had not been brought for question and the Planning and Zoning Commission has not made their recommendation. Councilman Kibodeaux withdrew his second. Councilwoman Cline withdrew her motion. Mayor Meza declared the Joint Hearing on thact 5, 6, 7 and 9 to be closed at 8:22 P.M. P+Iayor Meza stated this part of the Joint Public Hearing was to consider the pros and cons of rezoning Outlots 56, 57, 58, 61, 63, 64 and 65 from Residential to Commercial. He asked that those persons present who wished to address the Hearing come forward to the microphone and state their names and addresses. • Kenneth Schick, Houston, Texas, spoke as the developer of the site, laying before Council the plan for a shopping center and a group of apartments. Chip Stockard, Houston, Texas, advised Council he felt the site was well suited for such a development. There being no one else to come before the Hearing, the Plan- ning and Zoning Commission retired to the conference room to dis-~ cuss further the things heard tonight. The Hearing reconvened at 8;55 P.M. Chairperson Muston spoke on behalf of the Commission. Muston stated the Commission is in agreement, favoring the rezoning of the 45 acre tract of Florance property from Commercial to Industrial. Chairperson Muston stated it is the contention of Planning and Zoning that Outlots 56, 57, 58, 61, 63, 64 and 65 should be rezoned from Residential to Commercial. Councilman Malone asked if he might review a few facts with the Council. He brought to Council's attention the studies done by Glenor Cozporation showing the Florance property to be unsuit- able for residences, the need this day and time for employment, the fact that this project would not only bring taxes to the City • but the salaries paid will be spent in La Porte. He then reviewed the statement by a professional apartment, townhouse builder who states the property is unsuitable for such residences. He then i Minutes, Regular Meeting - January 7, 1981, Page 5 • asked that they consider the statement that if this development is not permitted under City control the City could lose control and tax dollars to the Port Authority. Malone closed his sum- mation by stating he highly recommended the Council accept and approve the recommendation by the Planning and Zoning Commission. Mayor Meza declared the Joint Public Hearing adjourned. • • 5. Regular Meeting of the La Porte City Council was reconvened. C 6. City Attorney Askins read a Resolution No. 81,1 giving La Porte City Council support and approval to the improvement of Fairmont Parkway between State Highway 146 and Sylvan Beach Park. Motion was made by Councilman Tomerlin to adopt and approve Resolution No. 81-1 as read. Seconded by Councilman Simons. The motion carried, 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Council-- woman Cline, Councilman Simons Nays: None 12. Administrative Reports: City Manager Hudgens informed Council the departments were ready to proceed to advertise for bids on the budgeted equip- ment. Council authorized advertising for equipment (capital outlay) budgeted in the 1980-81 approved budget. Hudgens requested a short executive session to discuss a contractural matter. • There being nothing to be brought by the Council, Mayor Meza extended an invitation to the Council to attend a Legislative Breakfast being given by the Harris County P~Iayors' and Council-- men's Association, January 20 in the Stephen F. Austin Hotel in Austin at 8:00 A.M. Council adjourned into executive session at 9:25 P.M. Council reconvened at 10:02 P.M. Meeting was duly adjourned at 10:03 P.M. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PO~:`.~`~~: Section 1. The City Council of the City of La Pore hereby finds, determines and declares that heretofore, to-wit, on the 7th day of January, 1981, at 7:00 P.M., a joint public heax.i_;ag was held before the Planning and Zoning Commission, and the C:~ty Council, of the City of La Porte, Texas; pursuant to due notice, to consider the question of the possible re-classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference hereir. and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. MEMORANDUM • becember 2, 1980 T0: Mayor and City Council FRODi: Planning and Zoning Commission SUBJECT: Trans-Continental Services, 1~1c. Representatives of Trans-ContinEnt-a1 Services, Inc . , ITcc'.t with Planning and Zoning on December 1, 1980, regarding a tract of land located at the intersection of .State Highways 22,E Gird 146. Their wish is to construct a. complete transportation facility on the property to serve Barbou~-'s Cut Terminal. Ttz~~ fac?_lity would include stoz age and repair of oceanic contain~ars, ~a~~re- housing, truck terminal, office building, and rail servicFy. The prospectus indicates a great deal of thought in planning the facility. They have planned service roads to facilitate traffic flow and have placed structures on the property in a man- ner which w~.ll hide the unattractive aspects of such a terminal. The loading, unloading, and storage of cargo such as petro- chemicals, radio-active materials, etc., would of course be regulated by environmental agencies of the various governments. Planning and Zoning feels the property is well suited for such use. It is easily accessible to highway and rail, yet is rather isolated and well removed from residential areas. • The property is presently zoned commercial or light industrial if a special use permit is granted. Planning and Zoning recommends that such a special use permit be granted to enable construction of this facility. The alley located in Block Eleven Hundred Seventy- five (1175) and Block Eleven Hundred Seventy-six (1176) of the Town of La Porte, Harris County, Texas, is hereby permanently vacated, abandoned and closed by the City of La Porte.
